Bracken Burns, Sr. Absent being Commissioner Diana L. Irey who was out of the country. Also being present: Leo Trich, Director of Administration; Lynn DeHaven, Solicitor; Mary Helicke, Chief Clerk; Linda Belcher, Administrative Assistant; Joy Sprowls and Joann Metz, Commissioner's Office; Captain Todd Hammond; Father George Moneck, Saint Joseph Catholic Church; Addie Bertram and Aaron Vanatta, Juvenile Probation; George Eckert, Forty and Eight; Betsy Dane, Lisa Woods and Shannon Moore, Crime Victim Witness Program; Dr. Tom Pucci, Darcie Vincent, Megan Stock, Becky Siembak and Heather Kearney, California University of Pennsylvania Women's Basketball team; Susan Priest, Citizen's Library; Marcella Dalverny, Phil Ames, Harry Sabatasse, Jerry Seaman, Peter West, Marcella Delverny, Manuel Yocolano, Dave Blose, John Adams, interested citizens; Jim Jefferson, WJPA; Linda Metz, Observer - Reporter; Chris Haines, Herald Standard; Ken Bonnell, Weekly Recorder; Casey Gelder, PA Focus and Gary Smith, CaIUTV. Co -Chairman Burns called the meeting to order at approximately 10:00a.m. Father Moneck led the meeting with a prayer. Mr. Eckert led the Pledge of Allegiance. Co -Chairman Burns entertained a motion to approve Minute No. 741 dated April 1, 2004. Moved by Mr. Maggi, seconded by Mr. Burns, approving Minute No. 741 as written. Roll call vote taken: Mr. Maggi — Yes; Mr. Burns- Yes. Motion carried unanimously. SPEICAL ORDER OF BUSINESS The Commissioners presented a plaque recognizing Saint Joseph's Catholic Church in celebrating the 100' anniversary of their parish. Father Moneck accepted the plaque and thanked the Board for the recognition. The Commissioners presented a certificate to the California University Women's Basketball Team and coach Darcie Vincent. Coach Vincent thanked the Board for the recognition and introduced team members that were present at the meeting. The Commissioner read a Proclamation declaring April 18-23, 2004 as "National Library Week. Moved by Mr. Maggi, seconded by Mr. Burns, adopting the foregoing Proclamation. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Susan Priest accepted the Proclamation and thanked the Board for their continued support. The Commissioners read a Proclamation declaring April 18-25, 2004 as Washington County Crime Victims' Week. MINUTE BoOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Betsy Dane of the Crime Victim/Witness Program accepted the Proclamation and thanked the Board for the Proclamation. She stated this program provides critical support to victims of crime and noted there will be a special event to be held at Washington and Jefferson College on April 23, 2004 to commemorate Crime Victims' Rights Week. The Commissioners read a Proclamation declaring April 26-30, 2004 a "Mon Valley Reads Week". Moved by Mr. Maggi, seconded by Mr. Burns, adopting the foregoing Proclamation. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. (RECESS FOR PHOTOS) PUBLIC COMMENTS Phil Ames, of Scenery Hill, commented on the satellite problems he is experiencing in his area. Peter West, of Washington, stated his concerns regarding eminent domain and congratulated Marcella Delverny for the blight certification being removed from her property. He stated it is his goal to have the blight certification removed from his property. Harry Sabatasse, of Smith Township, stated as taxpayer he is entitled to answers to the list of previously submitted questions to the Board. Co -Chairman Burns pointed out to Mr. Sabatasse that this portion of the meeting is not a question and answer session. Mr. Sabatasse also questioned if the county plans to adopt a policy whereby employees must be residents of Washington County. Susan Priest, of Citizens Library, presented to the Board the quarterly report of activity at county libraries and the summary of use at county libraries for 2003. George Eckert of Forty and Eight thanked the Board, on behalf of his organization, for flags to be used on the veterans' graves. OLD BUSINESS Solicitor DeHaven recommended the Board award the bid for the HVAC maintenance to Quality Mechanical, Verona, PA as follows: Preventative Maintenance: Health Center $2,800/yr Courthouse Square 500/yr Courthouse & FCC 1,800/yr Public Safety Towers 360/yr Correctional Facility 4,400/yr TOTAL $9,860/yr Hourly rates for services not provided under the preventative maintenance contract are as follows: Regular $58/hr Overtime $92/hr Based on time and material costs for the past year the total cost is estimated at approximately $25,000-$30,000. 370 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA Moved by Mr. Maggi, seconded by Mr. Burns, awarding the bid for the HVAC Maintenance as per above. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Solicitor DeHaven recommended the Board award the bid for the maintenance for the Nurse Call System at the Health Center to Alarmtex, Scottdale, PA. This bid is for time and material at the cost of $70/hour for regular and $105/hour for overtime. above. Moved by Mr. Maggi, seconded by Mr. Burns, awarding the bid for the Nurse Call System Maintenance as per Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Solicitor DeHaven recommended the Board award the bid for Gloves to the following vendors based on their per unit cost submitted in their bid proposals: Druzak Medical, Inc., Ambridge PA Xpedx, Camp Hill PA Moore Medical Corp., New Britain CT Interboro Packaging Corp., Montgomery NY This bid has been awarded to the lowest bidders meeting specifications. The effective date is May 1, 2004 through April 30, 2005 for yearly cost of approximately $27,000.00. Moved by Mr. Maggi, seconded by Mr. Burns, awarding the bid for Gloves as per above. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. NEW BUSINESS Chief Clerk presented to the Board for their consideration and approval the adoption of a Resolution supporting the federal reauthorization of the Workforce Investment Act. The Resolution is to be sent to all members of the Pennsylvania delegation to the U.S. House and U. S. Senate. Moved by Mr. Maggi, seconded by Mr. Burns, adopting the foregoing Resolution. Roll call vote taken: Mr. Maggi — Yes; Mr. Burns — Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval a grant agreement previously contracted by the Washington County Authority with the Department of Economic Development for the development of the Mid Mon Valley Multi -municipal Comprehensive Plan for the Borough of Finleyville and Nottingham, Carroll and Union Townships. The grant is in the amount of $23,000.00. Moved by Mr. Maggi, seconded by Mr. Burns, approving the foregoing grant agreement. Roll call vote taken: 9 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the West Nile Virus Program Funding Grant Agreement for the period of January 1, 2004 through December 31, 2004. The total amount of the three year grant is $245,213.10. Moved by Mr. Maggi, seconded by Mr. Burns, approving the West Nile Virus Program Funding Grant Agreement as per above. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval authorization to advertise for bids for a truck for the Public Safety Department. The cost will be between $30,000 and $40,000 and approximately $24,000 would come from the West Nile Virus three year grant and the balance will come from homeland security and Haz Mat. Moved by Mr. Maggi, seconded by Mr. Burns, approving authorization to advertise for bids for a truck for the Public Safety Department as per above. Chief Clerk presented to the Board for their consideration and approval the continuation of the Intermediate Punishment Grant with the Pennsylvania Commission''l on Crime and Delinquency. This state grant in the amount of $82,540 is for a two year period beginning July 1, 2004. Moved Mr. Maggi, seconded by Mr. Burns, approving the continuation of the Intermediate Punishment Grant as per above. Roll call vote taken: Mr. Maggi — Yes; Mr. Burns — Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval authorization for the payment of the license renewal for the Washington County Recorder of Deeds LANDEX system. This renewal is for twenty-one licenses at a total cost of $11,680.00 to IMR Limited, Harrisburg, PA. Moved by Mr. Maggi, seconded by Mr. Burns, approving authorization for payment of the license renewal for the Recorder of Deeds Office. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the following Child Care Provider Agreements. Chief Clerk presented to the Board for their consideration and approval a land lease with Skyward Aviation in the amount of $10,976 per year for a period retroactive from November 1, 2003 ending November 30, 2007 with an option to extend for six additional four terms. Moved by Mr. Maggi, seconded by Mr. Burns, approving the land lease with Skyward Aviation as per above Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the following contracts for engineering bridge projects at an 80% state, 20% county liquid fuels cost sharing agreement: GAI Engineers: Mingo #10, $254,293.08 TW Engineers: Pigeon #30, $238,657.97 Monaloh Basin Engineers: Chartiers #30, $250,422.47 Moved by Mr. Maggi, seconded by Mr. Burns, approving the foregoing contracts for engineering bridge projects. Roll call vote taken: Mr. Maggi — Yes; Mr. Burns — Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the reappointment of Dr. John A. Holets, M.D. to the Washington County Hospital Authority for five year term effective through December 31, 2008. Moved by Mr. Maggi, seconded by Mr. Burns, approving the appointment of Dr. John A. Holets to the Washington County Hospital Authority as per above. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the provisions of the interest arbitration award for the Washington Court Association of Professional Employees (WCAPE) that are not in direct conflict with the Courts constitutional separation of power rights. The Courts have requested the issues infringing upon their constitutional rights be appealed. Moved by Mr. Maggi, seconded by Mr. Burns, approving the interest arbitration award as per above. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the Certificate of Applicable Elected Representative outlining the obligations set for the Butler County Hospital Authority's Resolution adopted on April 14, 2004, authorizing the issuance of its tax-exempt note for the benefit of Lifesteps, Inc. and the refinancing of certain outstanding debts relating to its debt and the payment of costs of issuance. Moved by Mr. Maggi, seconded by Mr. Burns, adopting the foregoing Resolution. Roll call vote taken: Mr. Maggi - Yes; Mr. Burns - Yes. Motion carried unanimously. ANNOUNCEMENTS An Executive Session was held on April 14, 2004 immediately following the Agenda Meeting as an informational session related to personnel matters, labor relations issues, including the Charles Rockwell case and litigation styled John C. Pettit, District Attorney, v. Michael Namie, Controller, with the Board of Commissioners of Washington County and Frederick A. Brilla, noted as interested parties, filed at 2003-6317 in the Civil Division of the Court of Common Pleas of Washington County. All County Offices will be closed on April 27, 2004 in observance of the Primary Election.
