PALUSO, COMMISSIONERS Aw- Minute No. 272 Washington County Commissioners Washington, PA, November 2, 1989 The Board of Washington County Commissioners met in regular session in the Public Meeting Room, Courthouse Square, Washington, Pennsylvania, with the following members being present: Commissioners Mascara, Petrosky and Paluso. Chairman Mascara called the meeting to order at approximately 10:10 a.m. and entertained a motion to approve Minute No. 271. Moved by Mr. Paluso, seconded by Mr. Petrosky, that Minute No. 271 be approved as written. Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried unanimously. SPECIAL ORDER OF BUSINESS Commissioner Paluso read a Proclamation declaring the week of November 5-11, 1989, as "Veterans Appreciation Week". Moved by Mr. Paluso, seconded by Mr. Petrosky, adopting the foregoing Proclamation. Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried unanimously. The Commissioners presented the Proclamation to Thomas Morris, Charleroi Veterans Council Parade Committee Chairman and Harry E. Spencer, Charleroi Veterans Council General Chairman. Commissioner Petrosky read a Proclamation declaring the month of November as "Decency Month". Moved by Mr. Petrosky, seconded by Mr. Paluso, adopting the foregoing Proclamation. Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Motion carried unanimously. The Commissioners presented the Proclamation to Barbara Cobucci, Secretary of Washington County Citizens for Decency. week of November 6-13, 1989, as "League of Women Voters Week". (This agreement replaces the one approved at the Board meeting on June 1, 1989 - Minute #252, p. 127.) above. Chief Clerk presented to the Board for their consideration and approval an Agreement with Attorney R. Maureen Myers as a Child Custody Conference Officer at the rate of $75.00 per half day, $150.00 per day, with an annual maximum amount of $15,000.00, effective 11-1-89. above. Chief Clerk presented to the Board for their consideration and approval the following Change Orders to the contract with Frank Gavlik and Sons, Inc., relative to the Western Center Bridge Project: Change Order No. 2 which increases the contract amount by $5,626.52 for additional work related to the sanitary sewer system Change Order No. 3 which extends the time of completion of Phase I from 129 days to 199 days Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the Change Orders as per above and authorizing the Chairman of the Board to so execute. Chief Clerk presented to the Board for their consideration and approval Change Order No. 7 to the contract with Dick Enterprises, Inc., relative to the Washington County Airport Project. The Change Order increases the contract amount by $42,400 and is for paving of an additional 700 feet of runway. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the Change Order as per above and authorizing the Chairman of the Board to so execute. Chief Clerk presented to the Board for their consideration and approval an Agreement with JEK Construction Company, Inc., of Monessen, Pa., relative to reserved capacity at its planned landfill which is projected to be opened in 1992. The term of the agreement is ten years, effective on the "Opening Day" of the landfill. Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the Agreement as per above. Chief Clerk presented to the Board for their consideration and approval a request to amend the following agreements relative to the JTPA Program: Contractor On -The -Job Training Services Creative Training Concepts Amendment Add an additional $2,000.00 to cover the staff costs in the coal miners dislocated workers grant (Title III). The revised contract amount is $12,000.00. Add an additional $1,800.00 to cover underestimated tuition costs authorized on October 21, 1989. These tuition costs are for asbestos removal training. The revised contract amount is $19,600.00. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing amendments. Chief Clerk presented to the Board for their consideration and approval an Agreement with Bell of Pennsylvania for public telephone service for the purpose of maintaining the public telephones and all associated equipment owned by Bell of Pennsylvania and located within county -owned buildings. Bell will also collect the money from the public telephones and pay to the county a percentage of billable gross revenues, less taxes, on calls originated from each public telephone that are wholly transported by the Telephone Company for each month as follows: 8% on revenue 10% on revenue 12% on revenue 154 on revenue $0 - $60.00 $60.01 to $120.00 $120.01 to $250.00 Over $250.00 Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the Agreement as per above and authorizing the Chairman of the Board to so execute. Chief Clerk presented to the Board for their approval and ratification a grant proposal submitted to PennDot for the Southwestern Pennsylvania Highway Safety Program for a twelve-month (1-1-90 - 12-31-90) regional comprehensive highway safety grant with a proposed budget of $160,943.00. This grant is a combination of the Comprehensive Highway Safety Grant and the Model County DUI Grant. Those in attendance included: Commissioners Mascara, Petrosky and Paluso; Chief Clerk Dallatore; Attorney Eric Held; Lou Falbo, Executive Director, Industrial Development Authority; Attorney Daniel Amidon of Buchanan Ingersoll, bond counsel for this project; Attorney Raymond Hoeler of North Branch Energy Partners, L.P.; and Patricia A. Beharry, County Controller. (Public Hearing - IDA Project) At this time, the Board of Commissioners, in conjunction with the Washington County Industrial Development Authority, held a public hearing for the purpose of accepting public comments on the following proposed bond issue which was presented by Attorney Eric Held of Retos and Held, IDA Solicitor: Comments: Applicant Project North Branch Energy - to finance the acquisition and construction Partners, L.P. of a waste to energy co -generation facility and the equipping thereof. The facility will use bitumimous coal waste as fuel and have a capacity of approximately 91 megawatts. Said facility will be located at the intersection of PA Route 980 and U.S. Route 22 in Robinson Township, Washington County, Pennsylvania, in an amount not to exceed $140,000,000. The owner and operator of the facility is North Branch Energy Partners, L.P., a Delaware limited partnership. Attorney Held noted that this project was originally approved in December of 1987, but due to various delays, the project was not commenced and another public hearing is therefore required. 1 11 1 1 J 1 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY. Commissioner Mascara questioned the status of this project in light of appeals filed in the Commonwealth Court by Allegheny Ludlum Corporation and Armco, Inc., as well as West Penn Power Company. Attorney Amidon stated that they don't intend to close the financing until the matter is settled either through the courts or a settlement agreement. Attorney Hoeler explained that their contract with West Penn Power Company requires that there be a final nonappealable order issued by the PUC before a financial closing is held. Commissioner Paluso questioned if this appeal is lumped with the appeal also filed concerning the project in Greene County. Mr. Hoeler explained that they are separate appeals but some of the issues are the same and for expediency purposes, they were consolidated for hearing purposes. Ms. Beharry questioned the need for another public hearing. Attorney Amidon explained that the TEFRA regulations require that a closing must be held within one year of the public hearing. Since that time has been exceeded, another public hearing was required. Ms. Beharry also questioned the objections filed by Allegheny Ludlum and Armco. Attorney Hoeler explained his understanding of their objections. Discussion was held between Commissioner Mascara and Attorney Hoeler relative to the projected number of construction jobs and permanent jobs related to this project. They also commented on the process of putting the residual ash back on the property and combining it with water which would make the site capable to be developed for further industrial growth. Ms. Beharry questioned Attorney Hoeler as to the limited partners. Attorney Hoeler answered that their names North Branch Energy, Inc., and the 980 Corporation, Inc., which are two Pennsylvania corporate entities; and that North Branch Energy Partners, L.P., has been filed as a limited partnership using a Delaware address. There were no other public comments on this project.
