Chairman Mascara called the meeting to order at approximately 10:10 a.m. and asked if there were any corrections, additions or omissions to Minute No. 64, ,each member having received a copy. Moved by Mr.Petrosky, seconded by Mr. Paluso, that Minute No. 64 be approved as written. Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes, Motion carried unanimously. ' rSpecial Order of Business: i Commissioner Paluso read the following Proclamation: WHEREAS, the right to purchase and own property is one of the fundamental rights guaranteed to all Americans; and t WHEREAS, nearly three -fourths of the housing in Washington County is occupied by the property owner, which encourages these citizens to participate in the decision -making process of all levels of government; and WHEREAS, the wide distribution of private property in its many forms --homer, apartments, offices, farms, businesses and k industries --and the human desire to maintain the rights asso- ciated with private property helps keep America and Washington County strong and prosperous; and WHEREAS, the Greater Washington Board of Realtors in con- junction with their national organizations are setting aside a week to celebrate the constitutional right of all Americans to own real property. THEREFORE BE IT RESOLVED that the Board of Washington County Commissioners proclaims the week of April 28 - May 4, 1985, as Private Property Week in Washington County,'and that we join with the Greater Washington Board of Realtors and its members in setting aside this period to remind ourselves that we are a free people endowed with the right to own real„pro- perty and given the responsibility to protect that right. The Commissioners then presented the Proclamation to Elizabeth "Buffy" ;Johnson, President of the Greater Washington Board of Realtors and June Harris, Chairperson of the Private Property Week Campaign Project. Roland Bourke of the Redevelpment Authority presented to the Board for :their consideration and approval a Resolution approving an Amends,_ to the Re - ,development Proposal for the Canonsburg Pike Street Redevelopment Project Area V.1 k� Mr. Bourke brielfy explained the Amendment to this project. t Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the foregoing Resolution. Old Business: Bids Solicitor Bassi recommended to the Board that the bid for the furnishing and delivering of linen items for the Washington County Health Center be awarded to ATD American Company, the only bidder. Moved by -Mr. Petrosky, seconded by Mr. Paluso, awarding the bid for the k ;furnishing and delivering of linen items for the Washington County Health Center e to ATD American Company for the amount of $13,625.00; this being the only bid re, ceived in accordance with the specifications. Commonwealth of Pa. - $23,390.00 - Adult Probation Grant -in -Aid appropriation for 1985 g Chief Clerk made available to the news media a News Release in reference` to the following project: 1. City of Washington Road Reconstruction Project New Business: Chief Clerk read the following Proclamation: WHEREAS, the apparel industry is a major factor in the stability and economic well-being of our community; and WHEREAS, factories engaged in the production of American - made garments provide job opportunities and security for our citizens; their payrolls contribute taxes to our government agencies; and their workers provide the purchasing power that keeps our service industries healthy and growing; and WHEREAS, the very existence of this vital American in- dustry is threatendd by a rising tide of imported apparel from low -wage countries around the world; and WHEREAS, this take-over of the American market must be rolled back and controlled; our factories must not be shut down; and our citizens must not be forced to suffer unbearable economic hardship. THEREFORE, BE IT RESOLVED, that the Washington County Board of Commissioners hereby supports the International Ladies' Gar- ment Workers Union campaign to roll -back the flood of imported apparel to a controllable level and give American workers and their employers a chance to compete in the marketplace under fair trade conditions. Chief Clerk presented to the Board for their consideration and approval I the following Resolution: I 1 1 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA FRANK R. MASCARA, METRO PETROSKY, JR, EDWARD M PALUSO, COMMISSIONERS WHEREAS, The Pennsylvania Department of Transportation is required by the Pennsylvania Eminent Domain Code, Article VI -A, to provide relocation assistance to all persons displaced by ac- quisition of right of way Project Number L.R. 181, Section 014, involving the replacement of the Monongahela City Bridge. WHEREAS, one aspect of this code is appendix "B" Act 304 Section 3, authorized by the Governor on December 6, 1972, which 3 provides for housing replacements by acquiring as last resort: WHEREAS, Section 3 of this Act provides that the acquiring Agency may acquire or lease and rehabilitate new or existing a housing units for family units which cannot secure comparable, decent, safe and sanitary housing that is within their means and meets their requirements: WHEREAS, The Commissioners of the County in which the public project is located must certify that such decent, safe, and san- itary housing that meets the requirements of certain relocatees € is not available; k WHEREAS, the Pennsylvania Department of Transportation has requested such certification in order to prepare such housing replacement, as last resort plans, as maybe required: AND WHEREAS, the Pennsylvania Department of Transportation and the Federal Highway Administration will assume total responsi- bility for the funding of such last resort measures: NOW, THEREFORE, We the Commissioners of Washington County, hereby certify that comparable dwelling units that meet the re- quirements of certain relocatees are not available, AND WE HEREBY authorize the Pennsylvania Department of Transportation to pro- ceed with such last resort housing measures as may be required. Chief Clerk presented to the Board for their consideration and approval a Resolution authorizing the sale of surplus personal property consisting of seventy-five (75) bookends which hook to metal book shelves. Chief Clerk presented to the Board for their consideration and approval an Agreement with Allegheny County, through its Department of Laboratories, to € perform drug and alcohol screens on urine samples. Request for Nancy Gratz, Administration Office, to attend a System 75 training class sponsored by AT&T Information i g Systems in Pittsburgh, Pa., on May 6-10, 1985. 2. Request for Kenneth L. Baker of the District Attorney s Office to attend a FBI National Academy Associates, Inc., retraining session in Tampa, FL, on July 16-19, 1985. 3. Request for two Assistant District Attorneys to attend a Criminal Law Symposium in Hershey, Pa., on April 26-27, 1985. r s Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the foregoing travel requests and authorizing the payment of all necessary expenses incident I thereto. '*^NOTE: This motion is deemed necessary because of the position taken by the County Controller and is pending resolution of the Court case involving travel requests. I Appointment of Special Counsel: 4 Moved by Mr. Petrosky, seconded by Mr. Paluso, that the firm of Berkman, Ruslander, Pohl, Lieber & Engel, of Pittsburgh, Pennsylvania, be appointed as f S special counsel for the purpose of pursuing legal remedies against any and all D i 1persons, firms or corporations responsible for damages incurred by the County as I ;a result of deterioration and damages to the Washington County Health Center !building arising from original construction; and directing the County Solicitor Ito prepare and submit a written contract for such personal services. REMARKS: Commissioner Petrosky announced that the construction work at the Washing Iton County Health Center facility has been completed and that the transferred patients are being re -admitted. Henry Fiumelli, Director of Human Services, re- tported to the Board on the status of re -admission of the transferred patients. H lalso noted that the County is seeking applications to the facility for skilled and ;intermediate care patients and will be accepting new patients within the next twol weeks. In reference to the above motion, Commissioner Petrosky noted that during' the past several months to a year the Commissioners have been reviewing the possibility of taking legal action against various and sundry individuals relativ� Ito the original construction of the nursing home. He made some comments relatives ito this issue as contained in the 1984 Annual Financial Report of the County file by Controller Beharry. MASCARA, METRO PETROSKY, JR, EDWARD M PALUSO, COMMISSIONERS Hospitalization Coverage for Dependents: � Moved by Mr. Petrosky, seconded by Mr. Paluao, that based upon grievance filed by the union for interpretation of the union contract relating to payment of dependent insurance premiums and having been resolved by arbitrator's opinion ;and award, it is directed that all previous actions and resolutions by the Board I sof County Commissioners are revoked and rescinded. We will abide by the interpre- s x nation of the contract set forth by the arbitrator and consider these matters x :closed. All premiums for dependent care will be paid pursuant to arbitrator's jopinion and past practice. Roll call vote taken: Mr. Paluso - Yes; Mr. Peirosky - Yes; -Mr. Mascara - Yes. The Commissioners made some brief comments relative to this matter. =Announcement: Chief Clerk announced that a Salary Board Meeting will be held on Thursday, E wMay 2, 1985, immediately following the Board of Commissioners Meeting. ;Solicitor: Solicitor Bassi presented to the Board for their :consideration and approval the following tax refunds. Motion carried unanimously. A 4 Chairman Mascara noted _ the receipt of another billing suhmitted by lAttorney Frank C. Carroll for his representation of Controller Beharry in the case of the Controller's solicitor matter (No. 116, April Term, 1984). He noted Nudge'' Bell's order approving payment of $1,064.03 for this billing. Total payment to Attorney Carroll for this case, to date, is $10,981.89.
