Also being present: Chief Clerk Dallatore; Solicitor Bassi; Earl Bugaile, a Planning Commission; Barbara Davis, Administrative Assistant; Judi Lomago, Executive :Secretary; Linda Hands, Clerk -Steno II; Jon Stevens, Observer -Reporter; Jim i Jefferson, WJPA; Don Nelsen; WKEG; Natalie Eddy, Herald -Standard; and Philip Garrow, Brownsville Telegraph. Chairman Mascara called the meeting to order at approximately 2:30 p.m. and asked if there were any corrections, additions or omissions to Minute No. 99,= each member having received a copy. Moved by Mr. Petrosky, seconded by Mr. Paluso, that Minute No, 99 be approved as written, Roll call vote taken: Mr. Paluso - Yes; Mr, Petrosky - Yes; Mr. Mascara - Yes, Motion carried unanimously. Old Business: (Disposable Briefs for the Washington County Health Center) Solicitor Bassi informed the Board that subsequent to the last meeting, the County received notification from Penn Medical Supply, Inc., that the prices submitted in their original bid proposal for the large and medium disposable briefs had been incorrectly reversed. Therefore, it was recommended that the bid for ;both large and medium disposable briefs be awarded to Penn Medical Supply, Inc., for the costs of $24.45/case and $36.00/case respectively. Moved by Mr. Paluso, seconded by Mr. Petrosky, rescinding the action taken: at the meeting on December 19, 1985, (Minute No. 198, p. 272) relative to awarding of the bids for the medium and large disposable briefs for the Washington County 'Health Center; and that the bids be awarded to Penn Medical Supply, Inc., as per E 'above. New Business: Chief Clerk presented to the Board for their consideration and approval a Resolution and Grant Application to be submitted to the Department of Community s � Affairs relative to the Recreational Improvement and Rehabilitation Act (RIRA) 'Program. It was noted that this application was being submitted to DCA for an Access Road Rehabilitation Project at Cross Creek Park. The total cost of the project is $237,000, with a grant amount of $118,500 and the remaining $118,500 o ;local matching funds to be paid by Liquid Fuels funds. i Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing .Resolution and Grant Application to be submitted to DCA and authorizing the Chair ,man of the Board to so execute. f Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Agreement with Johnson Controls, Inc., of Pittsburgh, Pa., for an Alliance III Custom Programmed maintenance program at the Washington County Jail for a period a of one year at an annual cost of $1,436.00. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing ,Agreement with Johnson Controls, Inc.; and authorizing the Chairman of the Board to so execute. Chief Clerk presented to the Board for their consideration and approval ani nAgreement with the Washington -Greene Community Action Corporation for the purpose, 'of Community Action Corporation administering the County's allocation of $194,40� sunder the Pennsylvania Department of Agriculture's $9 million Food Program for ;fiscal year 1985-86. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing EAgreement with the Washington -Greene Community Action Corporation. Chief Clerk presented to the Board for their consideration and approval a iSection 406 Application to the Pennsylvania Department of Transportation which amends the former amended Application which was submitted in April of 1985. Chief Clerk requested authorization to advertise for bids for (a) Flags and Markers for Veterans graves,,and (b) ballot cards and ballot pages for the May! I ;1986 Primary Election. Chief Clerk presented to the Board a request--t-ey-to extend the present lease with Sunset Sales and Service of Claysville for the purpose of leasing office spare ;for District Justice Martin until January 31, 1986, at the present rate of $425.00 per month. Also, that the Board approve a Lease Renewal Agreement with Sunset Sales and Service for the period of February 1, 1986 through December 31, 1991, Sat a cost of $500.00 per month. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving a one -month ,extension to the present lease agreement and also approving a Lease Renewal Agreement with Sunset Sales and Service as per above. Chief Clerk presented to the Board a request from NACo to contribute an amount equal to one -tenth of one percent of the General Revenue Sharing Funds i ,that the County receives (which would amount to $1,039.00) to a national campaign; ;program to save General Revenue Sharing funds. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing ,payment of $1,039.00 to NACo as per above. Roll call vote taken: Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes. Chief Clerk presented to the Board for their consideration and approval an Agreement with Lucinda A Bush, Esquire, as attorney for the Non -Marital Child ;Program of the Domestic Relations Office. The agreement is effective immediatelty sand ends on December 31, 1986. Request for Commissioners, Chief Clerk, Solicitor and Directors of Administration, Planning and Human Services `s to attend NACo's Legislative Conference in Washington, D.C., on March 1-4, 1986. 8. Request for Felicia Filipponi of Adult Probation to attend a Retail Theft Prevention Program at Erie, Pa., on January 14-15, I 1986. Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing travel requests and authorizing the payment of all necessary expenses incident thereto. Solicitor Bassi advised the Board that relative to the Complaint filed ,against the County by Judge Bell's employees who worked during the Wallace Trial Jury selection, the County has filed an Answer to the Complaint and Counterclaim `for Interpleader asking that any and all liability along with counsel fees, �penalities and/or liquidated damages assessed be imposed upon Controller Patriba p5 3 �Beharry, individually, and not on the County. Some discussion followed. Solicitor Bassi and the Commissioners discussed the matter of Allegheny ;County's appeal to the Supreme Court of the Commonwealth Court's decision to dis- miss Allegheny County's Application for Declaratory Judgment against the Common- I i rwealth. of Pennsylvania. It was noted that the purpose of the action filed by Allegheny County was to raise the question of the constitutionality of the County`s obligation to fund the State courts in the face of the 1968 Constitutional amend ments vesting the judicial power of the state in a "unified judicial system." ;Subsequently, Allegheny County has asked Washington County to join with them in }presenting this matter to the Supreme Court of Pennsylvania. The Commissioners k i ;directed Solicitor Bassi to take whatever legal action necessary to join with . d rAllegheny County in this matter and to also ask PSACC to support the position i Eof Allegheny County.
