PALLISO. COMMISSIONERS Minute No. 152 Washington County Commissioners Washington, PA, February 10, 1983 The Board of Washington County Cammissioners met in regular session with the following members being present: Commissioners Mascara and Gilmore. Absent being: Commissioner Paluso w is in the hospital. Also being present: Chief Clerk Dallatore, Administrative Assistant Davis, Solicitor Bassi, Coroner Jackson; Edward DuJordan, Administrative Assistant; Linda Hands, Clerk - Steno II; Jim Jefferson, WJPA; Scott Myers, WKEG; Jon Stevens, Observer -Reporter; Joann Sarkett, Brownsville Telegraph and Martha McCleery, League of Women Voters. Chairman Mascara called the meeting to order at approximately 10:00 a.m, and asked if there were any corrections, additions or omissions to Minute No. 151, each member having received a copy. Moved by Mr. Gilmore, seconded by Mr. Mascara, that Minute No. 151 be approved as read. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Correspondence: Chief Clerk informed the Board of the receipt of the following checks: 1. U. S. Treasury - $27,800.00 - Eanploymen.t & Training Program 2. Commonwealth of Pa. - $12,066.96 - Medical Assistance 3. Commonwealth of Pa. - $20,488.10 - Day Care Program - Month of December New Business: Chief Clerk requested authorization to advertise for bids for flags and markers for Veterans' Graves. Moved by Mr. Gilmore, seconded by Mr. Mascara, authorizing the Chief Clerk to advertise for bids as per above. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval an Agreement James W. Haines, Jr., Esquire, for the District Attorney's Office as Assistant District Attorney, effective February 1, 1983, at an annual sum of $11,900.00. Chief Clerk noted that Attorney will replace Attorney John Olshock who resigned. Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the foregoing Agreement with James W. Haines, Jr., Esquire as per above. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. COMMISSIONERS F-j E F11 Chief Clerk presented to the Board for their consideration and approval an Agreement wi Electronics, Inc,, of Pittsburgh, Pennsylvania, for the installation of a sound system for new courtroom in the Courthouse. Said agreement is in the amount of $3,297.00. Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the agreement with RD-CEL :s, Inc. as per above. Roll call vote taken: Mr. - Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval two agreements the Pennsylvania Department of Transporation, Bureau of Aviation, which propose State for planned improvements at the Washington County Airport. Chief Clerk noted that agreement requests $23,055.00 (FAA Project lt3-42-0101-01) and the second agreement requests $44,444.00 (FAA Project lk3-42-0101-02). Chief., -Clerk noted that these two requests represent. 5% the total project costs and that 90% has already been secured from the Federal Government. remaining 5% will be supplied by Washington County. Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the foregoing Agreement in the nt of $23,055.00 and that the County of Washington has the funds and will make them available for its share of the project costs; said motion also authorizes the Chairman of the Board to the said Agreement. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the foregoing Agreement in the amount of $44,444.00 and that the County of Washington has the funds and will make them available for its share of the project costs; said motion also authorizes the Chairman of the Board to execute the said Agreement. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk presented to the Board for their consideration and approval the following Supplemental Budget Appropriation requests: 1. Request from the Children & Youth Department for the transfer of funds to establish a budget line item for the purposes of staff training as follows: Account No. Decrease Increase 0302-454-01 58.00 0304-448-00 250.00 0305-432-02 400.00 0309-448-00 178.00 0304-441-00 886.00 2. Request from the Law Library for a supplemental appropriation of $1,178 from the Unappropriated Balance to Account No. 0830-434-00 in order to establish $35,000 budget for books, etc.; and a request to transfer $678 from Account No. 0830-448-00 01isc.) to Account No. 0830-434-00 (Subsidies). 4. Request from the Clerk of Courts for a Supplemental Appropriation of $2,400 from the Unappropriated Balance to Account No. 0505-428-01 to accomTodata payment of Solicitor. Moved by Mr. Gihwre, seconded by Mr. Mascara, approving the foregoing Supplemental Budget Appropriation requests. Solicitor: Roll call vote taken: Mr, Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Solicitor Bassi presented to the Board for their consideration and approval the tax refunds. Moved by Mr. Gilmore, seconded by Mr. Mascara, that the Tax Assessment Office be authorized to prepare the following tax refunds due to either duplication or overpayment of real estate or personal property tax: 1. Donald Robert Ross, Jr. R.D. #2, Box 60B Canonsburg, PA 15317 District: North Strabane District No: 520 - Section No: Total amount: $17.85 2. David B. Parks 801 East Maiden Street Washington, PA 15301 District: South Franklin District No: 590 - Section No: Total amount: $69.32 Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. (1982 County Tax) 002 - Parcel No: 0008-01 (1982 County Tax) 011 - Parcel No: 0016-11, 14 and 15 Solicitor Bassi presented to the Board for their consideration and approval an invoice in the amount of $1,850.00 from Attorney Keith Melenyzer for professional services rendered in the case of James Crews vs. Metro Petrosky, Clerk of Courts (Civil Action 80283J, Federal Distric Court). Mr. Bassi explained that this billing is in excess of Attorney Melenyzer's normal retain as Solicitor for the Clerk of Courts, Mr. Bassi also explained that settlement has not been made on this case yet and that litigation is continuing. Solicitor Bassi recommended that the Board approve payment to Attorney Melenyzer and also approve Mr. Melenyzer's continued representation of Mr. Petrosky due to the continuing litigation. Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the payment of $1,850.00 to Attorney Keith Melenyzer and also approving Attorney Melenyzer's continued representation of Mr. Petrosky due to the continuing litigation in the case of James Crews vs. Metro Petrosky, Clerk of Courts, as per above; said action based an the recommendation of Solicitor Bassi. COMMISSIONERS Roll call vote taken.: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Solicitor Bassi presented to the Board for their consideration and approval two from Mayview State Hospital totaling $8,046.00 for Edward J. Vitek ($3,427.00) and Milton Marchich ($4,619.00). Moved by Mr. Gilmore, seconded by Mr. Mascara, approving the payment of the two from Mayview State Hospital as per above. Roll call vote taken: Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Solicitor Bassi informed the Board that the Tax Claim Bureau will have their Free and Clear Sale on February 24, 1983.
