Washington County Commissioners
Washington, PA, March 8, 1984
The Board of Washington County Commissioners met in regular session with the
following members being present: Commissioners Mascara, Petrosky and Paluso. Also being present
Chief Clerk Dallatore, Solicitor Bassi, Administrative Assistant Davis, Judi Lomago, Executive
Secretary; Linda Hands, Clerk -Steno II; Earl Bugaile, Public Relations, Jim Jefferson, WJPA;
Jon Stevens, Observer -Reporter; Scott Myers, WKEG; Jim Provance, Herald -Standard; Joann Sarkett,
Brownsville Telegraph; Lucy Rea, interested citizen and Ralph Piatt, President of the Pa. Society
of Land Surveyors, Debbie O"Dell Seneca and Chief Deputy Sheriff Littleton.
Chairman Mascara called the meeting to order at approximately.10:10 a.m, and asked if
there were any corrections, additions or omissions to Minute No. 11, each member having received
a copy.
Moved by Mr. Petrosky, seconded by Mr. Paluso, that Minute No. 11 be approved as read.
Roll call vote taken:
Mr. Paluso - Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes.
Motion carried unanimously.
Special Order of Business:
Chairman Mascara read the following Proclamation:
WHEREAS, the surveying profession has made valuable contributions
to the history, development and quality of life in the United States and
Washington County; and
WHEREAS, the surveying profession requires special education,
training, experience and knowledge of the principles of mathematics,
the related physical and applied sciences, and requirements of law for
adequate evidence; and
WHEREAS, since the early days of our Nation when many of our fore-
fathers including our first and third Presidents were surveyors, the pro-
fession of surveying has continued to be uniquely qualified to determine
and describe land and water boundaries for the management of our natural
resources and the protection of private property rights; and
WHEREAS, the Congress of the United States has officially recognized
the role of the surveyor by calling upon all Americans to pay tribute to
their contributions to society.
THEREFORE, BE IT RESOLVED, that the Board of Washington County
Commissioners designates the week beginning March 11, 1984, as "SURVEYORS
WEEK" and urges the people to join a county -wide and nationwide effort
to recognize the surveying profession and those of our County who are
members of the Southwest Regional Chapter of the Pennsylvania Society
of Land Surveyors.
Moved by Mr. Petrosky, seconded by Me'. Paluso, adopting the foregoing Proclamation.

Chairman Mascara then presented the Proclamation to Ralph Piatt, President of the Pa.

Correspondence:
Chief Clerk informed the Board of the receipt of the following checks:
1. U. S. Treasury - $35,000.00 - Employment & Training Program
2. Commonwealth of Pa. - Medical Assistance - $231,348.14 and $3,482.48
Chief Clerk made available to the news media. a News Release in reference to the
pro j ect :
1. Funds for Moderate Rehabilitation Program for rental housing
Also, Chief Clerk noted for the record the resignation of Attorney Roger J.
Ecker as Solicitor to the Controller, effective March 5, 1984.
New Business:
Chief Clerk informed the Board that Attorney William Henkel of McMurray has been re, -
commended for appointment to the Washington -Greene County Hannan Services Advisory Commission,
filling a vacancy in the "Business and Industry" category; term to expire in June of 1985.
Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the foregoing appointment of
William Henkel.

Chief Clerk presented to the Board for their consideration and approval an Amendment to
the agreement with Felice Associates, Inc., which increases the hourly consulting fee from
$45.00 per hour to $50.00 per hour, retroactive to October 1, 1980. Discussion followed.
Moved by Mr. Paluso, seconded by Mr. Petrosky, to ratify and confirm the agreement re-
lating to the amount paid per hour as adopted and practiced by the parties and to amend the
ment to conform to such arrangement as per above retroactively to October 1, 1980.

Chief Clerk presented to the Board for their consideration and approval an invoice in
amount of $322.74 from Attorney David S. Posner for costs incurred in the case of Judges vs.
Beharry. Discussion followed. Solicitor Bassi recommended that a motion authorizing payment be
made.
Moved by Mr. Petrosky, seconded by Mr. Paluso, authorizing payment of the foregoing
invoice as submitted by Attorney David S. Posner.

Chief Clerk presented to the Board for their consideration and approval the following
Revenue
Note Resolution for a Tax/and Anticipation Note in the amount of $3,000,000 with Pittsburgh
National Bank at an interest rate of 6.125%
Resolution authorizing the issuance of tax and revenue anticipation
notes in the above -stated aggregate principal amount; providing for
the date, interest rate, maturity date, place of payment and redemp-
tion provisions in respect of the notes; accepting the proposal of

Pittsburgh National Bank for the purchase of the notes; providing
for the security of the notes; authorizing the proper officers to
execute and deliver the notes; authorizing and directing the pre-
paration, certification and filing of the proceedings with the
Department of Cam mity Affairs; appointing a paying agent and
sinking fund depositary; creating a sinking fund; providing a form
of note; and repealing inconsistent resolutions.
Moved by Mr. Petrosky, seconded by Mr. Paluso, adopting the foregoing Note Resolution.

Chief Clerk presented to the Board for their consideration and approval an. Amendment to
the Agreement with Attorney George Retos, Jr., as professional advisor for the Commissioners/Soli
citor's Offices. Chief Clerk noted that the amendment increases the annual contract amount from
$14,900 to $17,500, effective April 1, 1984.
Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the Amendment to the Agreement
with Attorney George Retos, Jr., as per above.

Chief Clerk presented to the Board for their consideration and approval an Agreement
with Attorney William Johnson for professional services as First Assistant District Attorney in
the District Attorney's Office at an annual contract amount of $18,000, retroactive to January 3,
1984.
Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the agreement with Attorney
William Johnson as per above.

Chief Clerk presented to the Board for their consideration and approval the following
Travel Requests:
1. Request for David Suski, Acting Director of JTPA, to attend a
meeting of the Pennsylvania Service Delivery Area Association
in Harrisburg, PA, on March 15, 1984.
2. Request for Kenneth Baker of the District Attorney's Office
to attend a Wiretapping and Electronic Surveillance Training
and Certification Program at Hershey, PA, on March 12-16, 1984.
3. Request for Norma Somales,Jeannine Kjrl.skey,Mary Rowland and
Teresa Crawford, Nurses at the Washington County Health Center,
to attend a seminar at Monroeville, PA, on April 12, 1984.
4. Request for David Daniels, EMA Director, to attend PEMA meetings
in Harrisburg and Valley Forge, PA, on Feburary 23-25 and a
PEMA Planning Session in Pittsburgh, PA, on March 5, 1984.
5, Request for Rita Hritz, Bill Crawford, Minerva Frye, Judy
Beneccio and Ellamaye Calvert to attend an Intergenerational
Training Seminar in Monessen on Feburary 21-22, 1984.

6. Request for Controller Beharry to attend a one day session dealing
with the problems of employee theft and fraud in district justice
offices sponsored by the Pennsylvania Association of Special Court
Administrators to be held in Lancaster County on March 27, 1984.
Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing travel requests.

**NOTE: This motion is deemed necessary because of the position taken by the County Controller
and is pending resolution of the Court case involving travel expenses.

Solicitor Bassi presented to the Board for their consideration and approval the
Tax Refunds.
Moved by Mr. Paluso, seconded by Mr. Petrosky, that the Tax Assessment Office be
authorized to prepare the following tax refunds due to either duplication or overpayment of real
estate or personal property tax:

Solicitor Bassi presented to the Board for their consideration and approval a Deed to be
issued by the Tax Claim Bureau to Ben Shrivers, Jr. Mr. Bassi explained the details of the deed
and noted that Evelyn Black., Director of the Tax Claim Bureau, has been hospitalized and recommend-
ed that the Board designate Mr. Fleming, the Chief Assesor., to execute the deed.
Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing deed and authorizing
the Chief Asseswrto execute said deed in the absence of the Director of the Tax Claim Bureau.

Solicitor Bassi presented to the Board for their consideration and approval invoices
from Mayyvi.ew State Hospital totaling $9,672.00 for Joseph Rosman ($3,720.00) and John Nuzzi
($5,952.00). A lengthy discussion followed. Solicitor Bassi advised the Board that he has had
a conference with the Court concerning the matter of the costs to the County for ttndi',vMuals com-
mitted to State institutions. Mr. Bassi advised the Board that there is a bill pending in the
legislature which would make the Commonwealth responsible for the payment of observation or

I cedures Act. Mr. Bassi noted that Judge Bell is willing to meet with the Commissioners and
legislators in an attempt to move this bill off of the floor of the legislature.

invoices from Mayvview State Hospital.

Solicitor Bassi noted that the bid bond did not accompany the bid but that a copy of
the invoice for the purchase of the bid bond accompanied the bid. Solicitor Bassi directed the
County Commissioners to contact Rotolo's and have them furnish the County with the actual bid
bond. He noted that the Comnissioners could hold this bid pending receipt of the bid bond.
