Minute No. 39
Washington County Commissioners
Washington, PA, October 4, 1984
The Board of Washington County Commissioners met in regular session with
the following members being present: Commissioners Mascara, Petrosky and Paluso.
Also being present: Chief Clerk Dallatore; Solicitor Bassi; Coroner Jackson;
Administrative Assistant Davis; Judi Lomago, Executive Secretary; Linda Hands,
Clerk -Steno II; Barbara Miller, Oberver-Reporter; Jim Jefferson, WJPA; Scott
Myers, WKEG; Natalie Moore, Herald -Standard; Joann Sarkett, Brownsville Telegraph.
Chairman Mascara called the meeting to order and asked if there were any
corrections, additions or omissions to Minute No. 38, each member having received
a copy.
Moved by Mr. Petrosky, seconded by Mr. Paluso, that Minute No. 38 be approv?d
as read.
Roll call vote taken:
Mr. Paluso -Yes; Mr. Petrosky - Yes; Mr. Mascara - Yes.
Motion carried unanimously.
Special Order of Business:
Chairman Mascara read the following Proclamation:
WHEREAS, the conservation of the natural, scenic, his-
toric and aesthetic resources of Washington County, Penn-
sylvania, is of concern to the Washington County Commissioners;
and
WHEREAS, the Washington County Commissioners established
the Washington County Conservation District on March 10, 1947,
as a result of this concern for our resources; and
WHEREAS, the Washington County Conservation District, as
one of the 66 conservation districts in Pennsylvania, is
playing a key role in developing and implementing programs
and practices to protect the natural resources in Washington
County and the Commonwealth of Pennsylvania.
NOW, THEREFORE, the Washington County Commissioners pro-
claim the week of October 7-13, 1984, as CONSERVATION DISTRICT
WEEK and urge all citizens to give recognition to the people
involved in the Washington County Conservation District and
participate in their events and activities.
Moved by Mr. Petrosky, seconded by Mr. Paluso, adopting the foregoing
Proclamation.

Motion carried unanimously.
Chairman Mascara then presented the Proclamation to Gary Stokum, Conser-
vation District Manager. Mr. Stokum made a few remarks.

Chief Clerk presented to the Board for their consideration and approval
the following Resolution:
WHEREAS, the Federal Surface Mining Control and Reclamation
Act of 1977 (Public Law 95-87) authorizes fee be collected for
a National Abandoned Mine Reclamation Fund; and
WHEREAS, the Western Pennsylvania area has thousands of
acres of qualified abandoned mine lands; and
WHEREAS, Western Pennsylvania counties have not received
adequate funding for needed mine reclamation work; and
WHEREAS, the Western Pennsylvania Coalition for Abandoned
Mine Reclamation is striving to convince the United States Con-
gress to allocate increased funding for abandoned mine reclamation;
THEREFORE, be it Resolved, that we the undersigned as
County Commissioners support the Western Pennsylvania Coalition
for Abandoned Mine Reclamation and
BE IT FURTHER RESOLVED, that Washington County will con-
tribute an amount of $50.00 as dues in order to support the
Coalition for Abandoned Mine Reclamation.
Moved by Mr. Petrosky, seconded by Mr. Paluso, adopting the foregoing
Resolution.

Old Business:
Commissioner Petrosky made reference to an article that appeared in today's
Observer -Reporter regarding an application for Extraordinary Relief filed with
the Pennsylvania Supreme Court by Controller Beharry in reference to the Con-
troller's Solicitor matter. Solicitor Bassi and each of the Commissioners then
made some comments on this matter.
Correspondence:
Chief Clerk informed the Board of the receipt of the following checks:
1. Commonwealth of Pa. - $5,566.14 - Child Support Program -
Incentives for July, 1984
2. Commonwealth of Pa. - $89,408.89 - Monies due from provisions
of Pa. Public Utility Realty Tax Act
Chief Clerk made available to the news media News Releases in reference
to the following projects:
1. Phase I - Downtown Street Revitalization Project - Donora
2. Finleyville Storm Improvement Project
Chief Clerk noted that the Health Systems Agency (HSA) of Southwestern
Pennsylvania is proposing revisions to its Health Systems Plan and that a copy
of those revisions is available for public comment and review in the Human Ser-
vices Department located on the 5th Floor of the Courthouse Square Office Building.
Chief Clerk noted that a public hearing on the proposed revisions will be held
in Pittsburgh on November 2, 1984.

New Business:
Chief Clerk presented to the Board for their consideration and approval
the following Resolution:
WHEREAS, The Pennsylvania Department of Transportation
is required by the Pennsylvania Eminent Domain Code, Article
VI -A, to provide relocation assistance to all persons dis-
placed by acquisition of right of way Project Number L.R. 247
Section B-10, involving the reconstruction and rehabilitation
of the North Charleroi-Monessen Bridge and its approaches.
WHEREAS, one aspect of this code is appendix "B" Act 304
Section 3, authorized by the Governor on December 6, 1972,
which provides for housing replacements by acquiring as last
resort:
WHEREAS, Section 3 of this Act provides that the acquiring
Agency may acquire or lease and rehabilitate new or existing
housing units for family units which cannot secure comparable,
decent, safe and sanitary housing that is within their means
and meets their requirements;
WHEREAS, the Commissioners of the County in which the
public project is located must certify that such decent,
safe, and sanitary housing that meets the requirements of
certain relocatees is not available:
WHEREAS, the Pennsylvania Department of Transportation
has requested such certification in order to prepare such
housing replacement, as last resort plans, as may be required:
AND
WHEREAS, the Pennsylvania Department of Transportation
and the Federal Highway Administration will assume total re-
sponsiblity for the funding of such last resort measures:
NOW, THEREFORE, We the Commissioners of Washington County,
hereby certify that comparable dwelling units that meet the
requirements of certain relocatees are not available, AND WE
HEREBY authorize the Pennsylvania Department of Transportation
to proceed with such last resort housing measures as may be
required.
Moved by Mr. Petrosky, seconded by Mr. Paluso, adopting the foregoing
Resolution.

Chief Clerk presented to the Board for their consideration and approval
an Intermediate Care Facility Agreement with the Department of Public Welfare,
Medical Assistance Program, in connection with the Washington County Health Center.
Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the Intermediate
Care Facility Agreement as per above and authorizing the Chairman of the Board to
so execute.

Chief Clerk requested authorization to re -advertise for bids for a
4-Wheel Drive Pickup Truck for the Parks Department.
Moved by Mr. Petrosky, seconded by Mr. Paluso, giving the Chief Clerk
authorization to re -advertise for bads as per above.

Chief Clerk presented to the Board for their consideration and approval
the following travel requests:
1. Request for Ken Krupa of the Planning Commission
to attend an Aviation Conference in Altoona, Pa.,
on October 10-11, 1984.
2. Request for Wayne Fleming, Chief Assessor, to
attend a Legislative Meeting of the PSACC in
Harrisburg, Pa., on October 23, 1984.
Moved by Mr. Petrosky, seconded by Mr. Paluso, approving the foregoing
travel requests and authorizing the payment of all necessary expenses incident
thereto.

Motion carried unanimously.
**NOTE: This motion is deemed necessary because of the position taken by the
County Controller and is pending resolution of the Court case involving
travel expenses.
Chief Clerk presented to the Board for their consideration and approval
the following transfer of funds:
September 28, 1984 - $5,000,00 from General Fund to Debt Service
Sinking Fund
Moved by Mr. Paluso, seconded by Mr. Petrosky, approving the foregoing
transfer of funds.

Motion carried unanimously.
Chief Clerk announced to all those present that the County Offices will
be closed on Monday, October 8th in observance of the Columbus Day Holiday.
Solicitor:
Solicitor Bassi requested authorization to petition the Court of Common
Pleas to permit the County to run a simultaneous tabulation to test the suffi-
ciency of the county computer's back-up program for the General Election which is
to be held on November 6, 1984. Mr. Bassi noted that if this program is success-
ful in the General Election, then the County will petition the Secretary of the
Commonwealth to certify the county computer as an acceptable tabulating instru-
ment in future elections.

Motion carried.
There being no further business, Chairman Mascara declared the meeting
adjourned at approximately 10:30 a.m.
