Minute No. 196
Office of County Commissioners
Washington, PA., December 6, 1979
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Gilmore, Paluso and Morgan. Also being
present: Chief Clerk Brady; Solicitor Porter; John Drake, Senior Citizens;
Jim Jefferson, WJPA; Bob Sabot, WKEG; Becky Andrews of the Daily Herald;
and Bob Robertson of Observer -Reporter.
Chairman noted for the record that the three Commissioners, the Chief
Clerk and County- Solicitor were in attendance.
Chairman asked if there were any corrections, additions or omissions to
Minute No, 195, each member having received a copy.
Moved by Mr, Paluso, seconded by Mr. Gilmore, that Minute No. 195, be
approved as read.
Roll call vote taken:

Regarding the bid received for the 10-Station Weight Training Machine for
the County Jail, Solicitor Porter stated that Warden Taylor was not satisfied
with the bid submitted by Play Sports Activities because Item "A" on the bid
was a 9-Station Machine and Item "B" was more expensive than previous quotes
and would take 30 to 40 days for delivery-, Solicitor Porter stated that the
bid should be refused,
Moved by Mr. Paluso, seconded by Mr, Gilmore, that the bid from Play Sports
Activities for the Weight Training Machine be refused and the Chief Clerk be
authorized to re -,bid,

Chief Clerk informed the Board of the receipt of the following checks:

(2) F.N.B. - Repurchase Agreement - Federal Revenue Sharing
Fund - Interest Earned - $1,896.53

Chief Clerk presented the following bills to the Board for their consider-
ation and approval:
(1) Robert Morris College - $640.00
Commissioner Gilmore stated that he wanted more information on the
above bill. Chief Clerk Brady stated that this was a bill for tuition for
the following students enrolled in the Legal Assistant Certificate Program and
that it would be paid out of the IV-D Program:
Gilbert Muir General Law $160.00
Barbara Gibbs Criminal Law Procedures $160.00
Richard Stickel Criminal Law Procedures $160,00
Thomas Welsh Criminal Law Procedures $160.00
Commissioner Gilmore stated that he does not believe that these
courses of study are directly related to the job function.
Moved by Mr. Paluso, seconded by Mr. Morgan, to pay the above bill
with the stipulation that future invoices will be paid only if the courses
of study are directly related to the job function.

Chief Clerk requested authorization to advertise for bids for the delivery
and pickup of laundry, items for the Washington County Health Center for a
period of one year.
Moved by Mrs Gilmore, seconded by Mr. Paluso, authorizing the Chief Clerk
to advertise for bids as stated above.

Motion carried unanimously.
The Chief Clerk stated that he had two deeds to be executed by the
Commissioners which had been previously approved by the Commissioners and
the Court, The Chief Clerk further stated that these deeds are two (2)
parcels of land adjacent to the Washington County Industrial Park -Houston
Area which the County is transferring as buffer areas between adjoining
residential properties and the industrial park and that this property after
being transferred to the Washington Industrial Development Corporation will
be reconveyed by the W',I,D,C, to the individual property owners.
Chief Clerk Brady, informed the Commissioners of two Settlement Agreements,
one being the Labor Settlement employees of the Sheriff's Office and the
other being a wage settlement from Wage & Hour Division for settlement of the
Nurses Aide case at the Washington County Health Center.
Moved by Mr, Gilmore, seconded by Mr. Paluso that the above Settlement
Agreements be approved,

Chief Clerk presented to the Board drawings from Roanoke Iron & Bridge
Works, Inc, for the basement electric control station for sallyport doors,
and paint specifications for the renovation of the County Jail.
Moved by Mr. Paluso, seconded by Mr. Gilmore, that these drawings be
approved.

Chief Clerk informed the Board of the following CETA Contracts:
CETA Contract between the Washington County Board of Commissioners and
the Pennsylvania Office of Employment Security for the provision of unemploy-
ment insurance verification for Fiscal Year 1980 at a cost of $3000.00
The following is a list of twelve (12) Special Project extensions for
CETA for the month of October.

Office be authorized to prepare the foregoing tax refund due to either duplica-
tion or overpayment of real estate or personal property tax.

The Solicitor presented to the Commissioners a deed from the County
which is to be executed by the Commissioners for an exchange of land
in which the County will obtain a parcel of land which will front on West
Cherry Avenue and the Parking Authority will obtain a parcel of land from the
County, which will front on Vest Wheeling Street. The Solicitor stated that
there is no consideration onrthis piece of property;that it is an exchange of
property, between the County and the Washington Parking Authority and he recom-
mended it be approved,
Moved by Mr. Gilmore, seconded by Mr. Paluso, that the foregoing deed be
approved.

The Solicitor advised the Board of the following litagations:
Mr. Kouche filed suit against the County and Mr. McCavitt of the Probation
Department regarding a probation order which was made by the court which had
a provision in it for restitution to be made to the plaintiff, Mr. Kouche, and
the defendant didn't pay the restitution and the County is being accused of
negligence in letting the defendant get across the border,
Wozniak & Theakston filed suit against the County and the Juvenile Deten-
tion Home, Mr. Porter stated that he had nothing to report on this case.

Mr. Porter further stated that on the matter of the appeals on the Coal

Assessments that the cases involving the major coal owners was settled last
year but two of the smaller ones, Gulf Oil and one of its subsidiaries and
Standard Oil of Ohio and one of its subsidiaries, have taken their appeal to
Commonwealth Court and there have been several delays in that case.
Solicitor Porter reported to the Board on another suit, in which, Hamay
vs. Washington County. This case involves Hamay being picked up on a Bench
Warrant and put in Washington County Jail for a couple of days, in which this
case was processed in the 'Washington County Courts and a judgement was handed
down in favor of the County and it is now on appeal to the Superior Court.
Solicitor Porter stated that Hamay has filed a duplicate action in Federal
District Court alleging the same violation of civil rights and that he had
filed an answer in Federal Court to that suit.
Solicitor Porter stated that he had received two tax appeals from two coal
companies appealing the actions of the Board of Assessment of Appeals.
Chief Clerk Brady announced that the 1980 Budget would be posted in the
Office of the Chief Clerk at 4:00 p.m. Friday, November 7, 1979.
