COMMISSIONERS Minute No. 13 Office of the County Commissioners Washington, Pa., April 3, 1980 The Board of County Commissioners met in regular session with the following members being present',: Commissioners Paluso, Gilmore and Mascara. Also being present: Chief Clerk Dallatore; Administrative Assistant Davis; Betty Gallo, Secretary; Solicitor DiSalle; George Retos, Law Clerk; Budget Director Gillespie; Coroner Jackson; Roland Bourke and Steve Wiencek, Redevelopment Authority; Mrs. Miller, League of Women Voters; Ginger Anderdas, Assistant Planner, Washington -Greene Community Action; Bob Sabot, WKEG; Bob Robertson, Observer -Reporter; Becky Andrews, Daily Herald. Chairman called the meeting to order at 10:02 a.m. and asked if there were any corrections, additions, or omissions to Minute No. 12, each member having received a copy. approved. Moved by Mr. Gilmore, seconded by Mr. Paluso, that Minute No. 12 be Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Old Business: Chairman noted that no action would be taken today on the bids received for construction materials for recreational facilities for CE'TA. Special Order of Business: Roland Bourke, Executive Director, Redevelopment Authority, presented the following two (2) Resolutions for consideration and approval by the Board: Resolution approving the Community Development Program and Filing of an Application for Financial Assistance for Federal Fiscal Year 1980 Program Resolution approving Local Amendments to the County's Community Development Programs for Fiscal Years 1975, 1976, 1977, 1978 and 1979, respectively, authorized under the Housing and Community Development Act of 1974, as amended Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing Resolutions. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. PALUSO, COMMISSIONERS Correspondence: Chief Clerk informed the Board of the receipt of the following checks: 1. Commonweath of Pa. - for EMS Highway Safety Project #EM-78-110-3 - $8,738.00 2. Commonwealth of Pa. - Day Care Contract #9630 month of Feb. (actual) - $15,898.11 3. P.N.B. - Interest on C.D. #1929 - Char House Project #R-170-8E - $2,782.51 New Business: Chief Clerk presented a Proclamation designating the month of April as "Census Month". Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing Proclamation. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk stated that the Director of Property and Supplies has requested that the County advertise for bids for one (1) automobile. Moved by Mr. Gilmore, seconded by Mr. Paluso, authorizing the Chief Clerk to advertise for bids for one (1) automobile. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk stated that the Director of CETA has requested that the County advertise for bids for playground equipment under the CETA program. Moved by Mr. Gilmore, seconded by Mr. Paluso, authorizing the Chief Clerk to advertise for bids as per above. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk presented a Planned Maintenance Agreement with the Barber -Colman Company for maintenance of the environmental control system at the Washington County Health Center. Agreement. Moved by Mr. Paluso, seconded by Mr. Gilmore, approving the foregoing Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore -Yes; Mr. Mascara - Yes. COMMISSIOPIERS Under the CETA Program, the Chief Clerk presented the following two (2) Agreements and one (1) OJT Contract. Agreement with Opticians Institute for provision of five (5) training slots in the field of opticianry at a cost not to exceed $8,599.50 for the period of June 1 to Sept. 30, 1980. Agreement with Pittsburgh Beauty Academy for pro- vision of five (5) training slots in the field of cosmotology at a cost not to exceed $3,675.00 for the period of May 1 to Sept. 30, 1980. On the Job Training Contract with General Heating Company of Canonsburg, Pa., at a cost not to exceed $2,080.00 for the period of April 7 to October 10, 1980. Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing Agreements and OJT Contract. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk informed the Board of a request for travel, authorization for Evelyn Comstock and Louis Wilson to attend a Domestic Relations Conference in Nashville, Tennessee on June 28 - July 3, 1980 Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing travel request. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk informed the Board of a quote from McDonald Associates of $4,600.00 to perform a survey of the Juvenile Detention Home site for the proposed construction of a shelter care facility. Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the survey by McDonald Associates as per above. Roll call vote taken: Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes. Motion carried unanimously. Chief Clerk announced that the Courthouse will be closed on Friday, April 6, 1980, in observance of Good Friday. Chief Clerk also announced that the next monthly Salary Board Meeting has been rescheduled to Thursday, April 10, 1980, at 2:00 p.m. BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY. PENNSYLVANIA Frank R. Mascara, . DAVID L. GILMORE. EDWARD M. PALUSO. COMMISSIONERS Concerning a problem involving the responsibilities of the Coroner in Washington County and Westmoreland County, Mr. Mascara stated that he had contacted officials in Westmoreland County, who felt that this matter should be litigated as this has been an ongoing problem for the past five years. Remarks: Coroner Jackson stated that there were really two violations being made by Westmoreland County - no proper- investigation is made and removal of the body before an investigation is made. Mr. Mascara added that the officials of Westmoreland County indicat to him that they were not going to move on this matter right now. He asked the County Solicitor to review the laws governing the Coroner's Office. Solicitor: Solicitor DiSalle presented the following five (5) tax refunds to the Board for their consideration and approval. Moved by Mr. Gilmore, seconded by Mr. Paluso, that the Tax Assessmeni Office be authorized to prepare the following tax refunds due to either duplica- tion or overpayment of real estate or personal property tax: 1. COMMISSIONERS Solicitor DiSalle presented a legal opinion which the Board had asked for with respect to the effect of the provisions of Act 170 of 1978, which requires the filing of financial statements by public employees and public officials in the Commonwealth of Pennsylvania. He stated that on February 9, 1980, the State Ethics Commission adopted proposed regulations implementing the legislation and these proposals were amended on February 23, 1980. He also outlined the definition of a public official and a public employee, and suggest that a notice be given to all department heads and their chief deputies regardi the mandate of this legislation, calling to their attention that the financial disclosure statements must be filed on or before May 1, 1980. Mr. DiSalle added that he had spoken with the Executive Director of the State Ethics Commission who advised him that the proposed rules will probably be acted upon within the next 7 to 10 days, and that he does not anticipate any substantial changes to be made in them. He also indicated to Mr. DiSalle that the May 1st deadline would not be extended. (Discussion was held.) Mr. Gilmore suggested that the notice be given to each County employee with a copy of the Solicitor's opinion, and then that employee can determine if he or she falls into the particular category for filing the statements. Mr. DiSalle added that the statements would be kept on file in the Chief Clerk's office. Mr. DiSalle informed the Board of a letter referred to him by the Acting Controller, requesting a complete report of any pending or threatened litigation involving Washington County to be submitted to the auditing firm of Main, Hurdman & Cranstoun of Pittsburgh. He stated that he had completed a summary of said litigation and included the current status of each case. Regarding the Tony Boyle trial, Mr. DiSalle noted that the Board had asked him to review the contractual arrangements the County has with Attorney Richard Sprague, and that he had reviewed the Letter of Agreement with Attorney Sprague dated February 21, 1978, which is still in effect. Mr. DiSalle informed the Board that he had checked with Judge Sweet and Acting District Attorney Costa, who informed him that there are no other agreements relative to the other defendants. Ginger Andredas, Assistant Planner of the Washington -Greene Community Action Corporation, attended today's meeting to discuss the distributic of certain community development funds and asked that more consideration be given for housing rehabilitation outside the targeted areas.
