Office of the County Commissioners
Washington, Pa., April 10, 1980
The Board of County Commissioners met in regular session with the
following members being present: Commissioners Paluso, Gilmore, and Mascara.
Also being present: Chief Clerk Dallatore; Administrative Assistant Davis;
Solicitor DiSalle, Budget Director Gillespie; Betty Gallo, Secretary; George
Retos, Law Clerk; Mrs. Miller, League of Women Voters; John Drake, Senior
Citizens; John Cadez, Township Officials; Bob Sabot, WKEG; Jim Jefferson, WJPA;
Becky Andrews, Daily Herald; Bob Robertson, Observer -Reporter.
Chairman called the meeting to order at 10:00 a.m. and asked if
there were any corrections, additions or omissions to Minute No. 13, each
member having received a copy.
Moved by Mr. Gilmore, seconded by Mr. Paluso, that Minute No. 13,
be approved as read.
Roll call vote taken:
Mr. Paluso - Yes; Mr. Gilmore - Yes; Mr. Mascara - Yes.
Motion carried unanimously.
Old Business:
Regarding the bids received for building materials for construction
of recreational facilities under the CETA Program, Solicitor DiSalle stated that
he had reviewed the bids and recommended the bid be awarded to Donora Lumber
Company for their bid in the amount of $22,995.00 without delivery.
Moved by Mr. Gilmore, seconded by Mr. Paluso, awarding the contract
for building materials for the construction of recreational facilities by the
CETA Program, to DONORA LUMBER COMPANY, 300 Meldon Avenue, Donora, Pa., for
the amount set forth in their bid without delivery; this being the lowest and
most responsible bid received in accordance with specifications.

Motion carried unanimously.
Regarding the bid received for leasing of a van for the CETA
Program, Solicitor DiSalle recommended that the bid be awarded to Pankopf Ford
as this was the only bid received and meets all specifications.
Moved by Mr. Gilmore, seconded by Mr. Paluso, awarding the contract
for the leasing of one 8-passenger van for the CETA Program, to PANKOPF FORD
SALES, INC., 470 Washington Road, Washington, Pa., for the amount set forth in
their bid; this being the lowest and only responsible bid received in accordance
with specifications.

Regarding the bid received for a horizontal camera for the Planning
Commission, Solicitor DiSalle recommended the bid be awarded to the Harry
Guckert Company as this was the only bid received and which meets all specifica-
tions.
Moved by Mr. Gilmore, seconded by Mr. Paluso, awarding the contract
for the delivery and installation of a Horizontal Process Camera for the
Washington County Planning Commission to HARRY GUCKERT COMPANY, 810 W North
Avenue, Pittsburgh, Pa., for the amount set forth in their bid; this being the
lowest and only responsible bid received in accordance with specifications.

Motion carried unanimously.
Regarding the bids received for a Pickup truck for the Bridge
Department, Solicitor DiSalle stated that the bid from Pankopf Ford did not
meet all of the specifications, and therefore, he recommended the bid be
awarded to Arnold Pontiac for their bid in the amount of $7,800.00 with trade-in

the lowest and most responsible bid received in accordance with specifications.

For the Board's adoption, the Chairman read a Policy Safety Statement
directed to all County employees requesting their participation in a functional
loss prevention program which will eliminate every safety hazard from every job.
Moved by Mr. Gilmore, seconded by Mr. Paluso, adopting the foregoing
Policy Safety Statement.

Chief Clerk announced that the next regularly scheduled Commissioners
(Meeting on Thursday, April 17, 1980, will be cancelled, and the first regional
Commissioners Meeting will be held on Saturday, April 19, 1980, at 10:00 a.m.
at the Charleroi Firehall on 328 Fallowfield Avenue, Charleroi, Pa.

Solicitor DiSalle informed the Board of an emergency situation which
exists in the Domestic Relations Office because of an error in check number
selection. He stated that the present supply of checks cannot be utilized,
and now there is an immediate need for a new supply of properly number checks.
He stated that an order of 50,000 checks has been placed and that the price of
these checks far exceeds the dollar amount that can be purchased without the
item being placed for bids. He added that a considerable savings ($2,500)
is being realized by purchasing the checks in this volume. Mr. DiSalle stated
that Judge Sweet has requested the Board to consider this an emergency situation
and do whatever is necessary to avoid placing the matter up for bid.
Mr. DiSalle informed the Board that he had Drevared a resolution pursuant to
Judge Sweet's request declaring this an emergency situation and that the require
ments for bidding be waived.
Moved by Gilmore, seconded by Mr. Paluso, approving the foregoing
Resolution as prepared by the County Solicitor.

Solicitor DiSalle Dresented the following request from the Tax
Claim Bureau:

Request to County Commissioners to cancel
Treasurer's Tax Sale of
April 24th, 1940
It is requested that the Tax Claim Bureau be authorized
to cancel the Treasurer's Tax Sale of April 24, 1940 for the
1933 County, School and Road Taxes, plus sale costs, for'the
property assessed to Margaret Thistlewaite and described as
Vacant Lot, South Ailey, situate in Centerville Borough,
Washington County, Pennsylvania; in as much as Margaret
Thistlewaite does not have a good and marketable title to the
above described property, as per attached title search. From
the description it is impossible to certify as to the location
of this property. Therefore, the tax sale should be void and
cancelled. The Tax Claim Bureau, the Assessment Office and the
Office of the Prothonotary are hereby directed to mark their
records accordingly.

Regarding the ongoing dispute between the Coroner's office of
Washington and Westmoreland Counties, Attorney George Retos, Jr., Law Clerk for
Washington County, submitted a legal opinion to the Board dated April 9, 1980.
Attorney Retos stated that while there are no specific provisions in the Fourth
Class County Code relative to the performance of the Coroner's official duties
with respect to decedents brought into the County from an adjacent jurisdiction,
there would appear to be no other reasonable interpretation than that
Westmoreland County must remain liable for the expenses incurred by Mr. Jackson';
office. He cited Section 1237 of the Code which imposes responsibility upon the
County for investigations of deaths that occur in their county. He stated that
if the elected officials of Westmoreland County refuse to comply with both the
law as well as the general principles of equity, litigation ought to be
instituted the next time this situation arises, and he urged the Board to contac,
various area legislators and request that an amendment be prepared which will
specifically set forth the responsibility of the county wherein the death
occurs to remain liable for all expenses related to official activities of the
Coroner's office in an adjacent county.
Remarks:
Mr. Paluso suggested that a copy of Attorney Retos legal opinion be forwarded
to the Solicitor of Westmoreland County for his review and action.
