The Board of County Commissioners riet in regular session with tie
following members being present: Commissioners Paluso, Gilmore and Mascara.
Also being present: Chief Clerk Dallatore, Administrative Assistant Davis,
Charles Gillespie, Budget Director; Farrell Jackson, Coroner: Roland Bourke,
Redevelopment Authority; Richard Brady, Property & Supplies Director; Acting
Solicitor Retos; Linda Hands, Secretary; Keith Long, Representative of CES;
Janet Moschetta; Susan cleft, WESA; Jim Jefferson, WJPA; Bob Sabot, WKEG;
Jon Stevens, Observer -Reporter; Helen t-tiller, League of Women Voters and Paul
King, Daily Herald.
Chairman called the meeting to order at approximately 10:05 a.m. and
asked if there were any corrections, additions or omissions to Minute No. 51
each member having received a copy.
Moved by Mr. Gilmore, seconded by Mr. Paluso, that Minute No. 51 be
approved as read.
Roll call vote taken:

Special Order of Business:
Roland Bourke, Executive Director of the Redevelopment Authority,
presented to the Board the following Resolutions for their Consideration and
approval:
(1). Resolution approving an Amendment to the County's Fiscal Year
1980 Community Development Program, authorized under the
Housing and Community Development Act of 1974, as amended.
(2). Resolution pledging Federal Community Development Grants for
Repayment of Federally -Guaranteed Notes in the amount of
$2,500,000.00
Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the fore-
going Resolutions.

Old Business: Bids - Electronic Voting Equipment
Acting Solicitor Retos provided to the Board the following written
Solicitor's opinion:
You have asked for an opinion with respect to the bid
proposal for the electronic voting equipment and supplies
provided by Computer Election Systems, Inc. Your question
concerns our bidding of this equipment before any suppliers
were certified by the Secretary of the Commonwealth and your
awarding or rejecting such a bid prior to the bidder receiving
state certification.
Act No. 1980-128, Section 1105-(b) (c), (Title 25 P.S.
§3031.5) provides that the Secretary of the Commonwealth shall
examine any proposed electronic voting system and state whether
"The system so examined can be safely used by venters at elections
as provided in this Act and meets all of the requirements here-
inafter set forth. If his report states that the system can
be so used and meets all such requirements, such system shall
be deemed approved and may be adopted for use at elections, as
herein provided." Subparagraph (c) states "No electronic voting
system not so approved shall be used at any election, . . ."
It is my opinion that so long as the Secretary of the
Commonwealth submits a report that approves an electronic
voting system at any time prior to the system's use in an
election, such a system can be used in any ensuing election
following the Secretary's approval. There is no requirement
that any supplier must be certified by the Secretary prior
to any bidding and, further, there is no prohibition in the
Act that would prevent you from bidding the equipment prior
to a supplier's certification.
Accordingly, I believe that the bid of Computer Election
Systems, Inc., being in proper form, may be accepted or rejected
by your Board in accordance with Title 16 P.§. S1802(e)
I might also note that Per. Keith Long of Computer Election
Systems, Inc. has notified our Chief Clerk that his firm received
verbal approval from the State Election Department concerning
their equipment being certified by the Secretary of the Common-
wealth on Friday, January 16, 1981.

Proved by Mr. Gilmore, seconded by Mr. Paluso, that Computer Election
Systems, Inc., be awarded the bird to provide 750 new and 250 used voting
machines and additional supplies as set forth in their Proposal #2 to Washing-
ton County for $338,2_A5.00 subject to the Commissioners' reserving the right,
at their option, to delete the purchase of one Electronic Tabulating Device
for $56,000.00. The acceptance of the bid is further contingent upon Computer
Electioai Jystems, Inc., receivin( the required necessary certification from
the Secretary of the Commonwealth pursuant to Act No. 1980-128: and if such
certification is not received sufficiently prior to the Play 1981 Primary
Election, the Commissioners reserve the right to terminate the purchase agree-
ment between the parties without any liability on the part of the County. It
is further understood that no payments will be made until the certification
above stated has been received.

Chief Clerk informed all those present of a Public Notice stating
that Eagle Borough has applied for a Department of the Army Permit • the
apFlicant proposes to construct a boat launching ramp to provide public access
to the river.

Chief Clerk presented to the Board a Proclamation designating
January 23, 1981 as Veteran's Outreach Day and encouraging the citizens of
Washington County to cooperate with The Govenor's veterans Outreach and
Assistance Center located in North Huntingdon, PA.

Chief Clerl: presented to the Board the renewal of a Maintenance
Agreement with JMCC Powers for the Courthouse and Jail Complex at the cost of
$789.00 per month effective February 1, 1981 for a one-year period.

Regarding the Drug & Alcohol Program, Chief Clerk presented to the
Hoard amendments to the original Base and State Wide Service Contracts with the
Governor's Council on Drug & Alcohol Abuse. Said Amendments require no addition-
al match monies by the County.

Concerning the LICETA Program, Chief Clerk presented to the Board a
PSE Agreement with YMCA for 1 Camp/Program Director under Title II-D for the
amount not to exceed $10,009.00.
Chief Clerk presented to the Board a request to rescind the authoriz-
tion of December 4, 1980, for Cross Creek Township, CETA Title VI Special Pro-
ject and authorize the 11ashington County Employment and Training Agency to enter
into an Agreement with Cross Creek Township for the Public Service Employment
of fifteen (15) participants. The Agreement term is from January 1, 1981 throul-Th
September 30, 1981 and the Agreement amount will not exceed $150,000.00. The
positions are as follows:
4 Light Equipment Operators
4 Skilled Laborers
6 Semi -Skilled Laborers
1 Clerk/Typist
The reason for this authorization was an increase in operation
costs for the project which was not included in the original authorization amoun-.
Chief Clerk presented to the Board the following amendments to FY 80
agreements; said amendments due to over -expenditures in certain cost categories.

Chief Clerk informed the Board of a request from C. Wayne Fleming,
Chief Assessor, that because of the conflict in the change of dates the "lien
taxes" are to be reported to the "Tax Claim Bureau", the County Commissioners
adopt the following Resolution:
"The 1980 tax bills were originally printed with the lien date of
May 1981. The Senate Bill 316, enacted July 10, 1980, changed this
date from the first Monday in May to the first Monday in April.
Since this creates a conflict and may be misleading to taxpayers,
the County Commissioners have instructed the Tax Claim Bureau to
accept the Liened Tax Report from Washington County Tax Collectors
on the originally stated date of Play 1981 and conform to the new
lien date in 1982. The 1981 tax bills will reflect the correct
lien date in 1982.1"

Resolution based upon the recommendation of the Chief Assessor.

Chief Clerk informed the Board that Frank J. Paterra of North
Charleroi has been recomme-nded for appointment to the Washington County Hospital
Authority for a five-year term (1-81 thru 12-85) replacing Lawrence Cook.

went of Frank J. Paterra as per above.

Chief Clerk informed the Board that Commissioner Gilmore's appoint -
meet on the SPRPC Board had expired at the end of 1980 and has been recommend-
ed for reappointment on the Board for a three-year term.

meet of Commissioner Gilmore as per above.
