PALUSO, COMMISSIONERS Minute No. 132 Office of County Commissioners Washington, Pa., August 17, 1978 The Board of County Commissioners met in rggular session with the following members being present: Commissioners Gilmore, Paluso and Morgan. Also being present: Chief Clerk Brady; Solicitor Derrico; Budget Director Gillespie; Don Ligman, Administrative Assistant; Michael G. Stefan, Washington County Housing Authority; Attorney Vincent Restauri, Jr.; Daniel A. Mushegian, Vice President, Butcher & Singer, Inc.; Helen B. Miller, League of Women Voters; John Drake, Senior Citizens; Attorney Dale Clapsaddle; David S. Barr, President, 21st Century Appraisals, Inc.; Marybeth Dobnai, WKEG; Barbara Raffaele, Daily Notes; Jon Stevens, Observer -Reporter. Chairman noted for the record that the three Commissioners, the Chief Clerk and County Solicitor were in attendance. Chairman asked if there were any corrections, additions or omissions to Minute No. 131, each member having received a copy. Moved by Mr. Gilmore, seconded by Mr. Paluso, that Minute No. 131, be approved as read. Roll call vote taken: Mr. Gilmore - Yes; Mr. Paluso - Yes; Mr. Morgan - Yes. Motion carried unanimously. Special Order of Business: Regarding the proposed Monongahela high-rise housing facility for the elderly, Mr. Michael Stefan of the Washington County Housing Authority, present an Ordinance to the Board of Commissioners which in effect - AUTHORIZES THE EXECUTION OF A GUARANTY WITH MELLON BANK, N.A., PITTSBURGH, PA., TRUSTEE, AND WASHINGTON COUNTY HOUSING AUTHORITY: BRIEFLY DESCRIBING THE PROJECT FOR WHICH DEBT IS TO BE INCURRED AND REQUESTING ITS UNDERTAKING AND SETTING FORTH ITS USEFUL LIFE: STATING $2,830,000 AS BEING THE AGGREG- ATE PRINCIPAL AMOUNT OF BONDS TO BE SECURED BY THE GUARANTY: STATING THAT THE GUARANTY IS TO BE INCURRED AS LEASE RENTAL DEBT: AUTHORIZING A SPECIFIED OFFICER OR SPECIFIED OFFICERS AND THEIR SUCCESSORS TO PREPARE AND CERTIFY THE DEBT STATE- MENT REQUIRED BY SECTION 410 OF ACT 52 AND TO EXECUTE, AC- KNOWLEDGE AND DELIVER THE GUARANTY AND TAKE OTHER NECESSARY ACTION: AUTHORIZING THE REPORT OF THE PROJECT ARCHITECT UNDER SECTION 206 (a) OF ACT 52; AUTHORIZING PROPER COUNTY OFFICIALS TO EXECUTE, ACKNOWLEDGE AND DELIVER A COVENANT OF THE AMOUNT PAYABLE IN RESPECT OF THE GUARANTY AS BEING IN ANY FISCAL YEAR ONLY THAT PORTION OF DEBT SERVICE WHICH CANNOT BE PAID FROM THE PROJECT -REVENUES OF THE AUTHORITY OR 1978 ARNOLD SERIES BOND PROCEEDS, SAID UNPAID PORTION TO BE PAYABLE, PUR- SUANT TO THE GUARANTY, ON OR ABOUT MAY 15 AND NOVEMBER 15 OF EACH YEAR, FROM SUMS BUDGETED THEREFOR BY THE COUNTY OUT OF ITS GENERAL REVENUES, THE COUNTY'S FULL FAITH, CREDIT AND TAXING POWER BEING PLEDGED TO SUCH PAYMENTS, AND ANY PAYMENT TO BE MADE THEREUNDER: AND REPEALING INCONSISTENT ORDINANCES OR RESOLUTIONS. Mr. Daniel Mushegian, Vice President of Butcher & Singer, Inc., gave a detailed explanation of what the Ordinance involves and also presented the following Resolution for the Board's consideration. PALUSO, COMMISSIONERS A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY, PENNSYLVANIA, APPROVING A PRELIMINARY OFFICIAL STATEMENT. WHEREAS, the Washington County Housing Authority ("Authority") a housing authority created and existing under the Pennsylvania Housing Authorities Law of May, 1937, P.L. 955, as amended, has determined to acquire, construct and equip certain rental housing for the elderly in the City of Monongahela, Washington County, Pennsylvania; and WHEREAS, in order to provide the funds necessary to pay the costs of acquisition, construction and equipment of the proposed housing facilities, consisting of a 72-unit complex for the elderly ("Project"), the Authority has determined to issue its First Mortgage Guaranteed Revenue Bonds, Series bf 1978, in the principal amount of $2,830,000 ("Series of 1978 Bonds"), to be issued under and secured by a trust indenture between the Authority and Mellon Bank, N.A., as Trustee ("Trustee"); and WHEREAS, the Board of County Commissioners of Washington County ("County") has authorized the execution, acknowledgment and delivery of a Guaranty Agreement with and among the Authority and the Trustee in order to facilitate the sale of the Series of 1978 Bonds; and WHEREAS, a Preliminary Official Statement to be used in conjunction with the issuance and sale of the Series of 1978 Bonds has been prepared for distribution purposes. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Washington County, Pennsylvania, and it is hereby resolved by the authority of the same, THAT: SECTION 1. The contents of the Preliminary Official Statement of the Authority in respect of the Series of 1978 Bonds relating to the County are hereby approved. ADOPTED at a meeting of the Board of County Commissioners of Washington County, Pennsylvania, held this 17th day of August, 1978. Mr. Dale Clapsaddle, business manager for the Peters Township School District, attended today's meeting to comment on inconsistencies with certain assessments in Peters Township, and to question the ethics in the hiring of the former County Chief Assessor, Richard Gubanish, by 21st Century Appraisals, Inc. which is conducting a countywide revaluation of real estate. Chief Clerk requested travel authorization for Mary Ann Bryner of Data Processing to attend a training school at Valley Vorge, which is paid for y Burroughs Corporation on September 11 - 15, 1978. hief Clerk also requested travel authorization for Leon Pappa, Director, uvenile Detention Home, to attend the National Juvenile Detention Association's eminar on September 24 - 27th, in Fort Wayne, Indiana. Chief Clerk informed the Board of a request from the Southwestern ennsylvania Regional Planning Commission for the County's final installment f its proportionate share of the Commission's budget for 1978 in the amount of 11,489.00. Chief Clerk presented an Agreement with Burroughs Corporation ing the B-800 CMS Report Annual License Charge of $150.00. Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing greement. Roll call vote taken: Mr. Gilmore - Yes; Mr. Paluso - Yes; Mr. Morgan - Yes. Motion carried unanimously. Chief Clerk noted that a letter will be sent to Mr. William Bierer, President of Equibank, Oliver Plaza in Pittsburgh,from the Office of Employment and Training expressing the County's appreciation for the cooperation extended by the various officeas of Equibank for the summer youth program to employ and instruct youths in the matters of career choice, counseling, etc. Regarding the Washington County Airport, the Chief Clerk presented a drawing from West Penn Power, which pertains to installation of a wooden pole and an additional electrical line to the Ohio Valley Piper Sales Hangar. Mr. Brady added that Ohio Valley Piper will pay for installation and materials if the County grants easement. Moved by Mr. Gilmore, seconded by Mr. Paluso, approving easement for the foregoing installation for additional electrical line. Also regarding the Washington County Airport, the Chief Clerk presented a Resolution of Governing Body, reflecting the County's share of $2,162.00 toward the cost of the Master Planning Project in order to qualify for Federal and State aid. Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the foregoing Resolution of Governing Body. Roll call vote taken: Mr. Gilmore - Yes; Mr. Paluso - Yes; Mr. Morgan - Yes. Motion carried unanimously. Chief Clerk informed the Board of a request from the Cooperative Extension Service for their. 1978 budget allocation of $7,000.00. Chief Clerk informed the Board of a request from the Washington -Greene Drug and Alcohol Planking Commission for the amount due from Washington County of $10,655.06 as the County's share in the Drug and Alcohol Program for the quarter of April 1, 1978 to June 30, 1978. Chief Clerk informed the Board of a letter from the News Election Service of Pittsburgh asking for our cooperation during Election time to relay information concerning the returns, and in return for our cooperation, they will make a donation to a charity of $3.00 for each call they receive. Chief Clerk presented the following Resolution regarding Adoption of Revenue Sharing Funds and County Budget: In Compliance with C.F.R. 51.14, the Washington County Commissioners after holding proposed use hearings on December 1, 1977, and June 22, 1978, hereby adopt the budget as advertised on June 12, 1978. The allocation of revenue sharing is as follows: 1. Construction of Public Parking Garage $1,000,000.00 2. Real Estate Tax Program $ 287,500.00 3. Northwest Community Medical Center $ 12,500.00 TOTAL $1,300,000.00 The following is a summary of the adopted budget: 1. General Government 2. Corrections 3. Welfare 4. Highways 5. Chief Clerk informed the Board of a notice announcing Public Hearings which the County will hold on a possible Urban Development Action Grant Program application. Said hearings to be held in specific locations in Donora, Canonsburg, and Washingtop, Pa., by the Washington County Redevelopment Authority from August 28 - 30th. PALUSO, COMMISSIONERS Solicitor: Regarding the recently advertised Public Notice announcing that the Commissioners intend to amend the Ordinance Prescribing Rules and Regulations for County Parks and Recreation and Prescribing Enforcement and Penalty Procedures, Mr. Derrico stated that after discussion with Mr. Ceisler, Solicit for the Parks, it was decided that this matter should be tabled as there were some questions concerning the legality of certain changes which were proposed. Moved by Mr. Gilmore, seconded by Mr. Paluso, that the foregoing matter be tabled for further review. Roll call vote taken: Mr. Gilmore - Yes; Mr. Paluso - Yes; Mr. Morgan - Yes.
