Office of the County Commissioners
Washington, Pa., February 19, 1976
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Paluso and Morgan, (Mr. Flynn entered the
meeting later. ) Also being present: Chief Clerk Brady; John Cadez, Engelhardt & Power
Assoc.; Bard Judy, Soil Conservation; Solicitor Diamond; Mrs. Miller, League of Women
Voters; Bob Robertson, of the Observer Reporter; Clay Graham, Land Acquisition;
Steve Wiencek, Redevelopment Authority; Roland Bourke, Redevelopment Authority;
John Drake, Senior Citizens; Phil Angelo of the Daily Notes; Earl Bugaile of WKEG.
Chairman noted for the record that Commissioner Paluso and Morgan, Chief Clerk
Brady and Solicitor Diamond were in attendance.
Approval of Minute No. 7 will be postponed due to the vast volume of the minutes
from the meeting of Friday, February 13, 1976 , stated the Chairman.
Special Order of Business:
(Mr. Flynn entered the meeting)
Chief Clerk introduced Roland Bourke'of the Redevelopment Authority to present
his resolution for approval by the Board of County Commissioners.
Mr. Bourke: I am presenting to the Board of County Commissioners a resolution approving
proposal for redevelopment of disposition parcel no. 9 ifi the Donora Southgate Urban Renewal
Area, Penna. R-324, by Mon -Valley Professional Associates and the form of the redevelop-
ment contract with said developer. This would be a two, story professional building covering
11, 000 sq, ft. The three partners are two physicians and a druggist and they claim to
occupy 50% of the building and they will lease the balance of the building unfinished. This is
a $450, 000 proposal where we are planning to sell them one acre of land. They are immed-
iately planning a 7000 sq. ft. addition to the building. The site itself provides for 65 parking
spaces, completely landscaped area around the building.
Mr. Paluso - What` is the projected completion?
Mr, Bourke - Probably they will be breaking ground in the next 60 to 90 days 'and figure 9
months to a year to complete it. So figure around next summer.
Moved by Mr. Paluso, seconded by'Mr. Flynn that the above resolution be approved.

Mr. Judy- The Soil Conservation Service is ready to build another site on the Harmon Creek
Site 486 which is right on the West Virginia line and we need to decide who is going to be the
contracting office. The contracting office has the responsibility of preparing the bids, adver-
tising the bids, awarding contracts, etc. The County has been the contracting office on two
sites and we have been the contracting office on two sites. You may have it if you would like
to or we may take it off of your hands. If we take it off of your hands we need a letter to that

effect.
Moved by Mr. Flynn, seconded b y Mr. Paluso, that we authorize Mr. Bard Judy,
of the Soil Conservation Service to be the contracting office.

Chief Clerk informed the Board of a letter dated January 22, 1976 from J. B.
Wilson, P. E. District Engineer of the Department of Transportation of Commonwealth of
Pennsylvania which states that plans and bid documents for lighting of the new inter -county
bridge over the Monongahela River (L. R. 1099, Section 2L) are currently being processed
and it is now necessary to execute legal agreements between our two (2) agencies.
Moved by Mr. Paluso, seconded by Mr. Flynn, to approve the above agreement.

Penn Central Transportation Company which states that Section 304 (a) has now been
amended, and to comply with the amended law the Trustees hereby give notice that the
termination of service of which you were previously notified will occur March 31, 1976 or on
the date of the Conveyance provided for by Section 303 of the Regional Rail Reorganization
Act of 1973, whichever date is later, instead of February 27, 1976.
Chief Clerk informed the Board of a request for Mr. Jack Wagner, Director of
Bureau of Elections and himself to attend a conference to be held in Harrisburg on March
31st, April 1st, April 2nd. Chief Clerk stated that this is a seminar in regard to election
procedures.
Moved by Mr. Paluso, seconded by Mr. Flynn, that the above request be approved.

Chief Clerk informed the Board of a letter dated February 9, 1976, from the
Allegheny County Board of Commissioners which outlines their opposition to Senate Bill 852.
Said letter states that as passed by the Senate, Bill 852 provided for reimbursement to
counties of up to 90 per cent of the expenditures for Child Welfare which is the original
form of the bill. Said letter stated that the Allegheny County Commissioners strenuously
object to the revision whereby counties would be forced to pay for 50 per cent of the care for
the children in institutions and urge the support of the Washington County Commissioners
for the passage of Senate Bill 852 in its original form -- to reimburse counties for Child
Welfare up to 90 per cent.
Chief Clerk informed the Board of a letter from Jack B. Wagner, Director of
Elections advising the Board that the day for casting lots to determine the position of names
on the General Primary ballots will be held on Friday February 27, 1976 at 10:00 A. M. in the
public meeting room in the Court House.
Chief Clerk informed the Board of a letter dated February 9, 1976 from Michael
George, Director of Parks and Recreation concerning a request, along with a proposed
agreement form,.from Consolidated Coal Company to drill one bore hole on County property
in Mingo Creek County Park.
Moved by Mr. Paluso, seconded by Mr. Flynn, that the above request be approved.

Chief Clerk read a letter dated February 9, 1976 from C. A. Williamson, Director
of Civil Defense (Acting) informing the Board that the papers relating to Edward M. Paluso's

appointment as Civil Defense Director for the County will be prepared and acted upon
promptly.
Chief Clerk informed the Board of a letter from the Curtis Noll Corporation of
Eastlake, Ohio , which states that the statement we received from them for $250. 42, was
sent to us in error as it was addressed to Washington County in Iowa.
Chief Clerk informed the Board of a letter dated February 17, 1976 from Miss
Louise Abel, Public Welfare Administrator III, in which the proposed regulations for the
stated
recently passed Child Protective Services Law were enclosed. Said letter/that the Child
Welfare Agency is the sole agency to receive Child Abuse reports and both the Law and
Regulations impose a great deal of additional mandatory work m the agency.
Chief Clerk informed the Board of a letter dated February 12, 1976 , from the
Mercer County Commissioners stating that in 1973 the Mercer County Commissioners
initiated legislation providing f or 100% reimbursement of county costs for care to
Medicaid recipients by the Commonwealth and have got nothing. Said letter stated
that reimbursement rates to private and non-profit nursing homes were increased to help
offset their increased costs and starting July 1, 1976, these facilities will be reimbursed
100% of reasonable costs for Medicaid patients and this is not true of County facilities.
Said letter stated they they are urging the Washington County Commissioners to write our
legislators and the governor in strong support of full reimbursement now in this year's
budget.
Moved by Mr. Paluso, seconded by Mr. Flynn, that Washington County Commis-
sioners support the position of the Mercer County Commissioners.

Chief Clerk informed the Board of a letter dated February 16, 1976, from the
Law Offices of Murphy and France, informing the Board that the bridge in Allenport
Borough has become unsafe and dangerous and requesting that this be brought to the
attention of the Bridge Department for immediate inspection to ascertain the present
danger.
Chairman informed the Board that he referred this problem about the bridge to
Mr. William Sember for inspection to see what the problem is.
Chief Clerk informed the Board of a letter dated February 10, 1976 from the
Sullivan County Commissioners regarding a change in the rate of 20� per acre for State-
owned land. Said letter states that it is House Bill No. 710 and calls for 30� per acre
which we should try to get amended to 40� when it reaches the Floor for a vote.

Mr. Flynn stated that it was not necessary. for ,the Board to send a letter on this
as he was attending meetings for the Pennsylvania State Association of County Commissioners
as a member of the Legislative Committee.
Chief Clerk informed the Board of a letter from Joanne Chappell, Mon Valley
District Chairman of the Girl Scouts of Southwestern Pennsylvania proclaiming March 7th
through 13th as Girl Scout Week in the Mon Valley District and requesting one of the County
Commissioners to represent Washington County at the Mon Valley Health Center on Thursday,
February 26, 1976 at 4:30 P.M.
Chairman appointed Mr. Paluso as the representative for the Washington County
Commissioners.
Chief Clerk read a letter dated February 12, 1976, from Emma Lee McMurtry,
thanking the Washington County Commissioners and the people of Washington for helping a
94 year old woman find a new home when her gas line had broken on January 9th, 1976.
Chairman stated that Mr. & Mrs. Miller who took this woman into their home
while they were trying to locate a suitable home for her, are to be truly commended for this.
e Chief Clerk read a letter dated February 12, 1976, from Consolidation Coal Company
Eastern Region regarding Section 10 of the Bituminous Mine Subsidence and Land Conservation
Act of 1966 and giving notice that Consolidation Coal Company is presently operating an
underground bituminous coal mine known as Montour #4 Mine, in Washington County, Penna.
Said letter stated that they expect mining operations to be in the vicinity of County property
within six months and that they will leave sufficient coal to support only those surface structures
entitled to support under Section 4 of the aforementioned act, specifically, dwellings erected
prior to April 27, 1966.
Chairman stated that the Chief Clerk should check with Mr. Black of the Consolida-
tion Coal Company to see exactly where they are talking about doing this mining.
Mr. Paluso stated that the news media should bring to the attention of the public,
that when they arE� filling out their Federal Income Tax forms that there are three small blocks
which ask you to designate what city, township or borough that you live. Mr. Paluso stated that
the public should be sure that these are filled in properly to make sure that revenue sharing
money is properly designated.
