Office of the County Commissioners
Washington, Pa., February 26, 1976
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Flynn, Paluso and Morgan. Also being present:
Chief Clerk Brady, County Solicitor Diamond; County Coroner Jackson; Charlotte Iams
and June Spengler from the League of Women Voters; Willie Mae Wright; Leonard
Anderson; Fletcher Brown; John Drake from the Washington Area Senior Citizens Center;
Phil Angelo from the Daily Notes; John Cadez from Engelhardt -Power and Associates;
Bob Robertson from the Observer -Reporter; Earl Bugaile from WKEG Radio; August'
Stache and Deputy Controller Daniels.
Chairman noted for the record that the three Commissioners, the Chief Clerk
and the County Solicitor were in attendance.
Chairman asked if there were any corrections, additions or omissions to
Minute Nos. 7 and 8, each member having received a copy.
Mr. Flynn then referred to Minute No. 7, Page 33, where reference to the
Sinking Fund was made and stated that the figure should be $30, 000 instead of $300, 000.
Moved by Mr. Flynn, seconded by Mr. Paluso, that Minute No. 7 and No. 8
be approved with said correction noted.

Old Business: Consolidation Coal Company
Chief Clerk stated that at the last meeting, he read a letter from Mr. Thomas
G. Norris, Vice -President of Washington Operations of Consolidated Coal Company
informing the Board that they would presently be operating close to County property.
At that time, Mr. Brady was directed to check into this matter. Mr. Brady stated that
the property in question is a house in Hendersonville which is located on a barrier. The
Consolidated Coal Company foresees no difficulty at all; it was just a matter of form to
notify the County.

Chief Clerk informed the Board of correspondence dated February 9, 1976,
from the Washington -Greene Drug and Alcohol Planning Council, which informed the
Board that the appointed term of Mr. William Brooks to the Washington/Greene Drug/
Alcohol Planning Council has expired effective February, 1976. Said letter stated that
Mr. Brooks has been very active on the Council and has indicated a desire to be re-
appointed for a three (3) year term.
Moved by Mr. Paluso, seconded by Mr. Flynn, that Mr. William Brooks
be re -appointed to the Washington/Greene Drug/Alcohol Planning Council for a three `(3)
year term as per above.

Chief Clerk advised the Board of a letter addressed to Mr. Graham, Land
Acquisition Agent, from Lynn Markovich, Clerk -Typist in the Land Acquisition Office.
Said letter informed Mr. Graham, that as of Friday, March 5, 1976, she is terminating
her employment with Washington County. Said letter thanked Mr. Graham, the Manpower
Office and the Commissioners for giving her the opportunity to work in this office.
Chief Clerk next read a letter directed to the Commissioners, from Lorraine
Proudfit, RN, Director of Nurses, at the Washington County Home, requesting permission
to attend a 35 hour course at the Hilton Hotel, Pittsburgh, Pa., on March 8 - 12, 1976.
The course is "Introduction To Long Term Patient Care Services Administration," and
is sponsored by the University of Pittsburgh, Long Term Care Unit. The fee will be
$200.00 plus lodging for five (5) days. Chief Clerk stated that he has a recommendation
from Mr. Mastrangelo, Administrator, that she be permitted to attend.
Remarks:
Chairman asked if the Commissioners approved her request to go to another conference,
and she was unable to attend.
Chief Clerk stated that she and Mrs. Burns were to attend the same conference, but
only Mrs. Burns could attend, because both of them could not be away at the same time.
Chief Clerk further -stated that this is a different conference, and this is the one that
Mr. Mastrangelo feels would be most beneficial.
Moved by Mr. Paluso, seconded by Mr. Flynn, that Mrs. Proudfit be per-
mitted to attend the seminar as requested upon recommendation of Mr. Mastrangelo.

Chief Clerk stated that at- the previous meeting, the Commissioners directed
the Soil Conservation Service to act as contracting agent for Site 486, Harmon Creek
Watershed Program. Chief Clerk stated that Mr. Judy has given him project agreements
with a total estimated cost of $1, 654, 356. 80.
Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board authorize
the Chairman to execute the project agreements for Site 486 of the Harmon Creek Water-
shed Project as per above.

Chief Clerk advised the Board of a letter dated February 23, 1976, directed
to the Commissioners, from the Charleroi Area Senior Citizens. Said letter requested
that the Commissioners meet with them at the Greater Charleroi Area Senior Citizens
Center, Second and Fallowfield Avenues,, Charleroi, Pa., at the Commissioners con-
venience to discuss matters pertaining to urgent business of the Center.
Remarks:
Chairman directed Chief Clerk Brady to make arrangements for a meeting.
Chief Clerk informed the Board of a letter directed to the Commissioners
from the Executive Director of the LeMoyne Community Center, Mr. Richard H. Mull.
Said letter stated that it has been brought to this attention that there is a definite need
in the
community
for a
voters registration
at the
LeMoyne
Community
Center.
Chief
Clerk
stated that
he has
a recommendation
from
Mr. Jack
B. Wagner,
Director
of
Elections, that a registration be held at LeMoyne Community Center on Wednesday,
March 10, 1976.
Remarks:
Mrs. Willie Mae Wright stated that they reconsidered this and they feel that they can
bring the people to the Courthouse to register. She stated that they are going to the
City Building to see if they can get permission to park the cars in front of the door and
not get a parking ticket.
Chairman then directed the Chief Clerk to write a letter to Mr. Mull and state that
Mrs. Wright and Mr. Anderson don't feel that this is necessary to have this and that they
have worked out other arrangements.
Chief Clerk advised the Board of a letter dated February 24, 1976, directed
to the Commissioners from Clerk of Courts Metro Petrosky, Jr., in regards to escheatable
funds. Said letter advised that this afternoon he met with Mr. Ross Kurtz, Field Auditor
for the Department of Revenue, Escheatable Fund Division, relative to the county's current
dilemna to the abovetnentioned subject. Mr. Kurtz indicated that the total of witness fees
and constable costs is $15, 779. 51. Mr. Petrosky stated that this figure is somewhat less

than the original $16, 000 which was first mentioned. Mr. Petrosky also stated that he
has the current list relative to unclaimed witness fees and costs with the various changes
Remarks:
Mr. Diamond stated that he has reviewed the various letters from the State with regard
to escheatable funds and that he has done some research on the matter and he is satis-
fied that the County should post haste transmit those funds to the State because the State
is in a position if they want to do so, to take the matter to Court and obtain interest;
some of these go back to 1958, which amounts to quite a bit of money. In addition,
Mr. Diamond stated that he believes that the money they are talking about is essentially
monies paid into Court for the purpose of paying witnesses at criminal trials where these
witnesses have not come in to recover the money which is due to them. Mr. Diamond
stated that this is not money which emanated from the County as such.
Mr. Morgan stated that one of the problems, as he understands it, is it isn't clear as
to whether some of those fees were paid by the County or whether they were paid by
individuals for their services.
Mr. Flynn stated that his knowledge of it is that it has been a problem for many years,
and for reasons unknown to him they approach us and then it is a forgotten matter.
Mr. Flynn stated that the position we took years ago is that a lot of "this unclaimed
money is County money. Mr. Flynn stated that they took the position that if it was
County money that was unclaimed, then how would you escheat County? It # was paid
in by an individual for witness fees, then it would be escheatable.
Mr. Diamond stated that this and a certain amount of inertia is what has caused the
problem over the years. Mr. Diamond stated that if the County paid money, the County
paid the money because the Court stated in a judgment, costs on the County, which meanE
that that money then was paid into the fund for the purpose of permitting the witnesses
to come in and obtain recompense for having attended Court. Mr. Diamond stated that in
his judgment, once the money is paid in that fashion, then it becomes the primary pro-
perty of the witness to come in and claim it. If that witness does not come in to claim
it within the statutory period, then it is no longer county money and the States comes in.
Mr. Diamond stated that he can see the point in not wanting County funds to go that way,
but this is how the money gets into the fund originally; the Court has ordered the costs
on the County.
Mr. Paluso stated that if the costs are on the County, the money is in fact not paid into
a fund. They just come down with a voucher and then it is paid out of the county
treasurer on demand of a witness. There is no actual transaction of money into a fund
for that, so there is no money that changes funds unless the person entitled to it comes
in and picks it up.
(Further discussion was held.)
Chairman recommended that Mr. Petrosky's letter be referred to the Solicitor for a
recommendation to the Board.
Mr. Paluso stated that this is the third time that he can remember that the figure sent
here from the State has been lower every time.
Deputy Controller Daniels stated that they noticed that the figure varies each time and
they have requested from Clerk of Courts Petrosky the file so that they can trace down
on an individual basis to make sure that these people haven't been paid, and to find what
the total is so that they can do an audit on it.
Mr. Diamond stated that in the audit, he would like indicated those funds which are
taxed to the County.
Mr. Paluso suggested that Mr. Flynn bring this matter up at the State Association of
County Commissioners meeting.
Chief Clerk presented to the Board charts for the installation of telephone
service from Bell Telephone Company for the Extended Care Facility.
Remarks:
Chairman asked if the architect has recommended that the Board approve these charts.
Chief Clerk stated that he hasn't talked with the architect yet, but it is his understanding
that these charts conform exactly to the specifications.

Chief Clerk informed the Board of a letter dated February 23, 1976, directf;d
to Mr. Charles Gillespie, Budget Director, from Mrs. Byrnece Vazzana, Executive Dir-
ector of the United Cerebral Palsy of Southwestern Pennsylvania. Said letter enclosed
information to enable the County Commissioners to make application to the Pennsylvania
Department of Public Welfare, Office of Children and Youth, Bureau of Child Welfare
for the Purchase of Day Care Services for the Physically Handicapped. Said letter also
noted that 'this is the only funding that they are able to receive for the physically handi-
capped. Said letter then gave figures and stated that the total amount requested was
$148, 226. 25.

the United Cerebral Palsy's application for this grant as per above.

Chairman stated that he is in receipt of a resignation in the Public
Defender's Office, from Mr. George Retos because of his pressing business. Mr. Liekar,
Public Defender, has recommended that Attorney John Rogers be appointed as his first
assistant in the Public Defender's Office. Mr. Rogers will receive the same salary that
Mr. Retos was receiving.

Attorney John Rogers as first assistant in the Public Defender's Office upon recommendaticm
of Mr. Liekar.
