PALUSO, COMMISSIONERS Minute No. 14 Office of the County Commissioners Washington, PA, April 1, 1976 The Board of County Commissioners met in regular session with the following members being present: Commissioners Paluso and Morgan. Absent Being: Commissioner Flynn. Also present being: Acting Chief Clerk Gillespie; Solicitor Diamond; Mrs. Miller, League of Women Voters; Earl Bugaile, WKEG; Michael George, Parks & Recreation; John Cadez, Engelhardt &.Power; Phil Angelo, The Daily Notes; Bob Robertson, Observer -Reporter; Grant L.iesch, Telegraph -Browns- ville., Group of concerned citizens representing Cross -Creek Flood Control Projec Chairman noted for the record that two Commissioners, Solicitor, and Acting Chief Clerk are in attendance. Chairman asked if there were any corrections, additions or omissions to Minute #13, each member having received a copy. Moved by Mr. Paluso, seconded by Mr. Morgan, that Minute #13 be approved as read. Roll call vote taken: Mr. Paluso - Yes; Mr. Morgan - Yes. Motion carried unanimously. Special Order of Business: Acting Chief Clerk informed the Board that Mr. Anthony Luppino was to be here to discuss proposed conferences sponsored by the Adult Welfare Ser- vices but has not arrived yet so we will postpone this till later in the meeti Correspondence: Acting Chief Clerk Gillespie informed the Board of the receipt of the following checks: 1. Acting Chief,Clerk._informed.the Board -of a Memorandum dated March 12, 1976, from William P. Sember, Executive Director of the Washington County Planning Commission, directed to Commissioner,Edward_M. Paluso, concerning the appointment of Mr. Charles,Murray to the Planning Commission. Mr. Paluso - Mr. Murray,is Operating Manager of the. Authority of the Borough of Charleroi which operates the -water and sewage authority and has been in operation for several years.. It is our idea.to appoint people to the Planning Commission Board in the various skills,dealing with the Planning Commission and one of them is sewage treatment plants and we feel that Mr. Murray would be abb to give a lot of input into this. Moved by Mr. Paluso, seconded -,by Mr. Morgan., that Mr. Murray be appointed to the Planning Commission. Roll call vote taken: Mr. P&Iuso - Yes; Mr. Morgan - Yes. Motion carried unanimously, Chairman stated that Mr. Murray will be replacing a former member and we will draft a letter to him commending him for his past services. Mr. Paluso stated that.Mr. Murray will be replacing Mr. Robert Authors which maintains geographic balance requested by the Planning Commission, as Mr. Authors own personal schedule precludes him from attending enough- of the meetings. Acting Chief Clerk informed the Board of a letter dated March 25, 197f, addressed to Mr. F. D. Whalen, former Chief Clerk, from the Governor's Justice Commission, stating that it is to the benefit of Washington County that the delinquent Fiscal and Progress reports for the quarter ending 6/30/75, 9/30/75, and 12/31/75, be submitted within the next ten days. Acting Chief Clerk stated that this concerns the full-time District Attorney funded for the last three years in part by the Governor's Justice Commission and that these reports are due for the last nine months of 1975 and the District Attorney's office has been notified of the deadline. Acting Chief Clerk Gillespie informed the Board of a letter dated March 22, 1976, from the Redevelopment Authority of the County of Washington, stating that the Board of the Redevelopment Authority of the County of Washingtoi at their meeting held on March 16, 1976, authorized the Executive Director to requisition the second quarterly payment of Twenty Three Thousand Dollars ($23,000) based on the 1976 County budget. Acting Chief Clerk Gillespie informed the Board of a letter dated March 12, 1976, from the Department of Public Welfare , stating that the alloca tions for Community Living Arrangements, CIA Coordinator, and Family Resource Services in the(bunty Mental Health/'Mental Retardation Program have been deter- mined for Fiscal Year 1975-76 as follows: Community Living Arrangements $121,705 CIA Coordinator $ 13,374 Family Resource Services $ 40,496 Total Allocation 7175,575 Acting Chief Clerk Gillespie read the following letter dated March 2 , 1976, from Anthony Luppino, Director of Adult Welfare Services: Dear Mr. Morgan: Please be advised that the lease and contract for relocation and renovation of the Claysville Senior Citizens Center (McGuffey Area) has been approved by the Area Agency on Aging (PSA-08). The contract had been put out for bid as per instructions through the Area Agency on Aging. The three estimates were sent to the Area Agency on Aging as directed whereupon they chose Mr. Calvert's estimate-- $6900.00. A check has been received: in that amount through the above - mentioned agency for Adult Welfare Services to be used solely for the renovation of the Claysville Center. It is necessary that we have the approval and signatures of the Washington County Board of Commissioners immediately as an emergency now exists in the form of a time limit for the expenditure of the $6900.00 renovation monies received. Construction was begun on March 24, 1976, after a discussion with Mr. Richard P. Brady, Chief Clerk, pending the Commissioners signatures. The state auditor will be reviewing Adult Welfare Services records March 26, 1976, and we would like the Commissioners signatures before the audit. Acting Chief Clerk Gillespie introduced Mr. Anthony, Luppino, Direc of Adult Welfare Services, who just entered the meeting. Mr. Luppino - I would like permission to plan two conferences for Senior Citi- zens - the first one to be held April 24, 1976, the second June'l, 1976. The first conference concerns health -related and social problems that the elderly most frequently encounter based upon statistical information gathered through out computerized information and referral system. PALUSO, COMMISSIONERS E the Senior Citizens, the cost of renting an adequate -and centrally located site and possible a transportation expense for -those areas for which our program vans would be unable to cover. Approximate cost to_the.County will be determined at a�later-,date. The second conference planned for June 1, 1976, deals with crimes against the elderly as a vulnerable target group for many types of crimes and offenses. I am asking the Commissioner's approval to apply for a Governor's Justice Commission grant to fully cover expenses for this corrections -oriented conference. The grant would be for $1500 at -a total County obligation of $75.00. This would cover the Meadowlands Hilton Inn facilities, etc., as well as publicity expenses. This is a one-time grant with absolutely no obligation to be assumed by the County other than giving the permission to the Adult Wel- fare Services Agency to hold.the conferences and the $75.00 matching funds. The total number of elderly participants anticipated for conference days First conference - 600, second conference-600-650.-Total -1250. Mr. Paluso - What did you say would be the cost of these conferences? Mr. Lu22ino - The projected cost of the first one would probably be around $600 or $650 and the second one would be $75.00 for a total of $1500. A letter will have to go from Mr.. Morgan to the Director of the Staff of the Southwest Justice Commission, Mr. William Forbes, giving approval for this grant Mr. Morgan - How do you plan to get all of your Senior Citizens from the various centers in the County to these conferences or will they have -to provide their own transportation. Mr. Lu22ino - We will use vans from Federally Funded Programs which are already in existence. We may have to contact sipme bus -lines and that is why we do not have the exact cost. Moved by Mr. Paluso, seconded by Mr. Morgan, that the April 24th seminar be approved and the cost not to exceed $650.00 to the County and the'June 1 seminar application be submitted as soon as it is received from 'Mro agency by the County Commissioners with the cost of $75.00 to the County. Acting Chief Clerk Gillespie informed the Board of a request from Washington County Office of Manpower Planning to enter into an agreement with School District of Pittsburgh through its Connelley Skill -Learning Center for the Practical Nurse Program which shall begin on or about February 16, 1976, shall end on or about February 15, 1977. Said letter stated that there shall be three clients and Washington County Manpower shall pay to Connelley the amount of $68.00 per month as tuition for each enrollee. Acting Chief Clerk Gillespie informed the Board of a Memorandum of Agreement to be entered into between the Department of Education and the State Board for Vocational Education of the Commonwealth of Pennsylvania, hereinafter referred to as the party of the first part, and the Washington Institute of Technology, Inc. for training in the occupation of Combination Welding Program, party of the second part. Said Memorandum of Agreement stated that the combination welding course shall be conducted in one group section to commence on or after April 19, 1976 to extend over a period to 24 weeks and•thi Course shall consist of at least 35 hours of instruction per week or a total number of 840 hours of training. Said agreement stated that the total tuition cost is $28,900.00 and prime sponsor assumes 50% of the tuition costs and the amount of the obligation will;'not exceed $14,450.00. Mr. Paluso stated that there are requirements in the Manpower Act to provide on-the-job training and school training for certain amount of dollars allocated to Washington County and this is not in lieu of providing public service jobs, it is a requirement in the Federal Manpower Act. Moved by Mr. Paluso, seconded by Mr. Morgan, that the above agreemen be approved as read. Roll call vote taken: Mr. Paluso - Yes; Mr. Morgan - Yes. Motion carried unanimously. Acting Chief Clerk Gillespie informed the Board of three (3) OJT Contracts between the Washington County Office of Ma"apower Planning and Automotive Service Council of'=.,Refinaylvania agrees to hire atsd provide on-the-job training for (1) William G. Jamison as Mechanic; (2) Lawrence P. Karnes as Mechanic; (3) William Megyesy as Auto Parts Counter Man. Acting Chief Clerk Gillespie informed the Board of one (1) OJT Contract between the Washington County Office of Manpower Planning and Mon Valley Mobile Housing agrees to hire and provide on-the-job training for Judith M. Bailey as Mobile Parts Clerk. Moved,by Mr. Paluso, seconded by Mr.,Morgan, that the above contract be approved. Roll call vote taken: Mr. Paluso - Yes; Mr. Morgan - Yes, Motion carried unanimously. MINUTE BOOK 105 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MALCOLM L. MORGAN, MICHAEL R. FLYNN, EDWARD M. PALUSO. COMMISSIONERS 1 1 Solicitor : Mr. Diamond: In regard with the proposed.right--of-way which Equitable Gas has requested from the County to relocate and construct a 20" pipeline in Mingo Park, they had submitted the written agreement and I have gone over this with Mr. George and he has several items that he wants to make.judgement on as far as the formal agreement is.concerned. However, he has indicated to me that the request of Equitable, that they be permitted to go in and make some preliminary site preparations. I would suggest that since we have a Solicitor for Parks that this matter be given to him for his final approval. Moved by Mr. Paluso, seconded by Mr. Morgan, that the Agreement be approved subject to the approval of the Solicitor of the Parks & Recreation and permission be granted to them to enter on and start making their preliminary work schedule. Roll call vote taken: Mr. Paluso -- Yes; Mr. Morgan -- Yes. Motion carried unanimously. Mn Diamond: In June 1972 the County entered into a lease agreement with Arden Downs, Inc. for the use of that corporation of certain areas at the County Fair Grounds. One of the pcovisions of that lease is_that the lessee, Arden Downs Inc., agree to make the track available to certain amateur horse breeders who want to use the track for exercising their horses. During the past week or ten days we have received several telephone complaints and it was intended that they had made application for the Fair Ground Racetrack and that this was denied them. Following these complaints I drafted a letter to Arden Downs indicating to the lease and advising Arden Downs, Inc. that we would enforce the lease and if thei v were any breaches of their conditions that we would seek to have the lease abrogated. Following receipt of that letter, Mr. Harry Harvey, the owner of tha Corporation, had a meeting with Mr. Morgan and myself and he maintans that he has not denied any proper requests. It is a part of the lease agreement that an request for the use of the racetrack must be submitted in writing and that Mr. Harvey has the right to refuse to lease or let the track be used by anybody who in the past has used it and has not paid the rental. I congest for the benefit of anyone who is interested -in using the racetrack that they make proper application in writing and that if they are in the fault on any past rentals tha they make those payments because Mr. Harvey is in proper compliance with the terms of the lease and within his rights under that lease to refuse any request that is not in writing or is made by an individual who owes money from past, rent4is. Mr. Paluso: When does this lease with Arden Downs expire, Mr. Diamond? Mr. Diamond: This lease expires on May 31, 1976. Mr. Harvey has indicated to me that if someone makes proper application they will let them use the track. So, at this point there is nothing else we can do. 106 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MALCOLM L. MORGAN, MICHAEL R. FLYNN. EDWARD M. PALUSO, COMMISSIONERS Mr. Morgan: Mr. Paluso, I assigned you a job last week. Do you have any prelim- inary explanation as to the conditions at the Airport after the letter we receive from the Federal Aviation Administration. Mr. Paluso: The letter of December 17, 1975, listed.six deficiencies-and,I will start with number one and what we have -determined in the past week. l.Specifice.deficiencies which are listed under November 3, 1975 include: Failure to maintain Runway Nine clear of obstructions. The obstruction that they are referring to are trees and bushes and we have made arrangements to have these cleared within the next ten days. The obstructions at the end of the runway hopefully, will be removed by County maintanence personnel. The outlining tree obstrlwtions they refer to the approach zone, haven't been removed because land acquisition and easements have not been accomplished. We have initiated action to grant permission from private land owners to allow for the topping of designated trees in that area. Should permission be readily granted by the land rs we will immediately initiate action to have those trees trimmed. I would recommend,however, the authority be granted now to enter into a contract to trim these trees because of their heighth and the difficulty intQpping of these trees. I don't think that it is something that our regular maintenance personnel can handle. This is climbing and topp4m9y of large trees, certain designated trees pointed out by the FAA. I would request the authority.to pursue if necessary to obtain the easements in the next week or so. 2. Failure to operate all obstruction lights. This has been a subject of discussion for the past several meetings. At the present time there i one light that is inoperative, one up on the hill. There is electrical power to the pole, however, there is no meter, and the junction box is not connected to the power source. M. Mackenzie, who is -coo! tracted to maintain this light, now claims that he has condemned this pole and he will not fix it. We have contacted West Penn Power Company, I believe we are paying, and this has not been verified, we are paying utility tax on that pole. If necessary, that pole will be replaced If West Penn Power determines that the pole is safe to climb, Mr. Mackenzie will be instructed to climb it and fix the light. 3. Failure to maintain proper threshold lights on Runway Nine. The problem on Runwayji-ne is that there are two threshold lights missing on both Runway 9 and 27. Receipt of these lights is expected within the next ten days barring any problems because of the teamsters strike. 4. Failure to maintain the Runway lighting in a satisfactory manner. This defici.enby will be corrected in the very near future. All required items; ay light assemblies, the transformers, the lamps, the lenses, cable, couplingo, lamp assemblies, etc., were ordered on March 30, 1976. All items except the lue lenses for the taxiways are available for immediate delivery. We expect elivery barring transportation problems within the week. Failure to acquire adequate land interests and clear obstructions on runway nine approach as required by the Grant Agreement with the FAA. This one is a little more complicated. We have not been able to locate Grant Appli- cation 936043B904. We had requested a copy,.which we received yesterday after- noon from the FAA. We are at present reviewing that and will take the necessary action and report back, 6. Failure to restrict vehicle traffic off of the Airport Area. The FAA is saying by that is that automobiles belonging to anyone are not permitted on Airport proper, taxiways, grassy areas in-between or on the ends of the runway. Elimination of these six discrepancies incidentally will assure receipt of approximately $9000 in federal funds and bring the County into comp- liance with this agreement with the FAA and the U. S. Government. We expect within a month to have this problem completely cleared up. The same time I might mention what it costs now.Right now the cost is in excess of $2300 for these hardware items that must be replaced and installed in order to comply with these six deficiencies. Chairman stated that he has had several calls from the East Bethlem area about the ferry up there as to when it is going into the water and asked Mr. Paluso, since he was here last year, as to where we stand on the ferry business in Fredricktown. Mr. Paluso: One of the problems that we encountered was the fact that the state would not recognize the two counties acting together as a sponsor for the ferry. At a meeting with the Fayette County Commissioners, it was determined that Fayette County would act as the agent and sponsor for the ferry. At that time we forwarded our share of the money and told them that our money was in escrow awaiting whatever action was taken. At that time they had.assured us that they would have their side of the river, the sites cleared, title searches and so on. Our side of the river has been cleared. We have the title search completed. We have done all the legal work necessary for Washington County. Subsequent to that, we had no information whatsoever frtam Fayette County. If you recall, I suggested in December that you as a new member and myself go to Fayette County and request action from Mr. Lebder, at which time we met with Mr. Lebder, the other two Commissioners were not available. We met with him for several hours, and Mr, Lebder informed us that everything was done except they needed approval for the flood line from the Axmy Corps of Engineers. He did not know the name of the man in charge at the Corps of Engineers and at that time I gave him the name and phone number, and he said he would forward to us that week, or would inform us that he had secured whatever permission he needed from the Corps and they would proceed to clear up the legal problems on the landing site in Fredericktown. To my knowledge that has not been done. Perhaps we should suggest that if they cannot carry this project to the completion, that we have 108 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MALCOLM L. MORGAN, MICHAEL R. FLYNN. EDWARD M. FALUSO. COMMISSIONERS the sponsor changed to Washington County to see that this gets done. Mr. Morgan: How much money have we advanced Fayette County? Mr. Paluso: We have advanced in the neighborhood.of $13,000,-originally, plus several thousand prior to the Bond Fund. We have $75,000 available to two counties from PennDOT. It is available for drawdown, but they haven't done anything. We also have in the Bond Issue $100,000.in our Escrow Account for thi specific purpose. Perhaps we should instruct the Chief Clerk to write the Board of Commissioners in Fayette County and ask them if they would rather we handle the ferry matter because we are not getting anything this way, and according to the agreement signed really we can't proceed. Our work is done, we are sitting here waiting. Chairman directed the Chief Clerk to write a letter to the Fayette County Commissioners concerning the ferry. Chairman stated that there are a group of individuals here that Mr. Flynn had invited from the Cross Creek area and they are represented by Mr. Tony Ostop, and they would like to address the Board for a moment. Mr. Ostop: I have just come with a committee of ten men into assist in the attempt for concerned citizens who want to help overcome any obstacles for the deadline on the flood project. I think you have a letter from our group. Mr. Paluso: Yes. I just received it today incidentally. We have had several inquiries, Mr. Ostop, about this. There were some erronous indications in the news release that came from the meeting of the various state agencies and Mr. Flynn, several weeks ago. For your information, the engineering on the road relocations is about 90% complete on two of the sites. On the other engineering work, we have a gentleman in Uniontown today. PennDOT is going to, hopefully, design the dam site itself. The road must be relocated before the dam site can be started. Mr. Morgan: This is on the third flood control area. Mr. Paluso: Right. There are three dams involved here. Mr. Morgan: There are three outside the park and one big one inside. Mr. Paluso: There are several properties outside the proposed flooded area i c n the 100 year flood line that easements must be obtained on, but that will not hold up building or the relocations. Mr. Morgan: We would lose the money for the road relocations on the three dams outside of the park itself. We had a meeting on it yesterday and we are expediating it as fast as we can. PennDOT has agreed to do the road design work on the one remaining that is yet to be done. And the other two, Englehardt 4 and Power, have got 99% of the engineering done, so we should be in the position to put this out for bid. Mr. Paluso: I would say well g'ior to July 1st. PALUSO, COMMISSIONERS fl E 1 specifications call for a 100 year flood design for relocation of the road. Mr. Morgan: That is the height of the road in relation to what the water is going to be in the dam. Mr. Paluso: Subsequent to that, the Federal Government and the state people hac decided that a 25 year flood line is more than sufficient for relocation of theE roads, which requires Englehardt and Power to redo -the engineering on the 659 and 660 sites that they had finished at the 100 year level. There is considerable amount of money involved and would.mean a difference of probably $600,000. Mn Morgan: Better than 31 a million dollars to change the specifications. Mr. Paluso: And they have assured us that they would do this in a minimum amount of time. We told them yesterday that we would accepta proposal from them, hopefully, before next Thursday to prepare the specs and bid tabulation, their part of the work. Now PennDOT is supposed to do the road relocation on 662 at 70/30 cost breakdown between the County and them, which would be a tremendous help to the County in engineering work. Mr. Ostop: We are already concerned about our future water supply. Mr. Paluso: I think that you can rest assured that..... Incidentally, the dam is not even designed yet by the Soil Conservation people. Mr. Morgan: We are cranking it up just as fast as we can. Mr. Ostop: I would like to come in and offer my services free. Any work we can do, my committee of men will do it. Mr. Morgan: We appreciate that from you and from your Committee. Mr. Paluso: We will be calling on you because there are some problems where some,people want relatively minor easements to put a telephone line in. You can be sure that the County's participation is up to date on the Cross Creek Projectl. Any delays will be caused by property owners or individuals who do not want to participate in some manner. We can't pursue that. There are a lot of obstaclesl, but they are being done. Mr. Morgan: For your information, Mr. Ostop, we authorized West Penn Power to relocate their power lines about two meetings agQ, which was approximately $12,000 and some odd dollars that we had to pay to West Penn Power in advance.
