Washington, Pa., February 3, 1977
The Board of County Commissioners met in regular session with the
following members being present: Commissioners Gilmore, Paluso and Morgan.
Also being present: Chief Clerk Brady; Solicitor Diamond; Budget Director
Gillespie; Warden Roupe; Coroner Jackson; John Cadez, Engelhardt & Power;
Mrs. Miller, League of Women Voters; John Stevens, Observer -Reporter;
Dave Lester, Brownsville Telegraph and Earl Bugaile, WKEG.
Chairman noted for the record that the three Commissioners, the Chief
Clerk, County Solicitor and Budget Director were in attendance.
Chairman asked if there were any corrections, additions or omissions
to Minute No. 54, each member having received a copy.
Moved by Mr. Gilmore, seconded by Mr. Paluso, that Minute No. 54 be
approved as read.
Roll call vote taken:
Mr. Gilmore - Yes; Mr. Paluso - Yes; Mr. Morgan - Yes.
Motion carried unanimously.
Epecial Order of Business:
Chairman presented a Certification of Appreciation to the former
Jail Warden, James 0. Roupe, acknowledging his services and dedication to
Washington County. Warden Roupe thanked the Commissioners and stated that he
had enjoyed serving Washington County.

Chief Clerk informed the Board of a letter from James R. DeLand, Jr.
Project Engineer with Engelhardt -Power & Associates, Inc., regarding Cross Creek
Flood Control Project Road Relocation - L.R. 62035, Site PA 662. Mr. DeLand
informed the Commissioners that he has directed a letter to the United States
Department of Agriculture, Soil Conservation Service in Harrisburg relative
to the horizontal geometrics of the road which is to bypass the proposed dam.
Mr. DeLand stated that he has reviewed the SCS proposal and has made some
revisions. He also stated that upon receipt of approval on the preliminary
layout from SCS, he will proceed with the necessary field work and final design.
Chief Clerk informed the Board of a letter dated January 28, 1977
from Thomas J. Brennan, Executive Director, Governor's Justice Commission,
regarding the Juvenile Probation Program (SW-76-C-9C-0093). Said letter informec
the Commissioners that the Commission has approved a preagreement for preincurre
costs on this grant as set forth in the Financial Guide in order that these cost
be recovered in the event our application is approved. Letter stated that these
preincurred costs are approved effective January 1, 1977.
Chief Clerk informed the Board of a letter from Frank M. van Ameringen,
Attorney -at -Law, which onclosed a revised Application to the Pennsylvania Public
Utility Commission by Quail Run Sanitary Corporation for approval of the right
to begin to offer, render, furnish or supply sanitary sewage collection and
disposal 5erVice to the public and a portion of Peters Township, known as Quail
Run Development. Mr. van Amerigen asked for the Commissioners review and ,
approval of this Application.
Remarks:
Mr. Morgan suggested that this matter be referred to William Sember for his
review before the Board takes action.
Chief Clerk informed the Board of a Public Notice from the Department
of the Army, Corps of Engineers, giving Notice of Exercise of Section 404
Jurisdiction over certain streams and lakes in Pennsylvania.
Chief Clerk informed the Board of three matters concerning Personnel -
Resignation of Thomas Oprosky, temporary emergency houseparent at the Juvenile
Detention Home, effective February 4, 1977; resignation of Charles I. Morris,
Correctional Officer, County Jail, effective January 28, 1977; and the employment
of Joseph Craig Meny to fill the vacancy left by Mr. Morris as Correctional
Officer, effective January 29, 1977, rate $343.55 bi-weekly.
Chief Clerk informed the Board of a letter from the Washington -Greene
Community Action Corporation, requesting the first half of the yearly allocation
in the amount of $7,500 from the 1977 budget.
Chief Clerk informed the Board of a letter from the Cooperative
Extension Service, requesting an allotment of $7,000 from the 1977 budget.

Chief Clerk informed the Board of the following letter dated February
1, 1977 from Jack B. Wagner, Director of Elections:
Gentlemen:
I have recently made a study of the Voting Precincts
of the City of Washington and I find that in Ward 2, 1st
Precinct there is a total of 313 registered voters and
that Precinct 2 has a total of 191 registered voters,
which makes a total of 504 voters for both precincts.
(The average per precinct in the County is 499).
I am recommending that these Precincts be merged into
one Precinct thus making it necessary to have only one
election board working and also both Precinets would vote
at the same polls.
I would also recommend that Ward 3, Precinct 1 (270
registered voters) and Precinct 2 (224 registered voters)
(Total 494 registered voters) be merged for the same
reasons.
I have contacted the present Committee People in
these areas for their opinions.

Remarks:
Mr. Morgan stated that a hearing will be held by the Election Board to hear the
opinions of the public on this matter.
Chief Clerk informed the Board of a travel request for Jess Costa,
District Attorney and Samuel Rodgers, First Assistant District Attorney, to
attend a criminal seminar, sponsored by the Pennsylvania District Attorney's
Association, to be held in Hershey, Pa., on February loth and llth.
Moved by Mr. Gilmore, seconded by Mr. Paluso, approving the travel
request as per above.

Chief Clerk informed the Board of a letter dated January 31, 1977,
from the Department of,Public Welfare advising that the per diem billing rate
for Farview State Hospital has been revised from $75.00 to $129.00 effective
March 1, 1977.
Regarding the Washington County Home for Men, Mr. Brady stated that
the Health Care Services Malpractice Act of 1975 decides cases of alleged medicaL
malpractice and is funded by an annual fee paid by each health care provider.
Mr. Brady stated that the County Home for Men qualifies under the Act as a
nursing home and the fee would be $100.00 for this insurance.
Moved by Mr. Gilmore, seconded by Paluso, approving payment of the
$100.00 fee for malpractice insurance as per above.

Solicitor:
Solicitor Diamond presented an Agreement between the County of
Washington, the City of Washington and the Washington County Volunteer Firemen's
Association, whereby the City would man and operate the Washington County Civil
Defense Radio Warning Network and the Washington County Fire Radio Network, at
no cost to the County or to the Firemen's Association. In addition, the City
of Washington Communications Center will handle all calls and radio transmissionF
involving the several ambulance services in the various fire departments,
Emergency Medical Services, and operations of the four (4) Hurst Tool sets
presently located in Washington, Canonsburg, Bentleyville and Claysville Fire
Departments.
Moved by Mr. Paluso, seconded by Mr. Gilmore, approving the Agreement
as per above.

Solicitor Diamond recommended that the Board approve a proposed
Hold Harmless Agreement whereby the County Commissioners on behalf of Washington
County, agrees to hold and save harmless the United States of America free from
liability for any damages which may be caused to Washington County owned property
including, but not limited to, County bridges, in connection with emergency
snow removal operations conducted,by, through, or on behalf of, the USA within
the ge6graphic jurisdiction and territory of Washington County. Mr. Diamond
also recommended the approval for similar type agreements for the other
municipalities involved.
Moved by Mr. Paluso, seconded by Mr. Gilmore, approving the proposed
Hold Harmless Agreements as recommended by the Solicitor.
