Washington, Pa., April 7, 1977
The Board of County Commissioners met in reqular session with the
following members being present: Commissioners Gilmore, Paluso and Morgan.
Also being present: Chief Clerk Brady; Solicitor Diamond; Budget Director
Gillespie; Joesph Giecek, Administrative Assistant; Mrs. Miller, League of
Women Voters; John Cadez, Engelhardt A Power; John Stevens, Observer -Reporter;
Dave Lester, Brownsville Telegraph and Earl Bugaile, WKEG.
Chairman noted for the record that three Commisi sioners, th&'Xhief Clerk,
County Solicitor and Budget Director were in attendance.
Chairman asked if there were any corrections, additions or omissions
to Minute No. 63, each member having received a copy.

Special Order of Business:
Regarding the retrial for Tony Boyle, Controller Mascara requested that
the Board approve a supplemental appropriation under Account 164, which is a
special judicial account, in the amount of $50,000,.to",Delaware County. He also
requested permission to travel to Delaware County, possibly with President
Judge Sweet, to set up the necessary band, accounts and take the necessary
precauti6na to insure the County of Washington that the money is being spent
appropriately under the County node. Mr. Mascara also requested th$tthhe Board
request Judge Sweet to issue a court order permitting him to draw the check and
advance it to Delaware County.
Remarks:
Mr. Diamond: The Code provides that we are going to bear the expense, and
normally we pay on the vouchers for services rendered. I suppose that as long
as you advance this in the sense you are depositing the money inaan account
which you control and make your withdrawals from that account after the expenses
have been incurred, then that would be satfficient in compliance with the law.

appropriation advance of $50,000.. to Delaware County for the Tony�,,Boyle retrial
as per above.

Chief Clerk presented the following bill to the Board for their

Chief Clerk presented a� Cooperative Agreement between District Eight
of the Bureau of Employment Security and Washington County (Prime Sponsor)
for the implementation of the CETA Title VI expansion, in which the Bureau agrees,
to inform the County of eligibility potential Title IV and will assume the
responsibility of keeping the County advised.
Moved by Mr. Paluso, seconded by Mr. Gilmore, approving the Cooperative
Agreement as per above.

Chief Clerk presented another Cooperative Agreement between the
Bureau of Employment Security and the Washington County Office of Employment
and Training (Manpower) for the Summer Youth Program of 1977. Mr. Brady added
that these are non -financial agreements.

Agreement as per above.

Chief Clerk presented a Lease Agreement with the M & C Leasing Co., Inc.
for a check writing machine in the Employment & Training Office, for a term of
12 months at $509.91 per month rental payment.

Chief Clerk informed the -Board that the Washington -Greene -Community
Action Corporation has requested the transfer of a check in the amount of
$2,742.78 for day care services provided und6r the Department of Welfare
Contract #3540.
Chief Clerk informed the Board of a travel request from Child Welfare
Services akking pppval r the attendance of Mrs. Mildred Spalla at an
Interdisciplinary Workshop on Child Abuse and Neglect sponsored by the Department
of Public Welfare to be held on April 12 and 13, 1977 at Hershey, Pa.

Chief Clerk informed the Board of a travelrequest from Child Welfare
Services asking approval for the attendance of James Henry ads a conference on
the contribution of children to marital quality and family interaction at
Penn State University on April 21, 22 and 23.
(No motion was made on this request.)
Chief Clerk informed p Board that two County employees, Rebecca S.
Braun and Dale V. Watson are members of the U.S. Army Reserves, and are required
to take active duty training periods. Mr. Brady stated that both employees
have requested a leave of absence.

Chief Clerk informed the Board of a request from the Washington County
Historical Society for further allocation of $1000, for the second quarter,
against budget6d funds for 1977.
Chief Clerk informed the Board of a press release from the Department
of Education announcing that they will conduct a four week course from May 2,
through Malr;- 28, 1977 at Wilson College, Chambersburg, for those interested
in becoming district justices of the peace. Notice stated that the "Magisterial
District Reform Act" (Act 204) requires that individuals -who are not members of
the bar of the Supreme Court, pass the course prior to filing for the primary
election or assuming appointed office.
Regarding the recent Open House held at the new Washington County
Health Center, Chief Clerk informed the Board of a letter from Mr. James White

congratulating the Commissioners for giving the citizens of Washington County
the beautiful home and surroundings.

Regarding a bridge between Donora and Webster, which was damaged by
a truck, the Chief Clerk informed the Board of a certified letter from
C.J. McElwee, Secretary, Pennsylvania Public Utility Commission, stating that
the Commission orders and directs the Pennsylvania Department of Transporation
at its initial,cost and expense to erect and maintain substantial barricades
at taah end of the structure to prevent passage of all motor vehicles, Md to
establish and maintain an approprihte detour route for the traveling public.
And that PennDOT, having agreed to do so, will advise the Commission of the
progress of the work on a thirty day basis commencing March 28, 1977.
Chief Clerk informed the Board of a letter from the Public Utility
Commission which stated that by concurrent resolution, Resolution No. 228, the
Senate and House of Representatives of the Commonwealth of Pennsylvania directed
the Pa. Public Utility Commission to undertake a thorough investigation of
alternative raft structures and to evaluate what changes, if any, should be made
in rate structure to conserve scarce natural resources, to promote more
efficient technologies and to promote more efficient utilization of electric
energy. As part of this investigation, the Commission will be holdihq_holding
evidentiary hearings through -the State and enclosed a current hearing calendar.
Mr. Morgan requested that this letter be posted on the bulletin board.for all
those who would like to attend -these hearings. .
Chief Clerk informed the Board of a letter from the Washington County
Agricultural Fair, Inc. requesting the annual contribution of $4,000.00 for the
1977 County Fair.

Regarding the Washington County Health Center, Mr. Diamond stated that
he had not prepared contracts for the Hairdresser and Barber, but that they were
discussed previously.on a rate schedule for each. He then requested authoriza-
tion to negotiate and prepare the contracts.

to prepare the contracts as per above.

Mr. Diamond presented a proposed Agreement between Washington County
and Harold Comedy and Son for the purpose of removing refuse at the Washington
County Health Center on a daily basis 7 days a week, 365 days a year for $150
per month.
Remarks:
Mr. Gilmore suggested that provisions be made in the agreement for pick up of
refuse at the Planning Commission also.

Mr. Diamond paeeented the following Consent To Assignment Of Lease And
Mortgage of Leased Premises and aecommended approval:
WHEREAS, by Lease Agreement dated September 10, 1965, the
Board of County Commissioners of Washington County, Pennsylvania,
leased to Tri-State Aviation, Inc., two certain parcels of land
situate in South Franklin Township, Washington County, Pennsylvania,
being a part of the property known as the Washington County Airport,
and therein described and referred to as Tract No. 1 consisting of
an area of 8,000 square feet and Tract No. 2 consisting of an area
of 12,000 square feet, and a Memorandum of said Lease having been
entered into between thh parties on November 10, 1965, in the
Washington County Recorder of Deeds Office in Deed Book 1224 at
page 605; and
WHEREAS, by Paragraph 7, of said Lease Agreement, "The
Lessee shall not assign this Lease without the written consent of
the Lessor, except that such Assignment to be a corporation then
owned or controlled by the Lessee. The Lessor agrees that such
consent shall not be unreasonable delayed or withheld?; and
WHEREAS, Tri-State Aviation, Inc., did assign the above
mentioned Lease to Jetcraft, Inc., a corporation on April 1, 1971;
and
WHEREAS, Jetcraft, Inc., desires to assign the aforesaid
Lease of September 10, 1965, to Christman Trucking Corporation and
in connection therewith, Christman Trucking Corporation desires to
execute and deliver a collateral note and security agreement to
First National Bank & Trust Co., Washington, Pennsylvania, in the
principal amount of Ninety -Three Thousand Seven Hundred Fifty and
00/100ths ($93,750.00) Dollars, and likewise a collateral note and
security agreement to Breese, Fox and Coen in the principal sum of
Twenty -Six Thousand Eight Hundred and 92/100ths ($26,800.92)
Dollars, which said collateral notes and security agreements shall
encumber only the balance of the term under said leasehold and the
improvements erect6d .thereon; and
WHEREAS, the proposed transaction shall be for the mutual
advantage of the Board of County Commissioners of Washin#ton County
as Lessor, Jetcraft, Inc., the Lessee under said Lease, and Christ-
man Trucking Corporation, and Assignee of said Lease;
NOW, THEREFORE, the said Board of County Commissioners
of Washington County does hereby give and grant its consent to the
Lessee, Jetcraft, Inc., to assign all of its right, title and
interest in the aforesaid Lease to Christman Trucking Corporation
and in connection therewith does hereby consent to the execution
and delivery of the aforesaid collateral notes and security agree-
ments by Christman Trucking Corporation to First National Bank &
Trust Co., Washington, Pennsylvania, in the amount of Ninety -Three
Thousand Seven Hundred Fifty and 00/100ths ($93,750.00) Dollars and

Regarding the Malden Park Property, Mr. Diamond reported that the
closing was held last Monday, and we acquired title of one half of the property
and then conveyed it to MIDA in return for a $200,000 promissGry note.
He then stated that he had the note and would become due and payable on the
first of two events - either when the Pennsylvania Industrial Development
Authority has been paid its advance of about $210,000, which will be paid as
those properties are subdivided and sold,or ten years from the date of the
execution of this agreement. Mr. Diamond stated that he would find some
appropriate way to protect the County for repayment of these funds in the future.
