The Board of County Commissioners met in regular session with the following
members being present: Commissioners Jones, Paluso and Flynn. Also being present:
Chief Clerk and County Administrator Whalen; Administrative Assistant Fetcko; Solicitors
Bigi and Gilmore; Larry Schwingle of Cable TV-3; Mrs. Miller of the League of Women
Voters; Earl Bugaile of WKEG Radio; Dave Budinger of the Observer -Reporter; and
Jerry Kolanic of WWVA Radio.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions or omissions to
Minute No. 150, each member having received. --a copy.
Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 150 be
approved as read.

Old Business:
Mr. Paluso: I brought up about that Mon Valley Council of Governments yesterday and
I looked into it a little more. -Mr. Massafra informed me that we have
never withdrawn from that organization; and I think Mr. Jones is our rep-
resentative to the COG and he tells me that... well, the fact that we haven't
withdrawn would seem to me that we are obligated to pay last year's dues
at least and give some indication if we are going to be in it or not. Our
dues for last year are for $3600. Another question that came up is whethe
or not any other counties are involved, and according to them, Westmore-
land County has paid it's dues in the amount of $2600. I questioned why
their dues were $2600 and Washington County's was $3600, and the answer
was that only three communities are involved - Monessen, North Belle
Vernon, and Rostraver Township - whereas Washington County has 12
municipalities who are members of the COG, and that is the reason for the
difference. I think we should pay them since we haven't withdrawn, and if
you don't withdraw, I would assume you are a member. At least they
should have the courtesy of knowing what our intentions are going to be.
Mr. Jones: This is the first time since the COG organization was founded that any of
the other counties have participated money -wise, and Washington County has
been in the organization since conception. I am the representative to the
Board; since we haven't paid our dues back for the time element concerned)
here, I have not been attending the meetings because I didn't think we had
representation on the Board without paying. I know that this is the first
time that Fayette or Westmoreland County had participated money -wise.
Mr. Paluso: I move that we pay our 1974 dues in the amount of $3600 and inform the
Mon Valley Council of Governments what our intentions are for 1975 and the
future, so at least they can plan on the County being a member or not.
Mr. Flynn: Well, the gentleman's motion is in order; is there a second? For lack of

The Board of County Commissioners met in regular session with the following
members being present: Commissioners Jones, Paluso and Flynn. Also being present:

Mr. Whalen referred to a matter which was discussed at last week's meeting
egarding the re -apportionment of the ward system at the Borough of Centreville, and stated
t after the meeting he had gotten together with Mr. Gilmore and researched the problem
and jointly made up a letter which they sent to the Secretary of the Borough of Centreville.
Mr. Whalen then read the letter of January 13, 1975 which stated that the "Ward System" within
political subdivision, for purposes of local government representation, is the sole responsi-
ity of that subdivision; and any changes contemplated must originate within the subdivision
structure. Letter further stated that the related matter is the "Voting precinct or precincts"
ithin the Ward and in the subdivision. This is the responsibility of the Board of County
Commissioners who also make up the County Board of Elections, therefore, once the Borough
Centreville has resolved the "Ward re -apportionment" as required, then and only then can the
ounty Board of Elections move to effect any required adjustments to the "precinct or precincts'

Remarks:

Chief Clerk informed the Board that the Public Hearing for the Housing Project,
Canonsburg Borough has been re -scheduled for Tuesday, February 18, 1975, at 8:00 p.m. in
the Canonsburg Borough Building. Mr. Whalen stated that this will be a joint Public Hearing
by the Board of County Commissioners and the Canonsburg Borough Council.
Chief Clerk presented to the Board the Grant Application for Adult Probation for
1975 which had been approved by Judge Sweet and covers the four (4) persons (Jerome N.
McCavitt, Stanley Rockovich, Nicholas Nardine and Elizabeth Dermont) who were discussed
previously and agreed upon. Mr. Whalen stated that the request is for $25, 998. 00 which is
reimburseable.
Moved by Mr. Jones, seconded by Mr. Paluso, that the LBoard execute the
Grant Application for Adult Probation for 1975 as per above.

Chief Clerk read a telegram received January 9, 1975 from Congressman
Thomas E. Morgan, announcing that the Office of Economic Opportunity has awarded a $17, 250
Refunding Grant to the Washington -Greene Community Action Corp.
Relative to the 1975 Federal Housing and Community Development Act,
Mr. Whalen reported that the resolutions between the Board of Washington County
Commissioners and the municipalities throughout Washington County had been approved and
returned by each of the 67 municipalities. These resolutions are required as support of
ashington County's effort to qualify as a urban county under this Act and their receipt
constitutes another step forward in the development of the County plans for utilization of monies
hich may be received under this new Act.
Chief Clerk read a letter dated January 13, 1975 from the Department of
Military Affairs, Bureau of Veterans Services, giving notice that the Bureau will host a two-day
seminar on recent changes in veterans benefits, entitlements and laws at the Sheraton Motor
Inn, Milesburg, Pa. on January 30 & 31, 1975. Said letter recommended that the Commissioner
authorize their County Director of Veterans Affairs to attend this seminar.

Chief Clerk read a letter dated January 13, 1975 from the Washington County
Agricultural Fair, Inc. expressing their appreciation to the Commissioners for their cooperati
and assistance in helping them to make the necessary improvements which were essential to
the success of the 1974 Fair.
Chief Clerk read a portion of a letter directed to Governor Milton J. Shapp
m the Pennsylvania Association of Older Persons, Inc. Said letter requested that the
Governor enact changes in the State/Federal Supplemental Security Income program to provide
an additional state payment of $34. 00 for individuals and $50. 00 for couples to bring minimum
SSI payments to $200. 00 for individuals and $300. 00 for couples. Said letter stated that becausf
its payments are so low, only 125, 000 persons have availed themselves of the SSI program, and
t if payments were reasonably increased many other persons, who are now qualified or who
would become qualified under higher eligibility standards, would step forward to receive what
is rightfully theirs under Federal and State law. Mr. Whalen stated, that they are asking that
e Board of County Commissioners endorse this request to the Governor, and that they have
sent a petition form to be circulated, if possible.
Remarks:

Chief Clerk read a portion of four (4) letters received from the Department of
the Army, Pittsburgh, Pa. , directed to Eugene Tenaglia, County Engineer, regarding Semi -
Annual Inspection of the Chartiers Creek Flood Protection Project, Canonsburg -Houston Reach,
Unite 1; the City of Washington and Township of Canton Flood Control Project; Granville, Pa.
Channel Improvement Project; and the Burgett stown -Slovan Channel Improvement Project.
Said letters stated that after inspection of these projects and areas, they had been found to be
c)vergrown with large weeds, high grass and that debris was building up around some projects.
Whalen stated that these areas called for an indepth inspection by the County, and also
some attempt of cooperative arrangements with the municipalities involved to restore them to
their required condition.
Chief Clerk informed the Board of the receipt of the following Administrative

ordered that henceforth the payroll for all Court employees, under

Chief Clerk read a letter dated January 14, 1975 from the Monessen Public
Library inquiring whether the Commissioners were- considering an allocation to their library

istory and Landmarks Foundation. Said letter referred to the recent announcement of the
ourt house being entered in the National Register of Historic Places and stated that the
oundation would like to acknowledge this by placing a bronze plaque on the Court house.

Letter also stated that the plaque had been paid for by the Foundation, but they would welcome
a contribution from the County to pay for all or part of the $72. 00 cost. The Foundation also
stated they would like to schedule a public ceremony to unveil the plaque.

Chief Clerk informed the Board of a letter dated January 14, 1975 ,from the
Pennsylvania Public Utility Commission regarding Application of Penn Central Transportation
Company, Debtor, for approval of the alteration of the crossing, at grade, by the construction
of a siding track to serve Mac -Plastics, Inc., where the tract of said company crosses State
Highway Route 62162 (Johnson Road), in the Borough of Houston, Washington County. Letter
advised the Commissioners that the Commission has set Wednesday, February 26, 1975, at
10:00 a. m. in the Courthouse at Washington as the time and place for hearing on the applicat

handling this. =
Chief Clerk read a letter dated December 27, 1974 from the Comprehensive
Health Planning Association of Western Pennsylvania, Inc. Said letter enclosed a mcmorandui
that had been directed to each of Washington County's emergency medical service agencies
that submitted a request for Federal financial assistance through a 12-county regional proposal
that is being developed to secure HEW funds under the Emergency Medical Services Systems
Act of 1973. Enclosed memorandum described the possibility of securing such funds. Letter
further stated that the Emergency Medical Service Institute, Inc. will be the applicant for the
Regional proposal, and since the EMSI Board of Directors will convene in the near future for
appropriate review of the proposal, they requested that the Board of Commissioners designate
its representative to the EMSI Board of Directors. Mr. Whalen stated that a letter has been
sent to them indicating that he had been appointed as the representative.
Chief Clerk read a letter dated January 6, 1975 from Andrew Cherpak, Meadow
Lands, Pa. regarding the worsening air quality of the Pittsburgh area. Said letter enclosed
air pollution records for 1973 and 1974, and Mr. Cherpak stated that this was the loth letter
he has sent with no results or answers.
Remarks:
Nor. Flynn stated that this is the first time he has ever heard of Mr. Cherpak and his
communications, but thatmhe would receive an answer from us.
Chief Clerk read a letter dated January 13, 1975 from the Department of Health,
Commonwealth of Pennsylvania. Said letter stated that they had received notification from
Honorable Jacob Kassab of the approval of our application for a Highway Safety Grant,
Project Number EM 75-08-1. Letter also enclosed the application with •an addendum contain

two conditions. Mr. Whalen stated that this grant in the amount of $6, 784. 00 which together
with a matching share of $2, 907. 00 from Washington County will be used for the purchase of
medical equipment and training supplies in the Emergency Medical Technician Ambulance
Training Program now being undertaken by the Emergency Medical Services Office.
Mr. Whalen also stated that this had been approved by the federal government, and is now
complete.
Chief Clerk informed the Board of a letter dated January 10, 1975 from Linda
Magera in which she announced her resignation from the Election Office. Mrs. Magera
stated that under her physician's advice she must resign her job, and requested that her
resignation take effect immediately.
Chief Clerk informed the Board of a memorandum dated January 14, 1975 from
Amor Flenniken, Director, Tax Claim Bureau, requesting 60 days leave of absence for
John P. Kelly due to serious illness. Mr. Whalen stated that Mr. Kelly has exhausted all
his sick leave, but that Mr. Kelly feels he will be able to return to work after this 60 day
leave of absence.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the
60 day leave of absence for Mr. John Kelly as per above.

New Business:
Manpower - Mr. Flynn
Mr. Flynn gave a special report relative to the role which the Washington County
office of Manpower Planning will play in attempting to deal with the current high unemployment
situation in Washington County. Mr. Flynn explained that a meeting had been held on Tuesday
January 14, 1975 with the Board of Commissioners and the staff of the Manpower Planning
office, in which the specifics of this situation were discussed. Mr. Flynn stated that
emergency funding has been provided by the federal government under Title 6 of the Compre-
hensive Employment and Training Act. Under this Title, Washington County has been allocate
$506, 66,4.00,however, Mr. Flynn pointed out that during this recent meeting it was brought
to light that this allocation will only provide for 84 positions with a annual salary of $6, 000. 00.
The Manpower Planning office has been in touch with each municipality throughout the County
requesting their input as to the number of positions which each would be able to utilize.
Mr. Piganell informed the Commissioners that only a 50% response by municipalities had b
received, indicating a total of 257 positions. Mr. Flynn stated that regretfully these needs
will not be able to be met at this time unless future emergency funding is received from the
federal government, and therefore, until such notice might be forthcoming it was the decision
of the Board that each municipality can only be granted one position at this time.

Concerning the 1975 Real Estate Tax, Mr. Whalen reported that approximately
85,000 tax notices will go into the mail Friday, January 17, 1975. Mr. Whalen stated that we
have 95, 000 properties in Washington County, but we have had a problem over the past years.
The books are closed in October and any property- changes made after that closing date -
there wasn't any facility for redoing these tax notiees,and as a result the notices went to the
previous owners, which caused a lot of confusion. Mr. Whalen further stated that in order to
eliminate this, the Tax Assessment Office has maintained a file of all changes that were made
sand once these notices came into us on Monday,Mrs. Lawrence immediately set to work pulling
all the changes. The new and correct tax notices on those changes will be mailed by February
15 and those will still have until June 30 to pay their taxes. Mr. Whalen added that these new
(tax notices are being used this year and will carry all necessary information such as discount
and penalty payment dates, office hours and addresses. Mr. Whalen stated that hopefully this
(new system will prove to be much more efficient in the collection of Real Estate taxes.
(Remarks:
Mr. Flynn asked if any of the dates,which have been established for discount or penalty paymentE
fall on Sunday or holidays. He then recommended that the Board make a motion if this situation
occurs at any time.

(the Treasurer in the event that any of the dates indicated on the tax notices should fall on any
day the Courthouse is not opened, the date is hereby extended to the next full day of business.

Moved by Mr. Jones, seconded by Mr. Paluso that the Board authorize the
l Chief Clerk to advertise for bids for Fleet Insurance for 1975 and for the purchase of flags and
(markers for veterans graves; said bids to be received in the Office of the County Controller
luntil 11:00 a.m., Local Prevailing Time, Thursday, February 6 , 1975, and opened
jimmediately thereafter in the Office of the County Commissioners.

As a result of last week's meeting, Mr. Whalen reported that we had sent out
inquiries to the banks asking for quotations on their rates for temporary borrowing. Mr.
stated that we received three replies - two of them carry the same interest rate, however, one
bank guaranteed their rate and also guaranteed that during the term of the loan, should the
irate reduce, they will accordingly reduce the interest rate for the County. Currently the prime
irate is 14% and the municipal rate is 5. 33%, however, in the event the prime rate should
further reduce from 10 %, the municipal rate is 52% prime.
(Remarks:
lMr. Paluso stated that this should be retroactive to the date of the actual bargaining.

private sale to the Board for their consideration and approval, and recommended that these

property situate in the Borough of Allenport, Washington County, Pennsylvania, sold on
September 12, 1958, Tax Claim Bureau Sale, being described as (1956) Lot, Adj. Ferri,
DB 972-326, situate in the Borough of Allenport, Washington County, Pennsylvania, and
formerly assessed in the name of Joseph and Christian Droter, be approved; and that the sum
of $270. 00 be accepted from FRANKLIN AND MAY ANN HAYWOOD; Washington County Tax
Claim Bureau receiving the consent of taxing district involved; California Area School District
December 9, 1974, and Allenport Borough Council - November 5, 1974.

Mr. Whalen or Mr. Fetcko - do we have communications from the Council
of Governments requesting any amount from us, prior to the adoption of our
budget?
Mr. Fetcko: Not that I know of.
Mr. Whalen: We had a letter that we read at a meeting here once, in which they requestec
an audience, and it was tabled; and was never brought back up again to the
best of my knowledge.
Mr. Flynn: Also for the record, Mr. Jones raised a very good point. I talked to
Mr. Massafra myself since the adoption of our budget and he asked me if
we made allowances in our budget; I told him definitely not. I made in-
quiries about Fayette County and Westmoreland County and Mr. Jones is
correct. This is the first time that Wesbwreland County has ever partici-
pated financially. And about the second time for Fayette County. Washingt
County has been, up until the last few years. But we never had anything
formal in writing from them, with the exception that they wanted an audienc
etc., etc., etc. And, therefore, there were no provisions made in the budg
for it. And I so informed Mr. Massafra to that effect. And I just want
the records to show that.
Mr. Paluso: Do you think we should inform them in the future? Explaining that we are
no longer participating?
Mr. Flynn: Well, I would find no fault with it, that we have never received any formal.,
I think for the record we will draft a letter to them stating that we've never
received any formal request from them. As a matter of fact, anybody
associated with the Council of Governments - the only man I have ever t lke
to since the very conception of the Council was Mr. Massafra. I never had
the opportunity to talk with any of the other leadership or the members or
the executive directors, at no time. There was a young man years ago, I
think he was with the Council - either with the Council of Governments or
MIDA.
Mr. Jones: Young Joe Simonin was the Executive Director...
Mr. Paluso: No. He was the assistant. The executive director left about a year ago a
they didn't have an executive director for the major part of the year, and
the Mayor of Belle Vernon, Ed Lyons is the president of the Council of
Governments and was also acting as the executive director until they hired
a new one.
Mr. Jones: But we have talked about it many, many times, but there was no... there
was a letter that came in the past.... after the budget hearings, asking for
an audience, and they requested, not requested,. they had told us how much
money theywanted, but did not request anything from the budget.
Mr. Flynn: With the exception of young Mr. Fredericks, the only person that I have
ever talked with was Mr. Massafra, and they were strictly phone conver-
sations, so we'll so notify them.

Mr. Paluso: I noticed that something has been missing lately from re -purchase interest, I
checked back last night and it seems to me that we missed seven weeks since
the middle of November that have not had re -purchase agreements over the
weekend, and I was wondering what the reason for this was. I noticed that sinc
the middle of November, there have been three (3) weekend re -purchase trans-
actions, and we missed seven weeks out of those ten and I was wondering what
the reason was. The way I figure, we lost almost $3, 000 by not making the
weekend investments that we've been making all year.
Mr. Flynn: Well, there was a couple weeks that Mr. Whalen and I did discuss this, that
was around Christmastime of the latter part of December, and time being of the
essence and balancing out our books and so forth, was one contributing factor;
perhaps you could add more to that, Mr. Whalen.
Mr. Whalen: Well, there hasn't been any large balances in the Account that would be involved
there and without checking it,- I would think that the $3, 000 figure that Mr. Palu�o
believes we lost, would be an extremely high figure. But I''d have to concur wi
what you said, Mr. Flynn. Possibly it's, maybe, a weak reasoning, but two
factors - the fact that we have been extremely busy and that the amounts in the
General Fund account haven't been such that it would develop any great amount
of investment.
r. Paluso: I beg to differ. On November 15, there was $811, 456 available; on December 16,
$ 928, 455; on December 20, $ 794,105; on December 27, $428,176; on January 3,
$402,113; on January 10, $330,214; and on January 17, $253,175. And at the
conservative rate of interest, it still comes out to $3, 000, approximately.

Mr. Flynn: It seems to me, Mr. Paluso, that you being aware of that fact, I think it would be
incumbent upon you... this is now January 23, it seems to me that it would be
incumbent upon you to make your findings known to the Board.
Mr. Paluso: I noticed it last week, and I just happened to notice that there was no interest
and I looked back and that's why I'm bringing it up now. Obviously, you were
aware of it because you said you- discussed it with Mr. Whalen.
Mr. Flynn: Well, we did - I'm talking about December - we certainly did. And time being th
essence, we can't wait until Thursday morning or Friday morning and try to mare
an investment. If we could have a continuing, outgoing investment like we used
to do, things may be different. I'm not trying to say that it was our error, but
once again, from November to January 23 is quite a spell, and I would assume
that you were aware of it before this.
Mr. Paluso: No, I wasn't. I just noticed it last week; it wasn't on the minutes of the meeting,
the interest. I saw the C. D. on there, - but there wasn't any re -purchase interest,
so I looked back to see if it was on the other ones. It has been done all year,
every weekend, up utitil November 15, and I want to know why. It is my under-
standing that the balance is sent over to Mr. Whalen every Thursday. There is
a resolution or motion in the minutes some mrnths ago, that he is to do this. He
is directed to invest this money every weekend.
Mr. Flynn: Well, there's no question that he is directed to invest every weekend, bua.t I think
there is an exception to all rules. And circumstances were such that time being
of the element, thht the gentleman didn't have the opportunity. And quite frankly,
when you're trying to close out our business, at the end of any given fiscal year,
and the uncertainty about the balances exists, I think this is a contributing factor
also.
Mr. Paluso: Don't they send that balance to you every Thursday afternoon, Mr. Whalen, for
that specific purpose?
Mr. Whalen: Usually on Thursday mornings; yes.
Mr. Flynn: Just for the record, so there won't be any misunderstanding, if we are in error,
it certainly wasn't done intentionally because I think that the records will show
that we have been very prudent in our investments over the years and the record;
will; show that, I believe last year, just off the top of my head, we earned thr
our investments between $400, 000 and $500, 000 in interest. So, I can assure
you that it wasn't deliberate; there had to be reasons, because any time we can
earn money, we try to do it.
Mr. Paluso: Well, I think if this system won't work the way we're doing it, if Mr. Whalen
doesn't have the time to call the bank and make that investment, then we better

look into another system; because I don't think - that's $3, 000, between
$2500 and $3000 that we're just throwing away. In the beginning, when we
started re -purchase agreements, the Controller's Office was doing it; so that
to make it less cumbersome and to see that it got done, that policy was change
some months after we initiated this. Perhaps if Mr. Whalen doesn't have time
to do this, we should revert back to the prior arrangement.
Mr. Flynn: Well, I think we are capable of handling our end of the fiscal affairs, and we
will continue to do so.
Mr. Paluso: I think this is an expensive oversight.
Mr. Flynn: Well, each one is entitled to his own opinion, but it seems to me, and again I
repeat...
Mr. Paluso: With the money that we lost, we could have paid our dues for the Mon Valley
Council of Governments.
Mr. Flynn: Well, may I remind you gentlemen, that we are not perfectionists and at no tim
do we claim to be. And again, may I remind you gentlemen, that you, in your
capacity, it is incumbent upon you - we don't wait two months or two months
and a half, to bring it to our attention - I think it is incumbent upon you to bring
it to our attention immediately.
Mr. Paluso: I brought it to your attention as soon as I found it. Obviously you discussed
it; why didn't you bring it to somebody's attention if you discussed it in
December?
Mr. Flynn:` Because of the uncertainty; I tried to explain it to you.
Mr. Paluso: There's no uncertainty. The money is there on Thursday, there's no uncert-
ainty. You can't lose it in the bank.
Mr. Flynn: Well, let's not belabor the point. You made your point and we'll take it under
consideration.
Mr. Paluso: The motion says it will be done, the way I understand it.
Mr. Flynn: Do some research on the motion, will you please, and let me read it. Do you
have the motion available? Can you put your finger on it?
Mr. Paluso: No.
Mr. Flynn: Alright, any further comments?
Mr. Jones: I would suggest, that in reference to this - I know sometimes it can get very
cumbersome - I would suggest, Mr. Whalen - you have many things to do -
that you instruct Mr. Crouse or Mr. Fetcko or yourself to do this. We can't
help what happened in the past, but I would suggest that maybe we do put one of
the gentlemen on this and make sure that we have this cbmmuni.cati.on with the

Chief Clerk then read a letter addressed to the Governor regarding the report of
inatural disaster on December 1, 1974 by Washington County, which was set up to be signed by
the Commissioners. Said letter stated that the Board feels that emergency loans should be ma
(available to eligible farmers and non -farmers affected by the storm to help in the financial
I crises.
(Remarks:)
Mr. Jones stated that in reference to this, Mr. Paul White from the Civil Defense Office of
Indiana, Pa., just brought this down to him, and stated that they did meet in an emergency
session in regards to this letter.
Mr. Flynn stated that for the record, the -Commissioners will sign this letter because it is a
must that this letter be sent.
Mr. Jones then stated that in regards to this, he received communications from Bell of Pa. ,
which stated that they are trying; to work on a better communications system for future needs.
Mr. Jones stated that as a result of this, a meeting wilt- be held for all interested parties to
determine how to better prepare for future emergencies or disasters. Mr. Jones also stated
that he is planning to attend the meeting which will be held on January 27, 1975, at 9:00 a.m.,
at the Belle Vernon Holiday Inn.
Mr. Paluso then referred to the West Penn Power - P. U. C. Hearings which are scheduled
for January 28, 1975, and asked if it would be too late to try and transfer the hearings
to a larger place to accommodate the large crowd that is anticipated.
Mr. Flynn stated that the point is well taken because of the size of the crowd at the
Uniontown hearings, and that he believes that Mr. Terputac, the hearing examiner, would
be in a better position to determine the size the crowd that can be expected. Mr. Flynn
stated that perhaps Mr. Terputac can make some type of request.
Mr. Paluso stated that maybe the hearing should be transferred to the W & J gym.
Mr. Flynn stated that he would be hesitant about changing the hearing until a request came
from the hearing examiner, because he is the one who sets up the hearings and schedules
the time and the place. Mr. Flynn stated that if, we received a request from Mr. Ter-
putac, then we would look for another place.
In conjunction with the hearings, Mr. Jones stated that he has a prepared statement to
be read at the hearings. Mr. Jones also stated that every person who called in during
the emergency situation would be notified of the PUC hearings; and stated that he thought
a larger place would be needed.

Mr. Flynn stated that this will be followed through with and that we would get in touch
with Mr. Terputac.
Chief Clerk then read a letter dated January 16, 1975, from the Borough of
Burgettstown, requesting that their County Aid application for $1, 400.00 be carried over
because they were unable to get the work done. Said letter stated that their contractor
could not work it into their schedule, and therefore they requested that it be carried over
to 1975.

Care Facility. Said letter enclosed to E nglehardt -Power two (2) prints of Drawing SP-1
showing the subject site location including the boundary description. Said letter also asked
that Englehardt =Power review this Drawing and if enough data is "shown, establish station
point 0+00 for the new access road onto the site and also establish a tangent line in order
that the 90 degree angle can be determined.
Chief Clerk stated that he talked with Mr. Snitger of Wallover & Mitchell and he stated
that E nglehardt -Power believes that the could establish this from the present drawings and
if so, the cost would be approximately $100; but in the event that they would have to get a
field survey on it, it would probably cost approximately $500. Chief Clerk stated that
Mr. Snitger will inform him of the progress made.

Chief Clerk then stated, that at the request of Mr. Piganell of the Manpower
(Office, Mr. Flynn ,prepared a letter to Congressman Morgan calling his attention to the
I current unemployment factor in Washington County; and, in effect, asked Congressman
Morgan to intercede with the federal government to increase the available monies for the
employment of our unemployed citizens.
Remarks:
Mr. Flynn then stated for the benefit of the news media that when the unfortunate contri-
buting factors of the federal government, Department of Labor, used under this Manpower
Program, Emergency Title 6, they used the statistics they had for the months of September,
October, and November; and based on these statistics, this is how they allocate this money.
Mr. Flynn then stated that at the last meeting, the request for the number of positions for
the municipalities and non-profit organizations, we received requests from, amounted to
$1, 600, 000'and involved about 260 positions, whereby we are only allocator, $560, 000 and
can only fund about 84 positions. Mr. Flynn then stated that Mr. Piganell called him
and stated that he received word from the Philadelphia office of the Manpower Commission,
that the $560, 000 possibly may not be allocated.
Chief Clerk then read a telegram from Congressman Morgan announcing that
the Borough of McDonald has qualified for enrollment in the Department of HUD's
"National Flood Insurance" Program.
Chief Clerk then informed the Board of notification dated January 17, 1975,
from the Pennsylvania Public Utility Commission in regards to Cecil Wastewater Treatme
Company's application for right to begin to offer, render, furnish or supply sanitary sew
collection and disposal 'service to the public in a portion of Cecil Township, Washington
County. Said correspondence advised the Commissioners that the Commission may consi
the above application without hearing, provided no protests are filed with the Commission
on or before February 14, 1975.

East of the subject property to deposit excess fill materials ( i.e., Proudfit Property).
Said letter also stated that Mr. Whalen reviewed their request with the Commissioners and
reported to Mr. Snitger by phone that it is the Commissioners' desire to upgrade the
specified property owned by the Washington Industrial Development Corporation as specified
in the Addendum No. 1.
Remarks:
r. Jones: Well, it was part of the contract where the fill was supposed to go, wasn't it,
Mr. Whalen: Yes, it was one of the specifics in the bid where the dirt would be dumped;
and that was at the specific request of the Industrial Development Corporation.
Mr. Whalen then stated that in his discussions with Mr. Snitger, he told him that he felt
that if it wasn't what the Board wanted, it wouldn't have been put in the gcAtions.

Mr. Whalen then stated that he had asked Mr. Snitger if they had indicated any difference
in the cost, and they said there would be no difference in cost.
Chief Clerk then stated that we have had considerable correspondence with the
Farview State Hospital over their statement that we owed them $1, 078. 80, dated back to
1967. Chief Clerk stated that this has been under considerable study for quite some time; 1
and Mr. Fetcko was finally able to resolve it as far as the records are concerned, after
he had received some additional data from the Commonwealth's accounting office. Mr. Wh:
then stated that Mr:---Fetcko believes that everything is substantiated, and after reviewing
it with Mr. Fetcko, Mr. Whalen stated that it is their recommendation that the bill for
the sum of $1, 078. 80 to Farview State Hospital be paid. Mr. Whalen stated that this
involves four different people.
Remarks:
Mr. Flynn stated that he thinks it would be wise to make it known to everyone what this
involves. Mr. Whalen stated that this goes back seven (7) years.
Moved by Mr. Jones, seconded by Mr. Paluso, that the bill in the amount of
$1, 078. 80 to Farview State Hospital be paid upon the recommendation of the Chief Clerk
and Mr. Fetcko.

September 20 and 21, 1975.

Chief Clerk then reported on a matter regarding Magistrate Mavrich's request
for additional space, and stated that last week, he and Court Administrator Posner
inspected the office facilities occupied by Mr. Mavrich. Chief Clerk stated that the origi-
nal space was adequate at the time of leasing since there was only one secretary; however,
since this is the busiest magistrate's office in the County system, the secretarial staff
has increased to three, and therefore, the space is inadequate at this time. Chief Clerk
then stated that there is an additional room adjacent to the office available at this time,
and amending the present lease to include this additional space would alleviate their pro
Chief Clerk also stated that he discussed the matter of rental with the landlord, Mr. Mar
and he informed him that his basis for renting in that building is $100 per month per room,
Mr. Whalen stated that this does seem true because they have three (3) rooms there now
and the rent is $300. In trying to drive a bargain with Mr. Markosky, Mr. Whalen stated
that they talked from $50 up, and Mr. Markosky told Mr. Whalen that the lowest he would
accept for the room would be an additional $80 per month.
Moved by Mr. Jones, seconded by Mr. Paluso, that Magistrate Mavrich be
provided additional space for an additional $80 per month for the remainder of 1975, effect-
ive February 1, 1975.
Remarks:
Mr. Flynn stated that the Commission appointed by the Presidert Judge, '_madam-- a study of
the operations and administrations of the office, etc., and Judge Sweet suggested that once
the Commissioners have the opportunity to peruse the report, he would like any comments
or constructive criticism as far as the operations are concerned. Mr. Flynn stated that o
area that was pointed out in the report was the leasing of properties, and stated that he
thinks that this is one area in,which we should be given more latitude when it comes to
trying to lease property, because originally, from the very inception of the magisterial
concept, in accordance with'the Constitution, we are restricted in the areas where we can
rent. Mr. Flynn meant that we were given a directive by the Court, which he has on
file, to locate in a certain given area, and this is what we did. The report stated that
there are people in government that lease property to the government, and the rates that
were established were in conformity with the rates that prevailed in the respective areas
at that time. Mr. Flynn stated that he thinks this is one area we should get into; he
doesn't think we should be bound by where we locate. Mr. Flynn stated that he is going
to recommend that we be given more latitude in this matter. Mr. Flynn then noted for
the record that this lease is only temporary, because all leases do expire with the tenure
of the incumbent magistrate's term of office, and new leases will have to be re -negotiated.

Chief Clerk then read a memorandum dated January 9, 1975, from Timothy R.
Harrison, which enclosed for the use of the Commissioners Office, a copy of the Group
Home Study completed by Mr. David E. Smith for the Juvenile Court. Said letter also
stated that Judge Simmons, Mr. Smith and Mr. Harrison would like to request a meeting
with the Commissioners at the earliest possible time so that the study may be formally
presented to the Commissioners and discussed.

Chief Clerk then read a memorandum dated January 22, 1975, from Controller
Mascara requesting that the Board of County Commissioners exonerate Malcolm L. Morga
County Treasurer, from any additional responsibility in connection with the 1973 Real Est
Tax Duplicate. Said memo stated that all uncollected taxes are accounted for in the attac
schedule of liens for personal and real property.
Remarks:
Mr. Flynn stated that this is a routine procedure.

exonerate Treasurer Morgan from any additional responsibility in connection with the 1973
Real Estate Tax Duplicate.

Chief Clerk then read a letter dated January 17, 1975, from the Department of
Environmental Resources addressed to Mr. Flynn, in reference to Washington County's
recent request for the financial participation of the DER in the Cross Creek Watershed
Protection Project. Said letter stated that they have reviewed this matter and have
determined that it will be possible for the Department to cost -share in the construction
of Site PA-661 in
the
amount of 35%
of the total construction cost
at
Site PA-661 to the
maximum amount
of
$350, 000. 00; but
in order for the Department
to
consider participation
in this project, it will be necessary for Washington County to adopt a resolution request
their financial aid.
Remarks:
Mr. Flynn stated that this is a result of the series of meetings that were held with rep-
resentatives of Dr. Goddard's office and the Soil Conservation representatives, asking th,
tia help us to secure additional funds to help us to underwrite the cost of the project.

purchase,

Remarks:
Mr. Paluso asked Mr. Gilmore if he had a copy of the agreement between the County of
Washington and the :industrial Development Corporation that spells out exactly what
Mr. Flynn referred to. Mr. Paluso stated that we should have this in writing, and prior
,to advancing the funds, he thinks that Mr. Gilmore should have the agreement.
Mr. Flynn then stated for the record, that we agreed to advance -the money; and that the
banking institutions, in the event that something would happen, agreed to underwrite it.
Mr. Paluso also stated that they also agreed, that if it is necessary in order to repay the
funds to the County, they would conduct a fund-raising drive.
Mr. Flynn stated that the money will be made available with the proviso that we have all
the needed stipulations as a memo of understanding.
