Washington, Pa., March 6, 1975
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Jones, Paluso and Flynn. Also being present:
Chief Clerk and County Administrator Whalen; Administrative Assistant Fetcko; Solicitor Bigi
Controller Mascara; Deputy Controller Daniels; Keery McAmbley of Industrial Development;
Dale Clapsaddle of Peters Township School District; John Drake of the Washington Area Senior
Citizens Center; Jay Mitchell of WJPA; Jerry Kolanic of WWVA; Dave Baker of The Daily
Notes; Earl Bugaile of WKEG; and Bob Robertson of the Observer -Reporter.
Meeting called to order by Chairman and roll call taken:
Mr. Jones - Present: Mr. Paluso - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions or omissions to
Minute No. 155 and 156, each member having received a copy.
Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 155 and 156 be
approved as read.

Report: Mr. Jones - Civil Defense
Mr. Jones gave a brief report concerning several meetings and discussions held
between Civil Defense, West Penn Power, Bell Telephone and several municipalities to try
and establish a plan wherby we could be prepared for any disaster or emergency situation.
Mr. Jones stated that Civil Defense is trying to make available emergency equipment such as
pumps, generators, etc. in case of an emergency. He further stated that it was difficult to
get people involved, but the more people involved the better off we would be in handling
these emergency situations.
Old Business: Mr. Keery McAmbley - Railroad Re -organization Act
Mr. Keery McAmbley, Executive Director of the Washington County Industrial
Development Authority this morning made a special presentation to the Board concerning
developments and activities of the Railroad Re -organization plan recently released. Mr.
McAmbley explained that several specific sections of rail services in Washington County have
been scheduled on a preliminary basis for abandonment under this plan. The Industrial
Development Authority has studied this section in depth and has been in contact with the
Federal agencies concerned in addition to attending hearings on this matter. He went on to
explain that the Industrial Development Authority has been successful in having several of

these sections of track in Washington County reconsidered. A final hearing has been schedule
for March 18 at which time the Industrial Development Authority will attempt to present their
findings concerning the need we have for the remaining sections scheduled for abandonment.
Mr. McAmbley stressed the serious economic implications of the proposed abandonment in
Washington County and stated that his office will strive to have as many lines maintained as
possible.
Remarks:
Mr. Flynn thanked Mr. McAmbley for his informative report and stated that the Board might
call upon him again to make another report on the results of the hearing on March 18, 1975.

Remarks:
Mr. Whalen informed the Board of the current situation on investments and stated that one
of the major New York banks announced yesterday that they were reducing the prime rate
from 8 1/4% to 7 3 /4% effective today. Mr. Whalen further stated that our current rate of
investments on certificates of deposit is between 6 and 6 1/8%, and that six months ago our
current rate was 11 3 /4 to 121o. Mr. Whalen called the Board's attention to the fact that the
money market has drastically changed in the last six months.

Chief Clerk presented to the Board for their consideration an application for
expenditure of liquid tax fuel funds, as a supplemental request in the amount of $15, 000. 00 in
connection with the Jefferson Avenue Bridge in the Borough of Canonsburg. Mr. Whalen stated
that this would be supplemental to the original appropriations. Mr. Whalen alsd-presented
a request for expenditure for liquid fuel tax allocations in the amount of $11, 000. 00 to cover the
cost of removing a wooden covered bridge from its present location and transport it to Mingo
Creek County Park. (Ebenezer Bridge) -
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the
two (2) applications for expenditure of liquid tax fuel funds in the amount of $15, 000. 00 and
$11, 000. 00 as per above.

Chief Clerk informed the Board of a letter dated February 28, 1975 from
the Comprehensive Health Planning Association of Western Pennsylvania,. Inc. requesting the
Board of County Commissioners to enact a resolution acknowledging and approving the action
of the Emergency Medical Services Institute in making application for Federal funds in behalf
of all EMS agencies. A sample copy of the resolution was attached to the letter, and Mr.
Whalen recommended that the Solicitors review this and have it prepared for consideration at
the next meeting.
Chief Clerk informed the Board of a letter dated February 22, 1975 from
Hopewell Township Supervisors regarding centralized enforcement of Act 537. Mr. Whalen
then read the entire letter to the Board:
Act 537 permitted the municipalities of the state to hire a sanitation officer
to enforce their regulations. In the past Hopewell Township, in concert with four other
townships issued sanitation permits at a charge to the land owner of $25. 00. Our
sanitation officer inspected the site for a septic sewage system, laid out a plan for the
system and performed perculation tests to see if the soils were acceptable to such a
system. His remuneration for this service consisted of $26. 00 he charged the land
owner f or the perculation test and the $25. 00 permit charge which the township
channelled to him.
Under amendment 208 to act 537 we are required to hire a Certified
Enforcement Sanitation Officer (C. E. S. O. ). Most townships of the second class do
not have such an officer and no permits can be processed without one. The officer we
hired in the past suggests a flat fee of $75. 00 per permit, plus mileage and expenses.
One can readily see that at this rate if a C. E. S. O. processed z00 permits he would
be earning $7, 500. 00 and this would constitute monies for full time employment.
If the County Commissioners were to hire enough C. E. S. O. 's for the
County or those municipalities which wish to participate in such a plan it would

provide full time employment for several persons. Allegheny County provides this
service county wide and it might be helpful to explore their implementation of the
program.
I'm sure this -could be worked out so it would not be an added expense to
the County. If any expense is involved, 50% is retrievable from D. E. R.
These thoughts are strictly my own, I have not discussed them with our
board or the county association and present them to you for your consideration from
the standpoint of full time employment for several people and a centralized enforce-
ment program.
The Washington County Township Supervisors Association is going to meet
on March 7, 1975. Sewage enforcement is on the agenda and D. E. R. will be
represented. If the Commissioners are interested perhaps they could plan to attend.

Remarks:
Mr. Flynn: I can appreciate the gentlemen's concern by suggesting that the County take over,
but this relates to the Sewage Facility Act which is strickly a local political subdivision' s
responsibility. We cannot be compared to Allegheny County which is a second class county -
they have a Department of Health and everything, and we don't. With 66 political subdivisions
in Washington County, if we were to create a department just to approve sanitary sewage permi
in any given locality, it would be impossible.
Mr. Jones: They are having a township supervisors meeting tomorrow night, and they are
going to discuss this matter with some D. E. R. people from- Harrisburg.

Chief Clerk read a letter dated February 18, 1975 from Penn Central Transporta-
tion Company and directed to Clay Graham, Land Acquisition Agent regarding Chartiers Creek
Flood Control Project. Said letter gave authorization to enter upon the property of the
Penn Central Transportation Company located in the Borough of Canonsburg and the Borough of
Houston, Washington, Pa., on those parcels which Mr. Graham had designated as Parcels 103,
142, 152 and 154, on the plans and descriptions previously furnished by Penn Central. Said
letter listed six (6) conditions to this authorization, and Mr. Whalen stated that conditions a, b,
c, d, and e were standard conditions of such a contract. Mr. Whalen then read condition f,
which stated that the employees, of Penn Central Transportation Company would recommend to
the Trustees of Pittsburgh, Baltimore and Washington Railroad Company and Penn Central
Transportation Company to convey a perpetual easement to the County of Washington to complete
the flood control project as covered in construction drawings previously submitted at a net
price of $26, 856. 00 to our Company, payable in cash upon delivery of said easement. In the
event our management, trustees and/or Reorganization Court fails to approve the consideration
for said easement, the value shall be determined by condemnation proceedings.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Chairman of the Board
of County Commissioners be authorized to accept the conditions as stated above by the Penn
Central Transportation Company.

Chief Clerk referred to a meeting held on January 13, 1975 with the Foster
Parents Association in which they raised numerous questions concerning their legal position
as far as being a foster parent is concerned. Mr. Whalen stated that we had received a
summary of this meeting and it has been recommended that this matter be referred to the
County Solicitors for a determination of their legal position and following the Solicitors legal
opinion another meeting be arranged with the Foster Parents Association.
Chief Clerk informed the Board of a proclamation for the national observance
of Weights and Measures Week on March 1 through March 7, 1975. Mr. Whalen recommended
that the Board adopt the Weights and Measures Week Proclamation.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board adopt the
Weights and Measures Week Proclamation as per above.

Chief Clerk read a letter dated February 21, 1975 from Eugene Tenaglia, Bridge
Engineer regarding the Department of Liquid Fuels Work Schedule for 1975. Said schedule
listed the work which will be performed during the winter, early spring, summer and fall
months. Also listed were the materials to be used for these projects and the approximate curt
of each.
Chief Clerk informed the Board of two (2) letters dated February 24, 1975
directed to the Corps of Engineers - Pittsburgh District, from Eugene Tenaglia, Bridge
Engineer, regarding the flood control maintenance of the Chartiers Creek Flood Protection
Project, Canonsburg -Houston Reach, Unit 1, and the Burgett stown-Slovan Channel Improve-
ment Project. Mr. Whalen states that these letters have been acknowledged and the Corps of
Engineers have been informed that as soon as the money becomes available, the County will
enter into the maintenance of these two projects.
In connection with our Utilization Review procedures at the two County Homes,
Mr. Whalen announced that there will be a seminar held on March 18, 1975 pertaining to new
regulations. Mr. Whalen stated that it has been recommended that seven members of our
medical and administrative staff be given permission to attend this seminar at the Holiday Inn
in Greehtree, for a registration fee of $ 7. 00 per person.

attendance of seven members of the medical and administrative staff at the Utilization Review
seminar on March 18, 1975 as per above.

Chief Clerk informed the Board of a letter dated February 25, 1975 from Louise
Abel, Public Welfare Administrator III, Child Welfare Services, requesting the Mr. James
Henry and herself be given permission to attend a one. week WorkShop - Foster Parent Skills
Training Program from March 17 through March 21, 1975 at the Penn State Campus. Said
WorkShop is being conducted by the Penn State University and the project is funded through the
Department of Public Welfare for all of Penn State's expenses in connection with the WorkShop
Said letter stated that each agency participating is expected to provide the participants with
expenses for food, lodging and travel. Mr. Whalen stated that this is a part of Miss Abel's
1975 budget, and he recommended that this request be approved.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the
attendance of Mr. James Henry and Miss Louise Abel at the WorkShop from March 17 through
March 21, 1975 as per above.

Chief Clerk announced that the Commissioners had received an invitation from
the Washington County Emergency Medical Services Council to attend their 1st Annual EMT
Certification Dinner to be held on March 15, 1975, 7:30 p, m, at the V.F. W. Post 191 in
Canonsburg, Pa.
Chief Clerk read a letter dated February 28, 1975 from Gerald F. Radke,
Regional Commissioner of Social and Medical Programs, Department of Public Welfare,
regarding the Washington County Juvenile Detention Home. Said letter read as follows:
Dear Commissioner Flynn:
During the Department of Public Welfare evaluation of the Washington County
Detention Home which was completed in September of 1974, it became apparent
that a number of children were regularly being confined to the Washington County
Juvenile Detention Home in violation of DPW regulations and the Public Welfare
Code. Specifically, this includes both alleged and adjudicated deprived youth
and adjudicated delinquent youth.
While I fully understand the problems you are encountering in terms of currently
available resources, I am obligated to inform you that placing of the above -
mentioned categories of youth in the Washington County Juvenile Detention Home
constitutes a clear violation of DPW Title 6400 Regulations -Section 6401 -
Paragraph "A" and the Juvenile Court Act (Act 333 of 1972) - Section 14 - Para-
graph 4 - Subparagraph "d".
In accordance with Sections 901, 902, and 911 of Article IX of the Public Welfare
Code, Act 21 of June 13, 1967, I am obligated, as a representative of the Depart-
ment of Public Welfare, to enforce the above -mentioned regulations. In that
regard, I am notifying you to immediately cease the admission of alleged/
adjudicated deprived and/or adjudicated delinquent youth into the facility in
question.
If the noted violations continue, a request Will be made to the General Counsel
of the Department of Public Welfare for further action.

do with the sentenctagof children or youth of these institutions. Our responsibility is to provide
a home for them, services etc. I would suggest that you notify the gentlemen that we are not
the judicial branch of government, and send a copy of this letter to Judge Simmons and the rest
of the Court.
Mr. Paluso: I suggest that we also send a copy to Greene County.
Mr. Jones: Mr. Paluso and I had quite a discussion with the gentlemen representing the state
concerning this. We informed him that we do not designate what they are or who they are.
These are people who have to be taken care of whether juvenile or in need of a place to stay.
Chief Clerk informed the Board that the annual report of expenditures for
Child Welfare services for 1974 had been received. Mr. Whalen stated that this report had
been prepared and certified by Miss Louise Abel, and requires approval of the Board of
Commissioners for approval.

annual financial report prepared by Miss Abel for Child Welfare services in 1974 as per above.

Chief Clerk read a letter dated February 26, 1975 from Reverend Hugh J. Lang,
Headmaster of the Monongahela Valley Catholic High School giving general recommendation
for all the senior business students at the High School. Said letter stated they would appreciate
any consideration extended to them toward the hiring of secretarial help. Letter also stated
that the girls are presently capable of the achievement required of students graduating from
business school.
Remarks:
Mr. Flynn stated that we should acknowledge the gentlemen's letter and inform him that there
could be interest in these students because there have been times where we have had problems
in acquiring people who could handle ' the required skills.
In connection with the Emergency Health Services, Mr. Whalen informed the
Board of a letter dated February 25, 1975 from the Department of Transportation. Mr. Whalen
referred to our contract with State and Federal governments on the equipment for this operation
and stated that some time ago we made a request for some substitutions of equipment and this
er is to advise that the substitutions have been approved. Mr. Whalen- stated that this was
training equipment for Emergency Medical Services.
Chief Clerk read three (3) telegrams from Congressman Thomas E. Morgan.
id telegrams announced the following: February 28, 1975 - The Environmental Protections
gency has awarded a $69, 000 grant to the Vestaburg-New Hill Joint Authority. The grant is
rized by the "Federal Water Pollution Control Act Amendments of 1972" and will be used t
construct additions and modifications to the existing sewage treatment plant.
March 4, 1975 - The Dusmal House in Gastonville has been entered in the National Register of
Historic Places which is the official schedule of the Nation's Cultural Property.

March 6, 1975 - The approval by the Bureau of Mines, Department of the Interior, of a
contract award of $61, 030 to the Consolidation Coal Company, Lee Engineering Division,
McMurray, Pa. The funds will be used for an ignition suppression device.
Chief Clerk read a letter dated February 26, 1975 .from Clay Graham, Land
Acquisition Agent, requesting approval for a revision to be added to the recently approved
engineering study at the Cross Creek Watershed to be done by Engelhardt & Power engineers.
Mr. Graham stated that approval would be for additional engineering relative to altering
LR 62035 within the confines of Site 662. Mr. Graham further stated that this was not
originally scheduled in the contract in the hope that abandonment of some or all of this road
would be done, but it has become apparent that abandonment may not be feasible and that
alterations to said road must be followed. Mr. Whalen recommended that Mr. Graham be
directed to get some cost estimate and an amendment be granted to the original contract to
cover the additional cost.
Remarks:
Mr. Paluso: I think Mr. Whalen is right. We should get some estimate of cost before we
give the go ahead.
Moved by Mr. Paluso, seconded by Mr. Jones, that the Board go on record
requesting Mr. Clay Graham to secure a cost estimate prior to any approval of additional
engineering as per above.

Chief Clerk read a letter dated March 3, 1975 from the Department of
Environmental Resources regarding Flood Control District No. 60. Said letter enclosed a
copy of the document for the "Establishment of Flood Control District No. 60 and Adoption of
Official Plans' for Cross Creek executed by Secretary Goddard on February 24, 1975. Said
letter stated that funds can now be allocated to this project to the extent of their agreed upon
participation which will be 35% of the total construction cost at Site PA -661 to the maximum
amount of $350, 000. Said letter also stated that the Soil Conservation Service is planning to
advertise for bids on the construction of PA-661 in April, 1976, and suggested that Washington
County make every effort to acquire all necessary land rights before the Soil Conservation
Service advertises for bids.
Remarks:
Mr. Flynn stated that this was very encouraging because this is the result of several meetings
conducted locally with the representatives of the Soil Conservation Service and several
meetings conducted in Harrisburg with �Dr. Goddard. He further stated that Dr. Goddard
will submit to the legislature for the next fiscal year the sum of $350, 000 as a grant to
Washington County. Mr. Flynn added that we should commend Mr. Graham on the fine job
he has done in accomplishing these results. Mr. Flynn suggested that all files pertaining
to this be recorded with Mr. Graham so he can establish a central file.

Chief Clerk informed the Board of an invitation received from the Office of
The Governor to attend the First Annual Conference of the Pennsylvania Intergovernmental
Council. Said invitation stated that this council serves as a landmark in the Commonwealth's
history by providing an organization whereby Federal, State, and Local Government Leaders
can work together to promote common goals and to solve common differences. Mr. Whalen
stated that this will be held at the Hershey Convention Center on April 23 and 24, 1975.
Remarks:
Mr. Flynn stated that this matter requires no formal action, but those who are available and
if they so desire, it is their privilege to attend.

Chief Clerk then read the following Notice to Candidates:
To candidates who filed nomination petitions for the County, Cities,
Boroughs and Township offices, with the County Board of Elections, of Washington
County, Pennsylvania, for the Municipal Primary, to be held on May 20, 1975.
In accordance with the provisions of the Pennsylvania Election Code, you
are hereby notified that the County Board of Elections of Washington County has
fixed Wednesday, March 19, 1975, as the day for casting lots to determine the
position --of names on the Primary Ballot. Lots will be cast in the Bureau of
Elections, Courthouse, Washington, Pennsylvania, at 10:00 o'clock a. m.
PREVAILING TIME, on the above date.
Candidates may appear in person or by agent duly authorized by letter
of attorney signed and acknowledged by an officer empowered to take acknow-
ledgements. If any candidate 'is notpresent, it shall be the duty of the County
Board of Elections to appoint some person to represent such absentee.
COUNTY BOARD OF ELECTIONS
Chief Clerk informed the Board of a request from Robert Criquellion,
Committeeman, Mt. Pleasant Twp. #3 that a registration date be held on or about April 1, 1975
in the Westland Miners Hall in Mt. Pleasant Township, Third Precinct, or any other date
that would fit in to our registration schedule.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the
Notice to Candidates and all matters pertaining to the forth coming election.

Moved by Mr. Jones, seconded by Mr. Paluso, authorizing to advertise for
bids for : (a) for the printing and delivering to the Election Department of the County
Commissioners the necessary ballots required for the Municipal Primary to be held on
Tuesday, May 20, 1975; (b) for printing and deliverling to the Election Department of the
County Commissioners the necessary election supplies required for the conduct of the
Municipal Primary to be held on Tuesday, May 20, 1975; and (c) the delivering of the ballot
boxes with election supplies to the Judges of Elections for approximately two hundred four
precincts required for the conduct of the Municipal Primary to be held on Tuesday, May 20,
1975; said bids to be received in the Office of the County Controller until 11:00 a. m. , Local
Prevailing Time, Thursday, , 1975, action subject to the approval of the
Solicitors until such time that the Solicitors have gone over the bids and the bids are ready
to be advertised.

Chief Clerk to advertise for bids for the removal of a covered bridge known as the Ebenezer
Bridge #9, located in Fallowfield Township to Mingo Creek County Park. Said bids to be
received in the office of the County Controller until 11:00 a. m. , Local Prevailing Time,

, 1975, and opened immediately thereafter in the office of the

Chairman stated that the next item of discussion concerns the request from the
Mon Valley Health and Welfare Council for thirteen (13) positions, which has been contemplates
for some time. Discussion also includes 20 postions for the County Parks and the emergency
meeting held on March 5, 1975 at which time it was recommended to try to get monies availabl
for 2 addtional slots for Deputy Sheriffs under the CETA - Manpower Program. Mr. Flynn
reported that a point was raised at the Prison Board Meeting as to whether or not it was
legally required to take prisoners from the Jail to the hospital and referred to the one situation
in which one prisoner escaped from the hospital. Mr. Flynn stated that the Jail Guards do
not have the do not have the power, authority and are not allowed to carry fire arms, and
therefore 2 additional slots for Deputy Sherrifs were requested. Mr. Flynn then suggested
that Mr. Whalen read the letter dated March 6, 1975 from the Mon Valley Health & Welfare
Council, Inc. which requested the Board's consideration for 13 positions to allow many of the

county sponsored aging projects under the administration of Mr. Metro Petrosky, to more
efficiently and effectively broaden their efforts to assure the accessibility of services to all
the aging throughout the county.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board go on record
authorizing the requested thirteen (13) positions by the Mon Valley Health & Welfare Council,
Inc.; the twenty (20) positions for the County Parks; and the two (2) positions for Deputy
Sheriff. All positions to be handled through the CETA-Manpower Program.

Solicitor Bigi presented to the Board a Manpower Agreement whereby the
Washington County Commissioners are prime sponsors under the CETA Program and is in
connection with the Canonsburg General Hospital for a Nurses Aid Training Program. Mr.
Bigi stated that similar agreements have been executed in the past and recommended that the
Board authorize this agreement.
Moved by Mr. Paluso, seconded by Mr. Jones, that the Board authorize
and execute the Manpower Agreement with the Canonsburg General Hospital as per above.

Remarks:
Regarding this agreement, Mr. Jones asked if a vehicle had been included in this training
program. Mr. Jones stated that he thought this was very important as they were having
problems with transportation not only with the Senior Citizens Centers, but everyone in
Washington County.
Mr. Flynn stated that this was the overall contract and did not go into different categories.
He also stated that Mr. Jones raised a very good point, because they had discussed the
transportation situation.
Solicitor Bigi presented a Lease between the Washington Trades & Labor
Building, Inc., Lessor, and the Washington County O. E. D. P. Mr. Bigi stated that the
terms and conditions in the lease are the same with the exception that the monthly rental
had been raised from $150. 00 to $175. 00, and he recommended that the Board execute the
lease if the rental is satisfactory.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute the
Lease between the Washington Trades & Labor Building, Inc. and Washington County'O. E. D.
as per above.

Solicitor Bigi informed the Board that Ram Construction Company has executed
an agreement with Nancy McCarrell Proudfit and James R. Proudfit, her husband and
Elizabeth McCarrell Crumrine and Clarence Acklin Crumrine, her husband, in regard to
the site preparation and ditsposing of excess fill materials. Mr. Bigi stated that a letter was
sent to Mr. Whalen concerning this and notifying the Board of the agreement entered into.
Solicitor Bigi presented to the Board an agreement between Toner Institute and
Washington County. Mr. Bigi stated this agreement involves wards of the County who will be
placed with the Toner Institute and we are to pay the Institute $22. 00 per day for services for
each ward. Mr. Bigi also stated that this agreement has been signed by Reverend Kevin
Miller, Executive Director of the Toner Institute and recommended that the Board of
Commissioners execute this agreement.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve and
execute the agreement with Toner Institute as presented by Solicitor Bigi.

Solicitor Bigi announced his resignation as County Solicitor effective March 7,
1975 in a letter to the Board of County Commissioners dated February 27, 1975. Mr. Bigi
stated in his letter that it would be impossible for him to continue as County Solicitor,
campaign for District Attorney and operate a private practice, and thanked the Board for
affording him the opprotunity to serve them and the public. Mr. Flynn then read his reply
to Mr. Bigi's resignation dated February 26, 1975 expressing his appreciation for Mr. Bigi's
performance of duties as County Solicitor, and wished Mr. Bigi every success in his future
endeavors. Mr. Jones also expressed his feelings and wished Mr. Bigi good luck in the
future.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board accept Solicitor
Bigi's resignation effective March 7, 1975.

Mr. Whalen referred to a news item in the Observer Reporter dated March 6,
1975 relative to flood control costs. Mr. Whalen pointed out that the figures quoted in the
news release cover the entire reach of the flood control project in Allegheny County, Pittsbur
to Houston, and that this is not the isolated cost for the Canonsburg -Houston reach of this
project.
