The Board of County Commissioners met in regular session with the following mem-
bers being present: Commissioners Jones, Paluso and Flynn. Also being present: Chief Cler
and County Administrator Whalen; Administrative Assistant Fetcko; Solicitor Gilmore; Deputy
Controller Daniels; Land Acquisition Agent Clay Graham; John Stevens from the Observer -
Reporter; Dave Baker of The Daily Notes; Jay Mitchell of WJPA; Mrs. Miller of The League of
Women Voters; and Mr. John W. Cadez of Engelhardt -Power & Associates.
Meeting called to order and roll call taken:

Chairman asked if there were any corrections, additions or omissions to Minute No. 15 ,
each member having received a copy.

Old Business:
Chief Clerk reported to the Board that concerning the request from the Bicentennial
Planning, Inc., of Southwestern Pennsylvania, for the submission of three names to serve on
the thematic committees, Mrs. Lane advised him that the following persons were appointed by
the Bicentennial Commission to serve on the respective committees:

Mr. Whalen then read a copy of a letter dated March 19, 1975, from William P. Sem-
ber directed to Mr. A. E. Molinski, P. E. , of the Department of Environmental Resources
concerning Project No. SL-142- 2, Catsburg Mine Drainage Facility, City of Monongahela,
Washington County. Enclosed with said letter to Mr. Molinski was a fully executed deed which
verifies that the real estate needed to construct a mine drainage facility is now in public owne
ship and also a fully executed Reciprocal Right -of -Way Agreement between the City of Monon-
gahela and the Fritch family. This agreement grants the Pennsylvania Department of Environ-
mental Resources a sixteen (16) foot right-of-way to the proposed treatment facility and a

Mr. Whalen brought to the Board's attention the following additional invoice:
Bruno Plumbing & Heating Company - Repairs to the
Sanitary Pump Station at the Arden Site - $716. 57
Mr. Whalen stated that upon approval and payment of this bill, we will be billing Superior Val
for 50% of this cost. Mr. Flynn stated that he was under the impression that sometime ago, a
meeting was to be arranged by Mr. Keery McAmbley with Superior Valve as to what is going to
be done with the lift pump and also the trunk line insofar as the sewage is concerned. Mr.

responded that Aspect -Four, Inc., is doing a study on that particular project but that the re-
port has not been received as of yet.
Moved by Mr. Jones, seconded by Mr. Paluso, approving the payment of the foregoing
bill to Bruno Plumbing & Heating Company, with the provision that Superior Valve will be bille
for 50% of the cost.

Mr. Whalen advised the Board of two tax items which were not included in the original
billings for 1974. Mrs. Mary J. Koraido did not receive her tax notice until after September
of 1974, which was in the penalty period. The Tax Assessment Office has researched this and
the matter was corrected. Mr. Whalen recommended that the Board accept the payment at the
discount rate.
Moved by Mr. Jones, seconded by Mr. Paluso, accepting the payment of the above tax
notice as per above.

Motion carried unanimously.
Mr. Whalen then advised the Board that in 1971 Mr. Lewis W. Morgan sold two lots
which were not taken from the tax rolls and, thus, paid the tax. The Tax Assessment Office
researched this matter and the amount involved is $3. 60. Mr. Whalen therefore recomme
that the Board approve this refund to Mr. Morgan.
Moved by Mr. Jones, seconded by Mr. Paluso, approving the above tax refund to
Mr. Morgan.

Mr. Whalen read a copy of a letter dated March 5, 1975, from Henrietta R. Buell
directed to Jacob Kassob in regards to Route 837, Washington County, Union Township,
Elrama, Pa. Ms. Buell stated in her letter that at the "crossroads, " there is practically no
road left -- due to the deterioration over the years and no practical or proper road mainten-
ance. Ms. Buell phoned PennDCT in Washington, Pa., complaining of the deteriorated condi-
tions and also phoned Senator Murphy's office, and nothing has been done to alleviate the situa-
tion.
Mr. Whalen was instructed to acknowledge said letter and to contact Mr. Felton of the Highwa
Department.

Mr. Whalen informed the Board of a special program seminar which has been
arranged for Monday, April 21, 1975, at the Host Inn in Harrisburg, Pa., for personnel who
will be involved in making assessments under the "Clean and Green Act. "
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing Mr. Gubanish, Chief
Assessor, and Solicitor Gilmore, if available, to attend said seminar as per above.

Moved by Mr. Jones, seconded by Mr. Paluso, authorizing attendance at the
following hearings and seminars:
a. William P. Sember to attend and present testimony at the
April 2, 1975, meeting of the State Transportation Commis-
sion in Harrisburg; also, to attend a meeting with PennDOT
to discuss the TOPICS Program on April 3, 1975.
b. Clay Graham to attend the Annual Right -of -Way Seminar at
Oglebay Park on April 2 and 3, 1975.
c. Director of Veterans Affairs to attend Training Seminar held
by the Veterans Services Division in Pittsburgh, Pa., on
April 17 and 18, 1975.
d. Mrs. Burns and Mrs. Proudfit to attend N. E. H. A. Seminar
in Pittsburgh, Pa., on April 11, 1975.
e. Representative of the County to attend a seminar on Energy
Management in Space Conditioning on April 23 & 24, 1975,
at the Washington Holiday Inn, sponsored by West Penn
Power Company.
Mr. Whalen noted that in some cases, the persons involved will be requesting an advance on
payment of expenses.

Mr. Whalen read a letter dated March 21, 1975, from William R. Kozy, P. E. of
Michael Baker, Jr., Inc., RE: New Jefferson Avenue Bridge - Columbia Gas Company,
Attachment of Gas Line. Said letter referred to a telephone conversation of March 21, 1975,
between Mr. Tenaglia and Mr. R. S. Capp of Michael Baker, Jr., Inc., whereby they were
advised that permission would be granted to Columbia Gas Company to occupy the subject struc1
ture with a six (6) inch gas pipeline located and attached in accordance with their drawing sub-
mitted to Michael Baker, Jr., Inc., by letter of February 26, 1975. Mr. Kozy recommended
that when the agreement is issued to Columbia Gas Company for this occupancy, that the Com-
missioners stipulate, in addition to their desired maintenance requirements, that the gas line b{
painted according to the painting specification used for the steel superstructure of this bridge

that any damage to the structure or painting of the structure during installation of this pipe -
be corrected by Columbia Gas Company to the Commissioners' satisfaction.

tion of Michael Baker, Jr. , Inc., as per above.

Mr. Whalen informed the Board of a memorandum dated February 26, 1975, from
Richard E. Horman, Ph. D. , Executive Director, Governor's Council on Drug and Alcohol Abusf
ch stated that the Governor's Council project approval system has been revised and updated
to incorporate changes in accordance with the few fiscal regulations (4 PA Code Ch. 273).
Mr. Whalen stated that he will set up a meeting with Mr. William Carl as soon as possible so
that the Board can work out requirements in order to comply with the regulations.
Mr. Whalen read letter dated March 13, 1975, from Dale V. Watson, Caseworker,
Child Welfare Services, stating that as a member of the U. S. Army Reserve assigned to the
630th Transportation Company, R. D. #6, Washington, Pa. , he is required to attend annual
training during the period of April 7 to April 18, 1975, and is therefore requesting a military
leave from the Child Welfare Services for that period of time.
Moved by Mr. Jones, seconded by Mr. Paluso, granting a military leave for Dale V.
Watson as per above.

Mr. Whalen reported that the County car which was involved in an accident has been
clared a total loss and that the insurance company has confirmed the settlement figure to be
, 830. 00 less $100. 00 deductible or $2, 730. 00. He therefore recommended that the Prod of
s form be executed and further recommended that the Board authorize the advertisement for
replacement of this car. Mr. Whalen pointed out that it would be better to bid for a 1974 car
d of a 1975 car because the 1975 models require unleaded gas, which would present a pro-
lem for us.

Mr. Whalen presented to the Board for their consideration and approval an invoice
the amount of $3, 000. 00 from Menego's Photographic Studio for photographic services in con-
nection with Mingo Park, Planning Commission, etc. The work dates back to 1971, but the
invoice was not submitted sooner due to severe illness of Mr. Menego.
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the payment of $3, 000. 00
to Menego's Photographic Studio as per above.

Mr. Whalen read a letter dated March 26, 1975, from Engelhardt -Power and
Associates regarding L. R. 62035 Relocation - Site 662 - Cross Creek Flood Control Project.
Said letter was a proposal for an extension of the existing Professional Services Agreement
dated February 18, 1975, for the above -mentioned site. Engelhardt -Power and Associates, Inc
recommended a Feasibility Study of the alternatives for relocation to be a part of said proposal,
(Clay Graham elaborated further on this matter. )
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute said proposal
as submitted by Engelhardt -Power and Associates, Inc., as per above.

New Business:
Mr. Whalen informed all those present that the Court House will be closed from
4:30 p. m. Thursday, March 27, 1975 until 9:00 a. m. Monday, March 31, 1975, in observance
of Good Friday.
Mr. Whalen recommended to the Board that they approve a budget for the Washington
County Grants & Gifts Escrow Account on the basis that the figures listed are anticipated be-
cause there is no available documentation for dollar value of the programs. Further discussior
was held. Mr. Whalen also pointed out that this budget will not relate to the County's net worth
(Mr. Whalen also referred to an excerpt from Minute No. 190, dated November 4, 1971. )
Moved by Mr. Paluso, seconded by Mr. Jones, adopting a budget for the Washington
County Grants & Gifts Escrow Account as per above and on the recommendation of Chief Clerk
Whalen.

County Solicitor Gilmore presented the following two (2) tax refunds to the Board for
their consideration and approval.
Moved by Mr. Paluso, seconded by Mr. Jones, that the Tax Assessment Office be
authorized to prepare the following tax refunds due to either duplication or overpayment of rea]
estate or personal property taxes:

(McDonald Associates)
In regard to a previous bill submitted to the Board from McDonald Associates,
Mr. Gilmore read the following opinion:
I have been asked to examine and render opinion on a request
for payment of $3, 250. 00 by McDonald Associates pursuant to the
agreement entered into between the County and the above named.
As we are all well aware, the contract calls for an initial
payment upon execution of the contract of $3, 250. 00, but that no
further payments be made unless and until federal and state funding
is secured. The prepayment of $3, 250. 00 is not a penalty or liquidated
damage clause. It is a payment in anticipation of the work that would
be necessary to make application for the funds above mentioned. It
would be my opinion, therefore, that even though the contract calls
for the payment in advance, and we did not do so, McDonald Associates
are not entitled to $3, 250. 00 except upon proof of work that they did in
preparation to file the application. If nothing was done rather than
execute the contract, I do not feel we should pay the same. If some
preliminary work was done, I think it is a valid claim and should be
honored.

Discussion was held; and the Board decided that in order to protect themselves, they should
have documentation from McDonald Associates that the work was done. Mr. Whalen stated
that he would get in touch with McDonald Associates and request them to submit this proof of
work.

11:00 a. m. - Opening of Bids for the Removal of the Ebenezer Bridge #9
Deputy Controller Daniels opened and read the following bid:

Bid bond in the amount of $2, 000. 00 with the Fireman's Insurance
Company of Newark, New Jersey, accompanied the bid.
Moved by Mr. Paluso, seconded by Mr. Jones, awarding the contract for the removal
of a covered bridge known as the Ebenezer Bridge #9 located in Fallowfield Township from its
present location to the Mingo Creek County Park to CRANE TRUCK SERVICE COMPANY for
the amount set forth in their bid; this being the lowest and only responsible bid and in accor
with specifications.
