Commissioners Jones, Paluso and Flynn. Also being present: Chief Clerk and County Administrator Whalen; Administrative Assistant Fetcko; County Solicit Gilmore; Beaver Perkins of Volunteers In Probation; Gregg Donolo of the Beaver Township High Schools; John Drake of the Washington Area Senior Citizens Center; Mrs. Helen Miller of the League of Women Voters; Jay Mitchell of WJPA Radio and Bob Robertson of the Observe�- Reporter. Meeting called to order and roll call vote taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions or omissions to Minute No. 167, each member having received a copy. as read. Old Business: PLRB CHef Clerk stated that at a previous meeting the Board of Commissioners went on record directing their labor consultant, John Felice & Associates to file an Exception to the Pennsylvania Labor Relations Board Order, and we have now been notified that oral argument on Exceptions is fixed for Wednesday, the eleventh day of June, 1975, at 11:80 a. m. , in Room 520 Labor and Industry Building, Seventh and Forster Streets, in Harrisburg, Pennsylvania. Chief Clerk read a letter dated May 15, 1975 from Michael George, Director of Parks and Recreation, regarding the expansion of the outdoor area at the Juvenile Detention MINUTE BOOK z?-Z BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R FLYNN. FRANK JONES. JR., EDWARD M. PALUSO, COMMISSIONERS Home, which entails relocation of 150' of existing fence and installation of 40' of new fence. N1r. George included in his letter an estimate of $916. 00 for this project which the Planning Commission -had provided him. Mr. George stated that he had considered performing the installation with his personnel, but that he had been informed that the labor cost would be considerably higher if the proper tools were not available, etc. Mr. George thought that the labor cost would almost double if they did the work, and it would take a considerable longer time to complete. Mr. George also stated that with the estimate he had received from the Planning Commission, he had contacted a local fence company which quoted a total cost of $ 913. 00. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the purchase of fence and installation at a total cost of $913. 00 for the expansion of the outdoor area at the Juvenile Detention Home as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk stated that the Manpower Office had found it necessary to purchase a duplicator with additional capacity. Mr. -Whalen informed the"Board that Manpower had the arrangements for this machine and the payment would come from Manpower funds. Mr. Whalen then presented a Service Agreement with Xerox for the Board's consideration. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute the Service Agrement with Xerox for the duplicator at the Manpower Office as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk informed the Board of an invoice dated May 20, 1975 received from the Mid -Monongahela Valley Council of Governments which covers the 1975-76 dues for the fifth year of the County's membership committment. Said invoice indicated the dues for our municipality as $3, 535. 00. Remarks: Mr. Jones suggested that this matter be held in abeyance until the Board had a chance to revi it. Moved by Mr. Jones, seconded by Mr. Flynn, that the Board goon record holding this matter in abeyance for further consideration. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - No; Mr. Flynn - Yes. Motion carried. Chief Clerk read a letter dated May 19, 1975 from Mchael R. Flynn, Chairman of the Sinking Fund Commission which reads as follows: MINUTE _■■ 423 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN. FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS 1 1 n In Compliance with the motion duly made and passed unanimously, the Sinking Fund Commission requests the Board of County Commissioners to loan to the Sinking Fund Commission from the General Fund the necessary monies to meet their current obligation on both the principle and interest obligation due on June 1, 1975. / s / Michael R. Flynn, Chairman Sinking Fund Commission Remarks: Mr. Paluso suggested that Mr. Flynn give a further elaboration on this matter for the benefit of the news media. Mr. Flynn: Beginning in June, under our $5, 000, 000. 00 Bond Issue, we owed to the Bank the sum of "x" number of dollars in principle and an "x" number of dollars in interest and this is due on the 1st of June. Therefore, as a result the Sinking Fund met last week and the Treasure, Mr. Morgan informed the Commission that the necessary money is not in the fund to pay the bank. Although we did make provisions in the budget for Sinking Fund purposes, we still do not have enough money.to meet our obligation as of June 1st. Mr. Paluso: There is a certain mill -age set aside each month from the taxes collected for that month to the Sinking Fund. As you know, this month and next month are the big tax collection months so that percentage each month has not made up the amount yet. Therefore, we are going to loan the money to the Sinking Fund and as that percentage is taken out each month, it will be immediately repaid to the General Fund. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the loan of necessary monies to the Sinking Fund from the General Fund in order to meet the current obligation on both the principle and interest due on June 1,1975 as per above. Roll call vote taken: Nfr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a letter dated May 15, 1975 directed to Mchael George of Parks and Recreation from Joseph Nicolella - of Raccoon Grade School. Mr. Nicolella and the sixth grade class at Raccoon Grade School expressed their appreciation to Martha Kulp and Thais Teppep for the very informative field trip which they took at Mingo Creek Park. Chief Clerk read a letter dated May 16, 1975 from Frank C. Carroll, Chairman of the Southwestern Pennsylvania Legal Aid Society. On behalf of the Board of Directors, the officers of the Corporation, and its employees and members, Mr. Carroll expressed their appreciation for all the courtesies shown them by the Washington County Commissioners and their staff over the past years. Chief Clerk then read another letter dated May 16, 1975 from Frank C. Carroll regarding the limited service to the poor by the Southwestern Pennsylvania Legal Aid Society. Mr. Carroll sited the reason for this limited service has been because of the fact that the budget had remained static from the time of its inception in 1967, but they were able to obtain additional funds from the state in 1974 through the Pennsylvania Legal Services Center and have expanded the program into Washington, Greene and Fayette counties. Mr. Carroll stated that one of the mandates of the monies is that funding must be obtained from local sources, and requested that the Board of Commissioners meet with them at some fu,-ture time to discuss the MINUTE BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS possibility of funding this important program. Remarks: Mr. Flynn stated that Mr. Carroll's letter should be acknowledged and a meeting arranged. Chief Clerk informed the Board of a request received from West Penn Power to install an anchor line on County property. Mr. Whalen stated that we had checked this with Mr. McAmbley, and he had informed us that there are no objections to the installation at their cost but advised that any agreement should contain a stipulation that if we would want the line removed at any future date, it should be removed at the expense of West Penn Power. Nbved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the request made by West Penn Power to install an anchor line on County property as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk reviewed a letter dated May 9, 1975 directed to Mr. James Blaze of the U. S. Railway Association from Mr. Keery McAmbley of the Washington County Industrial Development Agency. Mr. McAmbley called Mr. Blazers attention to the fact that he had been unable to determine if there are any substanial mineralogical reserves in Greene and Washington Counties which the Waynesburg to Houston right-of-way traverses. Mr. McAmbley mentioned that the U. S. Railway Association did not contact a single County or State agency that might have supplied them with this information. Mr. McAmbley also stated that he intended to ask our Congressman to further investigate this situation. Chief Clerk read a letter dated May 15, 1975 from Elliot Roger Knauer, Dire Division of Comprehensive Health Planning regarding the designation of Health Service Areas for Pennsylvania. Mr. Knauer expressed his appreciation, on behalf of everyone involved, for the recommendation and comments received from the Washington County Commissioners. Said letter also stated that a copy of the Commissioners letter had been forwarded for Federal review along with the Commonwealth Health Service Area Plan. (Earl Bugaile of WKEG entered the meeting.) Chief Clerk read a letter dated May 14, 1975 from the Pennsylvania Army National Guard, Headquarters 2d Brigade 28th Infantry Division regarding the need for help to upgrade the Armory. Said letter stated that in the past, there were four Nation Guard units in Washington County and now there are six, and therefore, they requested an additional of $3000 for the purpose of upgrading the Goodridge Armory and the other armories in the County of Washington. Said letter further expressed their appreciation for the $1, 500 which has been allocated to them in the past. Remarks: Mr. Flynn suggested that this matter be tabled until the Solicitor can investigate the legal aspects of this. PALUSO, COMMISSIONERS L 1 Chief Clerk read the following letter dated May 12, 1975 from James N. Wade, Secretary of Administration, Governor's Office, Harrisburg: Dear Mr. Flynn: The Public Employment Program (PEP), which is currently funded under the Emergency Employment Act (EEA) of 1971, is scheduled to be discontinued as of June 30, 1975. Presently, the Commonwealth has 351 participants funded under the program and working with various state agencies. General economic conditions affecting the Commonwealth budget prevent more than a very limited transition of these participants into the State work force. Consequently, we are faced with the possibility of having to involuntarily discharge hundreds of PEP participants on July 1, 1975. As you are probably aware, PEP participants are eligible for transfer to funding under the Comprehensive Employment and Training Act (CETA) without any intervening of unemployment. Many of our 351 PEP participants are residents of prime sponsors' jurisdiction, such as your own. To overcome the predicament of these PEP participants, we will need your cooperation in providing, if at all possible, for the transfer of PEP participants who are residents of your jurisdiction. A listing of these participants is provided as an attachment along with other participant information. State agencies have been notified with respect to this situation and are encouraged to contact prime sponsors in order to assist in transferring PEP participants. /s/ James N. Wade Remarks: It was suggested that this letter be forwarded to Mr. Piganell of the Manpower Office. Chief Clerk read a telegram received on May 19, 1975 from Congressman Thomas E. Morgan announcing that the Department of H. E. W. has awarded a $69, 650: 00 grant to California State College to provide training and technical assistance to Headstart personnel. Chief Clerk then read a letter dated May 16, 1975 from Congressman Thomas E. Morgan thanking Commissioner Flynn for a copy of his letter to Congressman Edward P. Boland, Chairman of the HUD -Space -Science -Veterans Appropriations, Subcommittee, which expressed support for the inclusion of Section 701 funds in the Fiscal Year 76 budget. Mr. Morgan stated that he has been a consistent supporters of community development legisla and intended to closely follow the deliberation of Chairman Boland's Subcommittee and to suppol t the funding for Section 701. Chief Clerk presented to the Board for their consideration two O. J. T. Contracts from the Office of Manpower Planning. Mr. Whalen stated that these two contracts were with the Washington Collision Service for Robert Blaze :as a Automobile Body Repairman and for John Krenzelak as a Automobile Mechanic. Mr. Whalen further stated that these contracts had been approved by the Bureau of Employment Security. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve and execute the two O. J. T. Contracts with the Washington Collision Service as per above. Chief Clerk stated that the Board had previously approved the financial participa tion in the Volunteers In Probation Program, and he now had the applications to -be executed by the Commissioners. Mr. Whalen stated that the applications would then go to=the Governor's Justice Commission. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute the necessary applications regarding participation in the Volunteers In Probation Program as per above. New Business: Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen informed all those present that the Court House will be closed from 4:30 p.m. Friday, May 23, 1975 until 9:00 a. m. Tuesday, May 27, 1975, in observance of Memorial Day. Mr. Whalen read the following Court Order regarding Impounding Ballot Boxes of Washington County in the Democrat Primary Election of May 20, 1975; AND NOW, this 21st day of May, 1975, the within Petition having been presented to the Court, upon consideration thereof, it is hereby ORDERED AND DECREED that all the ballot boxes used in the Primary Election of May 20, 1975, be and they are hereby impounded and the Sheriff of Washington County is hereby directed to immediately take custody of all of said ballot boses, and to maintain proper guard and protection of the said boxes on a twenty-four hour basis from the time of this order until the final, official recount of the Recount Board is completed; the said guards to be maintained at the expense of Washington County, at least initially. / s / C.
