PALUSO, COMMISSIONERS 1 1 1 Minute No. 171 Office of the County Commissioners Washington, Pa., June 19, 1975 The Board of County Commissioners met in regular session with the following members being present: Commissioners Paluso and Flynn. Absent being: Commissioner Jones. Also being present: Chief Clerk and County Administrator Whalen; Administrative Assistant Fetcko; Solicitor Gilmore; Court Administrator Posner; Michael Stefan of the Washington County Housing Authority; John Cadez of Engelhardt -Power Associates; Rev. Alex Wilson; Michael Lackovoich and John Paterra, students of California State College; Mrs. Helen Miller of The League of Women Voters; Bob Robertson of The Observer -Reporter; Earl Bugaile of WKEG; and Jay Mitchell of WJPA. Meeting called to order and roll call taken: Mr. Jones - Absent; Mr. Paluso - Present; Mr. Flynn - Present Chairman asked if there were any corrections, additions or omissions to Minute No. 170, each member having received a copy. as read. Moved by Mr. Paluso, seconded by Mr. Flynn, that Minute No. 170 be approved Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Special Order of Business: Mr. Michael G. Stefan, Executive Director Washington County Housing Authority Mr. Michael G. Stefan stated in his presentation that the Washington County Housing Authority is in the process of applying for 100 units of existing housing under the Section 8 Leased Housing Program. Mr. Stefan stated that these 100 units will be scattered through the County, and broken down into the five communities - Charleroi, Canonsburg, Donora, Monongahela and Washington, but will not be limited to these five communities. Mr. Stefan further explained that these units will be existing housing and they will not be new construction or a major rehabilitation program. Mr. Stefan added that the Housing Authority and HUD felt that these units are needed to help supplement rents that are now paid by many residents of our County who can not afford their present place of residence. Mr. Stefan then stated that according to HUD Regulations, a letter of comment and approval of this plan from the local governing body is required, and therefore, Mr. Stefan requested that the Board of Commissioners forward their written comments and approval relevant to the determination of this program. Moved by Mr. Paluso, seconded by Mr. Flynn that the Chief Clerk be instructed to make the appropriate written comments in a letter for use by the Washington County Housing ,43� BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Authority in the process of applying for 100 units of existing housing as per above. Remarks: Mr. Flynn asked Mr. Stefan if this comes under the Community Development Act of 1974 and NIr. Stefan replied that it does. Mr. Flynn also asked if this is in conflict with the program being undertaken by the Washington County Redevelopment Authority, and Mr. Stefan replied that it is not. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Old Business: Concerning the reimbursement of court related costs, Mr. Whalen stated that we had followed through with this matter and as of now, we don't know the final outcome of the budget that was passed. - Mr. Whalen stated that our legislators and senators have assured us that the $24 million has been restored to that account. Mr. Whalen added that in final analysis, we are not sure yet whether it was the entire $24 million, but that it has been acted upon. Concerning the Nation Guard allocations, Mr. Whalen read a memorandum received by Mr. Charles Crouse from Mr. Jospeh Fetcko dated June 11, 1975. Mr. Fetcko informed Mr. Crouse that he had contact the National Guard at the Goodridge Armory per the Commissioners request for an explanation of the specific units located in Washington County. Discussion was held. NIr. Flynn suggested that the Board continue to table this matter if there were no objections. Mr. Paluso stated that due to the financial situation, consideration should -be given to table this matter until the 1976 budget. Mr. Whalen added that this was an emergency and definitely needed to be repaired. Mr. Paluso suggested that the Board take action on all bills with the exception of the bill from Bryan Steam Corporation. He asked that Mr. Gilmore give further clarification on this bill before proceeding to taken action on it. Moved by Mr. Paluso, seconded by Mr. Flynn, that the above bills be approved for payment with the exception of the bill from Bryan Steam Corporation. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN. FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Remarks: Mr. Gilmore further elaborated on the bill in question and stated that this was definitely a emergency situation, but at the time no one thought that it would run into that amount of money. Therefore, it was not brought to a meeting. Mr. Gilmore added that from his review of the work that was done, he did not think it needed to be an item for bid pursuant to the statue of required bidding because it was a repair type situationi.- Mr. Gilmore also stated that even though there were new things put in, it was still a general repair. Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board approve payment of the bill from Bryan Steam Corporation, in that this was a general maintenance repair item and not an item for bid. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a letter dated June 3, 1975 from Jetcraft, Inc. and directed to Commissioner Paluso. Said letter notified the County of Washington that Jetcraft had filed an application service form for Aviation Services with the Federal Communications Commis to renew their Unicom License. Chief Clerk read a letter from Columbia Gas of Pennsylvania, Inc. dated May 22, 1975 concerning damage to a 2" service line serving the Washington County Home for Aged Men by Kosky Brothers while doing excavating work for Steel-Bilt Construction Co. on May 15. Said letter stated that this 2" service line is the property of Washington County and in the past Columbia Gas has provided maintenance work on this line as a convenience to the County on a charge basis. Said letter enclosed a bill for $193. 64 to replace and lower a 30' section of service line which was damaged by Kosky Brothers and required lowering to accommodate grading for the parking lot. Discussion was held. It was felt by the Board the the bill should be directed to the contractor, Kosky Brothers, who damaged the line, and that they should be insured for this type of situation. Mr. Flynn then suggested that Columbia Gas should be notified that the responsibility lies between the corporation and the contractor, and not the County. Chief Clerk read a letter dated June 5, 1975 from Wallover & Mitchell, Inc. regarding the Extended Care Facility, and directed to McAnallen Brothers, Inc. Said letter advised that the initial Job Conference for the referenced project will be held Wednesday, June 11, 1975, at 1Q-30 a. m. at the job .site. Mr. Whalen stated that there will be minutes taken at each Job Conference and will be forwarded to the Commissioners at a later date. Chief Clerk read a letter dated May 21, 1975 from the Commonwealth of Pennsylvania, Department of Transportation and directed to Mr. Gerald Esposito, Director of Emergency Medical Services. Attached to the letter was the Department of Transportation's report of on -site evaluation pertaining to the multi county EMS Council operational in Southwestern Pennsylvania. FLYNN. FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS 1 n J of the EMS project at the time of on -site evaluation was excellent. Chief Clerk then read three telegrams from Congressman Thomas E. Morgan announcing that the General Services Administration has certified the RCA Corporation of Meadowlands to sell indefinite quantities of radio equipment and antennaes to federal agencies. The certification will run from July 1, 1975 to June 30, 1976 and could amount to $3, 900, 000 in contracts for the Meadowlands plant. The second telegram announced that the Department of HUD has approved the City of Washington "Community Development Block Grant" application for $952, 000. 00. The funds will be used for acquisition, demoliton and public improvements in blighted areas. The third telegram announced that the Department of Health, Education and Welfare has awarded a three-month refunding grant for $17, 250 to the Washington -Greene Community Action Agency of Washington, Pa. Chief Clerk read two letters dated June 4, 1975 from Louise Abel of Child Welfare Services regarding incremental salary adjustments for Jeffrey L. Dykstra, Casework for Child Welfare Services and for Joan C. Susko, Clerk Typist. Said letter stated that Mr. Dykstra will be receiving a slary increase effective July 1, 1975 from $10, 054. 00 to an annual salary of $10, 523. 00. Letter also stated that Ms. Susko will be receiving a salary increase effective July 1, 1975 from $5, 829. 00 to an annual salary of $6, 083. 00, and that both these salary increases were based on a Performance Evaluation Report signed by the County Commissioners. Chief Clerk read the following memorandum dated June 12, 1975 to the Board of Commissioners from Charles A. Crouse, Administrative Assistant: As discussed in our agenda meeting yesterday, a problem has arisen with the Washington County Day Care Program. Since the agenda meeting, I have re- searched this matter more thoroughly and can offer the following information. 1. The Day Care Program was requested to modify their budgetary request from a 12-month to a 15-month base. In the process of sub- mitting this modification request, it was necessary to have a letter of commitment from the Child Welfare Services Office which would maintain our inkind contribution, i.e. one-third of Miss Jane Scrip's casework time to be spent at the Day Care Center.* 2. As you will recall, Miss Jane Scrip has resigned leaving a vacancy at the Child Welfare Office and, of course, preventing the commitment of her time to the Day Care Center. 3. The possibility of assigning another Child Welfare worker to the Day Care Center would very likely jeopardize our status with the Department of Public Welfare in that these workers are carrying a maximum amount of caseloads in Child Welfare activities. 4. Without a letter of commitment from the Board of Washington County Commissioners, the entire Day Care Program could be severly curtailed for lack of local share commitment. I have discussed this matter with Mr. Murdock of the Day Care Program, and he advised that a.mo•st feasible and workable solution to the problem would be a letter of commitment on behalf of the Board of Commissioners which, in essence, would commit and maintain the same level of inkind County resources to the program. PALUSO, COMMISSIONERS suitable replacement is found for the vacant position, an appropriate amount of time would be allocated to the Day Care Center. Until that time, an appropriate amount of inkind cash contribution could be made from the Child Welfare account from unexpended funds due to the vacancy created by Miss Scrip's resignation. This solution would allow uninterrupted operation of the Day Care Center and would not adversely affect budgetary position of the Child Welfare account. On this basis, I would recommend that the Board of Commissioners approve this letter of commitment and direct me to draft the necessary correspondence in order to satisfy the commitment to the Day Care Program. /s/ Charles A. Crouse Remarks: Mr. Flynn: Frankly, I don't think we have any choice because this is compulsary. The only question in my mind is could Miss Abel appoint someone in Miss Script's place? Mr. Whalen: She does not have the staff to do this. She would have to take them from their regular casework duties. Nfr. Paluso: What we were doing with these agencies is trying to get it arranged that in case a 15-month budget was passed, but it was not. So really the whole modification request does not make sense.because it is not a 15-month base. Mr. Whalen: They still do not have the services of a Child Welfare person down there. Mr. Flynn: This is a two part request. One is on a 15-month budgetary basis, and the other is that we are required by statue to provide services. Now that Miss Script has resigned, there is a vacancy and a need for a replacement. Further discussion was held. Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board adhere -to the recommendation made by Mr. Crouse and notify Miss Louise Abel to proceed as per above. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen referred to a previous matter concerning correspondence that basically took the County to task for failure to complete the cooperation agreements on the Community Development Block Grant Applications. Mr. Whalen then read a letter from Mr. William R. Costello, Deputy Area Director of the Department of Housing and Urban Development dated June 3, 1975. Said letter advised the Board of Commissioners that the cooperation agreements submitted by the Commissioners in support of our "urban county" Community Development Block Grant Application have been accepted and approved. Letter also stated that the agreements recognized herein are those with the third class cities in Washington County, viz. , Monongahela and Washington. NIr. Whalen stated that we had received a letter dated June 2, 1975 from the Department of Transportation regarding the Topics Program which is a companion program for the Traffic Operations Program to Increase Capacity and Safety. Mr. Whalen stated that this is operated in conjunction with the regular allocations to the counties. Mr. Whalen then stated that Mr. Sember has explored this and recommends that the Board approve his further participation in this program. PALUSO, COMMISSIONERS on the construction program that otherwise would not be included on the six or twelve year highway program. It was pointed out that the purpose of this program is to increase the efficiency of urban streets and roads, and that 29 municipalities within Pennsylvania have participated in the program to date. Said letter also stated that the Topics Program is financed 70% federal, 15% state and 15% local. Discussion was held. Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board authorize Mr. Sember to proceed and make application under the program with the understanding and proviso that our 15%, will be strictly an inkind service. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a letter dated June 5, 1975 from Fannie S. Jefferson of the Washington Area Senior Citizen Center, Inc. Said letter stressed the importance that an ordinance be passed asking all boarding homes and rest homes to register with the county. Ms. Jefferson stated in her letter that they are directing all their attention to help upgrade the boarding and nursing homes and help the residents live under more dignified living conditions, and urged the Commissioners to give as much assistance as possible to bring their county to a higher level of service than the residents are now receiving. Remarks: Mr. Flynn suggested that this matter be referred to the Solicitor. Chief Clerk read the following letter dated June 12, 1975 from Wallover & Mitchell Inc, regarding the Extended Care Facility for Washington County: Dear Mr. Flynn: Enclosed please find a copy of a letter dated May 9, 1975, from Mr. Michael C. Kaufman, of DAK Associates, recommending an extension of time of forty-four (44) calendar days from the original Contract completion date of August 31, 1976 to October 14, 1976. We are in agreement with Mr. Kaufman's recommendation that this extension of time be granted without penalty to the building Contractors because they have been delayed in gaining access to the site. The delay has been caused by less than satisfactory cooperation by the Site Preparation Contractor during the months of March and April in preparing those certain areas of the site to receive the building. We have reviewed the extension of time with the Prime Contractors and have been advised that no claims for additional charges will be made. Attached is a copy of a letter dated June 4, 1975 from Mr. Louis E. Waller of McAnAllew, Brothers, Inc., relative to extension of time. /s/ Charles R. PALUSO, COMMISSIONERS Remarks: Mr. Paluso requested a more detailed explanation of what "less than satisfactory cooperation" means. Mr. Paluso also stated that if the contractor is not cooperating, he wanted to know why. Mr. Flynn also agreed that we should request further explanation of this matter. Chief Clerk read a letter dated June 12, 1975 from the Southwestern Pennsylvania Economic Development District concerning H. R. 5247. Said letter stated that this bill has passed the U. S. House of Representatives and now is being deliberated in the Senate, and that this bill, when passed, will provide more than $5 billion in funds for public works projects nationwide. Letter further stated that in order to make all counties in the Southwestern Pennsylvania area eligible for Economic Development Administration (EDA) assistance, the Southwestern Pennsylvania Economic Development District (SPEDD) is proposing that the participating SPEDD counties apply for rggionwide designation. In order to proceed with the designation process SPEDD requested an indication, either by letter or resolution, of Washington County's intention of being a part of a regionwide economic development program. Mr. ,Whalen then read the following resolution which was enclosed with the letter: WHEREAS, The Southwestern Pennsylvania Economic Development District serving the counties of Allegheny, Armstrong, Beaver, Butler, Fayette, Greene, Indiana, Washington and Westmoreland for economic development programs, and WHEREAS, Only Armstrong, Fayette, Greene, and parts of Westmoreland County are qualified for assistance under all the programs of The Public Works and Economic Development Act of 1965 administered by the Economic Development Administration, (EDA), and WHEREAS, Title IV of the EDA legislation provides for the establishment of Economic Development Districts, (EDD), and WHEREAS, The Southwestern Pennsylvania Economic Development District will prepare an Overall Economic Development Program (OEDP) at no cost to the participating counties, and WHEREAS, Upon acceptance of an OEDP, as well as ultimate designation as an EDD, an applicant from the redevelopment areas will be eligible for a 10% bonus on the total project cost of public works from a qualified applicant, and WHEREAS, All qualified applicants from within the defined growth centers will become eligible for all the program benefits under EDA, and WHEREAS, The request for authorization must originate from the Governor's Office, BE IT THEREFORE RESOLVED, That we request and strongly urge the Governor to write to EDA requesting that the Southwestern Pennsylvania Economic Develop- ment District be authorized as a Provisional Economic Development District (EDD). Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board adopt the foregoing resolution. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. MINUTE ■■ 459 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN. FRANK .TONES. JR., EDWARD M. PALUSO, COMMISSIONERS E Chief Clerk informed the Board of a request received from Mr. Dan Martin of 711 N. Franklin Street, Washington, Pa. regarding the County's covered bridges. Mr. Whalen stated that Mr. Martin has proposed, at his own expense, to make and install name plates for all of the County's covered bridges, and he requested that he be permitted to place these on each end of the bridges. Mr. Whalen stated that this had been done at one time, but the signs had been torn down, and he thought that this was a valid project to undertake. Remarks: Mr. Paluso suggested that we contact Mr. Martin and thank him for the request to do this project, and give him permi"ion_to proceed. , Moved by Mr. Paluso, seconded by Mr. Flynn that the Board authorize Mr. Dan Martin to place name plates at each end of the County's covered bridges as per above. Roll call vote taken: Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk informed the Board of a letter dated June 2, 1975 from the Dep of Environmental Resources regarding Mingo Park strip mining. Said letter gave notification that Nello L. Teer, Company has made application for a surface mine drainage permit from Division of Mine Reclamation of the Department _cif Environmental Resources pursuant to The Clean Streams Law, to operate a mine in Nottingham Township, Washington County. Said stated that anyone objecting to the issuance of this permit should send their objection to the office of the DER,no later than 15 days from the receipt of this letter. Mr. Whalen stated that the Planning Commission on the Parks Department has filed preliminary notifications on this with the Department of Environmental Resources, so that they could stay within the time period set forth in the notice. Letter also stated that a fact-finding conference will be held on July 1, 1975 at 11:00 a. m. in Harrisburg for any objections to this application. Remarks: Mr. Paluso stated that Mr. George and Mr. Sember should proceed to the informal hearing in Harrisburg and find out more about what is going to affect our properties in this area. Moved by Mr. Paluso, seconded by Mr. Flynn, that the Board direct Mr. William Sember, Mr. Michael George, Mr. Clay Graham and Mr. Floyd Lobham to attend the hearing in Harrisburg on July 1, 1975 at 11:00 a, m, as per above. Chief Clerk read a letter dated June 11, 1975 from the Department of Education announcing the 1975-76 planning guide estimates of Vocational Education funds available for prime sponsors for the instructional portion of training programs under the Comprehensive 260 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK .TONES, JR., EDWARD M. PALUSO, COMMISSIONERS Employment and Training Act of 1973. Said letter listed the planning estimates for Fiscal Ye 1976 and included Washington County as a prime sponsor with a 1975-76 planning allocation of $57,422.65. Remarks: Mr. Flynn suggested that this letter be forwarded to Mr. Pi.ganell. Chief Clerk read a letter dated June 10, 1975 from Joan M. Gillespie, Project Director of the Pennsylvania Commission for Women. Said letter stated that the Pennsylvania Commission for Women has recently received CETA funds to produce an anti -discrimination aid for Pennsylvania's Prime Sponsors. Ms. Gillespie asked for any help the Board of Commissioners could offer in planning the program. Ms. Gillespie requested that the Commissioners forward her a copy of the most recent "Program Summary" which gives the number of individuals within the program as well as a brief program description. Mr. Whalen stated that he would refer this matter to Mr. Piganell of Manpower. Chief Clerk read a letter dated June 16, . 1975 from James A. McHale, Secretary of the Department of Agriculture. Said letter stated that the Pennsylvania Department of Agriculture, under authority contained in Section II of the Pennsylvania Farmland and Forest Land Assessment Act of 1974, Act 319, has prepared rules and regulations for the efficient, uniform statewide administration of that Act. Letter also stated that interested persons are invited to submit written comments, suggestions or objections regarding the proposed rules and regulations to the Department of Agriculture. Letter further explained that Act 319 is a pure land assessment actAhat does not deal with the assessment of the related structures that may be necessary for the continued use of the land in an eligible use category, and that it is recommended by the Department of Agriculture that these structures be assessed according to their contribution to the continued use of the land. Remarks: Mr. Paluso: I would suggest that this be brought to the attention of Mr. Gubanish, since this pertains to the assessment of buildings located on eligible farm land under the "Clean and Green" bill - not to be assessed under market value but to be assessed on their use in conjunction with farming. Chief Clerk read a letter dated June 16, 1975 from Harry M. Harvey, Arden Hills Farm concerning problems in collecting payment from certain individuals who use the track. Mr. Harvey stated in his letter that he has instituted legal proceedings against these people and has the right to deny use of the track. Letter stated that the first hearing on this issue will be on June 19th, and Mr. Harvey requested that the Commissioners meet with him to discuss this situation. Chief Clerk read a letter dated June 18, 1975 from the Southwest Regional Planning Council of the Governor's Justice Commission concerning their preparation of a budget for the n 1 1976 allocation. Letter also stated that they would appreciate any thoughts that we might have concerning the improvement of the County criminal justice system, and if we would like to endorse any proposals previously submitted and not funded, any continuation projects, or propose a new project for our County, to submit them to the Regional Office by June 23, 1975. Remarks: Mr. Whalen stated that the Juvenile Court offices did file a previous application with the Governor's Justice Commission in which they asked for some renovations to their present facilities including some additional equipment and they were turned down due to the fact that the GJC in Harrisburg sets a low priority on construction and equipment purchases. Mr. Whalen then stated that they have ready to file a new application that would be effective September 1, 1975 and continue for a 12 month period for specialized and intensive probation. Mr. Whalen then read a brief summary of the project which stated that the project, if funded, will allow for the reassignment of senior probation officers to the task of intensive parole supervision and intake. These individuals would be replaced by newly hired probation officers to keep the caseload per officer at an acceptable and reduced level further increasing the intensity of probation supervision overall. Mr. Whalen further explained that, if approved, this would give the Juvenile Probation Office two additional employees for this 12 month period. Mr. Whalen added that this has been recommended by Mr. Harrison as well as Judge Simmons. Mr. Whalen stated that we have received another proposal for the Governor's Justice Commission from the Washington Homes for Youth, Inc, which is proposed to be located in Burgettstown. Mr. Whalen stated that this is a proposal for a group home for boys from the ages of 11 through 16, and is for $52, 995 with federal funds of $46, 305, the state $2, 573 and the applicant - $4,117. 00. Mr. Whalen added that this does not require any financial contribution by the County of Washington and has been endorsed by Judge Simmons and Mr. Harrison. Mr. Whalen then stated that a group meeting has been arranged for June 24, 1975 with the Commissioners, Judge Simmons, Mr. Harrison, Miss Abel, Rev. Wilson, Rev. Weiss and Mr. Whalen's staff to discuss and fully explore this matter. PALUSO, COMMISSIONERS Mr. Whalen stated that in order to finalize the Charti.ers Flood Control Project, Mr. Clay Graham has arranged a joint meeting between the Board of County Commissioners, Canon -McMillan School Board and the Borough Council of Canonsburg for June 24, 1975 at 7:30 p. m. in the Canonsburg Borough Building. Mr. Whalen added that all concerned parties have been notified by mail and have received a complete file with a break of questions that have been resolved. Mr. Whalen referred to a telephone call that Mr. Flynn had received from Penn Dot concerning Centerville Borough which involves the additional excavation, back fill and cribbing of V e staburg- Mexico slide area. Mr. Whalen also stated that Centerville Borough has requested that the County participate again with an additional sum of $12, 000 to finish the project. Mr. Whalen further explained that it is now finished,, but they were not in the position to meet the financial obligations. Remarks: Mr. Flynn further elaborated on this matter and then stated that the Commissioners did authorize this project, but did not think we would get involved in this amount of money. Therefore, Mr. Flynn added that it is up to us to decide what to do. Mr. Paluso stated that he thought that we are obligated and we did participate in this project twide. Mr. Paluso added that he did not see any alternative, but suggested that in the future we should make it definitely known that we cannot be responsible for things that happen beyond the contract.
