Office of the County Commissioners
Washington, Pa., August 14, 1975
The Board of County Commissioners met in regular session with the following
members being present: Commissioners Jones, Paluso and Flynn. Also ;being present:
Chief Clerk and County Administrator Whalen; County Solicitor Gilmore; Mr. John Cadez
of Engelhardt -Power Associates; Court Administrator Posner; Beaver Perkins, Volunteers-1
In -Probation; John Stevens of the Observer -Reporter; and Reverend William E. Davis
from the Department of Environmental Resources.
Meeting called to order and roll call taken:
Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions or omissions to
Minute No. 178, each member having received a copy.

Special Order of Business: Reverend William E. Davis
Department of Environmental Resources
Reverend Davis stated that the State is trying to do away with-_ the Division of
Explosives, per se. Reverend Davis stated that they want to incorporate the Division of
Explosives into conservation, open -pit inspectors, which will give to the explosives area
the small segment of a county or district and this in turn will give to people like himself
just a small area of work rather than working by counties now, where he was assigned to
Beaver, Washington, Greene and Fayette Counties. Reverend Davis stated that they are
taking this away and want to turn the street explosives over to the federal government.
Reverend Davis stated that, in brief, ,the> people in the streets, any construction, farmers,
or fireworks, etc., are going to be left virtually without protection until something is done,
Reverend Davis stated that he is trying to salvage the Division of Explosives. Reverend
Davis then read a letter which he composed as a format to be followed, which is to be
directed to the Governor. Reverend Davis stated that the would leave the copy of the
letter with the Commissioners for them to read and revise if they wish. Reverend Davis
then asked the County Commissioners to endorse this letter and further elaborated on the
matter.
Remarks:
Chairman asked if it was the intent of the Department of Environmental Resources to

l abolish the category of the Division of Explosives.
Reverend Davis stated that they are going to retain just a small segment of the Division,
of Explosives, and that eventually the Division will be virtually extinct.
Chairman stated that in the metropolitan area such as Philadelphia and Pittsburgh, he
would imagine that they would have their own departments, such as a bomb and arson
squad, but counties such as Washington, which are classified as rural, do not. Chairman
stated that he thinks it would be wise for Washington County to take this matter under
consideration. Chairman asked if the United Mine Workers had taken a position in regards
to this.
Reverend Davis stated that he talked to an attorney in Uniontown and they took a position
on deep -mine safety, and in view of the fact that they were going to Washington, D.C. , in
regard to deep -mine safety, it is possible that it might be discussed there. Reverend
Davis stated that he hasn't talked to them since the meeting, but he does plan to get a
follow-up as to what `happened.
Chairman asked about the reception he received from the different political subdivisions.
Reverend Davis stated that the City has endorsed the letter.
Chairman suggested that the Board not take any action on the letter, until the Solicitor has
had an opportunity to peruse it. Chairman stated that the Board would take action as soon
as possible.
(Further discussion was held.)
Chairman then asked if Reverend Davis had any supporting data available on this subject.
Reverend Davis stated that he has articles from the newspapers and pictures.
Chairman stated that if the letter is left with Solicitor Gilmore, the Board will certainly
follow through with it immediately.
Old Business:
(A. Airport)
Chief Clerk stated that at the last meeting it was recorded that the engineers from III
Michael Baker, Inc., would be here on Friday of last week to make an on -sight inspection
of the Airport. Chief Clerk stated
that the Chief Engineer, Mr.
Wylie, and the
Soils
Engineer, Mr. Chen, did come on
Friday and Mr. Flynn, Mr.
Paluso, and Mr.
Whalen
went to the Airport with them and
made the inspections. Chief
Clerk then read
a letter
ated August 11, 1975, from Mr. Wylie, which stated that they will be forwarding to the
ounty Commissioners their proposal for work at the Airport; this work will be to deter-
ine the cause or causes for pavement heaving at the Airport. Said letter also stated
Pittsburgh Testing Laboratories cannot start work this week and they are currently
nvestigating other sources for drilling. Said letter further stated that they will be sending
Board a proposal for the accomplishment of a Master Plan for the Washington County
irport. Chief Clerk stated that he received a telephone message from Mr. Wylie yester
n which he stated that the proposal he asked for is going out today, and they will be here
n Friday to do the necessary inspection.
Chief Clerk then informed the Board of another letter of complaint from Mr. Don
enko, in which he calls attention to the serious condition that exists at the Airport. Said
etter stated that if the Board will check with the pilots that fly in and out of the Airport,
will find that approximately one half of the runway marker lights are inoperative;

B. Washington County Home for Women)
Chief Clerk stated that this item concerns an update on the negotiations current
nderway with the Department of Labor & Industry in order to keep the current Women's
ome Facility operating. Chief Clerk stated that they have set up a hearing before the
ndustrial Board for August 26, 1975, at 11:00, in Harrisburg, for the purpose of consideri
hether or not they will grant the County a waiver on basically the installation of a com
prinkler system for that building. Chief Clerk stated that it is important to note in their
etter that they say that the County has a right to request a variance from orders based
inst the institution by appealing to the Pennsylvania Industrial Board; however, as a resu
a change in the Federal Social Security Act, the right to grant waivers, which is a
erequisite for eligibility under federal provider agreements has been removed from the
urisdiction of the Commonwealth and transferred to the Department of Health, Education
nd Welfare. Chief Clerk stated that he did reply to this, calling their attention to the fact
iat the right of appeal by the County to the Industrial Board; however, in paragraph 4, the

lerk stated that their secretary wrote back and said, "Please be advised that the Industrial

ould be completed. Chief Clerk stated that we have every reason to believe that these two
entlemen from the executive branch of the Commonwealth are going to be able to do some

(C. Juvenile Court Judges' Commission)
Chief Clerk stated that this item concerns the Juvenile Court Judges' Commission'
grant to the County. Chief Clerk stated that this has involved correspondence dating back
to the earlier part of the year in which we have constructively set forth our position that
the Pennsylvania Civil Service Commission of the Pennsylvania Department of Welfare,
has- entered into an agreement with the State Association of County Commissioners that
counties have a definite salary classification as far as civil service is concerned. Chief
Clerk stated that as a result of that agreement, Washington County is classified as a
"B" County. Chief Clerk stated that we have pleaded this case with the Juvenile Court
Judges' Commission. Chief Clerk stated that in one of their letters, they say that they
agree that the salaries between the Juvenile Court employees and the Child Welfare
employees should be consistent. Under date of August 8, 1975, Mr. Whalen received a
letter from Christian Zander, Executive Director, which stated that the Commission met
on July 29, and considered Washington County's request to use the lower (Class B)
schedule for salaries in 1975. Said letter stated that this request was denied because the
Commission members felt that they have not granted such requests in the past, and they
feel that granting permission for those kind of requests would weaken the standards.
Chief Clerk stated that before he came to the meeting this morning, Mr. Meshaw from
I the Governor's office called him and said that he was in contact with the Juvenile Court
Judges' Commission, and that he had a meeting wiihthem today. and hopes by this afternoon]
that he will come back with a meaningful solution to the problem.
I Remarks:
Chairman asked the Chief Clerk to read the correspondence prior to this, whereby they
agreed about the difference between the two categories.
Chief Clerk then read a part of a letter dated May 2, from Mr. Rolf Lotz, Program
Planning Coordinator, which stated, "We believe salary ldvels of juvenile probation office
should be approximately equivalent with salaries paid Child Welfare workers." Chief Cle
stated that letter goes on to say that, "It was a pleasure hearing from you. Your sugge;
about salary equilizations will not be lost."
(Phil Angelo of the Daily Notes entered the meeting.)
Chairman stated for the benefit of the news media, that the problem is that some people
seem to think that we are opposed to some division of our social setup of our social
-workers and that is not the case. Chairman stated that the contract was entered into
between the Department of Welfare, Civil Service Commission, and the State Association
of County Commissioners. Chairman stated that they have different categories of counties,
"A" and "B"; Washington County is classified as a "B" County. Chairman stated that what
is taking place in Washington County is in the Juvenile Court Judges' Commission; they
have mandated that we give John Doe a certain salary as a caseworker. Chairman stated
that they have us in an "A" category, which is the same as Allegheny County. Chairman
stated that Washington County cannot be compared to Allegheny County, but assuming that
we were, it would seem to be that in all categories, Child Welfare, Mental Health, Adult
Probation, etc., would be in "A" category. Chairman stated that this is not the case.
In Child Welfare, we are classified as a "B" County, which means that you could be a
caseworker trainee and receive a lower salary, and in the Juvenile Probation Department
we are classified as an "A" County, and the equivalent to a caseworker trainee of one
in the Probation Office is making a higher salary. Chairman stated that the same case
exists in Mental Health/Mental Retardation; we are classified as an "A" County. Chairmar
stated that in the Adult Probation Office, they are not classified as any type category, and
they are making the lower salary. Chairman stated that they gave Washington County until

August 22, 1975, to execute the contract, and they ' are telling us in effect that we have to
pay you a certain salary; in addition to that, we receive $26, 000 grant to put on two more
in the probation office. Chairman stated that we are trying to have a uniform standard of
salaries in these different categories. Chairman stated that the Board of Commissioners
met at length with representatives of the Governor's office. Chairman stated that the
August 22 deadline does not prevail right now. Chairman stated that the Commissioners
will not even be here on August 22, due to the Commissioners' Convention. Chairman
stated that they are giving us an ultimatum - either we sign the contract by August 22,
or else. Chairman stated that we anticipate an answer this afternoon from the Governor's
office as to what they intend to do.

To state it simpler, Mr. Paluso stated that we have been classified as being a "B" County
for wage scale and they are ma
dd ti_ g that we use the "A" classification. Mr. Paluso
stated that there is no sense in having classifications if you don't use them.
(D. Chartiers Creek Flood Control Project)
Chief Clerk stated that the Canon -McMillan School District has given its legal
counsel authorization to approve the necessary petitions or court actions relating to the
transfers between the County and the School. Chief Clerk stated that Mr. Graham, Land
Acquisition Agent, stated that the School Board has approved this and that Attorneys Zeman
land Costello will have all of the necessary court actions ready to file by tomorrow.
Mr. Paluso inquired about the authorization to prepare the specifications for
stream maintenance, and stated that he was wondering if anything had been done on this
because we are running out of time.
Mr. Whalen stated that hopefully, we are going to be able to finish the
specifications for bidding and that it will be in such a state by the time he leaves on
Friday, that the staff will be able to advertise it next week. Chief Clerk stated that he
discussed the matter of specifications with Solicitor Gilmore Tuesday, and they tried to
work out some equitable method of advertising because it is almost impossible for a firm
to go in and pinpoint exactly the number of hours and minutes that it is going to take to
do the job. Chief Clerk stated that they have been discussing the possibility of having
the specifications drawn to the point where the contractor would have to inspect the parti
area to be cleared and then he would bid whatever equipment that he felt he would have to
use there. Chief Clerk stated that it would appear that this is the only equitable way to
draw up the specifications.
Remarks:
Chairman suggested that this be held in abeyance until the next regular meeting on
August 28, 1975.

Chief Clerk then read a bulletin from the Pennsylvania Commissioner of Elections.
advising the Board that for ballot planning purposes, there will be four statewide judicial
retention questions; two for Superior Court and two for the Commonwealth Court. Said
letter also stated that there may be Common Pleas Court retention questions depending
on whether or not any judges in our judicial district have submitted a declaration of
candidacy. Said bulletin also stated that their office hopes to certify the ballot by the
middle of September if all pending court cases are concluded.,
Chief Clerk then read a memorandum dated August 8, 1975, from Controller

Controller Daniels (attending the Controller's Convention the week of August 10),
administrative assistant Nancy Criquellion was appointed as Acting Deputy Controller.
Chief Clerk informed the Board of notification from the Joint Monongahela
Ferry Commission which stated that their next meeting will be held on August 14, 1975,
at 7:30 p.m., in the Gallatin Bank Building in Brownsville, Pa.
Remarks:
Mr. Jones stated that it was requested that Solicitor Gilmore attend this meeting.
Mr. Gilmore stated that he does plan on being there.
Chief Clerk read a letter dated August 7, 1975, from the Donora Public Libr
in which they acknowledge receipt of the 1975 allocation of $550.00 made by Washington
County. Said letter stated that the Board of Directors of the Donora Public Library
is most appreciative of this financial aid.
Chief Clerk read a letter .from Celene A. Minor, Protective Care Caseworker,
Adult Welfare Services, which stated that she has been designated by Mr. Luppino to
organize the site locations for the Washington County Mobile Services for the Aging,
and would like to invite the Commissioners to attend since Washington County has had
an active part in the funding as well as the organization of the Mobile Unit. Said letter
stated that the unit will be in operation from 11:00 a.m. , until 3:00 p.m., but the
staff will man the unit from 10:00 a.m. , until 3:30 p.m.
Remarks:
Chief Clerk stated that he has a copy of the schedule for each of the Commissioners.
Chairman stated that the Mobile Unit will be at the Fairgrounds on Saturday. Chairman
stated that we should advise Ms. Minor that it is impossible for the Commissioners to
be present at all of those places.
Chief Clerk informed the Board of a letter dated August 7, 1975, from the
Soil Conservation Service regarding the preparation and reproduction of the invitation
for bids for construction at Harmon Creek Site PA-485. Said letter stated that the bid
package has been prepared and copies will be sent under separate cover. Said letter
suggested that copies of the notice be posted in the Courthouse, Post Office and any
other places selected; information on the notice is also adequate for use in newspaper
advertising which is not required but may be desirable. Said letter further stated that
interested bidders will request bid packages from Mr. Graham, Land Acquisition Agent,
who will keep a record of all bidders who request complete assemblies of the invitation.
Remarks:
Chief Clerk stated that all of the notices and the lists came in and were turned over to
Mr. Graham. Chief Clerk stated that the only question that arises is whether the Board
wants to do any advertising. Chief Clerk stated that the bids will he opened on Thursday
September 11, 1975.
Chief Clerk informed the Board of a letter dated August 11, 1975, from the
Department of Military Affairs, which stated that due to the tremendous amount of

the Office of Veterans Affairs, at the direction of the Adjutant General, will host a
Veterans Affairs Seminar. Said seminar will be held at the Treadway Resort Inn,
Grantville, Pa., from 8:00 a.m. , September 16, 1975, to 12:00 p.m., September 18, 197!
Said letter requested that the County Director of Veterans Affairs and key members of
the staff be granted authorization to attend said seminar.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board authorize Mr.
and Mrs. Butka to attend said seminar as per above.

Chief Clerk informed the Board of a letter from Roland Bourke, Washington
County Community Development Agency, dated August 8, 1975, which stated for the record
that they have answered an Urban County Questionnaire on Washington County that came to
them from the Community Planning and Development Department of Housing and Urban
Development. Chief Clerk stated that copies are available for inspection.
Chief Clerk informed the Board of a request for a leave of absence from
Alberta Denson, due to pregnancy, for sixty (60) days, to be effective August 15, 1975.
Chief Clerk informed the Board of a second request for a leave of absence
submitted by Mr. Showalter for Mrs. Rose Freese because of medical reasons effective
August 16, 1975.
Moved by Mr. Jones, seconded by Mr. Paluso, that the above leaves of absence
be approved.

Chief Clerk informed the Board of a memorandum dated August 11, 1975, from
Richard W. Gubanish, Chief Assessor, in which he requests permission to go to Harris-
burg to get information pertaining to the Tax Equalization Board, and also to go to
Cole -Layer -Trumble Company in Dayton, Ohio, in regards to the processing and distribut
of the 1976 Tax Duplicates.
Moved by Mr. Jones, seconded by Mr. Paluso, that Chief Assessor Gubanish be
permitted to go to Harrisburg for information pertaining to the Tax Equalization Board and
also to Dayton, Ohio, to the Cole -Layer -Trumble Company, regarding 1976 Tax Duplicates.

Chief Clerk advised the Board of a communication from the Department of
Labor & Industry in regards to Child Welfare Services, Washington, Pa. Chief Clerk
stated that the letter stated that they are conditionally stating that this facility is not in
conformity with the Fire and Panic Act and the Life Safety Code, and they have set forth
certain conditions that must be met. Chief Clerk stated that they require a reply to this
letter within a period of 60 days.
Remarks:
Chairman stated that we are familiar with the problem and have instructed Mr. Whalen
and Mr. Bevec to do an indepth study as far as the space is concerned. Chairman stated
that they have come up with a plan whereby we will be able to utilize 3000 sq. ft. as
sufficient space to house the Child Welfare Services. Chairman stated that this is county
property and we intend to proceed with this plan.
Chief Clerk next informed the Board of notification from the Pennsylvania Public
Utility Commission, dated August 6, 1975, in regards to the Federal Highway Administrat
Safer Roads Demonstration Program, Section 230 and Section 203 of the Federal Highway
Act of 1973. Said letter stated that field conferences will be held at the site of the
crossings involved in the above -entitled proceeding on:
Wednesday, August 20, 1975, at 2 p.m., Wade Avenue, City of
Washington, Washington County, crossing with the Baltimore and
Ohio Railroad Company. Project No. FF381.
Thursday, August 21, 1975, at 9 a.m. , SHR735, Independence
Township, Washington County, crossing with the Norfolk and
Western Railway Company. Project No. FF181.
At 10:30 a.m. , SHR 115, Florence Road, Borough of Burgetts-
town, Washington County, crossing with the Penn Central Trans-
portation Company. Project No. FF182.
Remarks:
Chairman suggested that this be referred to Mr. McAmbley.
Chief Clerk stated that due to the Commissioners' Convention next week and
his vacation the following week, he recommends that the Board appoint Charles A. Crouse
as the Acting" . Chief Clerk, from August 18 through September 1, 1975; and if in any

Chief Clerk informed the Board of a request to set up a Voter Registration

l Facility at the Washington County Fair. Chief Clerk stated that we do have a registration
l booth in operation at the Fair, Monday through Friday, from 10 a.m., until 4 p.m.,
1which is manned by the Election Office personnel.
Mr. Paluso then stated for the benefit of those concerned that the regular
(meeting of the Washington County Prison Board will be postponed until August 27, 1975,
I due to the Commissioners' Convention.
Chairman stated that the next item concerns the proposal submitted to the Board
l of Commissioners some time ago. Chairman stated that the Board, acting in the capacity
l of the prime sponsors of the CETA Program, better known as the Manpower Program,
received a breakdown of professional services that the Bureau of Employment Security
could offer on a per capita basis and the over-all total cost for each category. Chairman
stated for the record that the Board of, County Commissioners met with representatives
l of the Bureau of Employment Security on August 11, 1975. Chairman stated that as a
(result of this meeUag, they have met and discussed each item individually as proposed to
them and have arrived at the conclusion that we only need a portion of their services.
Chief Clerk then read the following for the record:
A meeting was held between the Washington County Commissioners and
the representatives of the Bureau of Employment Security on August 11, 1975
for the purpose of discussing the proposed contract for CETA Manpower
Services to be approved by the Bureau of Employment Security. We the
County Commissioners after investigating the merits of the contract have
arrived at the following conclusion.
The services indicated in the proposed contract encompassing interviewing,
testing, counseling, OJT and payment of allowances are all functions which
can and should be under taken by the Manpower Planning Office staff. This
action will result in a substantial savings to the county under the CETA Pro-
gram.
It is, however, essential that in order to preclude duplication of payment
for those participants enrolled in new training programs that they be cleared
through the U. I. Section of the Bureau of Employment Security. Therefore,
negotiations will begin to contract for this particular service. Our research
for the average cost per individual per week cleared through the U. I. Section
of the Bureau of Employment Security amount to an average state wide of
$1. 12. According to the Federal Manpower official, CETA participants may
be cleared through the U. I. Section on a weekly, bi-weekly, monthly, bi-
monthly or at the very minimum, quarterly.
It is anticipated that approximately 99 participants will be enrolled in
training in FY 1976. Therefore, based on contract cost which were sub-
mitted by the Bureau of Employment Security a contract will be developed
for the amount no to exceed $5, 576. 10
The reasoning for not negotiating a total service contract for the inter-
viewing, testing, counseling and OJT with the Bureau of Employment is to
realize a substantial savings of CETA money whereby it will then become
possible to hire and train additional unemployed people in Washington County.
Remarks:
Mr. Paluso stated that it is not because of any dissatisfaction with -the Bureau of Employ-
ment Security, but at the time of the inception of the Manpower Program, we did not
have the staff to do this work; but now that we have our own people, we don't need an
outside contractor. Mr. Paluso stated that by doing this, we will have approximately
$27, 000 available for direct use of employment for training that we would not have if we
contracted the services out.

Chairman stated that the total package that they proposed is $30, 941 plus. Chairman
stated for the services that we require, after much deliberation and review, we have the
staff, except for the employment insurance, which we have no control over. Chairman
stated that he has had the opportunity to speak with Mr. Piganell this morning, and in
view of the conclusion that they have arrived at, he suggested that the Board authorize
the Manpower Office to enter into a contract on a bi-weekly basis. Chairman therefore
recommended that Mr. Piganell, in his capacity as Executive Director of the CETA Progr l
contract with the Bureau of Employment Security, what is known as a payment system
which deals strictly with the unemployment insurance section of the Bureau of Employment
and execute the contract so we can have this service on a bi-weekly basis, not to exceed
the sum of $5, 576. 10, with the proviso that if this amount is not used, it will be refunded
to Washington County.
Moved by Mr. Paluso, seconded by Mr. Jones, that Mr. Piganell contract with
the Bureau of Employment Security as per above upon the recommendation of the Chairman.

Chairman stated that from what he can determine, the Department of Trans-
portation is going to take bids on the Donora-Monessen Bridge between August 20 and
September 26, 1975. Chairman stated that this is going to help underwrite the cost of
the approaches.
Remarks:
Mr. Paluso stated that this is for the rehabilitation - the approaches are not even on the
drawing board yet. Mr. Paluso stated that this is strictly for the bridge rehabilitation
proper - that is one project; the approach project is another.
Chairman stated that what they are saying is that we on thi s side of the County will be
responsible for the approaches and Westmoreland on the other side. Chairman stated that
he checked with the Engineer's Office and the Bridge Department and found that under
CA No. 61358, the widening of the approaches and sidewalks was approved. Chairman
stated that we did have a $30, 000 item that has been in escrow since 1973, so he would
assume...
Mr. Paluso stated that this won't apply to this part of the project. Mr. Paluso stated
that the approach project is not approved - $30, 000 is for the approaches.

Chief Clerk stated that it appears that the Controller's Office has been in
correspondence with the United States Marshal's Office in Philadelphia, Pa., regarding
United States Marshal's expenses in connection with. the Tony Boyle trial. Chief Clerk
stated that since Controller Mascara and Deputy Controller Daniels are at the Controllers'
Convention, Mrs. Criquellion was appointed Deputy Controller; but unfortunately, she was
absent yesterday, so Mrs. Queen advised Mr. Whalen that prior to going on his vacation,
Mr. Mascara had left instructions that as soon as this invoice was received, it was to be
paid immediately. Chief Clerk stated that they had a signed check available, but after
looking at the invoice, he deferred any approvement on the payment because, primarily,
the amount of $13, 029. 79 shocked him. Chief Clerk stated that the people involved are
basically federal prisoners and were in the custody of the deputy marshals. Mr. Whalen
stated that he deferred any action on it and told Mrs. Queen that the best he could do

would be to bring it to the attention of the Board, because, evidently, it was an item
that Mr. Mascara felt quite important. - Chief Clerk stated that he has all of the corres-
pondence on this matter.
Remarks:
Mr. Paluso stated that he doesn't see why we should be getting the bill because if they
are federal prisoners, the cost should be paid by the federal government. Mr. Paluso
recommended that this matter be tabled until the Board has a chance to look into the
matter.

request for payment for outstanding bills for the Tony Boyle trial and that the Controller
be instructed not to make any payment in connection with this until he authorized to do so
by the Board of County Commissioners.

recommended that the Board execute the lease.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute said
lease for the McDonald Senior Citizens Center as per above.
