Office of the County Commissioners
Washington, Pa., September 11, 1975
The Board of County Commissioners met in regular session with the following mem-
bers being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Clerk
and County Administrator Whalen; Administrative Assistant Fetcko; Coroner Farrell Jackson;
Mr. John Cadez of Engelhardt -Power and Associates; Mrs. Helen Miller of The League of Wo
Voters; Reporter Robertson of The Observer -Reporter; and Earl Bugaile of WKEG Radio.
Meeting called to order by Chairman and roll call taken:
Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions or omissions to Minute #181,
each member having received a copy.

Old Business:
a. Washington City Department of Health
In regard to the property located at 427-427 z East Hallam Avenue, Mr. Whalen repor-
ted that this property was not sold at the last tax sale and, therefore, still rests with the Tax
Claim Bureau. Mr. Whalen stated that he called Mrs. Flenniken and she is in the process of
sending out the necessary notices to the City, School District and also to the County to get the
procedure underway to demolish this building and get it off the unsafe conditions.

b. Adult Probation Office - Subgrant for Application
Mr. Whalen reported that since last week's meeting, we have made some investigati
on this matter and also received the following letter signed by all five Judges:
Gentlemen:
The undersigned, Judges of the Court of Common Pleas, hereby endorse
the request of the Washington County Adult Probation Office for an addi-
tional Probation Officer to supervise ARD and regular parolees and pro-
bationers.
Accelerated Rehabilitative Dispostion is a relatively new program and
its continued successful use will have a significant impact on the reduc-
tion of the criminal trial list. Because of the special nature of the ARD
program, it would be appropriate to have a Probation Officer specifically
assigned to these cases. We would therefore appreciate your giving this
matter favorable consideration and executing the Application for Subgrant
to be filed with the Governor's Justice Commission.

Remarks:
Mr. Flynn: This is for what period of time?
Mr. Whalen: One year. The anticipated starting date was October 1st, but I believe that wou
be moved back to November lst now. It requires a commitment by the County for that period
of time of $1, 119. 00 as the County's share.
Mr. Paluso: I guess it's one of those continuing arguments we are having with the State, not
over the grant, but over how they administer and who makes the rules and salaries. Unfor-
tunately, you abide by their rules or you don't get the additional grants and personnel so we
sort of back in the corner again.
Mr. Flynn: As you said, they put us on the so-called "proverbial spot. " However, we could
adopt that with the proviso that if there are no monies forthcoming at the end of that contracts
year that the program ceases to exist as far as we are concerned.
Mr. Paluso: I think the minutes should so that this grant is strictly for a one-year term; and
if the grant is not forthcoming in the future, the personnel involved will be made aware of that
in the beginning that the County can not afford to pick up the additional expenses.
Mr. Jones then commented on classification and pay schedules.
Moved by Mr. Paluso, seconded by Mr. Flynn, approving the execution of the Sub -
grant for Application for the Adult Probation Office as per above with the proviso that if there
are no monies forthcoming at the end of the contractual year that the program ceases to exist
as far as Washington County is concerned,; also, that the personnel involved be made aware of
this fact in the beginning.

c. Decision of the PLRB - RE: Child Welfare Services and MH/MR Clinic
Mr. Whalen stated that this situation involves a conflict in salary schedules because
the Commonwealth has used an "A" classification as far as Mental Health is concerned and a
"B" classification for Child Welfare; and yet they expect the County to enter into a union con-
tractual agreement attempting to justify those two problems. Mr. Whalen therefore recom-
mended that the Board of County Commissioners seriously consider another appeal in this case
(Mr. Merdian and Phil Angelo entered the meeting. )

appeal on the final order of the PLRB as relates to the Child Welfare Services and Central
Washington County MH/MR, Clinic.

d. Child Welfare Services
Mr. Whalen reported that he had been in contact with Mr. Kistler, who is the super-
visor for Western Region for Labor and Industry, concerning the Child Welfare Services.

Mr. Kistler informed Mr. Whalen that he will be out of town Monday and Tuesday of next week
but that he will get in touch with Mr. Whalen the latter part of the week to make arrangements
to personally come down and inspect the office building at Arden and to make recommendations
at that time.
e. Mr. Meshaw - Governor's Office
Mr. Whalen reported that he tried to contact Mr. Meshaw this morning about the
grant-in-aid program, but Mr. Meshaw was not in his office; however, Mr. Meshaw's office
informed Mr. Whalen that they would have Mr. Meshaw call Mr. Whalen this afternoon.

Mr. Whalen informed the Board that at the opening of bids on the Harmon Creek Site
485 this morning, there will be a Mr. Addison present who will bring with him a check in the
amount of $200, 000. 00 payable to the Washington County Commissioners. Mr. Whalen stated
that the Commissioners in this case are acting as the receiving agent for this money because it
is to be, in turn, sent out to the Soil Conservation Service who will hold it in escrow until it is
appropriate to spend the money. Mr. Whalen further stated that the procedure to be followed is
upon receipt of the check, it will be deposited into the Grants and Gifts Escrow Account and a
check from that account will then be drawn to the Soil Conservation Service in order to have an
audit trail on the funds. Mr. Whalen then recommended that the Board go on record acknow-
ledging receipt of the money and authorizing the expenditure of the money to the Soil Conserva-
tion Service. Mr. Clay Graham then made a few comments.
Moved by Mr. Paluso, seconded by Mr. Jones, that the Board go on record accepting
the funds as mentioned above and authorizing the expenditure of the money to the Soil Conserva-
tion Service as explained by Mr. Whalen.

Mr. Whalen informed the Board of an invitation to join in the celebration of Veterans
Day to be held in Monongahela on Tuesday, November 11, 1975.
Mr. Whalen stated that regarding Carroll Township flood damage, Mr. Tenaglia,
Bridge Engineer, made an investigation of the damages and submitted to the Board an estimate
of the costs for the repairs of the bridges and pipe culverts:

Mr. Flynn explained that they are asking the Commissioners to make an emergency appropria-
tion of approximately $10, 000. 00 with our crew doing the work on the wing wall.
Moved by Mr. Paluso, seconded by Mr. Jones, that the Bridge Engineer be authorized
to proceed with the emergency repairs at an approximate amount of $10, 000. 00 for the three
projects located on Township Road #854 in Carroll Township as per above.

I am a resident of Dry Run Road, Rt 136, in Monongahela, Pa.
On this road is a small creek called Dry Run Creek. The creek runs
under a road called Chess Street in Monongahela, Pa. There is a
grating in front of the underpass to stop large trees and debris from
blocking the flow of the stream. Every time there is a hard rain
dead trees from up stream wash up to this grating and block it. As
a result the creek floods its banks and endangers our homes and
roadway.
During the hard rain on September 1, the heavy flow of the
stream carried much debris to the underpass almost completely
blocking it even though it was just deaned out by Washington County
1 week before. Also about 200 feet up the creek from the grating
there is a fallen tree which is creating a dam effect with debris
collecting against it. We fear the next rain will cause serious
damage to our property.
We are voters and tax payers and feel it is our right to have
this stream cleaned at least once a year. As of this date it needs
cleaned now. I pray you will give this matter your immediate
attention before we suffer more property damage. We do not have
time to have this matter passed from Dept. to Dept. or hung up in
"red tape. "
Mr. Paluso stated that the County owns a bridge in that location; and using that as a reason, of
bridge crew has gone down four times in the past five weeks. Mr. Paluso suggested that the
Board direct Mr. Tenaglia to contact Mr. Lange of the DER in Carnegie to make an investiga-
tion to determine the source of the debris problem. Mr. Flynn stated that Mr. Whalen will so
instruct Mr. Tenaglia by a memorandum.
(Deputy Controller Daniels entered the meeting. )
Mr. Whalen then informed the Board of a request for County Aid Application from
Peters Township for two concrete railroad piers on West McMurray Road at an estimated cost
of $12, 800. 00. The Township is asking the County for an appropriation of $8, 250. 00. Coroner
Jackson then elaborated on the matter for a few minutes.
Moved by Mr. Paluso, seconded by Mr. Jones, that the County Aid Application for
Peters Township be approved as requested.

Mr. Whalen informed the Board of notification from the Washington County Overall
Economic Development Office that a new 1975 Municipal Officials Training Program will begin
on Wednesday, September 173. 1975, and will continue for five consecutive Wednesdays. Regis-
tration fee is $10. 00 per person.
Mr. Whalen stated that per Minute No. 179 dated August 14, 1975, Whe Board directe,
Mr. McAmbley to attend various field conferences regarding railroad crossings in Washington
County. Mr. Whalen reported that Mr. McAmbley did attend these three hearings and has filed
a report with the County Commissioners.
Mr. Whalen informed the Board of the resignation of Joan C. Susko as Clerk Typist I
for Washington County Child Welfare Services, effective Friday, September 19, 1975, due to
her acceptance of a position elsewhere.

Mr. Whalen informed the Board of a letter dated August 29, 1975, from Richard Zari
ting Director, Division of Licensure, Department of Health, to the effect that all of the func-
ns formerly handled by the Department of Public Welfare with regard to supervision, app
licensing of skilled nursing homes, intermediate care nursing homes, homes for the aged
and inform, convalescent homes, etc. , that all of the responsibilities have now been transferre
to the Pennsylvania Department of Health.
Mr. Whalen stated that the League of Women Voters of the Mon Valley Area has

Mr. Whalen informed the Board of correspondence dated September 5, 1975, from the
artment of Transportation which enclosed a copy of the Draft Environmental Impact State
r the six mile link of Interstate 70 between the proposed Monongahela Valley Expressway and
existing Arnold City Interchange. Said letter asked that the Board review this document and
eturn any comments to the Department prior to October 31, 1975.
Mr. Whalen informed the Board of a request from Miss Louise Abel, Public Welfare
dministrator III, to attend the fall meeting of the Pennsylvania Council of Child Welfare Admini
trators from Wednesday, October 8, 1975, through Friday, October 10, 1975, at the Host Inn,
risburg, Pa.

Mr. Whalen presented to the Board a Right -of -Way Agreement with West Penn Powe
Company for the installation of the underground services to the new Extended Care Facility.
Moved by Mr. Paluso, seconded by Mr. Jones, authorizing the execution of the Righ
of -Way Agreement with West Penn Power Company as per above.

Mr. Whalen read correspondence dated August 19, 1975, from Mayor W. C. Reed
from the Borough of West Alexander requesting a flagpole be erected in the Church cemetery
where the traditional memorial services will be held in the future. Mayor Reed also asked if
it would be possible for the Board to determine the amount of County services that have occurre
in the Borough of West Alexander during the past five years.
Discussion followed. It was decided that the Board would check into the matter of
getting a flagpole, possibly through the Tourist Promotion Agency; and that they would follow
through on the request for the determination of County services provided to the Borough.
Mr. Whalen then read the following letter dated September 8, 1975, from Michael
George, Director, Department of Parks and Recreation:
Gentlemen:
Since the County has taken over roads in Mingo Creek Park that have
been abandoned by the State and Nottingham Township, the County is now
in a position to close some or portions of these roads.
Effective October 6, 1975, gates will be in place to close the following
roads (identified by former State and Township numbers) as listed below and
shown on the attached map.

The purpose of this action is to provide better control and security
for the park and at the same time reduce the expense of police patrol.
These roads will only be open for park operations and for public use
of the park when necessary.
If there is any objection to this action please let me know as soon
as possible.

Mr. Whalen read correspondence dated September 8, 1975, from Michael George,
Director, Department of Parks and Recreation, which requested authorization to prepare or
have prepared specifications to advertise for the following:
1. Purchase and erection of a maintenance and storage building in
Mingo Creek Park (36' x 70' with steel exterior sheeting and in-
sulated). Total estimated cost is $20, 000 which includes a 6"
concrete floor and four large overhead doors.
2. Seal and chip parking lots and roadways in Mingo Creek Park.
Estimated cost is $20, 000.
3. Purchase of lumber and hardware to build 100 picnic tables
Mr. George stated in his letter that the expense of these items can be met 100116 with Federal
and State grant monies which are forthcoming.

tise for the above -mentioned items as requested by Mr. George.

Mr. Whalen presented to the Board for their consideration four (4) OJT contracts
with the Automotive Services Council of Pennsylvania for on-the-job training for Robert Mc
Joseph Huggins, Octavius Charles Proia, and Tan Hai Pham.
Moved by Mr. Jones, seconded by Mr. Paluso, approving the above -mentioned OJT
contracts.

election supplies to the Judges of Election for approximately two hundred five precincts requires
for the conduct of the Municipal Election to be held on Tuesday, November 4, 1975. Said bids
to be received in the Office of the County Controller until 11:00 a. m. , Prevailing Time, Thurs-
day, September 18, 1975, and publicly opened immediately thereafter in the presence of the
County Commissioners.

Solicitor Gilmore presented to the Board a MH/MR, Lease in connection with the
Group Home contract. Mr. Gilmore explained that under the law, they are not capable of
execmt°igg aAease so the County has to do it on their behalf. (It was noted that this lease is
predicated on the availability of funds. )
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the execution of the
MH/MR. Lease as recommended by Solicitor Gilmore.

Solicitor Gilmore informed the Board that in regard to the right-of-way agreement
with Reliance Electric Company which was passed at a previous meeting subject r to the addi-
tion of several items concerning relocation, maintenance and restoration of services, he had
prepared those addendums and communicated with Reliance Electric Company and they seem to
have no difficulties in this matter.

Mr. Addison from the Soil Conservation Service in Harrisburg appeared before the
Board in regard to the $200, 000. 00 check mentioned at the beginning of the meeting. Mr. Addi-
son stated that the check is still in the hands of the Pennsylvania Fish Commission and made
payable to the Washington County Commissioners. He also stated that the understanding of the
Pennsylvania Fish Commission is that the money would be placed in trust with the Soil Conser-
vation Service pending the construction of Site 481. He further stated that the Soil Conservatio
Service proposes to hand carry and deliver to the Board the check; and at the same time, ask
the Board to sign the trust fund agreement and, in turn, the Board would give him a check in
the amount of $200, 000. 00 payable to the Soil Conservation Service. Mr. Addison stated that
his reason for being here today is to see if this proposal is agreeable with the Board. Chairm
then explained to Mr. Addison the action that the Board took at the beginning of the meeting con
cerning the deposit and expenditure of this check. It was then agreed by the Board and Mr. A
son that he would be on next week's agenda in order to present the check and agreement to the
Board. Mr. Addison also stated that he would put the agreement in the mail in order for the
Board to peruse it before next week's meeting.
(All the gentlemen from the Soil Conservation Service left the meeting. )
