PALUSO, COMMISSIONERS Minute No. 183 Office of the County Commissioners Washington, PA., September 18, 1975 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Clerk and County Administrator Whalen; Administrative Assistant Fetcko; Solicitor Gilmore; Clay Graham, Land Acquisition Agent, Mrs. Helen Miller of the League of Women Voters; John Cadez of Engelhardt -Power & Associates; John Drake of the Washington Area Senior Citizens Center; Ermil Caleffie, Electrician; Bob Robertson of the Observer -Reporter; Earl Bugaile of WKEG and Jerry Kolanic of WWVA. Meeting called to order and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions or omissions to Minute No. 182, each member having received a copy. as read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 182 be approved, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Old Business: Airport (Mr. Whalen) Mr. Whalen reported that he had talked to Mr. Wiley, the Engineer of Michael Baker, Jr. , Inc. , concerning the report they were compiiing on the necessary corrections of runway which they had hoped to have completed by now, but due to illness on their staff the report was not finished. Mr. Wiley informed Mr. Whalen that they would try and have the report in by tomorrow. Correspondence: Chief Clerk informed the Board of the receipt of the following checks: 1. Treasurer of the U. PALUSO, COMMISSIONERS 1. Carrier Machinery and Systems Division - $1, 962. 59 Remarks: Mr. Whalen stated that a request was made from the Board for this bill to --be investigated which is for the installation of a oil cooler water regulating valve on the heating and air- conditioning unit. Mr. Whalen further stated that Mr. Crouse had made inquiry with the engineers, Michael Baker, Jr. Inc. , and we had received the following answer to our inquiry dated September 8, 1975. Dear Mr. Crouse: In reference to your letter dated August 25, 1975, 1 have reviewed the original specifications and found the following: The intent of the contract is to provide preventative maintenance functions for equipment. The recent problem with the chiller had to do with a mechanical failure, (not attributed to lack of improper maintenance) therefore I do not feel that the work required to repair the air conditioning equipment is covered under the preventative maintenance contract with Powers Regulating Company. In reference to Item two as to whether the amount of the invoice from Carrier is reasonable for work performed, I feel the amount of this invoice is reasonable and I would recommend payment. I have reviewed our files and found that the cost estimated for a maintenance agreement covering preventative maintenance, repair and replacement, and emergency service discussed in October, 1974 was $27, 000 per year. At that time the County was not able to allocate this amount of money and it was decided that only a maintenance agree- ment covering preventative maintenance would be contracted. The cost of the maintenance agreement now being provided by Powers Regulator Company is $9,468. 00. Should you like to review or consider increasing the present scope of the preventative maintenance contract for the upcoming year or should you have any questions in reference to the above, do not hesitate to call. / s / Michael Baker, Jr. Inc. Denis O'Leary Remarks: Mr. Jones asked Mr. Gilmore if there was something that could be done concerning this problem. He stated that we have problems with this system ever since it was put in. Mr. Gilmore stated that he was not sure that anything could be done unless we could prove that something was wrong in the beginning. Mr. Flynn asked Ermil Caleffie to elaborate on this situation down at the Parks with the air- conditioning. Mr. Caleffie stated that the- problem concerned small parts and they had to redo the whole machine. He further stated that all the facts involving this problem was sent through a computer in Chicago, but whatever was causing the problem did not show up. Mr. Caleffie also stated that this was something far beyond a maintenance problem, and is not likely to happen again. (Further discussion was held.) Moved by Mr. Jones, seconded by Mr. Paluso, that the above bill from Carrier Machinery and Systems Division be approved for payment. , Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a letter dated September 16, 1975 from Richard Gubanish, Chief Assessor regarding a Tax Bill received by Daryl J. & Marcie A. Potts. Mr. Gubanish recommended that Mr. Potts be able to pay his taxes at the face value of $57. 86, due to the fact that Mr. Potts did not receive his Tax Bill in time to pay his taxes. Moved by Mr. Paluso, seconded by Mr. Jones, that the recommendation made by Richard Gubanish be accepted as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen read a letter dated September 15, 1975 concerning the payment of taxes from Mrs. Mary Lou Tyrpin of Daisytown, Pa. Mrs. Tyrpin stated in her letter that she did not receive her tax bill until May (five months later than other citizens), and she felt that she should be allowed five extra months in which to pay the discount instead of being forced to pay a penalty. Remarks: Mr. Paluso asked what the law was on this and thought that even if a person does not receive his tax notice, he would still be responsible. Mr. Gilmore stated that technically you are responsible, and that when we give the people the opportunity to pay just the tax and not the penalty, we are doing that out of basic fairness but the law says even if a person does not get their notice, they are still obligated to pay the tax. Mr. Flynn stated that we are not trying to infringe upon Mrs. Tyrpin's rights at all, but the method we have of sending out tax notices which gives the taxpayers six months or less to pay MINUTE BOOK 411 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA _ MICHAEL R. Mr. Paluso stated that if we are going to make exceptions to this policy, there is no use ill _ having a policy. Mr. Flynn stated that he could not understand why Mr. Tyrpin had waited until September to pay the taxes. If someone should overlook the right to pay the taxes, intentionally or not, they will have to suffer the consequences. Moved by Mr. Paluso, seconded by Mr. Jones, that the Board will notify Mrs. Tyrpin of their decision to deny her request and the reasons for the denial as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen informed the Board of a memorandum dated September 16, 1975 from Richard Gubanish requesting permission to visit Mr. Dave Barr, Chief Assessor of Centre County in regards to the Tax Assessment procedures of his office. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve the request made by Richard Gubanish, Chief Assessor as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen informed the Board of a letter dated September 11, 1975 from Louise Abel of Child Welfare Services advising that Marcia Wilson, Caseworker, will be receiving a salary increase effective September 1, 1975. Said letter stated that Mrs. Wilson is to be granted an increment from an annual salary of $11, 032 to an annual salary of $11, 540. Said increment based on her Performance Evaluation Report. Mr. Whalen read a letter dated September 10, 1975 from Fred C. Briggs, President, Charleroi Borough Council. Mr. Briggs stated in his letter that the Borough of Charleroi is in the process of trying to acquire the First Christian Church in Charleroi, to convert it into a Mini -Health Center. Said letter also stated that the Mon Valley Health Center would like to lease this building from the Borough of Charleroi and remodel it to their specifi- cations, at their own expense. Mr. Briggs stated that they were confronted with a financial problem and asked if the Commissioners could offer some assistance to make this project a reality. R emarks: Mr. Paluso: I looked into this and my understanding is that the congregate feeding program that takes place in the various Senior Citizens Centers - they do not do it in the present Senior Citizens quarters in the Second Street School Building in Charleroi. For some reason the State has not -seen fit to allow them to do it in that building. I understand that if the Church is remodeled and serve as a Health Center in which a lunch program is undertaken, then it would be permitted. Why the Second Street School Building is not being used as a nutrition program, I don't know. This is a strange situation. Mr. Flynn recommended that this matter be tabled until it can be arranged for Mr. Luppino to research this further. 412 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Chief Clerk read a letter dated September 9, 1975 from the Department of Agriculture, regarding rural transportation in Fayette, Greene, Washington and Westmoreland Counties. Said letter stated that combined efforts have helped the rural residents of these counties to have improved mobility, but the lackof coordination of their services has led to duplication of effort as well as inadequate use of private transit operators. Letter also stated t hat the Department is interested in exploring means of coordinating services and they have attempted to develop an innovative approach to this problem, which calls for establishment of a Scrip System in the four counties. Letter further stated that a meeting had been arranged with all interested social service agencies, county commissioners and private transit operators inv in the area to discuss this concept, on Tuesday, September 23, 1975 at the Holiday Inn, Washington, Pa. Chief Clerk read a letter dated September 17, 1975 from Clay Graham, Land Acquisition Agent requesting permission to attend a right-of-way course in Indianapolis, Indiana, sponsored by the American Right -of -Way Association. Mr. Graham stated that this ,I is a senior course in the economics of right-of-way valuation and would give him 120 educational credits toward his senior designation in the American Right -of Way Association. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approved the request made by Clay Graham as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a letter dated September 11, 1975 from Charles Crouse, Administrative Assistant regarding a request forwarded to him from the Washington County Home for Aged Men. Mr. Crouse stated in his letter that a regulation now in effect, states that long term care facilities must have a food supervisor who has met one of a few alternate basic requirements, and one of the alternates is completion of a correspondence or classroom course approved by the American Dietetic Association. Mr. Crouse stated that Mary Pradettd, supervising cook_ at the Men's Home would be most willing and interested in completing this course available through the University of Florida, and that she had been recommended highly by Mrs. Kasper. Remarks: Mr. Whalen stated that he had discussed this with Mr. Crouse, who recommended that the Board approve this to comply with a upcoming regulation. Mr. Whalen referred to a letter dated September 5, 1975 from the Retired Senior Volunteer Program, which stated that one major difficulty has been overcome by the Washington County Board of Commissioners since 1971 when they appointed us to the position of Protective Services Director for the Aged. Said letter further stated that this official position provides assistance to the County elderly for advice in dealing with contractors and other suppliers, and also assistance in applying for admission to nursing homes and other such institutions, etc. Mr. Whalen stated that by going back into the records it was found that this appointment was never made. Mr. Whalen then mentioned, as a follow up on this, that a letter dated September 16, 1975 had been received from Rev. Edward A. Sadvary, Director which reads as follows: Dear Mr. Flynn: Recently Mrs. Joan Owens called your office and said that I wrote a letter to the Greene County Commissioners telling them that you had appointed the RSVP Office as the Protective Services Director for Washington County and that they should do likewise. This is not the case. What I told them was: that I worked for the Washington County Commissioners as the Protective Services Director in 1971 and that I had experience in this field. I wanted to volunteer my experience and service free of any charge or obligation to Greene County because many people were calling my agency as well as other agencies. I felt with the official blessing of the Commissioners more could be accomplished. Mrs. Owens is not experienced in this field and has no one on her staff to do this work, but since she claims the position, I backed away as well as I could. I only want you to know that I was not involving your office in any way and I did not intend to misrepresent the facts in any way. /s/ Rev. Edward A. Sadvary Remarks: Mr. Flynn: We will let this matter rest, but the fact remains that on the basis of the letter he sent to Greene County, they did appoint him and then rescinded the action at a subsequent meeting. Mr. Whalen informed the Board of a request for field registration to be held in Township Building in Prosperity, from Edna Miller, Committee Woman. Mr. Whalen informed the Board that we had received, from the Secretary of the Corn iarrwealth, samples for the election which cover the Judicial ballot on the retention basis which involves the Superior Court. Mr. Whalen stated that there are no retentions in this County. jMr. Whalen added that there was a copy of the retention ballot included, but this is all we have received up to this particular time. Mr. Whalen read a letter dated September 9, 1975 from the Penn's Southwest Association requesting support for their 1975 funding. Said letter gave a brief statement regarding the record of the Association which was created to expand employment and business opportunities in the nine counties in Southwestern Pennsylvania, and also elaborated on the rationale behind the Association's program. Said letter stated that the annual budget objective of the Association is to generate funding of $1 million dollars, and that they appreciated the generous support we have given them previously. The Association requested a contribution of $1, 000 for 1975. Remarks: Mr. Flynn suggested that the Association should be considered in next year's budgetary appropriations. Mr. Flynn stated that we did make a appropriation to them in 1974, so we will follow up in this manner and make it a budgetary item. Mr. Whalen read a letter dated September 9, 1975 directed to Anthony Luppino Director of Adult Welfare Services from Ian G. Rawson, Research Associate, thanking Mr. Luppino and his staff for the assistance provided during the Washington County Phase of their Health and Nutrition Survey. Said letter stated that the interviews obtained were currently being prepared for computer processing, and they hoped to have a report on the project available before the end of the year. Mr. Whalen read a letter dated September 10, 1975 from Mrs. Walter E. Keally of the St. Francis of Assisi Library in Finleyville, Pa. Mrs. Keally expressed the Library's pleasure in participating in the programs offered for children on Tuesday mornings at Mingo Creek- County Park. Mrs. Keally stated that they had found the programs very interesting, well selected and well prepared, and they look forward to joining in similar programs in coming years. Mr. Whalen read a letter dated September 10, 1975 from Mary C. Harris, Special Assistant to the Governor regarding the control of explosives in the Department of Environmental Resources. PALUSO, COMMISSIONERS Governor Shapp concerning this matter, and she stated that it has not come to her attention that there is any reorganization planned in the Bureau of Surface Mine Reclamation and Land Protection, however, she did ask Dr. Goddard to take Mr. Flynn's recommendation under advisement in the event that any action in this area is planned. Remarks: Mr. Flynn stated that this reply relates to a meeting several weeks ago which Rev. Davis attended, and this was the follow up on his request. Mr. Whalen read a letter dated September 9, 1975 from the Wheeling Creek Watershed Commission submitting to the Washington County Board of Commissioners the Estimated Budget for the period July 1, 1975 to June 30, 1976, which was approved at the annual Watershed Commission meeting of July 30, 1975. Also enclosed with said letter, was a copy of their annual audit, by H. S. Hutzell & Company, for the past fiscal year. R emarks: Mr. -Flynn noted that a meeting will be held in the Public Meeting Room, Monday, September 22 at 2:00 p. m. with the Wheeling Creek Watershed Commission relating to the two dam sites in Greene County. 11:00 A. Remarks: Mr. Bontempo of Wallover & Mitchell: The bid documents were issued to four bidders, all of which we have had conversations with, and to the best of my knowledge, three out of four were going to submit bids and I am at a loss as to why we did not receive any. Mr. Flynn: What would suggest that we do at this point? Mr. Bontempo: There is no pressing need, because all of the coordination necessary for the receipt of the dental equipment has been taken care of. We will have to have conversations with them to see what their reasons were for not submitting bids and make a judgement on wha should be done. Is there any possibility that we would not have to take bids on this equipment, bud rather go to a dental equipment company and negotiate a contract with them? Mr. Gilmore: I am not sure. It seems to me that if no one will bid, that does not mean that you cannot buy. There must be something you can do here, so I will take a look into the matter. Off hand, I think that after a reasonable and diligent effort to try to get bids, you should be able to get it on your own. Mr. Paluso: I recommend then that the Solicitor give us an opinion regarding this s1tuation by the next meeting. (Mr. Carl, a representative from Hafer Plumbing & Equipment Company, asked Mr. Flynn what the procedures were concerning the bids for the air conditioning. Mr. Flynn explained that when we have a substantial number of bids on any given item, we table the subject matter for the time being in order to give our legal department a chance to .peruse the bids to make sure that they meet the specifications. Mr. Flynn added that hopefully within the next week or two we will then be able to award the bid to the lowest responsible bidder.) Chief Clerk read a letter dated September 12, 1975 from the Soil Conservation Service regarding Cross Creek dam sites and obtaining road permits in the pools of these sites Said letter stated that since a meeting on August 19 with Clay Graham to determine how to proceed, they had contacted the Deputy Secretary for Highway Administration, who suggested that we work through the District Engineer for PennDOT at Uniontown, Mr. Jim Wilson. Said letter also stated that Mr. Wilson knows the criteria necessary to obtain PennDOT approval on the Legislative routes, and he in turn can obtain the necessary PennDOT approvals through their Harrisburg office. Chief Clerk read a letter dated September 12, 1975 from the Washington County Humane Society asking the Commissioners for financial support in order to finish and furnish the $112, 000 building it now has under construction. Said letter stated that the Society needs $45, 000 to complete the building which will enable them to keep more, and for a -longer time, some of the animals left on their doorstep. Said letter further explained the procedures at the shelter and mentioned several people who were involved with the Society and its functions. Porter, Attorney at Law, directed to Clay Graham, Land Acquisition Agent, regarding Harmon Creek Flood Control, Site 480. Dear Clay: At the earliest possible meeting (September 18 if possible, otherwise September 25) please have the Commissioners adopt a resolution under the provisions of Act No. 4 of 1972 to acquire by eminent domain the following flooding or flowage easements, all in Jefferson Township: 1. Said letter stated that the agreements had been executed on behalf of the Service, and they were now being presented to the Commissioners for their approval. Mr. Whalen stated that Mr. Gilmore had reviewed the Trust Fund Agreement and found it in order. Mr. Whalen read the following memorandum from the Office of Manpower Plann regarding confirmation of two additional slots under Title VI, dated September 17, 1975: As discussed in the Agenda Meeting September 17, 1975 this letter confirms the approval to fill two additional slots under Title VI, (1) for Child Welfare Services as per Mrs. Abel's request, and (1) for Council of Governments for an Inspector for the Rodent Control Program. Said letter gave a brief summary of Mr. Kinskey's background and experience, and also mentioned that Mr. Kinskey had served their organization in different board positions over the past ten years. Mr. Whalen informed the Board that he had been advised by Warden Roupe, Mr. Bevec and Mr. Ermil Caleffie that the present washer in use at the Washington County Prison is in very poor condition and could possibly break down at any time, and they had asked that the Commissioners advertise for a replacement unit. Mr. Whalen stated that he had discussed this matter with them and recommended that the Board advertise for the washer. Moved by Mr. Jones, seconded by Mr. Paluso, that the Chief Clerk be authorized to advertise for bids for a washer at the Washington County Prison. Said bids to be received in the Office of the County Controller until 11:00 a. m. , Prevailing Time, Thursday, , 1975, and publicly opened immediately thereafter in the presence of the County Commissioners. Mr. Whalen referred to a meeting several weeks ago, at which the Commissioner; approved an additional payment for the National Guard, and he stated that action had not been taken to make the necessary budgetary transfer at that time. Therefore, Mr. Whalen recommended that the Board of Commissioners approve the transfer of $2, 0.00 from Account 1499-1 (Balance at End of Year) to Account 626 (National Guard Budgetary Account). Mr. Whalen stated that the next matter of business involves the refurbishing of Courtrooms No. 1 and No. 2, and as a part of the Bond Issue which was formulated in 1974, there was money set aside to do this work, but thus far no action as been taken. Mr. Whalen stated that the only use that has been put to this money, was the corrections made for the Courts with the Domestic Relations and Adult Probation Offices involved. PALUSO, COMMISSIONERS that the balance of this money is still remaining, but with the Bicentennial year fast approaching, he recommended that the Board get some minor architectural advice and then proceed to draw up specifications for the refurbishing of those two courtrooms. Remarks: Mr. Paluso: Several months ago, I believe we discussed this and as a part of the Bicentennial there is a fund to be used by another county to refurbish the interior. I thought that this was supposed to be investigated to see if we could apply to that, and this in turn would free us to do some of the other things that need done. Mr. Whalen: Pending some additional correspondence, right now the answer from them is No, but hopefully we can develop some additonal information. However, I would not hold out any hope for help from that source. I believe there should be a joint meeting between the Board of Judges and the Board of Commissioners to further explore this matter because this involves a considerable amount of money. Mr. Flynn: I think the proper thing to do, is for you to make arrangements to meet with the Judges to discuss this problem, iron out all the pros and cons and then proceed from there. In the meantime, we could still follow through and check with Chuck Chattaway to see if there is any money we can get. Mr. Whalen informed the Board that he had received, through the Superintendent' Office, a proposal from Pearl V inocur, Interiors of Pittsburgh to refurbish Judge Sweet's chambers. Mr. Whalen stated that this letter had been addressed to Judge Charles Sweet, who then turned it over to Mr. Bevec. Mr. Whalen also stated that this proposal calls for the expenditure of $7, 896. 20 to refurbish the chambers, and he read the list of the following items to be included in the refurbishing. Gnl i ritnr• Solicitor Gilmore presented a proposed Agreement for the Board's consideration whereby Washington County would purchase from Washington Tool and Machine Company two tracts of land situate in North Strabane Township, Washington County, Pennsylvania. Mr. Gilmore stated that the Board had asked him to look into an agreement some time ago for the purchase of land for our Eighty Four Industrial Site. Mr. Gilmore stated that as in most of these agreements, WIDC eventually takes title to the land after we initially acquire it, and then they acquire the funds to buy it back from us. This agreement merely provides that we are going to buy the land from the people who are selling it, which is Washington Tool and Machine, and then they will in turn buy it from us after all the arrangements are made. Mr. Gilmore added that this agreement is for our own protection and recommended that the Board enter into this agreement.
