COMMISSIONERS Mnute No. #74 Office of the County Commissioners Washington, Pa., July 5, 1973 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso and Flynn. Also present being: Acting Chief Clerk & Administrative Assistant Whalen; Assistant County Solicitor Gilmore;- Michael George - Director of the Department of Parks & Recreation; Mr. Keery McA mbley - Director of the Washington County Industrial Development Agency; Reporter Budinger of The Observer - Reporter; Mrs. June Lilley of The Daily Notes; Mr. Earl Bugaile - WKEG; and .Mrs. Helen Mller of The League of Women Voters of Peters Township. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr., Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions or omissions to Minute No. #73, each member having received a copy. as read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. #73 be approved, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Reports - None Old Business - None Correspondence - Mr. Whalen Acting Chief Clerk informed the Board of the following checks which were received by the Commonwealth of Pennsylvania: ;Bills) 'or payment: (a) State Council of Civil Defense - $2, 562. 05 - personal and administrative reimbursement. (b) Two checks - one in the amount of $6, 000. 00 representing the State's share for the Senior Citizens Center and the other check in the amount of $6, 000. 00 representing the Federal share for the Senior Citizens Center as received from the Department of Public Welfare, Office of Adult Pro- grams, Bureau for the Aging. (c) Check in the amount of $2, 775.25 representing final payment to Washington County for the Sewage Facilities Assistance Program. Remarks: Mr. Jones: Have you checked out everything on the first bill for Mr. Sprague? Mr. Whalen: Yes, and it has been approved by District Attorney Costa. Acting Chief Clerk read a copy of a letter sent by Mr. William Sember to Mayor George Stewart under date of June 28, 1973, in reference to the Mass Transit Study for Greaten Washington Area. Correspondence stated that Mr. Sember is forwarding three draft copies of a tentative work program for a study of the Mass Transit Study for Greater Washington Area. Correspondence stated in conclusion that upon review of said draft that Mr. Sember would suggest a meeting between Mayor Stewart and/or designated representatives and the staff of the Planning Commission to finalize the work program. Correspondence stated tLlso that a decision must be made as to whether the application will be submitted to PennDOT or UMTA (Fed. Gov.) and that in the meantime Mr. Sember will be in contact with PennDOT relative to obtaining a list of transit planning consultants and any additional information that may be re- quired. Acting Chief Clerk also read a copy of a letter from Mr. -Sember directed to Repre- sentative J. Barry Stout which stated that the Washington County Planning Commission is not preparing a mass transportation study for the Greater Washington Area; said task will be done by a transit consultant based on competitive bidding. Correspondence stated that the Planning Commission has only agreed to formulate a work program to serve as a guide for the Washing- ton City officials to follow in requesting proposals from consultants and that since the proposed study has been initiated by Washington City officials and since the study is for the Greater Wash- ington Area, any inclusion of the B entl eyvill e- Ellsworth areas into this study is a decision that has to be made by City officials with advice from the consultant that is chosen. Flynn for the courtesies extended to the city officials at the Public Transit Meeting of Friday, June 8, 1973, in the Commissioners' Conference Room. Acting Chief Clerk read correspondence under date of June 27, 1973, from C. Vance DeiCas - McDonald Associates Engineering, directed to Michael R. Flynn, which request- ed the county to submit in writing the payment status of each job that is now under progress; correspondence listed said work involved with the county. Correspondence also listed all in- voices and their amounts which are current only to April 1, 1973. Mr. Jones: He is asking why we have not paid the bills. I think we have a couple of cases in Court right now under mandamus asking this same question. Nfr. Flynn: We did have our legal department file a petition of mandamus. We will acknowledge receipt of the letter telling him that we have done everything possible. Acting Chief Clerk read correspondence under date of July 2, 1973, directed to F. D. Whalen, from Metro Petrosky, Jr., Director of the Adult Welfare Services, which en- closed the narrative and budget for the Protective Care Unit of the Adult Welfare Services Office for 1973-1974; said service including Protective Services, Information -and Referral and Foster Homes. Correspondence requested the County to contribute $1, 9 29. 00 as the cash contribution for the continuation of the Protective Care Unit which will cover the cost of supplies and telephorme. Correspondence further stated that said sum will enable the County to be eligible for a grant of W, 374. 00 from the State Government which will cover the cost of personnel, transportation and other miscellaneous costs incurri6d by the program. Moved by Mr. Paluso, seconded by Mr. Jones, authori2ing Mr. Metro Petrosky, Jr. , Director of the Adult Welfare Services, to submit the requested budget for tho Protective Care Unit of the Office of Adult Welfare Services for 1973-1974-. Acting Chief Clerk informed the Board that Mr. Joseph Mouyard, Clerk of Courts, ,,vho is a member of the Committee on retention and disposition of various county records, has Submitted to the Commissioners a tentative proposed schedule for, the records maintained by the Dffice of the County Commissioners. Mr. Whalen stated that .said matter was brought.up at the _ :!onventi.on and that the final meeting to take action on the Commissioners' portion of this is in September and that between said. time possibly -the Commissioners, the, ol.i-citori and Mr. Mou- ;lard could have a meeting to review said schedule and possibly make any -additional suggestions -o incorporate into the schedule._ Vfr, Paluso: I think that we ought to have the Solicitor give us -a written Qpir>ion>on whether or=not -;his schedule conforms_ to all legal requirements. PALUSO, COMMISSIONERS Acting Chief Clerk read correspondence under date of June 21, 1973, from Controller Peter Elish directed to Michael R. Flynn, which stated that a review of the records indicate that several of the Lessors of space for the District Magistrate offices have faded to provide Liability insurance in compliance with the terms of their leases. Correspondence listed said Lessors. Correspondence stated in conclusion that it is requested that the County Solicitor expedite compliance with said requirements. Mr. Whalen: In order to comply, we have directed all of the landlords in this case to furnish current insurance certificates. We have received three new ones and a letter from one other one stating that said certificate is forthcoming. Acting Chief Clerk read correspondence under date of June 25, 1973, from Naomi " Hilton, Director of the Washington Area Senior Citizens Center, Inc. , directed to the Washington County Commissioners in reference to said Center. Correspondence stated in conclusion that funds to continue the Meals -on -Wheels program are desperately needed. N1r. Flynn: We will acknowledge receipt of the above letter. Acting Chief Clerk read a News Release under date of June 29, 1973, from Charles G. Schlimm, President of the 'Pennsylvania State Association of County Directors of Veterans Affairs, which stated that at the Annual Convention held in Allentown, Pa. , recently Mr. Elmer Obitko of Washington County was appointed to the Hospital Committee. ` News Release stated that Mr. Obitko's record as a director is an outstanding one and that Washington County should be proud to have a man of Mr. Obitko's ability handling the position of Director of Veterans Affairs. Acting Chief Clerk read correspondence under date of June 29, 1973, from James R. Kelley, President of the Board of Trustees, Westmoreland County Bicentennial Association, Inc. , directed to Michael R. Flynn, which invited the Commissioners and the citizens of Washington County to attend activities during the week of July 8th through July '14th but particularly at the parade in the City of Greensburg on July 14, 1979, to help celebrate the-200th anniversary of Westmoreland County. Acting Chief Clerk read correspondence under date of June 29, 1973, from William Sember directed to Michael R. Flynn, which was in reference to the Catsburg Project. Corres- pondence stated the latest events concerning said Project. Correspondence, stated that there were still some unanswered questions concerning the use of Mon City property for the treatment Facility, demolition of the incinerator and refuse removal cost, Fritch property cost ,and right -of- wa.y cost. Correspondence stated in conclusion that the Commissioners have three options: (1) purchase the Fritch property - $9, 000. 00 to $10, 000; (2) Purchase a right-of-way through Fritch ?roperty (cost unknown) and underwrite cost of incinerator and refuse removal ($6, 000 & $17, 000. This would entail the' use of approximately 2-3 acres of Mon City property; and (3) do not take any action. Luley, Regional Sanitary Engineer - Bureau. of Water Quality Management, directed to Alchael R. Flynn, which stated that,the Department of Environmental Resources'has recently adopted Rules and Regulations to control -Erosion and Sedimentation. Correspondence stated that ane provision -of these regulations required -any municipality which issues building permits to notify said Department immediately of all earthmoving activities over five acres and that a municipality is not to issue a building permit to those engaged in-earthmoving activities on areas ever 25 acres until said Department has issued the erosion control permit'. Correspondence stated in conclusion that it is- requested that said information -be forwarded to the Washington County Conservation District, Mr. Paluso: I would suggest that the- above be forwarded -to -all municipalities. - . Bloom, Esq. - Chairman of the Renovation of Courthouse Committee of the Washington County BAr Association, which requested that the -County Commissioners proceed forthwith for making a study and planning for a future Court Annex which should house all of the offices other than those Dertinent to the operation of the Courts. Correspondence requested that all operating personnel and all interested parities be present and listed said schedule of ,times allotted: Mr. Whalen: Tony Bevec has been given the schedule so that 'he can coordinate it with his employees. Acting Chief Clerk read- co•rrespondence'under date of'Jurie'181, 1973, from the Wash- ington County Humane Society directed to the Commissioners which requested financial assist- ance this year. Correspondence stated' that according to Acts 338 and 339 of 1972 that certain free local transit service in Pennsylvania 'Will be Orovided to persons " 65 years of age or older. PALUSO, COMMISSIONERS Tax Bureau, which stated that for the year 1971 a penalty has been assessed in the amount of $1, 822. 98 plus interest in the amount of $362. 78. ' A long discussion was then held on said mat- ter. In conclusion, Mr. Whalen informed the Board that correspondence has been directed to Mr. Seaton requesting all pertinent information on said matter and that a reply should be forth- - with. Chairman suggested said matter be held in abeyance until said reply is received from Mr. Seaton. Mr. Keery McAmbley, Director of the Washington County Industrial Development Agency, made a presentation to the Board in reference to Mac -Plastics, Inc. , proposing to buy 6. 5675 acre tract of land in Chartiers Township and an additional 1. 5408 acre tract across Chartiers Creek in North Strabane. Mr, McAmbley stated that said tract of land has been appraised by York Realty for the sum of $37, 000. 00. Moved by Mr. Paluso, seconded by Mr. Jones, that the Washington County Board of Commissioners recommend to the Court that permission be granted for the sale of the above- , w , mentioned property to Mac -Plastics, Inc. Acting Chief Clerk read correspondence under date of June 25, 1973, from E. Drexel Godfrey, Jr. , Executive Director of the Governor's Justice Commission, directed to the Commissioners which informed that on June 20, 1973, the Governor's Justice Commission awarded the subgrant No. #SW-184-71E in the amount of $26, 794. 00 for the project known as "Physical Upgrading of Prison" and the duration of the project is to be from February, 1973 to June, 1973. Acting Chief Clerk also read correspondence under date of June 22, 1973, from William L. Patterson, Director of Planning - Governor's Justice Commission, which requested that if the Commissioners are considering requesting the Governor's Justice Commission funds Suring 1974 that an enclosed questionnaire must be returned to the Council's office no later than July 31, 1973. Acting Chief Clerk read correspondence under date of June 25, 1973, from Honor- , . able Judge Paul A. Simmons directed to Mr. Flynn which enclosed a letter from Dr. Kathryn H. Lewis in reference to updating and 'improving the Washington County Juvenile Detention Center. Mr. Whalen: I would recommend that we combine the Juvenile Detention Home, any additional Items which may have to be done at the Jail and also take the Juvenile Court office into consider- ation and see if programs can be developed that will come under the umbrella of the Governors' Justice Commission. 8 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Sember, Execu- tive Director of the Washington County Planning Commission, be appointed to replace John Anthony on the Wheeling Creek Watershed Commi*lssion; said appointment to become effective immediately. Motion carried unanimously. 1 r Moved by Mr. Jones, seconded by Mr. Paluso, that Mr. Joseph Frye, c/o Frye Lum•- ber Company, 6th and Railroad Streets, Monongahela, Pa., be appointed to fill the unexpired term of Judge Paul A. Simmons, who resigned, on the Redevelopment Authority Board; said term to expire July 31, 1974. .I , Roll call vote taken: r Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chairman informed the Board that a Mr. Ralph Gundlach was in his office on Monday, July 2, 1973, in reference to his County Taxes. Chairman stated that Mr. Gundlach had drafted a check on June 28, 1973, payable to Malcolm L. Morgan, County Treasurer, in the amount of $76. 69 (net amount less discount). Chairman stated that Mr. Morgan refused to accept said check. Chairman further stated that on Tuesday, July 3, 1973, he instructed Mr. Whalen to contact Mr. Morgan to ask him to accept said check, but Mr. Morgan refused and stated that he had refused other people the discount on Monday. Chairman stated that the tax duplicate definite - ly stated that five (51o) percent discount is applicable if paid on or before June 30, 1973, which fell on a Saturday and that the Treasurer's Office is not open on Saturdays. Chairman further stated that it is the County Commissioners which establish from January 1, 1973 to June 30, 1973, to pay the discount on county taxes and that said persons whould not be penalized because said date fell on a Saturday. Assistant County Solicitor Gilmore stated that it is his opinion that since the Commis- sioners set the date for paying taxes at discount that the Commissioners can also extend that dates for a legitimate cause; furthermore, since the final date to pay the discount falls on a day which C 1 U MINUTE BOOK 9 $OARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Moved by Mr. Paluso, seconded by Mr. Jones', that it be made a matter of record that in the event that the last day to pay and County Tax and/or Penalty at Face or Discount should fall on a non -working day, that the taxpayer be allowed until the close of business on the next working day to take advantage of same; said policy is to be applicable for 1973'taxes and said policy is to be applicable in the future years. Remarks: Mr. Paluso: I think that Mr. Whalen should contact the Treasurer and tell him to go back to the ones that were paid on Monday. Motion carried unanimously. Solicitor: Assistant County Solicitor presented a request from the West Penn Power Company for a right-of-way for improved and relocated roads in Mingo Creek County Park. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of Commissioners approve and execute the Right -of -Way Agreement with West Penn Power Company to construct, operate, maintain, repair, renew and remove an electric energy system or systerr s consisting of such trenches, vaults, conduits, etc. , as grantee may at any time deem necessary . .I r across land or grantor (s) known as Mingo Creek County Park; said action based upon the rdcom- mendation of the Assistant Coantyr Solicitor. Assistant County Solicitor presented a Resolution to the Board in connection with the condemnation of certain tracts of land for purposes of recreation and expansion of the Mingo Creek County Park for consideration and approval. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of Commissioners approve and execute the Resolution that the County acquire by condemnation for purposes of recreation and expansion of the Mingo Creek County Park the following described parcels or tracts of land, all situate in Nottingham Township, Washington County, Pennsylvania: 1. Tract of William J. Bartram, Jr., containing an area of 75 acres, more or less. 2. Tract of William J. Bartram, Jr. ; and Marjorie •B. Bartram, his wife, containing an area of 114. 333 acres. 3. In said memorandum Mr. Sember made reference to public information meetings which were held con- cerning the abovementioned subject at which only 5 out of 14 communities from the Washington Area were represented, and 1 out of 19 communities' from the'Mon Valley was represented. En- closed with said memorandum was the following information: (1) Questions and Answers relatin; to the National Flood Insurance Program; (2) A Model Resolution of Compliance with the Flood Insurance Program Regulations; and (3) An Application Checklist. Mr. Sember strongly recom- mended that the abovementioned material be reviewed and the severity of the situation in each community relative to the Flood Insurance Program be examined. Mr. Sember stated that any Elected Official who feels that there is sufficient justification for his community to become eligi- ble under this program should read the enclosed checklist and adopt the enclosed resolution and notify the Planning Commission by mail or phone of his intention. In conclusion, Mr. Sember stated that if the response from local communities is great enough, the -County P1aCnning Commis - sion will consider entering into a contract with the Commonwealth to, undertake ,the tasks neces- sary to have the community certified. If the response is not great, the Planning Commission will provide technical assistance to those interested communities. Mr. McAmbley informed the Board that said Company has sub mitted a $500. 00 deposit towards the purchase of said land.
