PALUSO, COMMISSIONERS Minute No. 77 Office of the County Commissioners Washington, Pa., July 26, 1973 The Board of County Commissioners met in regular session with the following mem- bers being present: Commissioners Jones, Paluso and Flynn. Also present being: Acting Chief Clerk and Administrative Assistant Whalen; A/fr. Earl Bugaile of WKEG;.Reporter Robert- son of The Observer -Reporter; Mr. Jack Merdian of WJPA; and Mrs. June Lilley of The Daily Notes. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections., additions or omissions to Minute No. 76, each member having received a copy. read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 76 be approved, as Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Reports: Mr. Jones - Mr. Paluso Commissioners Jones and Paluso reported on an inspection made by them at the Washington County Airport and in conclusion of the report recommended that the Commissioner, be authorized to advertise for bids for the sealing of the runway at the Airport and the taxi w$sy leading to the runway. Authorization to Advertise: Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington Cot}nty Commi.9- sioners be authorized to advertise for bids for the sealing. of the runway and the taxi way leading to the runway at the Washington County Airport. Said bids to be received in the Office of the County Controller until 11:00 a.m., Prevailing Time, Thursday, 1973, and opened immediately thereafter in the Office of the County Commissioners. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Jones further reported on the present highway program and a meeting held by the Southwestern Pennsylvania Regional Planning Commission on Monday, July 23, 1973, at which meeting the problems being presented by the highway program were discussed. ( a discussion was held) MINUTE B❑❑K 31 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES. JR., EDWARD M. PALUSO, COMMISSIONERS (Assistant Solicitor Gilmore entered the meeting) Mr. Whalen- stated that he has been meeting with the planning department of the Governor's Justice Commission concerning the upcoming budget for their department. The areas discussed were the Emergency Medical program and improvements to the County Jail and the Juvenile Detention Home. Mr. Whalen stated that they will hold another meeting after additional information has been received from the Jail and Juvenile Court. Mr. Paluso requested that Mr. Whalen defer any recommendations until his committee has completed their investigation of the jail because they are going to submit corrective, construc- tive recommendations to the County Jail. Mr. Whalen also informed the Board that he discussed the radio equipment for ambu- lance services in the County with the Governor's Justice Commission and although this phase does not fall within their framework on their Emergency Medical Services, funding may be obtained through the Federal Highway Safety Act which is sponsored by Penn DOT. Mr. Whalen stated that Mr. Sember of the Planning Commission is checking into this. In reference to the stream clearance that was necessary after Hurricane Agues, Mr. Whalen stated that Washington County is entitled to approximately $49, 000 which was ex- pended to pay the contractors for the stream clearance with the understanding that the county would be reimbursed from the State Office of Civil Defense. Mr. Whalen stated that due to the illness of Mr. Yuhas, he has requested the file so that the matter can be looked into. Mr. Whalen stated that Washington County's request to construct a new 250-bed county home facility was unanimously approved at the mon#lily board meeting of the Compre- hensive Health Planning Association of Western Pennsylvania held on Wednesday, July 25, 1973. Old Business: Mr. Whalen Acting Chief Clerk read correspondence under date of July 19, 1973, from Metro Petrosky, Jr., Director, Adult Welfare Services, responding to correspondence from Acting Chief Clerk under date of June 7, 1973, concerning the establishment of a Senior Citizens Cen- ter in the McDonald area. (Attached to said correspondence was a memorandum from Deborah DeStefano, Senior Citizens Coordinator) Mr. Petrosky stated that in their opinion the Senior Citizens in the McDonald area are not ready for the establishment of a formal Senior Citizens Center and the attitude that prevails at this point in time is that this group is satisfied to meet on an informal basis monthly. Motion carried unanimously. Acting Chief Clerk read correspondence under date of July 17, 1973, from James R. Showrank, Project Coordinator, Southwestern Pennsylvania Economic Development District, stating that the Seventh Annual Report of the SPEDD has been accepted by the Board of Directors and is available to be officially presented to the County Commissioners.Mr. Showrank requested to be placed on the agenda for the next meeting to present a brief summary to the Commissioners. Acting Chief Clerk read correspondence under date of July 23, 1973, from Keery McAmbley, Director, Washington County Industrial Development Agency, stating that SPEDD has requested each of the participating counties to pay at this time their local share for funding the District Office, which in turn makes possible the Appalachia Grants secured in the District. Washington County's fair share of the local budget based on population, land area, and distribu- tion is $1, 906. 00. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing payment of $1, 906. 00 to SPEDD as Washington County's share in funding the District Office. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of July 9, 1973, from James D. Barger, Commissioner, Pennsylvania State Police, stating that the primary objective of all police departments in Pa. is to render the most efficient and effective police service possible. To assist in attaining this objective, a system of liaison and mutual cooperation among all police departments must be established. PALUSO, COMMISSIONERS L 1 1 Washington County Mental Health/Mental Retardation Clinic for Washington County to provide $4. 00 a day needed to secure residential placement for Randy Young, who has been under the auspices of the MH/MR Program since 1969 in the Children's Developmental Center in Abbotts- town, Pa. Randy was previously in Pry Home, West Sunbury, Pa., but is to be released due to the home reducing its population. Moved by Mr. Paluso, seconded by Mr. Jones, "that the above request as submitted by the Washington Co; MH/MR Clinic be approved. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of July 20, , 1973, from Philip T. McGee, Chief, Planning and Grants Section, Division of -Solid Waste Management, Department of Environmental Resources, informing the Commissioners that the Washington County Solid Waste Management Plan, as prepared by Green Engineering Company and the Washington County Plan- ning Commission, now meets the technical requirements of the Pennsylvania Solid Waste Manage - ment Act and is, therefore, provisionally approved. Acting Chief Clerk read further correspondence from C. ,Victor Funk, Program Specialist, Department of Environmental Resources, stating that our claim for reimbursement under the watershed agreement for fiscal year 1972-1973 between the Washington County Com- missioners and the State Conservation Commission has been reviewed. It has been determined that all the items of the Department's agreement and the supporting documentation is adequate to justify our claim, and accordingly the invoice will be submitted to the Comptroller's office of the Department of Environmental Resources for payment processing. Acting Chief Clerk read a copy of correspondence under date of July 18, 1973, from Alexander Unkovic, Esquire, directed to The Honorable Raymond L. Scheib, Chairman, Penn- sylvania Labor Relations Board, enclosing a Petition requesting Authority -to file a brief Amicus Curiae on behalf of the Pennsylvania Conference of State Trial Judges. Said petition is in refer- ence to the matter of the Employees of Washington County, Case No. PERA-R-2209-W. ( a brief discussion was held) Acting Chief Clerk informed the,Board that lthe ,County has received $1, 843, 505. 00 from the Federal Government in Federal Revenue Sharing Funds,to date. Acting Chief Clerk read correspondence under date of July 19, 1973, from J. B. Marino, Branch Manager, General Elevator Company, -stating that their contract for the installa- tion of the elevator includes three months of free service on the elevator which was recently installed in the Courthouse. Mr. Marino stated in conclusion that he will prepare and submit to the Commissioners for their consideration General Elevator's standard Full Maintenance Agreement. Acting Chief Clerk presented to the Board a request _under date of July 24, 1973, frorr. the Child Welfare Services for funds in the amount of $106. 27 for transportation for Elmer David Lloyd to Minot Air Force Base, North Dakota, where his maternal aunt and her husband will assume responsibility for him and possibly consider adopting him. Moved by Mr. Jones, seconded by Mr. Pal-uso, that the above -request as submitted by the Child Welfare Services be approved. Roll call vote taken: Nfr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk informed the Board of correspondence under date of July 18, 1973, from The Public Utility Commission, in reference to an application of George F. Fleeher for approval of the right to begin to offer, render, furnish or supply sanitary sewage collection and disposal service to the public in a portion of Cecil Township, Washington County. Letter stated that the Commission may consider the .above matter without hearing, provided no protests are filed on or before August 8, 1973, and requested that the Commissioners acknowledge receipt of their letter. Mr. Whalen stated that he acknowledged receipt of the correspondence on July 23, 1973. Moved by Mr. Paluso, seconded by Mr. Jones, that the Washington County Board of Commissioners adopt a resolution to include the Nbn Valley Road Project (Route 837) in the six - year highway program that was previously adopted by the Commissioners. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; 'N1r. Flynn - Yes. Motion carried unanimously. New Business: Mr. Flynn (Appointment of County Administrator and Chief Clerk) Moved by Mr. Jones, seconded by Mr. Paluso, appointing F. D. Whalen as County Administrator and Chief Clerk to the County Commissioners, effectively immediately. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. PALUSO, COMMISSIONERS order that it could be made a matter of record) Solicitor: Mr. Gilmore Mr. Gilmore stated that Mr. John Fantini, Director of'the Washington County Public Employment Program has advised the Commissioners that additional funds in the amount of $20, 000. 00 are available for operation of the Summer Youth Program which the County entered into with the Educational Programs Diocesan School Board of Pittsburgh, Inc., on June 21, 1973, The original allocation was $67, 696. 00 and Mr. Fantini requested that the Commissioners execute an addendum to the above contract making the allocation a total of $87, 696. 00 with the conditions and ,other provisions of the contract remaining the same. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board of Commissioners authorize the execution of an addendum to the abovementioned contract with the Educational Programs Diocesan School Board of Pittsburgh, Inc. , for an additional $20, 000. 00 for the operation of the Summer Youth Program. A brief discussion was held on the Sale of the IBM Computer to the city and it was decided that the matter be tabled until a further study can be made by the Solicitor's Office. Meeting adjourned. Paluso, Commissioner Commissioner Jones reported on the status of the County Airport in reference to expansion and the work which has to be done at said Airport. Mr. Jones stated that Vance DeiCas - McDonald Associates has submitted recommendations insofar as the sub -surface soil investigation and report being initiated and investigation of the entire runway. Mr. Jones read correspondence under date of July 31, 1973, from William Sember, Director of the Planning Commission, which recommended that test borings be undertaken to determine if in fact the problem relates to expanding clays or sulfide -'bearing mineral; and that once the borings are completed, a minerals analysis will have to be completed. Mr. Jones informed the Board that Mr. DeiCas has submitted an estimate in reference to the amount of blacktop needed according to FAA regulations. PALUSO, COMMISSIONERS William Sember, Director of the Planning Commission, which stated that one important pro- ject was not included in the Six -Year Highway Program which was adopted by the Commission- ers on June 12, 1973. Correspondence stated that said project involved about $400, 000. 00 worth of improvements to Main and Railroad Streets within the Redevelopment Project (PAR 355) in the city of Monongahela. Mr. Jones stated that as Per Minute No. # 77 the Commissioners passed a motion that said project be included in the 6-year Highway Program. Mr. Jones also read a special PHIA report under date of July 23, 1973. Old Business: Note was made that the proper bond has been filed with the County Controller with reference to the office of Chief Clerk and County Administrator. Correspondence: Mr. Whalen (check) Chief Clerk informed the Board of the receipt of a check in the amount of $5729. 10 for Mon Valley United Health Service, Inc. - Contract 1317 for the month of May, 1973. (bills) Moved by Mr. Jones, seconded by Mr. Paluso; that the following bills be approved for payment: (a) Griswold, Winters, Swain & Mullin - $934. 65 - Mingo Creek County Park for professional services from June 1st through June 30, 1973. (b) Frank Irey, Jr., Inc. - $38, 527. 08 - Mingo Creek County Park Contract. (c) Recreation Equipment Unlimited, Inc. - $3377. 50 - contract for 150 wood picnic tables. Chief Clerk informed the Board that the Treasurer's Office has advised that in connection with the delinquent penalty which has been collected by said Office during the period beginning January 1, 1972, (said money having been held in escrow due to a court case pending as to whether or not the Treasurer was entitled to retain it) - that Treasurer Morgan has de- posited to the General Fund all of the monies held in escrow in the total amount of $26, 931. 95. Mr. Whalen stated that bearing interest was in the amount of $18, 000.00 was in a savings account and included in Mr. Morgan's remittance to the County as interest earned in the amours: of $270.00. Chief Clerk read correspondence under date of July 25, 1973, from Joseph P. Kennedy, Director - Department of Revenue, Bureau of Institutional Collections, which stated MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS that on December 6, 19.72, Gocernor Shapp signed Acts No. 317 and 318 relating to payments of maintenance costs by counties to the Commonwealth for minors committed to the Youth Development Centers and Youth Forestry Camps; and that effective July 1, 1973, the rate will be 22 of the daily rate. Correspondence stated that the per capita daily rate of $26.00 will be applied to Youth Development Centers with the sum of $3. 25 as reimbursement from counties at 122%; and that the per capita daily rate of $22. 00 will be applied to Youth Forestry Camps- 2 with the sum of $2. 75 as reimbursement from counties at 121%. Chief Clerk read correspondence under date of July 25, 1973, from Mayor Virgil F. Puskarich, which requested another voter field registration day in Bentleyville befor the upcoming general election. Chief Clerk stated that a similar -request has been received from Hanover Township. Moved by Mr. Paluso, seconded by Mr. Jones, that the Board of County Commissioners instruct the Election Office to include said two (2) requests in the Field Registration locations. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk presented two (2) Medical Assistance Program Skilled Nursing Home Care Agreements which will expire shortly with the Department of Public Welfare; one being for the Washington County Home for Aged Women and one for the Washington County Home and Hospital for Men. Moved by Mr. Jones, seconded by Mr. Paluso, that the Chairman of the Board of County Commissioners, Michael R. Flynn, be authorized to execute the abovementioned Agreements subject to the perusal of the County Solicitor. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk informed the Board that in connection with the PennDOT Traffic Count Contract that it is necessary that the County will require two (2) vans for said purpose. Chief Clerk stated that said action is reimbursable under the contract. Chief Clerk stated that Mr. Sember has made an investigation of local dealers and that no vans were available. Chief Clerk stated that Mr. Sember has secured two (2) quotes; one from Avis for the total cost of $108. 00 per week and another from Hertz for the total amount of $133. 85 per week. Moved by Mr. Jones, seconded by Mr. Paluso, that approval be given for Mr. William Sember, Director of the Planning Commission, to accept the quote of $108. 00 as sub- mitted by Avis for the rental of two (2) vans for the PennDOT Traffic Count program. Chief Clerk read correspondence under date of July 25, 1973, from Eugene Tenaglia, Bridge Engineer, which stated that Mr. Tenaglia met with a Mr. Farabee on July 24, 1973, concerning the Manon Bridge # 69 spanning Ten Mile Creek. Said correspondence stated that Mr. Farabee has a combine which he has to take to other farms in the vicinity - said combine being sixteen feet wide (width of bridge is fourteen feet) so he cannot pass througr the bridge. Correspondence stated in conclusion that it is Mr. Tenaglia's opinion that it is not proper to warrant to widen said bridge to accommodate one individual becuase said bridge is in good condition. Chief Clerk read correspondence under date of July 30, 1973, from James H. Higgins, President - Penn's Southwest Association, which expressed appreciation and thanks to the Commissioners for their recent contribution. Chief Clerk read correspondence under date of July 25, 1973, from Hugh A. Hall, Acting Director - American Revolution Bicentennial Commission, which invited Washing- ton County to participate in the "Bicentennial Communities" Program. Siad correspondence enclosed documents to enable Washington County to receive recognition by the American Revolution Bicentennial Commission as one of the Nation'-s Bicentennial counties. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board of County Commissioners go on record to have Washington County participate in the "Bicentennial Communities" Program. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of June 21, 1973, directed to all County Commissioners, MH/MR Administrators and Regional Deputy Secretaries in reference to a cutback in Federal funds - County MH/MR Program, from Secretary of Public Welfare, Helene Wohlgemuth. Correspondence stated that the Federal government has taken actions which will seriously impact upon the financial operations of the Community MH/MR programs beginning July 1, 1973. Correspondence recommended that an re-evaluation of operational plans for 1973-1974'be taken -on the assumption that said Federal resource will be greatly re- duced. Chief Clerk read correspondence under date of July 23, 1973, from George Murin, Director - Mon Valley Campus, Westmoreland County Community College, which state& that approximately 25% of the students, attending the Mon Valley Satellite are from Washington County and that it is believed that said enrollment will increase substantially if Washington County will participate in terms of a reimbursement plan that is acceptable to the Commissioners. 40 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Assistant County Solicitor informed the Board that in reference to the Court Rules bill, that it is Mr. Hormell's and his own opinion that the County Commissioners should not pay said bill without a Court Order directing the Commissioners to do so. Assistant County Solicitor stated that several months ago the Board requester the legal department to issue an opinion as to the legal requirements for the installation of voting machines in the County. Mr. Gilmore stated that the statute in question was examined by the legal department, and that in conclusion, it will be necessary to have a referendum. Mr. Gilmore stated that said referendum can be done either on the motion of the Board or if enough citizens sign a petition they can force the Commissioners to have said referendum. Moved by Mr. Paluso, seconded by Mr. Jones, that the Washington County Board of Commissioners place on a county -wide referendum on the November ballot the question of whether to install or not to install voting machines. Remarks: Mr. Paluso: I think that the question as to be presented on the ballot should be submitted by the Solicitor to the Board of Commissioners for approval on the wording. In reference to the Home Rule Assistant Solicitor Gilmore informed the Boardd that they have two responsibilities, they are: (1) How it is to be initiated - by Resolution of the Board or the Commissioners can wait until a sufficient number of citizens petition the Board to do it. (2) The County is responsible for the mechanics of putting a spebial question on the ballot and all of the election problems that are going to be raised by having petitions, etc.. . Mr. Gilmore stated that other than the abovementioned, the Board will have no other responsib _- lities. If the Home Rule is voted in by the citizens, the County is obligated to pay actual expended costs. A final draft of the opinion will be given to each Commissioner prior to the next regular board meeting. (A brief discussion was held) Mr. Flynn: Yesterday, as was relayed on the news media, radio and T. V. and newspapers we held a meeting with all interested parties relating to the Yablonski case in some manner. The report as I read it this morning, was a little misleading, and the report as I heard it last night on T. V. was a little misleading. I talked to the District Attorney by phone this morning and I asked him what his opinion was and he agrees with me. PALUSO, COMMISSIONERS that we discussed was the payment of bills. I don't think that is fair to the Commissioners. The main thing was we were trying to determine what the overall picture is and what the status of the Yablonski case is now and in the future. We went on to relate different reasons why we were asking a number of questions. No one questioned the manner in which they were going about conducting the case. Naturally cost is a major item, the two bills presented to us yesterday was minor from the overall picture. I asked the question of Mr. Sprague shortly after the Pass Trial whereby a former Federal Official who now since has resigned, stated that as far as the Federal Government is concerned, the Yablonski case is closed and the gentleman related to me the government official's name who made the statement. Then I asked Mr. Sprague and according to him when he was on the news he said that there would be 3 to 4 more months needed. Now this morning when I read it, it says one year. Now I never heard the term one year used yesterday at all. It was 3 to 4 months. Now the question was raised, just where do we go from here? One of the questions being brought to the attention of the Commissioners, now I can speak for myself, but I can't speak for this Board of Commissioner: and no one can try to imply that I am. One of the questions raised to me as a Commissioner on many occasions is the retention of certain prisoners in places other than our local facilities right here, the jail. I said to the D. A. although the question is directed to us, it is a reflectioY_ on him, I can't answer that. I made it clear yesterday we are not the Judicial branch of government and we don't intend to be, and we are not in the law enforcement branch, we are in the Executive branch and our responsibility is to see that the necessary monies are available and that the necessary monies are spent right so on and so forth. The only thing is again, I thi-ik the point is missed, why some of these prisoners aren't in the jail. One in particular that did not testify in the Prater trial nor the Pass trial. The question was raised just whose prisoners are these? The question was are they Federal prisoners, are they State Prisoners, or are they County prisoners and the answer was that they are County prisoners and therefore they remain in the custody of the sheriff. The question was also raised that if that being so then why aren't these prisoners, those who are retained in places other than the jail, why aren't they under custody then in the local bastille over here? After I talked with Mr. Costa this morning and he is in concurrence, the question was reised who determines where these prisoners are being kept if they are County prisoners and the gentleman told me that although they are wards of the County so to speak and under the custody of the Sheriff as the Chief Law Enforcemzat Officer, that they are under Court Order that these prisoners whomever they may be are being held in their present location wherever they may be Order of the Washington County Courts. So the point I am trying to make is that relieves the Board of County Commissioners. We have no responsibility in this whatsoever and the intent of that meeting yesterday was to try to resolve some of these problems other than just the two bills that were submitted to us a 0 L� year late. Mr. Paluso: My own personal opinion is that everything is proceeding, I think, the way it is suppose to be done. Actually, the publicity I have seen has been rather uncompli- mentary and I think it should be just the opposite. There were five people convicted of murder here in probably the fastest trial time in -any major murder case that I am aware of. I think that the County deserves a pat on the back instead of unfavorable publicity about a few major bills. It has proved to my satisfaction that since our meeting with the District Attorney and the interested parties last June of 1972, it has been cheaper for the County to maintain the prisoners you are referring to, Mrs. Gilly. It has been cheaper as far as the County taxpayer is concerned to keep her where she is, whereever that may be. I figure approximately $20.00 a day cheaper. I think that financially we -have made out on the whole deal. Mr. Jones: I pointed this out to Mr. Sprague -that we are not questioning what they are doing with her, etc. Our responsibility as County Commissioners is to pay nodified bills when we get them. Mr. Paluso: I thinly that for the record I am totally opposed to private counsel and if they do that for their trial there is no reason for the taxpayers of this County to pay legal fees for' any appeals for these two men. ' If they need an attorney, I think we can tell - them right now that we Have no public defenders available down here on the payroll and they can use them if they so desire but I personally will absolutely not condone paying any legal fees for these gentlemen. In the meantime, however, it il; good construction -weather and Mac,Plastics and their builders would like to get site preparation started while we have this good weather so that they can get in the building as soon as possible. So they have requested that the County enter an agreement allowing them to go on the land even prior to the approval by the Court and prior to them actually owning the land and begin certain site preparation. Mr. McAmbley: A meeting took place on August 6, 1973, at the County Planning Office with I � Messrs. Sperring, Sember, Adamson, and myself along with those citizens of Chartiers Town- . E '- ship in the Neighborhood of Johnson Road. All of them came and raised what objections they had and we went over what objections they had at length. After the meeting, we then took the pro- - - -- blems that they had raised and put them into letter form and we sent this letter to them and in this letter we described what we were doing about those problems or what could be done about those problems. We then put on the letter that we were recommending to theCommissioners that they proceed with the sale of the property and that they give Mac -Plastics the right to go on the land during this building season. We said specifically in the letter that if the people had any problems that they thought we hadn't answered correctly that we would ask them to contact the Chief County Clerk and be here today and state those problems and as you can see, none of them are here today. We have done our best as a committee to assure these people that by the county owning this land and controlling what is going to be there and the type of building to be on it, that the people down there are probably in far better hands than if it had been sold to some private developer. FLYNN. FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Mr. Flynn: We are here today to execute the contract which has been negotiated in good faith. I understand the contract has been ratified by all three (3) units; that is, Court -Related Employe -Qs, Professional Employees and Non -Court Related Employees, and we are, therefore, in a positior. to execute an Agreement in view of the fact that it has been ratified by the membership. Mr. Stackhouse: That is definitely so. We had a special meeting on Saturday, August 18, 1973, for the Court -Related Employees and they voted by a vast majority to ratify the contract. I was sent a copy of the contract by your representative, John Felice, which I reviewed and found to be in good order. Mr. Whalen: Up to the final pages of this contract, all of these matters concerning the rights of both the management and union members were all negotiated at the bargaining table and this was all actually concluded prior to our last two meetings. The final negotiations came about in the way of Exhibit A of this contract which is Wages and Fringe Benefits and they are all out- lined under Exhibit A. The contract basically is the same in total value to the employee as the one just ratified for the Jail Guards with this exception. In the fiscal year 1973 the pay increas(! due to the lateness of the year was reduced to a total of $250. 00 however effective in January 1, 1974, it will be $550. 00 which will bring it back into the proper perspective with the other contract and then the third year of the contract the increase is $450. 00. The other important provision is that the County will provide fully paid life insurance in the principal amount of $5000. 00 to all employees. And also effective January 1, 1974, the County will contribute $10. 00 per montL toward hospitalization and effective January 1, 1975, an additional $10. 00 for a total of $20. 00 toward the cost of hospitalization, however, in the case of a single person at the present time it is understood that the cost will not exceed the monthly cost of the hospitalization which at present is around $18. 50, I believe. Employees who are scheduled to work four hours each day shall bE entitled to one-half of the aforementioned wage increases. Provision No. 7 it is understood that any employee who has already received a wage increase for 1973 will not be entitled to the aforementioned $250. 00 raise; however, if the raise already granted is less than $250. 00, the said employee will be entitled to receive the difference up to the maximum of $250. 00. It is understood that employees salary shall be calculated on an hourly basis for payroll purposes. This is a little change and the reason is that under this contract, for example, the employees here in the Courthouse work a 6z hour day. Due to this contract also incorporating forty hour per week employees which is a 8 hour day, the people working 322 hours, if they are required to work up to 8 hours, their overtime pay for up to 8 hours would be at their regular rate of pay and then the premium pay would come into effect after 8 hours. So this was necessary to do this because this covers two different hourly factors in the agreement. That basically is the Wage and Fringe Benefits which was negotiated with SEIU after many strenuous hours. Gossett, Secretary - Deemston Borough Council, which stated that since the original request for county aid funds for the replacment of the Hastings Bridge that a consulation has been made with McDonald Associates and it was found that the estimated cost of the project was far too low. Correspondence stated that there is a posibility that the Borough may be forced to purchase land for the relocation of &, stream which will add to the cost. Correspondence requested consideration and the allocation of as much of the available county aid funds to the successful completion of said project. Further discussion was held and Admisistrative Assistant Crouse was insturcted to prepare a financial survey prior to the next regular Board meeting before a definite decision is made. Commissioner Paluso suggested that the Architect be advised to hold in abeyance a zy further action at all on his part and also advise that the Commissioners are contemplating term - inating the whole project.
