PALUSO, COMMISSIONERS Minute No. # 84 Office of the County Commissioners Washington, Pa., September 13, 1973 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Clerk and County Administrator Whalen; Administrative Assistant Crouse; County Solicitor Hormell; Mr. John Merdian - WJPA: Mrs. Helen Miller of The League of Women Voters; Mr. Earl Bugail•: WKEG; Mr. Grant Liesch of The Brownsville Telegrp.ph; Mr. Bob Robertson of The Observer - Reporter; and Mr. Kelanic , WWVA. Old Business - None Reports: Commissioner Jones reported to the Board on the results of a meeting held on Tuesday, September 11, 1973, with the Southwestern Pennsylvania Regional Planning Commission members and other interested persons. Correspondence: (bills) Chief Clerk informed the Board of the receipt of the following checks: (a) Commonwealth of Pennsylvania - $2, 365. 03 - personnel and administrative expenses (Civil Defense). (b) Commonwealth of Pennsylvania - $1, 173.36 - public assistance payment for Child Welfare Services. (c) Commonwealth of Pennsylvania - $775.35 - 5016 reimbursement in connection with the Chartiers Creek Flood Control Project for legal expenses. Chief Clerk read correspondence under date of September 7, 1973, from C. Vance DeiCas, P. E. - McDonald Associates,, directed to Lawrence W. Walsh, Chief of Airports District Office, which stated that in compliance with the FAA's request, Wa.shin ton County Commissioners,have entered into a contract with McDonald Associates Engineering and Ross - Adams, Inc. ,• for $32, 500. 00 and that Washington County will be applying for a grant in the amount of two-thirds of the cost in preparation of a master plan. Correspondence stated that when the master plan is completed for Washington County, then and only then will the,require- ments needed under the Airport Development Acceleration Act of 1973 be able to be projected. Chief Clerk read correspondence under date of September 11, 1973, from Adrian V. Sannier, Esquire, directed to the Washington County Board of Elections, which stated that as Chairman of the Washington County Republican Party that the name of Richard F. Wright, Jr., be submitted for placement on the November 6 General Election ballot as a candidate of the Republican Party.for School Director, Region II, Ringgold. School District. Chief Clerk read correspondence under date of September 13, 1973, from Isobel R. Peterson,. Vice Chairman - Republican Committee of Washington County, which informed that Richard L,, Patton, ,R. D. #1, Avella, Pennsylvania, is the Republican nominee for School Director for Region 2 consisting of the borough of West Middletown and the Township of Hope- well in the Avella Area.Scho9l District. Correspondence requested the pursuing in the work of acquiring the rights -of -way and arranging for the adjustment of the utilities and miscellaneous structures in order that initiation of construction of Unit 2 is not delayed. N1r. Flynn: I would like to instruct the Chief Clerk to arrange a meeting for next Thursday or Friday with all interested parties (Mr. DeiCas, 'Mr. Zeman and Mr. Graham's.nd the 3 Commie- sioners). Chief Clerk read correspondence under date of September 10, 1973, from Norman J. Taylor, Deputy Secretary - Department of Public Welfare, Western Region, directed to the Commissioners of Fayette, 'Greene, Washington' and Westmoreland Counties, in reference to the Nutrition Act Planning. A lengthy discussion was tlhen held on the above correspondence. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of Commissioners notify Deputy Secretary Norman J. Taylor - that on the basis of the information now available, that the Board of Commissioners reaffirm their position originally in that Optior. #3 (State handle the Nutrition Program aside from County Government) be maintained. Chief Clerk read correspondence under date of September 7', 1973, from Michael George directed to Jerry R. Wettstone, Director - Bureau of Recreation and Conservation, which re- quested an extension of six months to June 30, 1974, in reference to the $500-M Contract, Adngo Creek Park, Phase II, Project'3-4-62-00-2. 1. Chief Clerk read correspondence under date of September 7, 1973, from Michael George dirrected to Jerry R. Wettstone, Director - Bureau of Recreation and Conservation, which enclosed a copy of Nottingham Township Ordinance No. 17 for the abandonment of Township Road 605 in Mingo Creek Park along with a copy of the proposed advertisement of said Ordinan<e. Correspondence requested that the proposed construction on said Township Road as includedin the original grant application be reinstated as an eligible construction cost since the road is now owned by the County. Moved by Mr. Jones, seconded by Mr. Paluso, that four employees representing the Child Welfare Services be authorized to attend a one -day seminar on the Foster Child on Mon- day, October 1, 1973, at the Beaver County Child Welfare Services; total of $28. 00 including lunch and registration fee for four employees to be charged to Account #320-2-11 is hereby approved. Chief Clerk read correspondence under date of September 6, 1973, from Merico Jignelli, Chief Assessor, which requested authorization for the fieldmen in the Tax Assessment Office to attend.the assessors' training classes to be held at Seven Springs on October `15-16 and December 10-11 with a registration fee of $20,; 00 per person which covers both courses. The Board was of the opinion that the above request be tabled. Chief. Clerk read correspondence under date of September 5, 1973, from William P. 3ember, Director of the Planning Commission, which enclosed a copy of a legal advertisement -hat was published in a few of the Mon Valley newspapers concerning the Mon Valley Expressway, correspondence then gave an explanation of said advertisement. Correspondence, in conclusion, -equested that the Commissioners and any units of local government and civic organizations in :he Valley forward correspondence to the Federal Highway Administration reflecting our view- point and enclosed a letter for the Commissioners to sign. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of commissioners comply with the Planning Commission's request and forward correspondence to :he Federal Highway Administration as per above. Sowers, Executive Director - Pennsylvania Game Commission, in reference to State Game Land s 1 N. o. 245 Addition -Washington County -Project 70. Said correspondence listed parcels of land -:hat were acquired in Washington County and which are eligible for in lieu of tax payments for :he current year. Correspondence requested the assessor to verify said parcels so that they are correct in the application to the State Tax Equalization Board. V1r. Whalen: I will forward the above correspondence to the Tax Assessment Office and also to V1r, Clay Graham for certification. Chief Clerk read correspondence under date of September 5, 1973, from Joseph onti, Secretary - Tri-Community Ambulance Service, which requested any assistance by the commissioners in the costs incurred for radio installation at said Service. D. - Assistant Deputy Secretary for Medical Services, Department of Public Welfare, n reference to the County Home for Men and Women. PALUSO, COMMISSIONERS the Homes, and listed the options available to the Commissioners at this 'time. Correspondence, in conclusion, requested that a construction ,timetable -be forwarded by September.25, 1973, detailing plans for contracting and building the new facility; and also, the preparing of a plan for assuring the safety of the -patients im the existing facilities, including fire drills, fire patrols, and any other reasonable precautions. A very lengthy discussion was then held on the above 'correspondence. Commissioner Paluso recommended that the Commissioners request the same *variance as Westmoreland County. It was noted that any architectural firm must notify the Commissioners by September 20, 1973,- in order to make -a presentation to the -Board in,reference to the construction of a new County Home Facility. Chief Clerk informed the Boaird that within a week's time all of the necessary data will be prepared and possibly a meeting could be arranged with Dr. Cutt and also the Department of Labor & Industry.* Commissioner Paluso suggested that'said data be forwarded to Dr. Cutt as expeditiously as possible. Mr-, Bugaile entered the meeting. Mrs. Jean Kalamas entered the meeting. Mr. Elish entered the meeting. Mr. Roney entered the meeting. Chief Clerk informed the Board of correspondence received under date of August 23, 1973, from the Office of the Attorney General, which was directed to the Secretary of the Com- monwealth, in reference to the rules and regulations set forth for the upcoming November election. New Business: Chairman informed those present that Veterans Day will be observed on Sunday, Novem- ber 11, 1973, as per House Bill #47 now referred to as Act #4; and that the Courthouse will be closed on Monday, November 12, 1973. Opening of Bids for: The furnishing and delivering of Rough Oak Bridge Timbers for the Washington County Bridge Department The following bid was opened and read by County Controller Elish at 11:13 a. m. : 1. Name of bidder: Donora Lumber Company Address: 232 Meldon Avenue Donora, Pennsylvania 15033 Total Amount of Bid: $4, 701. 31 Certified check in the amount of 10% accompanied the bid. 4 - Moved by Mr. Paluso, seconded by Mr. Jones, that the contract for the furnishing and delivering of Rough Oak Bridge Timbers for the Washington County Bridge Department be awarded to DONORA LUMBER COMPANY for the price as set forth in their bid ($4, 701. 31). This being the lowest and only responsible bid received and in accordance with the specifications and subject to approval by the County Solicitor. Solicitor: County Solicitor Hormell referred to correspondence under date of Augusf 30, 1973, from William C. 'Porter directed to Ntr�. Clay Graham -in reference to School and Township Taxes on County Park Property. Correspondence recommended that the County pay -such school and township taxes on park properties previously acquired as remain unpaid for the year in which such properties were acquired; and the' same policy as to properties hereafter acquired with the continuahco of the practice of pro -rating the taxes as of the date of closing - such policy constituting no real burden on the County since the County will be paying to the school district and township no more than its fair pro-rata share -of local taxes for the year,of closing. Motion carried unanimously: I, - - 1 1 i County Solicitor informed the Board that as a result of the correspondence under date of September 5, 1973, from Controller Elish in reference to the contract between McDon- ald Associates and Ross -Adams, Inc., and the qualifications of one Mr: William E: Adams, correspondence under date of September 10, 1973, has been received from C. Vance DeiCas, P. E. , McDonald Associates Engineering, which enclosed the qualifications of Mr. Adams. Mr. Hormell reviewed said qualifications and stated that it was his opinion that said list was a very imposing list of qualifications and that if the FAA would not approve Mr. Adams' quali- fications that the FAA would have quite a burden to overcome. Chairman suggested that Con- troller Elish be given a copy of Mr. Adams' qualifications. County Solicitor informed the Board that the Supreme Court has entered an order to transfer the matter on the appeal from the Common Pleas Court to the Commonwealth Court for disposition in conjunction with the Pennsylvania Labor Relations Board. Assistant County Solicitor informed the Board that the Court of Common Pleas of Washington County effective Monday, September 10, 1973, approved the sale of land in Char - tiers and North Strabane Township to the Washington Industrial Development Corporation for eventual transfer to Mac -Plastics. The Court approved both the sale and the sale price. Chief Clerk Whalen read correspondence under date of September 17, 1973, from Elliott Bianchi, President, Board of Library Directors, Monessen Public Library, directed to Mr. Flynn. Correspondence inquired whether the Commissioners are thinking of an allocation to the Monessen Public Library for the current year. Letter stated that they sincerely hope that the Commissioners can see its way clear, as a minimum, to repeat the $1, 000 allocation that they made last year. Moved by Mr. Paluso, seconded by Mr. Flynn, that the Washington County Commissioners allocate the sum of $1, 000 to the Monessen Public Library. Remarks: Mr. Jones: I think we have enough libraries in Washington County that we can designate and send money to them. Roll call vote taken: Mr. Jones - No; Mr. Paluso - Yes; Mr. Flynn - Yes. Moved by Mr. Jones, seconded by Mr. Paluso, that Louise Abel, Public Welfare Adminis- trator III, Child Welfare Services, be authorized to attend the Governor's Conference on the Rights of Children on October 1 and 2, 1973, to be held at the Penn Harris Motor Inn, Harrisburg Pennsylvania. 1 n MINUTE BOOK $9 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Also included in this motion is that Margaret Burns, Director of Nursing at the Washington County Home for Aged Women, be authorized to attend the Conference on Care of the Aged in Nursing Homes which will be held at Keller Conference Center, University Park, Pennsylvania, on Tuesday, September 25-27, 1973. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk Whalen read a memorandum under the signature of Clay Graham regarding Harmon Creek Site 481 which requested permission to engage engineering services in order to set corners on the Borrow & Emergency Spillway at said site. This has been requested by West Penn Power in order to relocate transmission line already agreed to and paid for by the County. Discussion was then held on this matter. Moved by Mr. Paluso, seconded by Mr. Jones, that Engelhardt -Power Associates be appointed to engage in the engineering services as per above as requested by Clay Graham. Bard Judy, District Conservationist, Soil Conservation Service directed to Mr. Flynn. Letter stated that the final inspection for Harmon Creek Site PA -483 will be held on Monday, September 24, 1973, at 1:30 p.m. This structure is located on Wards Run north of Hanlin Station. Chief Clerk read correspondence from the Juvenile Court Judges' Commission directed to Judges, County Commissioners and Chief Juvenile Probation Officers relative to the availa- bility of funds for special projects. The county's request must be signed by the Juvenile Court Judge and by the County Commissioners. These monies will be non -recurring and must be used by December 31, 1973. After the Court examines it, this report is published one time in a newspaper, whichever newspaper or news- papers the Controller may direct. But there is a limitation in that the total cost of said publi- cation may not exceed $1, 500. 00. In addition to this publication, this report may also be pub- lished and printed in pamphlets; and the number anal cost of those pamphlets, is to be. determined by the Controller and County Commissioners. This, problem concerns the printing in the news- paper. On June 15, Mr. Whalen sent a letter to the Controller's office. This request was repeated on July 16, 1973 and was repeated again on August 7, 1973; and I understanc. that Mr. Whalen has also spoken with the Controller's Office. The problem here is twofold. First, in my opinion, and I have so stated, you cannot spend more than $1, 500. 00 to print the Co i- troller's Report in the newspaper. The Controller already drew vouchers and drew checks for $1, 973. 00 which was done in two separate requests. I understand that each of those requests waE 11 less than $1, 500. 00 in among themselves. In my opinion, there is $473. 00 owed to the County bT- the Controller. The second problem with respect to the Observer -Reporter in that there was a contract made by that newspaper in good faith with the Controller for $2, 537.00. I do not think that it can be legally incurred by the County. I do not think you have the power to pay it, and I think the Observer should be notified of this effect and advised'that they should look to the Con- troller for payment of this amount. Mr. Whalen stated that he and Mr. Flythn met privately with Mr. Elfish and pointed out the problem to him and asked him to please resolve the matter. Mr. Elish had then stated that he felt the Commissioners were equally responsible for the overpayment. Mr. Flynn stated that he would like the -record to show that Mr. Elish has already spent his statutory limitation; and heis responsible, not the Board of County Commissioners. Mr. Hormell: I have made two recommendations, •Mr. Chairman. One of them would be that he be notified to the effect of the bill for $1, 973. 00; the other that the Observer be notified of our posi- tion with the respective contract. I would ask that I be directed to do those two things. Mr. Flynn: The Chair so' directs. "The Majority Commissioners are sorry, indeed, that Special Prosecutor Sprague saw fit to publicly castigate those of us ,who are fiscally responsible, not only for trial costs and expenses, but for all county operations. To be successful in the overall operation of the County, it is imperative that we have full knowledge of all anticipated expenditures so proper budgetary processes can be followed. ,In this case:there have been many instances where the County has been obligated to pay costly expenses by Mr. Sprague and others but it has been months and now even years before this Board became aware of such obligations. � (This, we can substantiates Personally, we have no quarrel or question concerning Mr. Sprague's competence as a Prosecutor; however, we do question his mathematical ability as well as' his administrative capacities. He equates the Federal_ payment of $1, 080 per month as the "lion's share" of Mrs. Gilly's maintenance. This amounts to $34. 80 per day; this County pays a Matron $30.00 per day or $930. 00 per month. How'Mr. Sprague determines this County is, in fact, "Making Money" is beyond our comprehension. Speaking for the Majority Commissioners, we will subscribe to Mr. Sprague's recent statement to us that you "cannot equate justice with a dollar sign;" however, we will not agree to abdicate our position as a fiscal officer of this County to Mr. Sprague or to the Judicm Branch of County Government. Personally, we want to be made fully knowledgeable of anticipated expenditures as far in advance as is possible. As the Chief Fiscal Officers of Washington County, it is the responsibility and duty of the Majority Commissioners to provide the necessaty services essential to the function- ing of our government,,and- to levy the required taxes to finance the -operation of same. There- fore it is essential that we keep the taxpayers knowledgeable of the expenditures of his tax dol- lars, particularly theunauthorized expenditure of funds without statutory consent and approval. In reply to comments that appeared in the local -media quoting Special Prosecutor Sprague as stating: 1. "Washington County has literally made money out of the custodial arrangement for Mrs. Gilly, " Sprague said at a bail hearing for her- and her father, Silous Huddleston, another defendant, in Washington County Court Tuesday. (This is certainly a stretch of somebody's imagination. How we have made money I wish the gentleman Would explain to us. I tried to point out previously we are spending quite a sum of money. The records will shove this: I have also tried to point out that we are receiving bills now that we didn't even know existed. Insofar as Mrs. Gilly's stay at Seven Springs as the gentlemen mentions, we can document where just last month in August, we paid twenty-nine hundred and some odd dollars to Seven Springs for a bill that was incurred that we knew nothing about.) 94 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Sheriff Alex Debreczeni administers the fund. (Whatever arrangement he is speaking of, I have no knowledge of; and I'm sure my colleagues have no knowledge of. I can assure the public that there is no money coming into this County. The $1, 080 I am told is arranged through by the federal government under the Crime Con- trol. Act of 1970 which, pertains to federal prisoners. We do know that the money is advanced by the U. S. Marshall. 3. Among the most vocal critics have been the Washington County Commissioners and certain newspapers circulating in the,,,.county. (Now when you speak about the most vocal critics, here again I think the gentlemen is going �a little bit overboard, be- cause I would like to refer to this editorial of March 11, 1970. Let's just quote part of this: 'As we were saying about a week ago, the Yablonski murder case can be turned into a prime vehicle for some real or imagined political advantage by local officials without half trying. No sooner was it said, practically, before Washington County Controller Peter Elish gave an excellent' example of what not to do. Elish has long been the county's best example of a knee-jerk opportunist in the political field, and this was never more evident than when he called a "news 'conference" late last week". The final paragraph read: "We thought it was obvious to everyone that as .the Yablonski case developed it presented a great chance for grabbing a fear cheap headlines. We assumed, however, that if the matter of taste did not forestall it, the question of common sense would. Our Controller has shown us that We made .& foolish assumption. " (Now, if I may, gentlemen, insofar as I am concerned and the majority is concerned, Mr. Elish, for number one, to climb aboard, as your editorial so states; and the gentler an) who wrote the editorial must have been look- ing at a crystal ball because it was finally climax0d yesterday the 19th when, Mr. Sprague, according to your editorial predictions, endorsed the trial Judge for re- tention for a 10-year position. Now, if_this isn't politics then -I don't knoww-hat is.) Mr. Sprague has established himself as a successful Criminal Trial Lawyer and rightly so; however, when it, comes to the fiscal management of Washington County tax dollars as related to"these cases, we would highly recommend that the Special Prosecutor confine his endeavor to the -Judicial Branch of Government as an officer of the Courts; and we in the Execu- tive Branch will discharge our duties and responsibilities in the best interests of the taxpayers. Finally, I would like to quote a paragraph from the Pittsburgh Press Editorial dated August 5, 1973; and I think this is most appropriate and I quote: "Every public official has an obligation to hold down the cost of government. And any official who simply tries to pass the buck should realize that what he really is doing is passing it on to the harried taxpayers. He stated that he had been in last year and offered to make a contribution to this project is someone would build up a fund, but no one got in touch with him. Mr. Flynn informed him that underthe general re-r- enue sharing, we have earmarked the necessary funds for the construction of a 250-bed facility and that today was the deadline for receiving proposals. Mr. Paluso informed Mr. McCarty that there are a few legal problems in raising money publicly for construction. As an alternative, Mr. Paluso suggested to him that he do undertake this to furnish several of the rooms or perhaps the solarium with an appropriate plaque. THEREFORE, the Board of County Commissioners of Washington County hereby authorizes the submission of an application to the U. S. Department of Labor - Manpower Administration for an Operational Planning Grant in the amount of $25, 000 and designates Keery McAmbley, presently coordinator for the County Emergency Employment Program, as manpower Planning Coordinator to act on behalf of the County in submitting and administering the manpower planning grant according to the requirements of the grant agreement and applicable Federal regulations. PALUSO, COMMISSIONERS Mr. Whalen informed all those present that a chronological report concerning all events and communications surrounding the crisis at the Washington County Extended Care Facilities has been completed and available to them. Mr. Whalen also stated that corres- pondence was received from Dr. Roger A. Cutt, Assistant Deputy Secretary for Medical Programs, stating that our facilities comply with Title VI of the Federal Civil Rights Act and the Pennsylvania Human Relations Act. Also, Mr. Whalen infonn ed the Board that, tentatively, he is to meet with Dr. Cutt in Harrisburg sometime next week. Mr. Whalen informed the Board of a telegram from Congressman Thomas E. Morgan which announced that the Health Services Administration, Department of Health, Education and Welfare, has approved the application filed by the Community Care Clinic, Northwest Washington County, Burgettstown, as a site for a national health service corps. The approval of this application means that the residents of twleve communities. in Northwest Washington County covering 25,446 people will now have access to adequate medical health and setting up the necessary medical facilities to provide such health. Letter stated that they had their monthly meeting, and Mr. Norman Monack showed them the design of the County Flag. Letter stated that they approve of the idea. Mr. Flynn stated that we acknowledge receipt of the same. Mr. Whalen read correspondence under date of September 21, 1973, from Helene Wohlgemuth, Secretary, Department of Public Welfare, stating that they are processing pay- ment to o-ur County Mental Health/Mental Retardation Program for the second quarter allot- ment for Fiscal Year 1973-1974 in the amount of $304,172. Mr. Whalen read correspondence under date of September 19, 1973, from Mrs. F- 11. Parent, Jr., Secretary, Child Welfare Advisory Board, which listed names of people for immediate membership to the Advisory Board subject to the Board's approval. Letter also stated that the Board would be pleased to welcome these people to their meeting. Thurs- day, October 11, if the approval is granted. Mr. Flynn stated that this matter be held in abeyance until the next meeting, October 4, 1973, so that in the meantime the Board could meet with Miss Abel to discuss the Board in its entire- ty. Mr. Paluso suggested that we inform Mrs. Patente that action will be taken at the next Board meeting to be held on Thursday, October 4, 1973. Mr. Whalen read a memorandum under date of September 26, 1973. from Anthony Bevec, Building Superintendent - Subject: Emeragency Repair Work at the Men's Home. Said BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS memorandum stated that on September 20th, the six-inch main water line at the Men's Home burst. Work was immediately started and thirty-eight feet of line was replaced. After this was completed and 'pressure turned on, more leaks were discovered. Mr. Bevec instructed the John Bruno Company to repair this condition. It appears another 100 feet,of line will be needed for a total of about 138 feet. This line is the main source of supply for the Men's Home. They are doing this work as quickly as possible so water service delay will be held to a mini- Mr. Whalen: I would recommend that the Board, declare this a dire emergency. Mr. Gilmore: We need a resolution saying that there is an emergency existing, that the expen- ditures that have been made were proper and necessary because of the emergency situation. and that future repairs for which ther is insufficient time to go through normal procedures that Mr. Bevec is given permission to go ahead with his plans. Fantz, MH/MR Administrator, regarding Recommendations regarding Separation of Central Washington Clinic. Discussion was held on the above matter. Mr. Flynn: I think we should go on record as leaving things as is. Moved by Mr. Paluso, seconded by Mr. Flynn, that at this time the Board of County Commissioners feel that the status quo should be maintained with an eye to the possibility of possible separation in the future. Mr. Whalen informed the Board of a request from the Juvenile Court Office for attendance at the Seminar to be held on October 16 47, 1973, at the University of Delaware. They would like two people to attend each of 'these seminars, and they have the sum of $1,120. in their grant for training purposes. Mr. Whalen was informed that the State Department has approved their attendance at the seminar. Mr. Whalen told the Board that if they approve this request, he will have the Juvenile Court Office furnish the Board with a letter from the 1 L, State Department authorizing this seminar as a part of this course. Letter informed the Board that an adequate vegetative cover had been'obtained on this work of improvement; therefore, the Commissioners now have complete operation and maintenance responsibility. Mr. Gilmore stated that the form resolution provided should not be used because it makes some allegation of facts that the Board is not is a position to make. Dis- cussion was held on this matter, and it was decided to table the matter until the next meeting so that Solicitor Gilmore could draft a proper resolution. Solicitor Gilmore informed the Board that when the contract was awarded for the printing and delivering of ballots for the General Election to be held on November 6, 1973, it did not include approximately 125, 000 white official ballots which will be necessary for the Special Ballot on the Judicial Retention vote. The reason for this was that we did not receive a notification from the Secretary 61 the Commonwealth that a separate ballot would be necessary until after the advertising for bids had been made. Badzik Printing Service had sent his quotations for the necessary special ballots neededfor the election. They were as follows: 115, 000 official special question ballots - $43. 75 per thousand 23, 000 pink specimen official question ballots - $27. 00 per thousand Sets for Election Department - $275.00 Mr. Gilmore further stated that it would be proper for the Commissioners to enter into a contract with said bidder since he was the only bidder for the printing of these additional b allots and since there was little time to go through normal procedures.
