The Board of County Commissioners met in regular session with the following members
being present: Commissioners Jones, Paluso, and Flynn. Also present being: Aief Clerk
and County Administrator Whalen; Administrative Assistant Crouse; County Solicitor Hormell;
Mrs. June Lilley of The Daily Notes; Mr. Bob Robertson of The Observer -Reporter; Mr. Grans
Liesch of The Brownsville Telegraph; Mr. John Merdian - WJPA; Mr. Earl Bugaile - WKEG;
Mr. Eric Bugaile - WESA; Mr. Don Gibson - Channel 3; and Ms. Helen Miller of The League
of Women Voters.
Meeting called to order by Chairman and roll call taken:
Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes.
Chairman asked if there were any corrections, additions, or omissions to Minute 88,
each member having received a copy.
Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. # 88 be approved as read.

Motion carried unanimously.
Reports -Commissioner Jones: Re: Ferry Commission
Commissioner Jones reported to the Board on the results of his meeting with the Ferry
Commission. He reports they are now ha,laling regular meetings twice a month on every second
and fourth Thursday. The meetings take place in the California Borough Building. He also
stated that they are working on their budget and have promised to have it prepared by
November.
Mr. Jones stated that he spoke to Mr. Whalen, Chief Clerk & Administrator, about the
first initial check to be sent to the Ferry Commission. These checks, from both counties,
which are for $5, 000. 00, have already been sent.
Mr. Jones stated that the P. U. C. Certifications which are needed on both sides of the
on
river are now being worked/. The Fayette County Solicitor, Mr. Eberly, is working with the
Commission of them. Mr. Jones went on to say that they now have a seven -member Board
that rotates every year. As of this present date the Board is as follows:
4 members - Washington County (This year)
3 members - Fayette County & Solicitor
3 members - Washington County & Solicitor (Next year)
4 members - Fayette County
Mr. Jones said that the work on this project is coming along fine.

Mr. Jones also reported to the Board on a 5-Evening Seminar. Entitled - "Road Construction
& Maintenance", sponsored by the Mid Monongahela Valley of Councils. They asked if we woul i

at the Mon Valley Area Vocational -Technical (Voc Tech) School (Speers, Pa.), at 7:00 P.Ad-
to 9:00 P. M. It will start October 30, and run through to November 20. It is open to the public.

(6) Sheraton Hotel - Re: Annette Gilly, et al.
Remarks:
Mr. Jones: This Silous Huddleston thing. We've talked many, many times about this. It goes
back to the same thing with me, Mr. Chairman, these people keep making the bill# as we've brought
out. I have no knowledge of any one making these arrangements for Mr. Huddleston. It's none
of my business where they keep the gentleman.. It is, however, my business when we have to
pay the bills. We have a jail, and the arrangements were made for the jail. Some people
already sentenced in this case have been in the jail for a couple of years. S41ous was in the
know
jail but as present, I don';t/where he's at. At the time of the Sheraton Bill he was not in our jail.
I firmly believe the gentleman belongs in the jail. Arrangements have been made to bring the
jail up to maximum security. As of this presnet date, some of the accounts are deficient. We
must bring the bills and money up-to-date. Our responsibility is to the tax payers of Washington
County not the Fedeval Government or the State Government. I firmly believe the gentleman
belongs in jail.

Mr. Paluso: Mr. Whalen please read the letter and the bill and tell us what it's for and who paid
what parts of it. What Mr. Jones said is correct, but this has nothing to do with -where they ar
keeping Mr. Huddleston. To my understanding, this was when Mr. Huddleston was taken to
Philadelphia to be questioned. (April 10, 1972)
Mr. Whalen read the following letter directed to the Honorable Charles G. Sweet, from
William H. Wolf, Jr., District Attorney's Office, Philadelphia, Pa:
'bear Judge Sweet:
Enclosed you will find two letters which set out a recapitulation of the amounts
spent and the amounts paid to the Sheraton Hotel in Philadelphia and Seven Springs'
accommodations in Champion, Pa.
As you will see at a glance, the lion's share of the money owed to the Sheraton
Hotel were paid by the State Police ($5, 534.19) and the federal government ($1,, 000. 00).
The balance of $735. 94 is far short of the actual money expended by Sheriff Debreo zeni
and his personnel while they had Annette Gilly in their custody.
Enclosed you will also find in a bill from Holland, Stern, and Flowers, which
bill id due and owing and I have written Mr. Costa about it on several occassions."
Mr. Paluso: Then are you saying that this bill is really for paying our sheriffs and deputies
lodging at the Sherton Hotel when they took these people for lie detector tests?
Mr. Whalen: It doesn't say that.
Mr. Paluso: Am I right by saying that when a bill is made by our law enforcement people, we
have no choice but to pay it?
Mr. Flynn: I think what Mr. Jones is trying to say is we were never consulted about what was
taking place. His point is we should at least be consulted if they are going to expend any sums
of money. The unfornuate thing about it is the bill occurred better than eighteen months ago, a -ad
we have just received it. I think Mr. Jones' point is very well taken. Certainly we should be
consulted.
Mr. Jones: What would happen if we didn't pay one of these bills?
Mr. Hormell: I don't know. It would probably end up in the Court someway. Either by the
Creditor, instituting suit or someone else.
Mr. Jones: If we didn't make the bill, how would they make us pay it?
Mr. Hormell: That's the legal question involved. Whether or not the bills were legitimately
contracted. I can't give you an answer to that because I don't know the particulars.
Mr. Flynn: To the best of my knowledge we have paid all of the bills. Although I ggree with
Mr. Jones, it is a moral obligation on our part, even though we were pot consulted, to pay thes
bills. Therefore, I recommend that we do approve the payment of the bill.

-Clief Clerk read correspondence under, date of October 11, 1973, from Louise Abel,
Public Welfare Administrator III, Child Welfare Services, Washington, Pa. The letter was
a request for their Homemaker to attend a conference in Harrisburg, Pa. The meeting will
take place at the Sherton Hotel, Tuesday, October 30, 1973.
Moved by Mr. Jones, seconded by Mr.. Paluso, that request be granted for Mrs.
Mary Merritt, Homemaker, to attend conference as per above.

Chief Clerk read correspondence under date of October 10, 1973, from C., DeLores
Tucker, Secretary of the Commonwealth, Department of State, directed to All County Boards
of Elections. The letter is in regards to a Special Ballot to be O r the November 6, 1973,
election. The Ballot will contain a special statewide question on it. A sample Ballot is availab.e.
Mr. Flynn: We received a notification from Mrs. DeLores Tucker, Secretary of the Common-
wealth and Head of the Bureau of .Elections, last Thursday afternoon after our regular meeting.
Which means in effect we definately had to take that action. We did this last Thursday so we
have those Ballots printed. The Bill has been approved on Monday of this week by the Senate;
therefore, we have no recourse.
The Chair recommends that we go on record that we did approve it, and I would
suggest that we confirm the action taken by the BoaW. as of last Thursday afternoon.

Board as per above.

Chief Clerk read correspondence under date of October 14, 1973, from Mrs. Jessen,
directed to Mr. Michael R. Flynn, Chairman. The letter is in regards to the way a voter is
allowed to vote on the Yes -No Ballots.
Mr. Flynn: Mrs. Miller, prehaps you can inform Mrs. Jessen that I have tried to contact her
with no accomplishment. � Please tell her she -is exactly conozect in the way she stated the voters
can vote on the Yes -No Ballots: The Ballots will be the same as the ones used in November 197 L
Also, let me bring this to your attention. In the Townships of Peters, Hanover, North Strabane,
and the Borough of Canonsburg, there will be four (4) ballots. They are as follows: (Ik•Regular.
Ballot; (2) Chartered Commission Ballot (3) Vietnam Ballot; and (4) Retention Ballot. Other
political sub -divisions will have three (3) ballots. They are as follows: (1) Regular; (2) Vietnam;
and (3) Retention.

Chief Clerk read correspondence under date of October 5, 1973, from the Pennsylvania
Labor Relations Board, directed to Mr. Michael R. Flynn, Chairman. The letter is in regards
to unfair labor practice charged against the County by the Service Employees International
Union, Local 585. We have now received a final order from the Tabor Relations Board dismiss ing
all action in correction with unfair labor practice that was filed against the County.
Mr. Whalen informed the Board that copies of the officers elected for the Washington. Cou zty
Jail Guards and for the other County employees are available.
Mr. Whalen also informed the Board that there have been two grievances charged by the
Service Employees International Union, Local 585, involving two (2) -Court employees. The
County has been adviced by the Union that the Courts have not followed through with the proper
handling of these grievances. They have requested in accordance with Article 20 of the Contract,
that the matter go to Management Level Grievance.
Chief Clerk read correspondence under date of October, 1973, from the Office of the
Registratibn_ Commission The letter is in regards to the final registration figures for the
November election. Copies are available. The total registration for this election is - 99,468.
The total number of voting districts in the Washington County. is 205.
Chief Clerk read correspondence regarding a copy of a new statute in Pennsylvania invoiv'txg
the Pennsylvania Industrial Development Agency. A copy of this was referred to the Legal
Department for thair study.
Chief Clerk read correspondence in regards to a confirming memorandrum from Cole-
Layer-Trumble as a result of a meeting that was held with the Controller and•Treasurer and
CLT representatives concerning the various aspects of the Data Processing as related to the
Tax Assessment Office and the Treasury Office. All of the items that were discussed are
being properly handled.

the Canonsburg Hospital.

Chief Clerk read correspondence from Mrs. Carolyn Stevens, Secretary, Bridge
Department. Re: Federal Disaster Assistance Project. Application No. OEP-340-DR-63-14-S-1.
Correspondence stated that their records and documents have been audited by the Federal Auditors
be
and they found them to be in order. It also stated that the County will/ re -imbursed in the amount
of $49,189. 67, within four to six weeks.
Chief Clerk read correspondence dated October 4, 1973, from State Council of Civil
Defense. The State Council has asked the County to approve setting up a County Wide meeting.
Mr. Jones: F we so desire, it is a civil prepanation course. It is an hour-long program. The
preferrable dates are either the tweReth or the fourteenth of November. They also request
that all elected County officials be present. They have asked, if possible, for us to try to get
a tcmrtr . _ ,
Mr. Flynn: I would• suggest that you make the arrangements for November 12th.
Mr. Jones: In regards to Civil Defense. We are having a meeting of all County Civil Defense
Directors and Ham Operators. The meeting will be held Tuesday, October 23, 1973, at 7:30 P.M.
in Judge Sweet's Courtroom. The meeting is open to the public.
Chief Clerk read correspondence under date of October 5, 1973, directed to Robert
D. Graham, 'R. A. Administrative Architect. The letter was in._ wards to a tech:,nical problem
with the heating in the Carpenter Shop and the Paint Shop, which is below the Garage Facilities.
As of yesterday, two men have begun working on it.
Chief Clerk read correspondence under October 9, 1973, from the Department of
Agriculture, directed to George Messerotes, Chief Sealer. The letter is a request for 'our
Department of Weights & Measures to arrange to take their testing equipment to Harrisburg
and have it checked and approved by the Bureau of Standards in Harrisburg,
Chief Clerk read correspondence under date October 5, 1973, from the Department
of Environmental Resources. The letter, in detail, defines what a "rural residence" is.
"Rural residence means a structure occupied or intended to be occupied by not more that two (2)
families on a tract of land of ten acres or more. It This will be referred to the County Fining
Commission.
Chief Clerk read correspondence under date of October 3, 1973, from Mrs. Robert
A. Roach, Jr. Girb Scout Leader, expressing appreciation for facilities available at Mingo Park.
Chief Clerk read correspondence from the Tri-County Borough Association concerning
a meeting to be held on October 17, 1973, in the Santa Barbara Lodge .Hall. The time is 7:15 P.' M.
Chief Clerk read correspondence under date of October 12, 1073, from Grant Underwood,
M.D. , Washington County Medical Society. The letter confirmed a meeting on Wednesday,
October 31, 1973, at the Ramada Inn between the Executive Board of Washington County Medical
Society and the Washington County Commissioners. I `

Mr. Flynn: The gentleman called me and asked if the Board of Commisidoners would attend thik-
meeting. I asked if it would be permissable if Mr. Whalen, Chief Clerk & Administrator, Mr.
Crouse, Administrative Assistant, and Mr. Jones, County Commissioner would attend this
meeting. This has been confirmed.
Chief Clerk read correspondence under date of October 11, 1973, from the Department
of Environmental Resources involving an application to build an incinerator at the County
Home & Hospital. In as much as the incinerator has never been built, this permit has been
cancelled.
New Business:
Mr. Whalen: (Electrical Requirements for Jail Facilities) In connection with the installation of
equipment at the Jail, it is necessary to increase the electrical current facilities.. I!d request chat
permission to advertise the specification for bidding be given by the Board. I have a copy of
the specifications.
Authorization to Advertise:
Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Commissioner s
be authorized to advertise for bids for electrical requirements for jail facilities for the Washington
County Jail. Said bids to be received in the Office of the County Controller until 11:00 a.m. ,
Prevailing Time, Thursday, , 1973, and opened immediately thereafter in the
Office of the County Commissioners.

Moved by Mr. Jones, seconded by Mr. Paluso, that authorization be granted to transfer
$50, 000. 00 from the General Fund Account to the Retirement Fund.

Mr. Flynn: As you recall yesterday the lengthly discussion of our financial status of the County.
It was brought to our attention that some of our accounts are in the red. We received an
accounting from Mr. Elish - Controller and Mr. Gillespie yesterday of all the accounts.
Some of these accounts we had no control of:
Prater -Pass - We had no idea they would be taken to Erie.
Union Contract - We had no knowledge that a $125, 000. 00 Union Contract
would be approved of.
Therefore, I would like to have an open discussion of these different accounts. We had no
when
knowledge of some of these accounts and factors/we adopted the budget.
Open discussion was then held on this matter.

Mr. Flynn recommened that the amount of $500, 000. 00 be transferred from the
Revenue Sharing Trust Fund Account into the Capital Reserve Account of the County. .
Open discussion was also held on this matter.
Mr. Paluso: I request that for a matter of record Mr. Whalen read a quote stating how the money
placed in the Capital Reserve Account may be used.
Mr. Whalen: Quotes the following from the book titled Federal Use of Funds: ."In additior>
the Act specifies that any ordinary and necessary capital expenditure authorized, by state and
local law is an appropriate use of general revenue sharing funds. "
Open discussion was held on the above quote.
Moved by Mr. Jones, seconded by Mr. Paluso, that the amount of $500, 000.00 be
transferred from the Revenue Sharing Trust Fund Account into the Capital Reserve Account.

consideration and approval.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Tax Assessment Office

County Solicitor Hormell, read a request from Westmoreland County asking, over
the signature of their County Solicitor, that the County would enter into an ag°reeluent with
Westmoreland County for use of space in our Jail on the a space available basis.
Discussion was held on this matter.
Moved by Mr. Jones, seconded by Mr. Paluso, that we provid Westmoreland
County with space in our County Jail, providing that we have advanced notice.

Solicitor Hormell informed the Board of -a request to prepare a Resolution supporting,
passage of May Legislation to allow alternate voting systems to be used in the Commonwealth
of Pennsylvania.
Moved by Mr. Jones, seconded by Mr. Paluso approving the following:
A RESOLUTION OF THE COMMISSIONERS OF WASHINGTON COUNTY
SUPPORTING PASSAGE OF MAY LEGISLATION TO ALLOW ALTERNATE
VOTING SYSTEMS TO BE USED IN THE COMMONWEALTH OF
PENNSYLVANIA .
WHEREAS, electronic voting systems, in existence for eight Mears, are
widely used in twenty-eight of the fifty states.
WHEREAS, legislation should provide the opportunity for individual
countries in the Commonwealth of Pennsylvania in the public interest
to further investigate the use of alternate voting systems.
NOW THEREFORE, the County Commissioners of the County of Washington
hereby resolve as follows:
THAT The Commission in behalf of the citizens of
Washington County strongly supports the enactment
of may legislation for the use of alternate voting
systems at the option of the local election jurisdiction.
THAT The Clerk of the responsible department be
directed, and is hereby authorized, to forward a
certified copy of this Resolution to the Office of
the Secretary of State, State Capitol, Harrisburg,
Pennsylvania.
PASSED, APPROVED, AND ADOPTED THIS eighteenth DAY OF
October 1973.

of the action of this Board taken October 18, 1973 as recorded in minute No. # 89 and the Decree
of the Court of Common Pleas dated October 9, 1973, the said deeds to be delivered to, the

Mr. Hormell: Our next item goes back to 1964. At that time the Commonwealth, The Departm(:nt
of Revenue, and Bureau of County Collection in the Escheat Division made a claim/ or was making
a claim against Washington County for certain funds allegedly in the Clerk of Courts Office, and one
of those escheated to the State. At the time I was a Solicitor for the Controller; Mr. Capano wars
Solicitor for the Commissionerst and we met with a representative from Harrisburg and also the
Solicitor for the Clerk of Courts Office.
We wanted an opinion from the Attorney General as to payme nt of those funds. Mr. Mouyard
wrote a letter subsequent to that letter an October 29, where he referred to that, and then
indicated we have not received such an opinion.
On June 4, 1973, Mr. Mouyard had sent to Harrisburg a total in the amount of $344. 80 which wa

representing escheatable funds and a cash bond. He indicated that no decision was made concerning
payment of witness fees.

The matter again was brought to my attention by alittter from Jerry Brooks, the Assistant Chien
Division of Escheats wanting a sum of $1, 064. 02. I spoke to Mr. Brooks about this matter and
what it amounts to is this; there are two (2) catagories of money invovled. They are:
(1) Costs paid by a defendant. Money transferred by Clerk of Courts
Office over to the Treasurer. The figure is unknown.
(2) Costs which are taxked against a defendant. No money transaction
ever took place. The Dept. of Collection would come to the Clerk
of Courts office and take these book entries from the record and on
a basis of these entries make a claim for escheatable funds.
We are taking the position that with the respect to the first catagory that at the time we had
a discussion it had been conceded by the State that if we did pay this money we would make
an application to the State and get it back. We thought it was foolish to do this.
With respect to the second catagory we took the position that there were no funds in the Clerk
of Courts Office to escheat and how could funds escheat if no funds had been claimed.
They refer to Section 10 of the State and I will concede that there may be an
interpertation in statute that will give them something to stand upon. At the same time I told'.
Mr. Brooks, and I'd like to have it confirmed here today; "We are not going to take any funds
out of Washington County Treasury and pay them to the Commonwealth because there were no
funds received for these witness fees. They were unclaimed and did not constitute Escheatable
Funds. " I would suspect that we would go into Court on the Matter.
Moved by Mr. Jones, seconded by Mr. Paluso, that no funds be taken out of the
Washington County Treasury and pay to the Commonwealth as per above and recommendation
of Solicitor Hormell.
