The Board of County Commissioners met in regular session with the following members
being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Clerk and
County Administrator Whalen; Mr. John Merdian - WJPA; Mr. Jerry Kelanic - WWVA; Mr.
Dave Budinger - Observer -Reporter; Mr. Earl Bugaile - WKEG; Mr. Don Gibson - Channel
3; Mr. Clay Graham - Land Acquisition Agent; Mr. Grant Liesch - Brownsville Telegraph;
Mrs. June Lilley - The Daily Notes; and Mrs. Helen Miller - League of Women Voters.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions or omissions to Minute No. #90,
each member having received a copy.
Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. #90 be approved, as
read.

Special Order of Business:
Mr. Clay Graham, Land Acquisition Agent for the County, presented a Resolution for
approval by the Commissioners in reference to the Chartiers Creek Flood Protection Project,
Canonsburg -Houston Reach Unit 2.
Moved by Mr. Paluso, seconded by Mr. Jones, that the following Resolution be
adopted by the Washington Co unty Board of Commissioners:
-RESOLUTION-
Whereas, an Act of Congress of the United States of America (Flood Control Act of
1965) authorized a project for flood protection on Chartiers Creek, Pennsylvania, and
agreement between the Commonwealth of Pennsylvania, Department of Forests and Waters,
Water and Power Resources Board and the County of Washington was duly entered into for the
purpose of effecting flood control regulations in Flood Control District No. 40, as amended;
and,
Whereas, the County of Washington desires to undertake that part of said project for
flood protection which is denominated as the "Chartiers Creek Flood Protection Project,

Canonsburg -Houston Reach Unit 2 and it is desirable that said undertaking be formally auth-
orized and that preliminary performances, authorizations and commitments in connection
therewith be ratified and confirmed;
NOW THEREFORE, BE IT RESOLVED, that the County of Washington does hereby
approve, undertake, and authorize the completion of, that part of the project for flood protection
on Chartiers Creek in Washington County, Pennsylvania, denominated as the "Chartiers Creek
Flood Protection Project, Canonsburg -Houston Reach Unit 2"; and,
BE IT FURTHER RESOLVED, that the County of Washington does hereby authorize -and
direct the proper officers and the duly authorized agents thereof from time to time to perform
such acts, to execute, acknowledge, deliver and accept such documents, to make such expen-
ditures, to undertake such litigation, to acquire for Washington County such -lands and interests
in lands, to employ such persons and firms, to give such approvals, to make such requisitions,
and to authorize such future specific acts and performances that may be reasonably necessary,
desirable, or convenient to exercise the powers, and to fulfill the obligations of the County of
Washington in the completion of said "Chartiers Creek Flood Protection Project, Canonsburg -
Houston Reach Unit 2";
AND BE IT FURTHER RESOLVED, that all acts and performances, which have been
heretofore done by the County of Washington through its proper officers and duly authorized
agents in connection with said "Chartiers Creek Flood Protection Project, Canonsburg -Houston
Reach Unit 2" be, and the same are, hereby approved, rvatified and confirmed.

Cumberland County for the juvenile commitments of Richard Earl Lewis ($150. 00) and David
Chacko ($175. 00) be approved for payment; said invoices having been approved by Judge
Richard DiSalle.

payment:

(b) Jack and Norma Jones - $1441. 83 - ME-19 - final relocation and property
acquisition costs and interest differential.
(c) Frank Lesnock - ME-21 - $3000. 00 - final tenant rental supplement.
(d) Lee and Louise R,omanetti - $2200. 00 - Cross Creek - final farm moving expenses.
(e) Donald York - $250. 00 - update appraisals on Mingo Park parcels.

Company be authorized to proceed forthwith with the maintenance work in connection with
Harmon Creek Site #482 - $438. 50 and Site #479 - $513. 40L as per their quotation.

as Clerk -Representatives to the Board of Elections for the purpose of canvassing, computing
and certifying the returns from the district election officers in the forthcoming Municipal
Election. Also included in this motion is the appointment of the listed County Employees.

Chief Clerk read a Court Order/No. 505 September Term, 1973 A. D. , which ordered
that effective the 25th day of October, 1973, and pursuant to the request of Joseph Muscaro,
Director of Elections, that the following persons be appointed to the respective positions as
stated for the Fifth Precinct of Canton Township, Washington County, Pennsylvania:

Election/ Registration Office in connection with the necessary advertising of the Election

Chief Clerk read correspondence under date of October 24, 1973, from Evelyn K.
Parent, Secretary - Child Welfare Advisory Board, which thanked the Commissioners for
the prompt action taken on the recent appointment of new members to said Board. Cbrres-
pondence also requested that Mr. William Ermlick, Jr. be appointed to said Board.
Moved by Mr. Paluso, seconded by Mr. Jones, that Mr, William Ermlick, Jr.,
Roscoe, Pennsylvania, be appointed to a three-year term effective immediately and expiring
December 31, 1976, on the Child Welfare Advisory Board.

Chief Clerk regd correspondence under date of October 19, 1973, from H. Howard Lee
directed to the County Commissioners which thanked the Commissioners for their generosity
for their recent contribution to the Washington Area Senior Citizens Center.
Mr. Hormell entered the meeting.
Chief Clerk read a memorandum under date of October 19, 1973, from H. E. Myers,
Director - Bureau of Municipal Services, directed to all municipalities, which advised of time

limitations for any emergency work that would be in process as a result of disaster projects.
Chief Clerk informed the Board that as per correspondence received from the United
Way of Mon Valley which was read at the last regular Board meeting held on October 25, 1973,
and a copy directed to Mr. John Fantz - that Mr. Fantz has responded to said letter as per
October 25, 1973.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of
Commissioners go on record supporting House Bill No. #1335 which eliminates the responsibility
of the counties to pay convention expenses of second-class township supervisors; and that the
Chief Clerk so notify our respective Senators and Legislators.

Chief Clerk informed the Board that the heating problem with the boiler in the Garage
which heats the Child Welfare Office building and the Juvenile Court Office has been corrected
and appears to be in order.
Chief Clerk informed the Board of correspondence received from the National Assoc
iation of Counties concerning Community Development and proposed proposed legislation on
revenue sharing. Chairman Flynn stated that he was requested to attend a meeting in Wash-
ington, D. C. on November 8, 1973, but due to circumstances beyond his control could not
attend. Chairman stated that he contacted Congressman Morgan and requested him to contact
Senator John Sparkman, Chairman of the Senate Committee on Banking, Housing and Urban
Affairs, and request Senator Sparkman to supportthe amendments as offered by Senator
Alan Cranston.
Chief Clerk read correspondence under date of October 25, 1973, from John Haddad,
Ed. D. - Assistant Superintendent for Curriculum and Inst. , which informed that the Trinity
Area School District is interested in providing the students of the district with a curriculum
which is not only educationally sound but varied and relevant. Correspondence enclosed a
form to determine the availability of community resources.
Chief Clerk informed the Board of correspondence received under date of October 18,
1973, from Thomas Campbell, Project Coordinator - Diocese of Pittsburgh, concerning a
program which said Diocese would like to present for the elderly comprising five counties
outside of Allegheny County utilizing Title III of the Older Americans Act. Correspondence
requested a meeting with the Commiss,pon.ers in reference to same. Chief Clerk advised the
Commissioners that as per a telephone conversation with Metro Petrosky, Jr. that a meeting
has been arranged for Monday, October 5, 1973, with representatives from the Western
District Office at 2:00 p. m. with Mr. Petro sky and the Chief Clerk to be present.

Chief Clerk informed the Board that at the last regular Board meeting held October 25,
1973, the Commissioners approved on a contingency basis McAna ai rother's request to
remove some 3, 000 cubic yards of dirt from the County Fairgrounds property. Chief Clerk
stated that said company has met the requirements of the sedimentation control and are going
to furnish the County with a letter of idemnification relative to any damages or pertinent
matters arising.
Chief Clerk read correspondence from Paul M. Petro, Assistant District Attorney,
under date of October 22, 1973, in reference to the November Armistice Trial Term bedicatel
to the Unknown Defendant.
Chief Clerk read a memorandum under date of October 26, 1973, from Clay Graham,
Land Acquisition Agent, which stated that Victor Funk, State Soil and Water Conservation
Commission, would like to meet,with the Commissioners on November 15, 1973, at which
time he would like to present the new Cost Share Contracts for Harmon Creek for the Com-
missioners' review and execution. Chief Clerk stated that arrangements have been made for
Mr. Funk to be placed on the Commissioners' Agenda for November 15, 1973.
Chief Clerk read correspondence under date of October 26, 1973, from Dr. Malcolm
G. Charles, President - Byers Memorial Library, which thanked the Commissioners for
their recent contribution to said Library.
Chief Clerk read a Court Order No. 474 September Term, 1973, A. D. signed by
Judges Charles G. Sweet, Richard DiSalle and Thomas D. Gladden, which ordered that
effective October 26, 1973, as a supplement to the method heretofore employed by the Jury
Commissioners and the Court in selecting names to be placed in said Wheel, the names of 500
prospective jurors shall be obtained by the Court from the Voters Registration List and placed
in said Wheel; said names to be selected on the basis of every 200th name appearing on said
Voters List, grouped alphabetically by voting district.
Chief Clerk informed the Board that as a result of the minutes of the last Regular Board
meeting - that correspondence has been directed to Colonel N. G. Delbridge - Co rps of
Engineers, acknowledging receipt of his letter under date of October 17, 1973, and informing
Colonel Delbridge that the Board of Commissioners are vitally interested in the Chartiers
Flood Protection Project, Environmental Improvement; and that as soon as -the Commissioner,:
are able to review any additional easement or right of entry required by said project that the
Commissioners will be in a position to give a definite answer within the next two or three
weeks.
Chief Clerk informed the Board of a Telegram received from Congressman Thomas E.
Morgan under date of October 26, 1973, which announced the approval of a Health, Education
and Welfare Headstart grant to the Washington -Greene County Community Action Agency in
the amount of $253, 149. 00 which will serve two counties and will run for eight months for 225

Cbunty Solicitor Hormell presented a tax refund to the Board for their consideration
and approval.
Moved by MT. Jones, seconded by Mr. Paluso, that the Tax Assessment Office be
authorized to prepare the following tax refund due to either duplication o-r overpayment of real
estate taxes:

Election
County Solicitor Hormell infonn ed the Board that Item 6-D on the Agenda - Return
Board appointments - is a misprint because the Commissioners are the Board of Elections
and sa-.dVersons are appointed as the Commissioners' representatives to act as Clerks.
County Solicitor Hormell requested that the record so indicate that the Commissioners are not
delegating any powers that the Election Board may have.
Chairman informed those present that under the contractual arrangements with the
SEIU Local 585 - that Election Day, November 6, 1973, is a full working day and that all de-
partments should live up to the requirements of the contract.
Chairman then referred to a article entitled "Lancaster County Home Rule Charter
Study Commission Expected to be Abolished".
Moved by Mr. Jones, seconded by Mr. Paluso, that the meeting adjourn.
