PALUSO, COMMISSIONERS LJ Minute No. # 92 Office of the County Commissioners Washington, Pa., November 8, 1973 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso, and Flynn. Also present being: Chief Clerk and County Administrator Whalen; Administrative Assistant Crouse; County Solicitor Hormell; Mrs. June Lilley of The Daily Notes; Mr. Bob Robertson of The Observer -Reporter; Mr. Earl Bugaile - WKEG; Mr. Eric Bugaile - WESA, Mr. Larry Schwingel - Channel 3; and Ms. Helen Miller of The League of Women Voters. Meeting called to order by Chairman and roll call taken: Mr, Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. #91, each member having received a copy. as read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. # 91 be approved, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. I pecial Order of Business: Messrs: Roland Burke and Joseph Speers, Washington Cour#,y Redevelopment Authority, presented a Resolution with reference to the undertaking of a Community Development Administrative Assistance Demonstration Program for the consideration and approval of the Board. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of Commissioners approve and adopt the resolution as submitted by the Washington County Redevelopment Authority with reference to the undertaking of a Community Development Administrative Assistance Demonstration Program, and obtainiig financial assistance from the Commonwealth of Pennsylvania in the amount of $100, 000. Said action based upon the approval of Solicitor Hormell. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso -Yes; Mr. Flynn - Yes. Motion carried unanimously. Old Business: Chief Clerk read correspondence from McAnallen Bros. concerning the removal of material from area north of barns parellel to Arden Road. (Washington County Fairgrounds) Correspondence stated they have complied with the environmental resources guidelines on MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS erosion and sedimentation. Correspondence also included a certificate of insurancewhich covered the removal of 300 cubic yards of dirt. Chief Clerk read correspondence from Westinghouse Electric Corp. under date of October 31, 1973, concerning the broken lenses of the beacon light at the Airport. I F, Discussion was held on above matter. Mr. Hormell stated the matter is an emergency that affects the safety of anyone who uses the Airport. He also stated he recommmends that the Commissioners declare that these beacon lights being non -operative constituted an emergency and require immediate action. I Moved by Mr. Jones, seconded by Mr. Paluso, that Solicitor Hormell's recommen- dation as per above, be approved. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. (Mr. Meridian entered meeting). Correspondence: Chief Clerk informed the Board of the following checks from the Commonwealth of Pennsylvania: 1. Commonwealth of Pennsylvania - $2192. 22 - Traffic Count Program - first payment. 2. Commonwealth of Pennsylavnia - $1864. 00 - first and second draw - down of subgrant SW-256-73A, correctional recruit inservice training program at the County Jail. Mr. Whalen stated that the contract was approved by the Comptroller for the Department of Justice on October 5, 1973. Moved by Mr. Jones, seconded by Mr. Paluso, that the following bills be authorized for payment: (1) Cole-Layer-Trumble Company - $8566.66 - data p1rocessing services as per contract for period covering November 1-30, 1973. (2) Washington -Greene County MH/MR Program - $3291.30 - Interim Care for October, 1973. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence frcxn Senator Austin J. Murphy under date of November 11, 1973, directed to Mr. Flynn. Said letter was in regards to a change in the election laws to permit alternate voting systems to be used in the Commonwealth. Discussion was held on above matter. Chief Clerk read correspondence from the United Mine Workers of America under date of November 2, 1973, directed to Mr. Flynn. Said letter was in regards to a Nutrition Prograrr. I n �1 for the Aging of Pennsylvania. MINUTE BOOK 157 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS 1 1 Discussion was held on the above matter. Chief Clerk redd correspondence from the Charleroi Public Library under date• of November 6, 1973 which thatnked the Commissioners for their appropriation of five hundred dollars ($500. 00) toward the operating expenses of the Charleroi Library. Chief Clerk read correspondence from the Allied Oil Co,m under date of October 10, 1973. Said letter was in regards to the purchase of distillate products from the said company during the 1972 calendar year. Discussion was held bn above matter. Mr. Whalen stated that due to President Nixon's speech we can anticipate we will get 70°jo of the oil we used in 1972; in 1973. Chief Clerk read copy of correspondence from Genevieve Motycki, Charleroi, Pa. under date of November 11, 1973. Said letter was in regards to her support checks, directed to Judge Sweet. Chief Clerk read correspondence from Ringgold School District under date of October 31, 1973, which thanked the Commissioners for providing facilities of Mingo Creek Park to the children of Ringgold School District this fall. Chief Clerk read correspondence from Washington County Planning Commission under date of November 11, 1973which extended invitations to the Commissioners and the Chief Clerk to attend this months dinner meeting of the County Planning Commission. The meeting will be held on November 15, 1973, at 6:00 p.m. at the Ramada Inn. (Mr. Kelanic entered meeting.) Chief Clerk read copy of correspondence from John A. Saweikis to Mr. William L. Carl, in regards to the replacement of Dr. William Lauda. Said letter stated that Mr. Walden is a teacher and he qualifies for "Educator" category and said Mr. Saweikis is pleased to approve his appointment. Chief Clerk read a memorandum from Commissioner Jones directed to varies in- terested parties dated November 5, 1973, which served as notification of a Civil Defense meeting to be held, Tuesday, November 20, 1973, at 1:30 p.m. in the Commissioner's Conference Room, Chief Clerk read a copy of correspondence from William P. Sember, Director of Pl-anning (commission, directed to Mayor George Stewart, which informed the Mayor and relates: State and Federal Agencies that the proposed Washington City Area Mass Transit Study does not conflict with County Comprehensive Planning efforts or long range Transportation Planning efforts. In fact, as in the past, the Washington County Planning Commission looks favorably upon the eM-)rts of the comminities in the Greater Washington Area to seek solutions to a very real problem. Also, as in the past, this agency will be assisting in any way it can. Chief Clerk read correspondence from Southwestern Pennsylvania Regional Planni% Commission, directed to Mr. Whalen, under date of November 1, 1973. Attached was a MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Memorandum, with enclosures, which describes the action taken by S. P. R. P. C. at its October 29th meeting relating to the Transportation Advisory Committee. Chief Clerk read a New's Release in regards to the Ringgold participation in the fall program at Mingo Creek Park. Chief Clerk read correspondence from Wolfe Enterprises under date of October 31, 1913, which thanked the Commissioners for allowing Willard R. Grace the opportunity to demonstrate the Automatic Voting Machine in the Courthouse to the League of Women Voters. Chief Clerk read a Court Order in connection to the application of Richard Barnes to have his name placed on the ballot for the General Election in 1973. Mr. Whalen stated that this Court that Order was followed and ballots were reprinted for that district. Mr. Whalen also stated/the costs of the reprinting of the ballots should be shared equally by Richard Barnes and the County of Washington. In this connection the County of Washington shall be primarily responsil le for paying the printer for the costs and Richard Barnes will reimburse the County fro a of the said printing costs. Chief Clerk read correspondence from the Governor's Justice Commission to Judge Gladden under date of October 30, 1973. Said letter concerns the subgrant (SW-184-71E) entitleal "Physical Upgrading - Washington County Prison." Discussion was held on above matter. Chief Clerk read a notification from the West Alexander Agricultural Association stating that there will be a meeting on November 15, 1973, at 7:00 p.m. at the Claysville Grange Hall. Chief Clerk notified the Board that the necessary budget transfers to bring the budget into /perceptive have been completed and analyzed. Mr. Whalen requested therefore, that the Board approve the Budgetary Transfer as outlined. Mr. Flynn stated that Mr. Crouse has informed him that the Budget Hearings are scheduled to begin Friday afternoon, November 9, 1973, and will concluded November 19, 1973. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board of Commissioners approve the following General Fund ;Budgeting Transfers: (See list at end of minutes). Chief Clerk read correspondence from himself directed to Mr. Charles Clark - Vice President of the Pittsburgh National Bank authorizing the Bank to mature a Certificate of DepgLt in thedmount of $400, 000. 00 by means of a credit memorandum to the Washington County Gener 1 Fund Account, and also authorization to debit the General Fund Account in the amount of $400, OO.Oa in payment' of a loan in this amount. New Business: Chief Clerk informed the Board that the Chairman of the Retirement Board has re- scheduled the monthly Retirement Board meeting from .November •15, 1973 to November 21, 1973. at 1:30 p.m. I MINUTE BOOK 159 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA- MICHAEL R. FLYNN, FRANK JONES. JR., EDWARD M. PALUSO, COMMISSIONERS 1 Chairman stated that under date of November 6, 1973, the, necessary notices were sent to the members of the Retirement Board informing them of said rescheduling of the Retirement Board meeting. Chief Clerk informed the Board that the. Courthouse will be closed from Friday, November 9, 1973, at 4:30 p.m. until Tuesday, November 13, 1933, at 9:00 -wn.in observance of Veterans Day. Chief Clerk informed the Board that the Regular Board Meeting has been rescheduled From Thursday, November 22, 1973, to Wednesday, November 21, 1973, at 9:30 a.m. due to Thanksgiving Holiday. Authorization to Advertise: Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Commissioners be authorized to advertise for bids for Group Employee Life Term Insurance. Said bids to be received in the Office of the County Controller until 11:00 a.m. , Prevailing Time, Thursday, November 29, 1973, and opened immediately thereafter in the Office of the County Commissioners. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Flynn - Re: Mingo Creek Park. Mr. Flynn stated he is directing Mr. Whalen to have a meeting with Mr. Michael George. He suggested that Mr. Whalen direct Mr. George to make recommendation ID the Board of Commissioners to make curtailment of staff at Mingo Creek Park until the middle of April, due to vandalism at the park. Solicitor: Solicitor Hormell presented various tax refunds to the Board for their consideratio 1 and approval. Moved by Mr. Jones, seconded by Mr. Paluso, that the Tax Assessment Office be authorized to prepare the following tax refunds due to either duplication or overpayment or real estate taxes: 1. Solicitor Hormell read correspondence from Superior Valve Company, under date of November 5, 1973: "Pursuant to that certain Memorandum of Agreement by and among Washington Industrial Development Corporation, etc., and Washington County, etc., and R. G. Brunton, W. H. Branualich, Mae C. Forbes, J. J. Roessle, W. C. Yocum, F. Neil Robson and the Estate of W. A. Siegfried (,hereinafter called "Owners") and specifically referring to Paragraph 7 thereof stating as follows: "7. Washington County reserves ownership and title to the barn and other outbuildings presently located on the 1.3533 acre parcel referred to in, Paragraphs 1 and 2 herein and shall have the right and obligation to remove the same upon receipt of ninety (90) days written notice to do so from owner of said tract." We herein exercise our right and hereby give you ninety (90) days notice in writing to remove the barn and other outbuildings on said property which you conveyed to the owners pursuant to the said Memorandum of Agreement. It is necessary for us to take this action at the time because of the urgent requirement that we extend `our parking lot because of increased employisnt 'over recent months and a projected increase in the near future." Solicitor Hormell suggested that the Board of Commissioners advertise in the following two (2) ways for the Demolition of the Barn: 1. Demolishing the barn and the people who are doing it keeping all property involved. 2. Demolishing the barn and having the material stored .or made available where you wish. Discussion was held on above matter. Moved by Mr. Jones, seconded by Mr. Paluso, that the recommendation to advertise as per Solicitor Hormell's suggestions be approved. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. (Controller Elish entered meeting). Solicitor Hormell read a letter from Grief Brothers of Delaware, Ohio. The letter requested the Board of Commissioners to set aside penalty charges which were assessed againE,t this Corporation. They have numerated nine (9) different reasons why they feel this should be I done. Solicitor Hormell, after examining the reasons, stated he feels the difficulty Grief Brothers have is of their own making. Solicitor Hormell recommended that the Board go on record as denying this request. He further states he will then correspond with them'"and so indicate. Moved by Mr. Jones, seconded by Mr. Paluso, that the above request be denied; said action based on Solicitor Hormell's recommendation. PALUSO, COMMISSIONERS E 1 in Pittsburgh on the date of November 7, 1973, where the argument was presented by the P6.nnsylvania Labor Relations Board and Mr. Douglas of Mr. Felices' organization, Mr. Posner in behalf of the Courts, Mr. Unkovich in behalf of the Pennsylvania Trial Lawyers Association and on behalf of the Controller, Mr. Roney submitted his argument on brief. Solicitor Hormell stated the agruments were arranged from simple procedure matters to serious constitutional issues, therefore Mr. Hormell stated it will take some time before the Commonwealth Court will make an answer to this. Bids: Opening of Bids for (a) Electrical Requirements for Jail Facilities for the Washington County Jail. The following bias were opened and read by Controller Elish. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board of Commissioners award the contract for electricial requirements for' jail facilities for the Washington County Jail to BALDWIN ELECTRIC CO., INC., 351 West Beau St., Washington, Pa. 15301, for the amount set forth in their bid; this being the lowest bid received in accordance with specifications. PALUSO, COMMISSIONERS Minute No. #93 Office of the County Commissioners Washington, Pa., November 15, 1973 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones and Paluso. Absent being: Commissioner Flynn, who was out of town on business. Also present being: Chief Clerk and County Administrator Whalen; County Solicitor Hormell; Mr. Kas Sala; Mrs. June Lilley of The Daily Notes; Mr. Bob Robertson of The Observer -Reporter; Mr. Earl Bugaile of WKEG Radio; Mrs. Helen Miller of The League of Women Voters; and Mr. Grant Liesch of The Brownsville Telegraph. Meeting called to order by Acting Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Absent. Acting Chairman asked if there were any corrections, additions or omissions to Minute No. #92, each member having received a copy. read. Reports - None Old Business - None Special Order of Business: Mr. Kas Sala, Monongahela, Pennsylvania, made a presentation to the Board with reference to Pigeon Creek Watershed. Mr. Sala requested that the County Commissioners render their assistance in order to help the City of Monongahela and the community of Pigeon Creek clean the stream beds, high water marks, etc. in said Watershed. Mr. Sala informed the Commissioners of a Stream Survey Report signed by the Pennsylvania Fish Commission which listed recommendations and a general statement as follows: "The combination of raw sewage, siltation and mine drainage and low gradient make this stream one of the most un- pleasant stretches of water one could imagine. Although the section of stream between Bentleyville and Monongahela has a better gradient and is more scenic, the amount of pollutants entering the upstream section during low flows would undoubtedly limit it as a fishery. Until the present pollution problems existing on the watershed are corrected, I feel the introduction of any fish to the stream would be an injustice to conservation. Although it is recognized that a mine acid abatement program has been started on the watershed, the improvement of water quality by initiating sewage treatment systems and the continued upgrading of mine drainage appears to be of prime importance if the stream is to realize its potential as a warmwater VINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. If there is any question about the continual damage done to the stream by the surrounding man -manipulated environment, our stream file shows that no less than five pollution reports have been made on this stream during the last year. " A discussion was then held on the above matter. Acting Chairman informed Mr. Sala that said matter is presently being handled by Assistant County Solicitor Gilmore and Mr. William Sember, Director of the Planning Commission, :,with reference to the Fritch property. Mr. Jerry Kelanic entered the meeting. Correspondence: (bills) Chief Clerk informed the Board of the receipt of the following checks: (a) Commonwealth of Pennsylvania - $5970. 67 - Sewage Facilities Planning Assistance Program. (b) Commonwealth of Pennsylvania - $4720. 90 - Public Assistance Payment for Child Welfare Services - Month of August, 1973. (c) The Hertz Corporation - $178. 48 - Traffic Count Program - Outside gasoline purchased for rentals. Moved by Mr. Paluso, seconded by Mr. Jones, that the following bills be approved for payment: (a) John M. Felice Associates, Inc. - $2800.45 - for professional services. Correspondence then listed the categories of funding and how said funds should be used. Chief Clerk read correspondence under date of November 5, 1973, from Penn's South- west Association directed to Commissioner Jones, which informed that the annual meeting of the Association will be held at 2:30 p. m. , November 21, 1973, at the Association's offices at One Oliver Plaza, Pittsburgh, Pa. Correspondence also enclosed a President's Report and a copy of the audited financial statement for the year ended June 30, 1973. Chief Clerk advised the Board that nominees for the Executive Committee include the names of Mr. James S. Lyon, Executive Vice -President of the Observer Publishing Company, and County Commissioner Frank Jones, Jr. Chief Clerk read correspondence under date of November 9, 1973, from John E. Costello, Esq. which advised that the Washington County Industrial Development Authority has just completed a loan to Steeltron Corporation to cover a substantial improvement program of said firm. Correspondence stated that said loan was financed via a mortgage in the amount of $265, 000. 00 at Mellon Bank N. A., with the rate being 52% per annum. Chief Clerk also read correspondence under date of November 9, 1973, from Mr. Costello which stated that the Wash- ington County Industrial Development Authority is pleased to advise the Commissioners that said Authority has just completed an Industrial Development loan to Ryan Homes, Inc. in connection with the rebuilding of its property in South Strabane Township. Correspondence prime stated that a mortgage loan was arranged from the Pittsburgh National Bank with a/rate plus 2. 25 % per annum but not less than 5. 25% nor more than 7% and that the debt was for a ten (10 ) year term and the total loan was in the amount of $510, 000. 00. Chief Clerk read correspondence under date of November 9, 1973, from W. Bryan Pizzi, II, which stated that as a member of the Board of Directors of the Senior Citizens Center Mr. Pizzi would like to personally express his appreciation to the County for its outstanding efforts in assisting said center W stay open. New Business: Chief Clerk noted again that the Regular Board meeting has been rescheduled to Wednesday, November 21, 1973, at 9:30 a. m. with Salary Board to immediately follow due to Thanksgiving; also, Prison Board is scheduled for Wednesday, November 21, 1973, at 11:30 a. m. and Retirement Board has been rescheduled from Thursday, November 15, 1973, to Wednesday, November 21, 1973, at 1:30 p.m. Mr. Paluso: I would like to propose that the Regular meeting be rescheduled for Friday, November 23, 1973, because I hear by the grapevine that there are going to be some discussions J 1 on the County Home, Architects, etc. I have made previous arrangements to be out of state on MINUTE B❑❑K 167 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Mr. Jones: Have you discussed this with Mr. Flynn - what was his reaction? Mr. Paluso: I did not get any answer. Since I see that the Retirement Board has been re- scheduled for his convenience since he is out of town this week, I think the same courtesy should be extended to the other members of this Board. We have never had a meeting on `A Thanksgiving week and that is why these arrangements were made. I want it noted in the minutes that these meetings have been rescheduled for the convenience of other Commissioner3 since this was done after it was learned that I would not be here and I think that this meeting should be rescheduled for the 23rd of November. Mr. Jones: I would like it noted in the minutes that you did receive a official notice of the re- scheduling of the Retirement Board meeting. Solicitor: County Solicitor Hormell presented one (1) tax refund to the Board for their consideratio-i and approval. County Solicitor Hormell presented a Lease Agreement with reference to the Addictive Disease Program in Burgettstown. Moved by Mr. Paluso, seconded by Mr. Jones, that the Washington County Board of Commissioners approve and execute the Lease Agreement with Amelia A. Kaezyk of Burgett- stown, Pennsylvania, and Washington County, for the term of one year commencing on the 1st day of July, 1973, and ending on the 30th day of June, 1974, for the total rent of $2200. 00 for the building located at 9 Main Street, Burgettsto wn , Pennsylvania; installments to be $185. 00 on the first day of each and every month. PALUSO, COMMISSIONERS Coun ty Solicitor presented an Agreement between Westmoreland County and Washington County with reference to use of cells in the retention- facility of the Jail on -a -spaceravzaiiable basis for the consideration and approval of the Board. Mr. Hormell stated that at the re- quest of Commissioners Jones and Paluso a survey was made by Mr. Whalen and it was de - for adults termined that the rate charged to Washington County by the State/was $11. 51 per day and that as a result of said information the sum of $12. 00 per day was included in the Agreement. Mr. Hormell stated that it would be his recommendation that said Agreement be sent to West- moreland County for their perusal and signature and then returned to Washington County for a computation on signature. Commissioner Paluso then requested/what the daily cost for Washington County's prisoners at the Jail or Detention Home would be. Moved by Mr. Paluso, seconded by Mr. Jones, that the said Agreement between Westmoreland County and Washington County concerning retention facilities as per above be sent to Westmoreland County with the proviso that Washington County's own costs be de- termined at the Washington County Jail and, if said figure is higher than the twelve ($12. 00) dollar figure presently in the Agreement, then said figure is to be inserted as the rate to Westmoreland County. County Solicitor presented an Agreement between Greene County and Washington County with reference'to the temporary use of the Juvenile Detention Home facilities. Mr. Hormell stated that said Agreement has the provision that Washington County will not take any juveniles from Greene County unless a specific -court order is issued or unless a specific court order states that the costs of detaining a juvenile, will be paid by Greene County. Mr. Hormell stated that Mr. Whalen has determined that the rate of $13. 00 per day is charged to Washington County for juveniles by the State. Moved by Mr. Paluso, seconded by Mr. Jones, that the said Agreement between Greene County and Washington County concerning the temporary use of the Juvenile Detention Home facilities as per above be sent to Greene County with the proviso that Washington County Is own costs be determined at the Juvenile Detention Home and, if said figure is higher than the $13. 00 figure presently in the Agreement, then said figure is to be inserted as the rate to Greene County.
