Also present being Chief Clerk and County Administrator Whalen; Administrative Assistant Crouse; County Solicitor _ Bigi- ; Assistant Solicitor Gilmore; Controller Mascara; Deputy Controller Daniels; Coroner Jackson; Mr. Dave Posner - Court Administrator; Mr. Robert Zeman Esq. ; Mrs. June Lilley of The Daily Notes; Mr. Bob Robertson of The Observer-Repor Mr. John Merdian - WJPA; Mr. Earl Bugaile - WKEG; Mr. Kelanic - WWVA; and MrE Edwards of The League of Women Voters. "TONY" BOY LE ) lomm AND NOW, this 8th day of March 1974, upon application of the Board of County Commissioners, the undersigned expresses his approval of the request for an advance pay- ment to the County of Delaware in the amount of Fifty Thousand Dollars ($50, 000), more or less, insofar as the undersigned has any authority in the premises. It is the under- standing of the undersigned that the Commissioners of Delaware County and the other con- cerned officials there will proceed normally and according to law in disbursing monies in connection with the trial of the above -captioned W. A. "Tony" Boyle and that a full accounting to the satisfaction of the County Controller of Washington County will take place as to this sum of money add any further sums advanced thereof. It seems impracticable foa us to expect Delaware County to lend us money for guying the many items of expense in the first instance and then demanding reimbursement. It seems far better for us to establish a account with them so that our money will be disbursed for the expenses subject to normal restraint, sec. reg. sec. leg. Said letter informed Mr. Pilgrim that said project is due for consideration for continuation by the Governor's Justice Commission. Casey, Auditor General. Said letter was in regards to the Commissioner's letter of January 28, 1974. Said correspondence stated that the Auditor General's office would certify the reasonable cost services provide by the Washington County Home, under the Medical Assistance Program for t calendar years 1971 and 1972; to the Department of Public Welfare. Said letter also stated that the Commissioners should receive a settlement from Welfare within the next few weeks. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Commissione table the request from the Washington County History and Landmark s'Foundation to use the Par for the "Whiskey Rebellion" until said matter has been perused by the Commissioners. Said House Bill requires that persons violating any ordinances adopted by the Tbard of County Commissioners under Section 509 (Ordinances and -■■ 28'7 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES. JR., EDWARD M. PALUSO, COMMISSIONERS F 1 I Resolutions), upon conviction at a summary proceeding, be sentenced to pay the fine pres in the ordinanceg, up to $100, to be paid to the use of the county, with costs of prosecution, or to be imprisoned for up to ten days, or both. Said bill goes into effect April 2, 1974. Mr. Wusa suggested that this House Bill be forwarded to all Magistrates and the Ftrk Dire Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Board of Commissioners will participate in the cost of the radio installation for the Tri Communi Ambulance Service. The total cost for the radio installation is $3, 484. 85. The County will be responsible for 50% of the cost. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Ye Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of March 1, 1974 from the Department of Community (fairs. Said letter was in regards to suppliers for gasoline and diesel fuel for Pennsylvanians. Chief Clerk read a News Bulletin under date of February 28, 1974 from the Pennsyl1 Mental Health Inc. Said news bulletin was in regards to the bitterly partisan debate over completion of the current year's State MH/MR budget. The result of this debate was that $7. 6 million additional for services to the mentally ill and the mentally retarded would be granted. However, the Department of Public Welfare sources indicated that because of this increment there will be an 8% increase over last year in the county MH/MR program fundi Chief Clerk read correspondence under date of January 22, 1974 from W. Addiso directed to Solomon & Teslovich stating that Mr. Addison hereby makes formal acceptance 0 nia the work performed under Contract No. 12-10-360-2903. site PA-483, Harmon Creek WatersNed, Washington, Pa. Acceptance is effective August 29, 1973 at which time the work was substantially complete. Moved by Mr. Jones, seconded by Mr. Paluso, that the Washington County Comm ;ionersi approve and execute a Dam Complet-ion, Report in regards to Harmon Creek Watershed P. A.I 483. Contractual Obligations) Mr. Flynn: As you gentlemen know we had a meeting on October 19, 1973, relating to grievances filed against the Board of County Commissioners as the employers of the Washington County employees. As you can well see according to this document it was somewhat of a luminous affair. A meeting was held on October 19, 1973, and it was adjourned and reconvened on October 22, 1973, and the final results of the grievance procedure was the decision that: 1. Mr. Brovey be reinstated to his position with back pay, etc. Mr. Flynn then went on to quote Judge Richard DiSalle: "I do want to reiterate one thing more for the record. I would like to have my letter of October 10, 1973, which constitutes my, answer to Mr. Dezack and Mr. Stackhouse made a part of the record in this proceeding and especially the last paragraph of this letter which states that we are following through the grievance mechanism without prejudice to our rights and to our position which we have taken in the appeal through the Commonwealth Court. FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Employees of one George K. Hanna addressed to Mr. Paul Stackhouse - Service/International Union: "The major problem arises from the fact that at present, there exists the unresolved issues wh ch are the subject of the case which is not to be heard by the Commonwealth Court. Until the issues in that case are decided, it is our opinion that no grievances involving the Court should be pursued until those basic issues are determined. It would surely seem practical to hold greivances involving the local court in abeyance, at least until the Commonwealth Court has made a decision" As we all know -gentlemen, the Commonwealth Court has made a decision and to follow through .as a result of these griew,n.ces filed against the Commissioners and at this testimony that I have in my han here. The Salary Board of the County of Washington followed through at a meeting on October 26, 197 - Minute 48S. On a motion made by Mr. Jone s, Seconded by Mr. Elish, that Mr. Brovey be rein tated, andfmn February 2, 1973 up until the present , with all back wages paid), unanimously was passed. Mr. Paluso was not present at this unmeting. However, as a result of the action taken there a C urt Order was issued by Judge Sweet in regards tag said matter. Mr. Flynn went on to quote Judge weet: "On the 16th day of November 1973, wherein the Judge directs to County Treasurer and the County Ccntroller not to make this ursement. The check was eady authorized by the Controller and the Court Order was sent down to the County Treasurer:'` To this date this man has not bee paid, and in this Court Order, a part of it, after the County sitting as the employee listen to the grievance on a third stage of it and had settled it and the Judge in his order said, " We also note that the reibstatement of said Brovey was accomplished without any ft ere 1 he7rence, here are the m Mutes of the hearing here, and that Commissioner Flynn announced tha would be no forstage or impartial arbitration. On the advice of our labor consultant, who `sat in on the meeting, there is no need or arbitration., the case has been resolved. However the salary wasn't paid. This Court Order was under dateof November 16, 1973, however on November 21, 1973 another opinion and order was issuddeby Judge Paul A. Simmons, and in his order he, said' and Mr. Flynn quotes:"It came to the atteRtfeWaxOrthe undersigned for the first time and without prior consultation that Judge Swe entered an Order dated November 16, wherein President Judge Sweet purported to direct the Co rt Administrator not to post a Court Crier job flaw filled by Nicholas Nardine and further the C.ontr'oller the County Treasurer not to pay Stanley Brovey in ac,cor&.pMce with a warrant executed by the County Controller and the County Commissioners. It is my opinion that the Order of Judge Swe t is of no legal farce or effect for the following reasons: 1. The President Judge did not meet with and/or obtain the concurrence of the other Judges of the Court of Common Pleas prior to making said Order. In counties such as Washington County where there are other Judges of the Court of Common Pleas, a President Judge sitting in chambers is not the Court. TheQasE!I9 are sited therein. 2. It is my opinion that inasmuch as the Order of Judge Sweet deals with a matter wherein Judge Sweet himself is the subject matter of a grievance filed against Stanley Brc under the terms of a valid union contract (until it is held to be invalid by a Court of compf jurisdiction), he should not in good conscience intervene judicially in a case where he has a personal interest. Further it might be noted that Judge Sweet appeared personally at a grievance hearing as a party litigant on October 19, 1973, in the Commissioners' Conferer Room, for the purpose of discussing this very matter." 0erm-nigadamwYlynn goes on to quote Judge Simmons : "It is my opinion that the agreement ent into by the County of Washington and Local 585, Service Employees International Union AFL -CI a legal contract binding until such time as the Pennsylvania Labor Relations Board decision has been overturned by a court of competent jurisdiction. There has never been a supersedeas enter to stay the effect of the aforementioned Pennsylvania Labor Relations Board decision, and until such time as the ruling of the Board has been overturned in a legally proper manner, it is the 1E of the case." Mr. Flynn: Since that time the opinion has been handed down by the Court, by the count of 4-3, that the Cou Commissioners are the employers and the the contract is valid, etc., until over ruled by a higr Court. Therefore, we are liable, on advise of our labor consultant and his legal counsel- . I Esquire. At no time did we rely on our County Solicitors relating to this Union Contract. Mr. Flynn stated that the Commissioners did bargain in good fait Mr. Flynn further stated that Mr. Felice and Mr. Douglas would be at the Courthouse on Marcr 15, 1974. (Discussion was held) Mr. Flynn then read a letter from Judge Sweet directed to Mr. Andrew Dezack: Dear Mr. Dezack: th This is to advise you that you are no longer employed by the Courts. We do not have work for you and it appears that you are superannuarted. The Advisory Opinion of MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS 1 L Judicial Ethics Committee of the Pennsylvania Conference of State Trial Judges, No. 1, May 22, 1972, is referred to for your information and guidance. Your recent arcts against a member of this Court are of record. We are not particularly anxious to change the status of anyone until the Common- wealth Court Opinion comes down on the relation of the Court and the Commissioners in employment and we will not, therefore, require the Commissioners to stop paying you. TI is strictly between you and them. We do not, however, consider you a Court Crier from a after this date and of course, it is not necessary for you to report for work since there is none. (Discussion was held) Moved by Mr. Jones, seconded by Mr. Flynn, authorizing payment to Stanley Bro in accordance with the provision contained in the Contract between Service Employees Local 585 International Union/and the County of Washington. Such payment to be retroactive to Fe 2, 1973 up to and including this date. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - No; Mr. Flynn - Yes. Motion carried. Remarks: Mr. Paluso: In the absence of a legal opinion from Mr. Douglas, I feel we should not take any steps concerning Mr. Brovey. Mr. Flynn: Speaking for myself, for the record, we have a, valid contract. Act 195 of the statute of the Commonwealth of Pennsylvania. We executed a contract with the Service Employees International Union - Local 585, and I affixed my signature thereto and I intend to live up to that agreement until such time that the Court has indicated by the Judges of a higher compe-tence,, overruled. Mr. Paluso: I still feel that we should not take any steps in the absence of a legal opinion. Mr. Jones: videntjy,;_ if they (Courts) think we're wrong, all they have to do is send a Court Order down.
