PALUSO, COMMISSIONERS Minute No. #116 Office of the County Commissioners Washington, Pa., April 25, 1974 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso, and Flynn. Also present being: Xating Chief Clerk Charles A. Crouse; County Solicitor Bigi; Assistant Solicitor Gilmore; Mrs. June Lilley The Daily Notes; Mr. Dave Budinger - The Observer Reporter; Mr. Earl Bugaile - WKEG; Ms. Miller - The League of Women Voters; Mr. Frank Mascara - Controller; Mr. Posner - Court Administrator; and Mr. Al Janovich of the Pennsylvania Economy League. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. #11 , each member having received a copy. read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. #115 be approved as Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Remarks: Chairman Flynn stated that due to Chief Clerk Whalen's absence, Administrative Assist Crouse will act as Chief Clerk for the meeting. Mr. Whalen is attending a meeting in Pittsbur of the Governor's Panel on Comprehensive Health Planning. Old Business: Commissioner Paluso read bids from three printing companies in regards to the printing of pamphlets for the Home Rule Study. They were: (1) McPeak Printing - Canonsburg, (2) Mr. Paluso gave the diferent colors Lydic Printing Co. - Washington, (3) Badzik Printing Co. - Washington. and prices for the pmphlets. Commissioner Paluso then stated that a motion should be taken authorizing the printing of the pamphlets. Commissioner Flynn stated that he feels that in the motion to be taken for the authorizat of the printing of the pamphlets for the Home Rule Study should be included a motion stating the Commissioners are in favor of the adoption of the one million dollar Bond Issue. Commissioner Paluso stated that he doesn't think the Board should take a stand on the two issues in one pamphlet. Commissioner Jones asked if an explanation of both issues be put into one pamphlet. Commissioner Flynn stated that both issues are very important and could be taken care of in one pamphlet. Commissioner Flynn stated that the Bond Issue deals with both private and public nursing institutions. MINUTE B❑❑K 327 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA_ ` MICHAEL R. PALUSO, COMMISSIONERS E C Moved by Mr. Jones, seconded by Mr. Paluso, that 40, 000, 000 pamplets be pri at the discretion of the County Commissioners in regards to the Home Rule Study and the Bond Issue. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. (Mr. Malcolm L. Morgan - County Treasurer entered meeting.) (Grant -In -Aid Applications) Acting Chief Clerk presented the request for approval of submission of the 1974 Grant -In -Aid Application trf the Juvenile Court Justice Commission. It was pointed out that the, amount of this grant will be $24,114. 00, however, it was pointed out that in order for approval of this grant an incremental salary increase must be granted teach juvenile probation officer in the amount outlined in their instructional booklet. Moved by Mr. Jones, seconded by Mr. Paluso, granting approval for funds in the 1974 Grant -In -Aid program. Roll c all vote taken: Mr. Jom s - Yes, -Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Correspondence: (Bills) bills: Acting Chief Clerk informed the Board of receipt of the following check: 1. Commonwealth of Pa. - Offices of Adult Programs - Aging Amount: $10, 605. 50 Moved by Mr. Jones, seconded by Mr. Paluso, authorizing payment of the follow 1. McDonald Associates - Chartiers Flood Control - $48, 223. 90 2. S. P.R. P.C. - $5, 794.00 - 2nd payment 3. Acting Chief Clerk read correspondence under date of April 22, 1974 from the Child Welfare Advisory Board. Said correspondence was asking permission to add Mr. Hunter Advisory Severding, of 1646 North Main Street, Washington, Pa., to the /Board . Moved by Mr. Jones, seconded by Mr. Paluso, granting permission to add Mr. JIunter Severding to the Child Welfare Advisory Board. PALUSO, COMMISSIONERS Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of April 19, 1974, from Mr. Albert D. Metzner. Said letter was asking that Mr. Metzner's gasoline station be added to the list of gasoline stations designated as "petroleum suppliers." Commissioner Jones stated that he has asked Mr. Charles Bohner, Civil Defense Director to make a county wide survey of service stations who would like to serve as emergency suppliers. Acting Chief Clerk read correspondence under date of April 18, 1974 from Congre man Morgan. Said letter was in regards to the Rail Service. Congressman Morgan stated that he shares the same concern as the Board has in regards to the proposed rail reorganization's effect upon the 22nd Congressional District. Acting Chief Clerk read correspondence under date of April 19, 1974 from Mr. Keery McAmbley, Washington County Industrial Development Agency. Said letter was in regards to Washington Caunty's testimony opposing the rail abandonment in the County at Langeloth and Westland. Said testimony la.s been received by the Interstate Comme rce Commission , filed, and is now part of the public record. Acting Chief Clerk read two letters from the House of Representatives in regards to the O.E.O. Act. The first letter from Mr. Carl D. Perkins, Chairman of the Committee of Education and Labor thanked the Commissioners for their support for the continuation of the Community Action program that is currently being funded through the Economic Opportunity Act. The second letter was from Mr. Augustus F. Hawkins, Chairman of Subcommittee on Equal Opportunites, thanked the Commissioners for their support of H. R. 12424, a bill to exte the Economic Opportunity Act of 1964 for three years. Acting Chief Clerk read correspondence under date of April 19, 1974 from Mr. Nicholas L. Exar, Assistant Director of Environmental Programs of the Conprehensive Health Planning Association of Western Pennsylvania. Said letter was in, regards to an intensi study of potential effects of H. B. 1425, 1426, and 1427. Acting Chief Clerk read correspondence under date of April 22, 1974 from Mr. Kenneth B. Lee, House of Representatives, Commonwealth of Pennsylvania. Said letter was in regards to the Nursing HomeProblem in Pennsylvania. Acting Chief Clerk read a copy of correspondence under date of April 18, 1974 from Mr. George Kubovcik, Adult Probation and Domestic Relations Office. Said letter was requesting permission for Mr. Jerome McCavitt be given permission to attend the Pennsylvani; Association of Probation, Parole, and Correction, Annual Training Institute, to be held May 19 to May 22, 1974 in Lancaster, Pa. 1 Moved by Mr. Jones, seconded by Mr. Paluso, granting permission for Mr. .J MINUTE BOOK, 329 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA _ MICHAEL R. Roll call vote taken: Mr. Jones, Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of April 18, 1974 from Coroner Farrell Jackson. Said letter was requesting permission to attend the International Coroner'; Convention which will held at Valley Forge, Pennsylvania, from June 9th to and including June 14, 1974. Moved by Mr. Jones, seconded by Mr. Paluso, granting permission for Coroner Jackson to attend the International Coroner's Covention which will be held at Valley Forge, Pennsylvania, from June 9th to and including June 14, 1974. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimous ly. Acting Chief Clerk read correspondence under date of April 13, 1974 from Byers Memorial Library. Said letter requested that the Washington County Commissioners con- sider this library for inclusion in their annual allocations to public libraries in Washington C ounty. Moved by Mr. Jones, seconded by Mr. Paluso, approving Byers Memorial Library in their annual allocations to public libraries in Washington County. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of April 24, 1974 from Mr. Johr. Fantini, Personnel Director. Said letter was in regards to the Intergovernmental Personnel Contract. Said letter stated that each employee of Washington County would be given forms to fill out for the classification study to be done by the United States Civil Service Commission. Acting Chief Clerk read correspondence under date of April 15, 1974, from the Western Pennsylvania Regional Planning Commission. Said letterwas directed to the Pennsylvania Department of Transportation endorsing the Fish Commission's letter out- lining possible problems in the presently proposed location for a Tourist Information Center on Interstate 70. The S. P. R. P. C. made four (4) alternative suggestions. Acting Chief Clerk informed the Board that Mrs. Grace McVeigh, 1296 Spencer Ave Washington, Pa. , turned in her resignation effective April 23, 1974, as Judge of Elections Canton Township - Precinct 4. PALUSO, COMMISSIONERS to advertise for repavement of road to County Airport. Roll call vote taken: Mr. Jones - Yes; Mr. Palusb - Yes; Mr. Flynn - Yes. Motion carried unanimously. (Mr. Mascara - Controller) Mr: Mascara st ated that he has petitioned the Court for an extension to file the Controller's Report for 1973. Mr. Flynn stated that the Board has met and discussed this problem with Mr. Mascara. Moved by Mr. Jones, seconded by Mr. Palum stating that the Commissioner's Office in conjunction with the Controller's Office request the -Washington Branch of the Penn - Sylvania Economy League to do an in-depth study of the accounting record keeping system in the Controller's Office. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Remarks: Mr. Mascara stated that there is no charge to the County for this service performed by the Pennsylvania Economy League. Mr. Mascara further stated that it has been agreed that a C. P. A. undertake to the problem of looking over records in the Controller's Office. He stated that Mr. John Sells, C. P. A., has been during this since Monday of this week. Mr. Mascara then commented on the 1973 Controller's Report. Mr. Mascara stated that there were some deficiencies in the report, but they could be cor Mr. Mascara stated that there were no misgivings on the part of any County officials. (Discussion was held) (Mr. Dave Daniels - Deputy Controller entered meeting) Mr. Mascara also stated that work was begun yesterday to audit the County. (Bank repurchase agreement) Vol ving Mr. Mascara stated that there is no problem in/repurc,hase ,, agreements from the Bank. He further stated that the County can start investing its money next week. Solicitor: Moved by Mr. Jones, seconded by Mr. Paluso, that the Board of County Commissioners adopt and execute an Agreement between the County of Washington, as"OWNER", and Raymond A. Wright, as "CONTRACTOR",_ said action taken upon the recommendation of Solicitor Bigi. Property located at Mingo Creek Park..... Roll call vote taken: Mr. Jones - Yes; Mr. Paluso- Yes; Mr. Flynn - Yes. Motion carried unanimously. PALUSO, COMMISSIONERS �J J 1 Moved by Mr. Jones, seconded by Mr. Paluso, adopting the following Resolution: WHEREAS, the Board of County Commissioners of the County of Washington has heretofore adopted a resolution directing that proceedings for a Writ of Possession be promptly instituted and prosecuted in proceedings at No. 291 November Term, 1973 A.D. in the Court of Common Pleas of Washington County, Pennsylvania; and WHEREAS, subsequent to the adoption of said resolution, Donaldson Supply & Equipment Company and Silvio Tonti et ux. et al, have granted Columbia Gas of Penn- sylvania, Inc. certain rights of way for the re -location of pipe lines, thereby rendering immediate possession unnecessary. NOW, THEREFORE, BE IT RESOLVED, That the Board of County Commissioners countermand the aforesaid resolution relating to the immediate institution of said proceeding for possession of property of Donaldson Supply & Equipment Company and that such action be withheld pending further action of the Board; and BE IT FURTHER RESOLVED, That the County Of Washington enter into two sep- arate agreements relating to the re -location of gas lines in the vicinity of the Jefferson Avenue Bridge in the Borough of Canonsburg, Washington County, Pennsylvania, copies of which agreements are hereto attached: the one agreement being between the County of Washington and Donaldson Supply & Equipment Company and the other agreement being between the County of Washington and Silvio Tonti et ux. et al. hnd that the Board of County Commissioners cause the said agreements to be duly executed and delivered. The foregoing resolution was moved by Mr. Jones, seconded by Mr. Paluso and duly passed this 25th day of April 1974. (Controller's Report 1973) Solicitor Bigi stated that the Commissioners are in receipt of a Rule to Show Cause from President Judge Charles G. Sweet inquiring why an audit shouldn't be held in regards to the Controller's Report for 1973 and why the deficiencies Mr. Mascara has stated are in the Report do not have to be answered. Mr. Bigi stated that he has prepared anl�iception' Opinion and Order of Court Dated 4-17-74 In The Nature Of Preliminary Objections and'he would like the Board of Commissioners to give him the approval to file said preliminary objections. Moved by Mr. Jones, seconded by Mr. Ttyrgks, recommending and approving Mr. Herman J. Bigi, County Solicitor, to file Preliminary Objections to President Judge Char G. Sweet's opinion and order. Mr. Paluso further stated that he did not know where he stood in this matter. Mr. Flynn stated that for the record he would like it to be noted that the motion carried as a result of a majority vote.
