PALUSO, COMMISSIONERS J Minute No. # 124 Office of the County Commissioners Washington, Pa., June 20, 1974 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso, and Flynn. Also present being: Chief Clerk and County Administrator Whalen; Solicitor Bigi; Assistant Solicitor Gilmore; Mr. Dave Daniels - Deputy Controller; Mrs. June Lilley of 'Ihe Daily Notes; Mr. Bob Robertson of The Observer -Reporter; Mr. John Merdian - WJPA; Mr. Earl Bugaile - WKEG; Ms. Helen Miller - The League of Women Voters; Mr. Clay Graham - Land Acquisition Agent; and Mr. Robert Zeman, Esq. - Special Counsel. Chairman asked if there were any corrections, additions, or omissions to Minute # 123, each member having received a copy. as read. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing that the following budgetary modifications be made: Reappropriate from Account 1499 Year -End -Balance, which presently reads $231, 475. 00, the amount of $37, 296. 00, to the following accounts: Account 112-2-11: Controller (other) 412 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Amount: $2, 296. 00 Reason: In order to appropriate sufficient monies for payment of service agreement with Burroughs on two L500's and two Auto Readers Account 629: (to be titled - Washington County Emergency Services) Amount: $15, 000.00 Reason: For the creation of a Washington County Emergency Service Office as per previous motion by the Board of Washington County Commissioners Account 206: Maintenance of Adjudicated Juveniles in Private Training Schoo Amount: $20, 000. 00 Reason: To appropriate sufficient monies to meet the projected claims for the maintenance of adjudicated juveniles due to recent increases in disposition to private institutions. Additionally, although the reasons for this rate of increase are presently under investigations, the amount of $20, 000 will represent a figure sufficient to meet present claims until this problem can be resolved. Chief Clerk read a Telegram from Congressman Thomas E. Morgan. Said Te stated that the Rural Electrification Administration of the State Department of Agriculture has approved a $655, 000 REA Loan at 5% annual interest to the Marianna and Scenery Hill Telephone Company. Chief Clerk read a copy of correspondence from Congressman Thomas E. Morgan thanking the Board for their support of the "Rural Development Act of 1972." Chief Clerk read a Memorandum from Charles A. Crouse informing the Board that a meeting will be held on July 2, 1974 at 1:30 p, m. in order that Wallover & Mitchell may make a presentation to the Board in regards to the preliminary cost estimates for the Washington County Long Term Care Facility. Chief Clerk read a copy of correspondence from Mr. William P. Sember, Direct an of the Washington County Planning Commission., Said letter was in regards to/Inner City Air Quality Sampling and Monitoring Program. Mr. Sember stated that the DER would like to set-up an air quality monitoring station in the City of Washington and the Court �l House would be ideal spot. MINUTE BOOK 413 'BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS F1 C Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Department of Environmental Resources to use the Court House to set-up an air quality monitoring station. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read correspondence under date of June 13, 1974, from the Office of the Auditor General. Said letter was in regards to guidance in respect to filing of the cost report for the Washington County Home and Hospital. Said letter stated that the County should continue to file the Annual Fiscal Report, Form AG-9. Chief Clerk read correspondence under date of June 11, 1974, from Dr. J.C. McGinnis. Said letter was thanking the Commissioners for meeting with the Washington County Medical Society in regards to the New County Nursing Facility. Chief Clerk read correspondence from Mr. Kenneth B. Lee under date of May 23, 1974, directed to Mr. Flynn. Said letter was in regards to the Nursing Prob in Pennsylvania. Chief Clerk then read the reply from Mr. Flynn to Mr. Lee. Said reply stated that Mr. Crouse has been assigned to outline a constructive course of action to be taken to confront the Nursing Home Problem in Pennsylvania. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing Mr. Crease to meet with Mr. Lee, if Mr. Lee desires such a meeting, to discuss the Nursing Home Problem. Chief Clerk read correspondence under date of June 12, 1974, from Columbia GaE of Pennsylvania, Inc. Said letter stated that the Columbia Gas Co. has completed the relocation and abandonment of its six (6) inch high pressure and six (6) inch low pressure gas pipelines on the Chartiers Creek Flood Protection Project, Canonsburg -Houston Reach Unit 2A, Jefferson Avenue Bridge. Chief Clerk read correspondence under date of June 9, 1974, from Odessa Said letter stated that Mrs. Kidder wishes to resign as Majority Inspector for the Tow of North Strabane -5th. Mr. Flynn stated that said letter should be turned over to Mr. Muscaro, Election De Chief Clerk read a Bulletin from the County Action Coalitions in regards to the House Floor Action on Community Development Bill. Said Bulletin stated that the r. e rt . Said bulletin also stated that it is imperative that Washington County immediately contact its congressmen a urge them to support the passage of the bill. Chief Clerk read correspondence under date of June 17, 1974 from Mr. Ivan W. Saunders. Said letter was in regards to setting up a tourist attraction in the old Waynesburg and Washington Railroad. Mr. Flynn stated that Mr. Whalen should acknowledge receipt of Mr. Saunder's letter. Chief Clerk read correspondence from the Borough of Charleroi. Said letter thanked the Board of Washington County Commissioners for the $15, 000.00 that the Bor of Charleroi will receive for year 1974 from the County Aid to pave certain streets this year. ] I Chief Clerk read correspondence under date of June 12, 1974, from the Departmen of Public Welfare. Said letter stated that the 1974 Annual Plan and Estimate of Expenditures for Child Welfare Services has been- approved. Chief Clerk informed the Board that two transfers in regards to the 1974 Bond Fu Account have been completed. They are the approved payment to the Washington County Capital Reserve Account in the amount of $200, 000. 00 for specific uses in accordance with the 1974 Bond Issue and the approved payment to the Washington County Parks and Recreation Account in the amount of $100, 000. 00 from the 1974 Bond Issue Account. Mr. Flynn stated that the Contract the County has with Cole -Layer -Trumble Comp in regards to the Tax Assessment Office expired June 3, 1974. He further stated that the Board would therefore have to let CLT know whether they want to renew the contract or cancel out. (Mr. Jerry Kelanic - WWVA entered meeting) has Mr. Ben Wilt from CLT then stated that the new contract/one (1) major change, that is the price of the contract - from $102, 000. 00 to $97, 000. 00; and One (1) minor change, that is the price of hard -cover bound duplicates for the townships, boroughs, and schools from $6.50 to $11.50. (Discussion was then held on the above matter) Moved by Mr. Jones, seconded by Mr. Paluso, that the Board renew the contract with CLT with the exception that Lino 7 on- Page 6, of the contract be stricken from the contract. ( Cancellation of Meetings) Mr: 'Flynn stated that the Regular Commissioner's Meetings scheduled for the weeks of June 24th and July 1st will be cancelled. Said meeting scheduled for the week of the 24th will be cancelled due to the Commissioner's Convention, and said meeting scheduled to the week of July 1st will be cancelled due to Fourth of July Holiday. (Ferry Commission -Letter) the above Solicitor Bigi stated that he received a letter from Mr. Edward Munce-Pa. Public Utility Commission. Said letter was in regards to the Joint Monongahela Ferry Commissio Mr. Bigi stated that said letter stated that the PUC has no jurisdiction over the rates or i services of the Ferry Commission. (Demolition Agreement) Mr. Bigi informed the Board of an Agreement between the County and Raymond A. right of R.D. #1, Bentleyville, Pa. Mr. Bigi further stated that this Agreement pertains o the purchase and removal of two buildings in Mingo Creek Park which have no value to C ounty. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve and execute Said action taken upon the re ommendation e Agreement between the County and Raymond A. Wright. of Solicitor Bigi. Columbia Gas Right -of -Way Assistant Solicitor Gilmore presented to the Board a Right -of -Way Agreement submitted by Columbia Gas for County, property situated in Coal Center Borough, regarding Ipipeline. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve said Right -of -Way subject to the provision that if it becomes necessary to move the pipeline, because of any projects, Columbia Gas will bear the cost of relocating said line. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Interest Refund on Mall Case Motion carried unanimously. Mr. Flynn -Yes. Solicitor Bigi stated that three questions have arisen in regards to the interest refund on the Mall Case. They -are as follows: (1) Was interest due on the refund; (2) If so, the amount of interest; and (3) When does the interest attach? Mr. Bigi then goes on to answer the above mentioned questions: (1)"There is interest the County must pay." (2) "'The Code does not specify the amount of interest, therefore I recommend that the County pay the legal interest which is 6%." (3) "The most difficult question to answer is when does the interest attach? Mr. Bigi further stated that Cases say interest should be paid on the date of demand by the taxpayers, therefore the question arises as to when is the date of demand. Mr. Bigi then stated that it is his recommenda to the Board that the interest be paid from the date of Judge Richard DiSalle's Order." Moved by Mr. Jones, seconded by Mr. Paluso, that interest due on the Mall Case be paid from the date of Judge Richard DiSalle's Order, as per recommendation of County Solicitor Bigi.
