Interest Refund on Mall Case Motion carried unanimously. Mr. Flynn -Yes.
Solicitor Bigi stated that three questions have arisen in regards to the interest
refund on the Mall Case. They -are as follows: (1) Was interest due on the refund;
(2) If so, the amount of interest; and
(3) When does the interest attach?
Mr. Bigi then goes on to answer the above mentioned questions: (1)"There is interest the
County must pay." (2) "'The Code does not specify the amount of interest, therefore I
recommend that the County pay the legal interest which is 6%." (3) "The most difficult
question to answer is when does the interest attach? Mr. Bigi further stated that Cases
say interest should be paid on the date of demand by the taxpayers, therefore the question
arises as to when is the date of demand. Mr. Bigi then stated that it is his recommenda
to the Board that the interest be paid from the date of Judge Richard DiSalle's Order."
Moved by Mr. Jones, seconded by Mr. Paluso, that interest due on the Mall
