The Board of County Commissioners met in regular session with the following mem-
bers being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Cle
and County Administrator Whalen; Solicitor Bigi; Assistant Solicitor Gilmore; Research Assist-
ant Fetcko; Deputy Controller Daniels; Mrs. Miller of The League of Women Voters and Mrs.
Swerdlove; Jack Merdian of WJPA; Bob Robertson of The Observer -Reporter; Earl Bugaile of
WKEG; and Dave Baker of The Daily Notes.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions or omissions to Minute No.
132, each member having received a copy.

Chief Clerk read letter dated August 29, 1974, from Mrs. Helene Wohlgemuth,
Secretary of the Department of Public Welfare, regarding a preliminary survey of all social
service programs for the aging administered for the Department of Public Welfare by communi
agencies through contractual agreements under the Social Security Act. Chief Clerk referred
this letter to Mr. Metro Petrosky, Jr., of the Adult Welfare Office and requested that he com-
plete the survey and return a copy to this office.
Chief Clerk informed the Board of notification from the Department of Environmen
Resources regarding examinations for Sewage Enforcement Officers to be held at 9:00 a. m. on
Saturday, September 28, 1974. Chief Clerk stated that these Officers must be certified by the
DER and recommended that this letter be referred to Mr. William Sember of the Planning Com-
mission.
Chief Clerk read a letter dated August 29, 1974, from the Southwest Regional Plan-
ning Council of the Governor's Justice Commission. Said letter stated that a session to finalize

the 1975 budget for the Southwest Regional Planning Council for the Governor's Justice Commis
lion will be held on September 19, 1974, at the Holiday Inn -Airport, 1406 Beers School Road.
Commissioner Jones suggested that the Commissioners be represented at this meeting.
Chief Clerk read a letter dated August 30, 1974, from Stephen R. Kladakis, Board of
Supervisors of Hanover Township, requesting field voter registration in Hanover Township.
Chief Clerk suggested that Wednesday, September 11, 1974, be designated as the field registra-
tion date for Hanover Township.
Moved by Mr. Paluso, seconded by Mr. Jones, that September 11, 1974, be designa-
ted as the field registration date for Hanover Township as per above.

Chief Clerk then read a bulletin dated August 21, 1974, from Ronald J. Pettine,
Deputy Secretary of the Commonwealth of Pennsylvania, regarding Act 153 which became effec-
tive July 3, 1974. This Act has changed the residency requirements of those electors moving
from one district to another from sixty (60) days to thirty (30) days. However, in passing the
Act, the Legislature has failed to amend the ninety (90) day provision of Section 701 §2 which
has caused some confusion in that many County Boards feel this new Act takes precedence over
any previous ruling. This is not the case; and, therefore, the requirement for in -state res
is still thirty (30) days. All citizens who have been in the state and election district for the
thirty (30) days immediately prior to the election should be permitted to register until October I.
Chief Clerk informed the Board of a notification of the West Alexander Fair to be hel
September 10, 1974 through September 14, 1974.
Chief Clerk then informed the Board of a request from the West Penn Power Com
to approve the service connection for power into the new barn recently constructed at the Fair
Grounds.
Moved by Mr. Jones, seconded by Mr. Paluso, approving the request for the service
connection into the new barn as per above.

Chief Clerk then requested authorization to transfer $300, 000. 00 from the 1974 Bond
Issue Account to Parks and Recreation Account in order to make payments aforelisted for M
Creek Park acquisition. Chief Clerk stated that the Bond Issue has $500, 000. 00 for such pur-
poses, of which $100, 000. 00 has been previously transferred.
Moved by Mr. Jones, seconded by Mr. Paluso, that the above request to transfer
$300, 000. 00 be approved.

New Business:
In regard to the resignation of Mr. Merico Lignelli as Chief Assessor effective
September 15, 1974, Chairman recommended that Mr. Richard Gubanish of R. D. #3, Avella,
Pennsylvania, be appointed. Mr. Gubanish would be hired September 9, 1974, in order to be
oriented and indoctrinated into the process of the office and would take over as Chief Assessor
as of September 16, 1974.
Moved by Mr. Jones, seconded by Mr. Paluso, that Richard Gubanish be appointed
as Chief Assessor replacing Merico Lignelli as per above.

Solicitor Bigi informed the Board that he had received a letter from Mr. Piganell
who received a letter from Mr. Clark of the Bureau of Employment Security with respect to the
CETA Contract of Washington County. On August 8, 1974, the Board executed the contract wi
the Pennsylvania State Employment Service; but after it reached Harrisburg, a few changes
were made. (The word "State" was changed to read "Bureau. ") This agreement provides
testing and counseling services, on-the-job training program, development and monitoring
services to the County.
Moved by Mr. Jones, seconded by Mr. Paluso, that the re -worded contract between
Washington County and the Bureau of Employment Security be approved and executed.

Assistant Solicitor Gilmore informed the Board that he had received Court approval
for the purchase of land from the American Brake Shoe Company, which is adjacent to the Ind
trial Park in Chartiers Township. Mr. Gilmore requested that the Board authorize the
of expenditures in the amount of $4, 650. 00 as approved by the Court for the purchase price of
the land.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve payment of
$4, 650. 00 to the American Brake Shoe Company for the purchase of land as per above; said
action based on the recommendation of Assistant Solicitor Gilmore.

Mr. Gilmore stated that the Juvenile Probation Office's grant for 1974-75 included a
provision for phychological training for the staff. The psychologist shall conduct 22 hours of
in -training services for a total of $766. 00. The psychologist shall receive the sum of $35. 00
per hour except that the last hour of training shall be at the rate of $31. 00 per hour; the entire
amount not to exceed $766. 00.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Board approve and execute
an agreement between the County of Washington and Charles Burbridge, Psychologist, as per
above; said action based on the recommendation of Assistant Solicitor Gilmore.

Remarks:
Mr. Gilmore stated that there has been some dispute over when the interest accrues on the
Washington Trust Building refund.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Tax Assessment Office be
authorized to prepare the foregoing tax refunds due to either duplication or overpayment of real
estate taxes with the exception of the interest on the Washington Trust Building refund.

Concerning the litigation of the nursing home (55% reimbursement compared to 10
reimbursement), Mr. Bigi stated that he has been in touch with Fayette and Allegheny Counties.
He also spoke with Harry Kramer, Administrator of the Allegheny County Law Department,
informed Mr. Bigi that a complaint has been drawn up but is pending until a meeting to be held
on September 9, 1974, which has been set up by Helene Wohlgemuth, Secretary of the Depart-
ment of Public Welfare. Mr. Bigi stated that hopefully, there may be some upcoming legisla-
tion to correct this situation. After the meeting, Allegheny County will contact Mr. Bigi and
tell him if they will go to Court or if the problem can be settled amicably. Mr. Paluso stated
that there isn't any room for compromise and that we shouldn't settle for any less than 100°10
reimbursement.
