PALUSO, COMMISSIONERS Minute No. 139 Office of the County Commissioners Washington, Pa., October 24, 1974 The Board of County Commissioners met in regular session with the following members being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Clerk & County Administrator Whalen; Solicitor Bigi; Assistant Solicitor Gilmore; Administrative Assir- tant Fetcko; Helen Miller of The League of Women Voters; Grant Liesch of The Brownsville Telegraph; Jack Merdian of WJPA; Dave Budinger of The Observer -Reporter; Earl Bugaile of WKEG; Jerry Kelanic of WWVA; Dave Baker of The Daily Notes; Scott Fergus; Mrs. Kipp of Robert C. Chairman asked if there were any corrections, additions or omissions to Minute No. 1& each member having received a copy. read. R-eports - None Old Business: Retroactive Pay for Female Jail Guards Chief Clerk stated that the effective date for the retroactive pay scale for the female jail guards was reviewed with representatives of S. E. I. U. , and they were able to answer the questions. They recommended that the 'retroactivity begin on July 1, 1973. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board go on record approving payment of the back salaries of the female jail guards as per above. Chief Clerk read a court order signed by the Honorable Judges Sweet, Hanna, and Gladden in regard to the Controller's Report, stating that the Controller at his request is granted an extension until Friday, November 1, 1974, at 2:00 p.m., for compliance with the Opinion and Order of August 28, 1974. Chief Clerk then read a telegram dated October 18, 1974, from Congressman Thomas E. Morgan, announcing that the office of Child Devblopment of HEW has awarded a $252, 960 grant to the Washington -Greene Community Action Agency, The Grant is effective for eight months beginning November 1, 1974, and will provide services for 215 chi.ldre n. Chief Clerk read a second telegram dated October 10, 1974, from Congressman Thomas E. Morgan, announcing that Bentleyville has qualified for enrollment in the Department of HUD's National Flood Insurance Program when it agreed to adopt land use and control measures that will minimize flood damage to future construction. Chief Clerk then read correspondence dated October 18, 1974, from the Observer Publishing Company notifying the Board that the Observer -Reporter will, publish its Progress Edition early in February, 1975. This reaches an audience of over 95,000 readers with special features on business, industry, and finance in Washington and Greene Counties. Chief Clerk read a letter dated October 21, 1974, from William Sember, Executive Director of the Washington County Planning Commission regarding new prsonnel in the Manpow-erOffice. Said letter was written for the purpose of obtaining the County Commissioners' approval for a position under the Manpower Planning Program. Mr. Sember 5' MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYI-VANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS stated that he has already spoken with Mr. Piganell and his office can accommodate this position if the Board grants approval. There will be no expenditures to the County. Mr. Sember recommended that Mrs. Carlana Edwards be appointed to the position of Research Assistant; at a salary of approximately $7, 500. 00; starting date to be October 28, 1974, with a probationary period of 60 - 90 days. Remarks: Chief Clerk stated that there will be a minimal cost to the County because the County is required to subsidize the fringe benefits, such as hospitalization and life insurance. Moved by Mr. Jones, seconded by Mr. Paluso, that the appointment of Mrs. Carlana Edwards as Research Assistant be approved at a salary of $7, 500.00 as per above. Chief Clerk then read a memorandum from William Sember, dated October 22, 1P74, regarding the Catsburg Project in Monongahela City. Mr. Sember stated that in a memo- randum dated October 15, 1974, he informed the Board that the Planning Commission had forwarded engineering maps to the Ebensburg Office of the DER to ascertain whether or not the parcel of ground (Fritch property and a parcel from Mon City) identified was adequate to accommodate, the pxopo-sed mine drainage treatment pond. Enclosed was correspondence from DER which verified. that the parcel of ground is adequate; therefore, it appears that proceedings can begin to acquire this piece of ground. Mr. Sember also stated that he would like to meet with the County's legal representative concerning a few specifics in this matter before discussions are held with Mr. Fritch and Mon City. Chief Clerk read correspondence from North Strabane Grange #1434, dated October 17, 1974, informing the Board that the Grange is raising the rent from $20.00 to $40.00, due to the increased rate of gas for heating and also increased rate of electricity. Chief Clerk then read a petition eigned by Alex Stetar, Committeeman, Gladys J. Cowden, Committeewoman, and Edward Dugas, Executive Chairman, petitioning the Washington County Election Board to change the location of Voting Precinct 2 Poll to the Storeroom of Quentin Filipponi, 430 South Main Street, Burgettstown, Pennsylvania, 15021, from the convent 'which is too small and inadequate in other ways. Chief Clerk then informed the Board of notification of a Fire Safety Program School being conducted by the Department of Public Welfare, which is an on -going educa- tion program for the benefit of the administrators. The program is being conducted at the Methodist Home in Pittsburgh, on October 31, 1974, and it is recommended that Mr. Showalter and Mrs. Burns of the Women's Home and Mr. Mastrangelo and Mrs. Proudfit of the Men's Home be permitted to attend. Chief Clerk then read a copy of correspondence in connection with the Cross Creek Watershed Program, dated October 21, 1974, from Clay Graham to Bell Telephone Company and West Penn Power Company. Said letter requested that the Companies pro - Geed with all necessary engineering and cost projections relative to the relocation of their facilities within Cross Creek Watershed Program, which includes Site 661, which is the County Park site, as well as the relocation of facilities at Sites 659, 660, and 662, as per the Soil Conservation Service, Land Rights Work Maps as previously supplied. Said tter also stated that Washington County, as the prime sponsor, will fund all relaea.tion sts of this project. Chief Clerk read a letter dated October 18, 1974, from the United States. District Court, which stated that it is again necessary for them to draw names of jurors. There- fore, they requested that the Commissioners supply them with a copy of the list of the registered voters in Washington County for the General Election of 1974. Chief Clerk then read a letter addressed to Mr. Flynn, from Benny Martin, State Conservationist of the United States Department of Agriculture, informing the Board that the Cross Creek Watershed Work Plan was approved by the House Public Works Committee on October 10, 1974. Letter also stated that as soon as Mr. Martin receives authorization for operation from the Administrator of the Soil Conservation Service, he will contact the Commissioners. Chairman stated that this meant there is an appropriatio of $1, 900, 000 for the Cross Creek Watershed Project. Chief Clerk then read a letter dated October 18, 1974, from the Commonwealth of Pennsylvania, Department of State, stating that as a service to the local Boards of Elections, the Bureau of Elections is sponsoring a series of five regional meetings -in an effort to deal more responsively with those problems specific to each region and thus perhaps facilitate a more orderly and organized election on November 5. Said letter invited the Board of Elections to attend the meeting to be held in our area, today, at 2:30 in New Stanton. Chief Clerk stated that it is doubtful that they could attend. Chief Clerk then informed the Board of notification dated October 17, 1974, from ns 17- Metro Petrosky, Jr., Director of Adult Welfare Services, informing the Board that the Office is acting as a support agency for the proposed Foster GranFlpare-nt Program to be MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA i MICHAEL R. Mr. Petrosky stated that the roll of his office will be to participate in the recruitment of Senior Citizens from Washington County to act as Foster Grandparents in the School and Hospital, being responsible for taking applications, initial interviews and screening, and participation in the final selection process. Mr. Petrosky stated that this program has been developed in conjunctiopwith Western State School and Hospital and the Foster Grandparent Program operating in Allegheny County. The committments of the Adult Welfare Office are limited to the listed areas above, and there is no financial, nor any other obligation, to this program. Chief Clerk informed the Board of a letter dated October 14, 1974, � from the Bentleyville Public Library, regarding the request made by Mr. Dean Gross on behalf of the public libraries, that the County aid be set at 25� per capita rather than a flat rate of $500 per library. Said letter supported Mr. Gross' request because of the rising library costs, and because it would equalize the aid given to each library. The letter alsc stated that they wish to apply for County aid in 1975, and they would like to be informed of the Board's decision so they may include this amount in their budget preparations for next year. Remarks: Chairman stated that we should acknowledge receipt of the letter, and stated that a decisiol will be made when we finalize the budget. Mr. Jones stated that we should make it known that"these budget hearings are open to the public, and requested that the press ask the public to attend these meetings. Mr. Jones requested that we advertise the public hearings. Chairman then stated that the same matter will appear later on the agenda. Chief Clerk then informed the Board of notification dated October 17, 1974, from Carl G. Baker/Architects, stating that they have prepared the construction drawings and specifications for the Life Safety Code Update at the Mirgo Creek Office Facility and are waiting authorization to proceed with the letting of contract documents for bidding purposes, (Discussion was held.) Chairman suggested that this be tabled. Chief Clerk then stated that the Board of the Marianna Public Library has passed a resolution thanking the Commissioners for the financial support received from them. Chief Clerk then read a letter dated October 10, 1974, from the Southwestern Pennsylvania Economic Development District requesting financial assistance to match funds provided by the State and Federal government for program operation. Said letter stated that in 1975, SPEDD will need Washington County's assistance in the amount of $1, 906. 00. Vernon, Inc., requesting clearance to use the aerial photographs made by Henderson Aerial Survey for Cole -Layer -Trumble Company, the contractor who prepared the 1971 tax map update project for Washington County.. (Discussion was held, with Mrs. Dawne Kipp, Associate of Robert C. Vernon, Inc.) Remarks: Mr. Paluso stated that these aerial photographs are available to the general public with the understanding that all costs will be borne by the user. Mr. Paluso also suggei3ted that the Chief Clerk be directed to authorize Henderson Surveys to allow Robert C. Verno In'.,to use the materials with the understanding that the cost be borne by them. Moved by Mr. Paluso, seconded by Mr. Jones, that Robert C. Vernon, Inc., be permitted to use the aerial photographs with the understanding that all costs will be borne by them. Chief Clerk informed the Board that a departmental meeting was scheduled for Election Day, November 5, 1974, and therefore, was re -scheduled for November 19, 1974, at 11:00 a. m. The speaker for this meeting will be Mr. Piganell of the Manpower Office. Chief Clerk read correspondence gated October�15, 1974, from the Department of Environmental Resources, which enclosed the original and six (6) copies of an Amended Agreement between the DER and the County of Washington transferring and encumbering $9, 794. 15 from Flood Control District No. 47 to Flood Control District No. 40. Moved by Mr. Jones, seconded by Mr. Paluso, that the Board execute the mended Agreement between the County of Washington and the Department of Environmental esources as per above. Chief Clerk then read a letter from John Fantini, Personnel Director, addressed to Mr. Flynn regarding the Classification Study. Said letter suggested that four (4) county representatives be a part of the Joint Labor Management Committee as stated in Article II of the Memorandum of Understanding between the County of Washington and Local 585, SEIU. Moved by Mr. Jones, seconded by Mr. Paluso, that the following be appointed to the Joint Labor Management Committee as per above: 1. John Fantini - Personnel Director 2. Charles A. Motion carried unanimously. Chief Clerk informed those present that the budget hearing schedule for the 1975 budget and the Washington County meeting schedule for 1975, are available. Chief Clerk also stated that these schedules have been posted and will be given to the news media and are available to any interested person upon request. R emarks : Chairman invited the general public to attend these meetings so that they can familiarize themselves with the budget. Chairman then read a copy of a letter dated October 21, 1974, addressed to Judge Sweet from the Chief Clerk relative to the problem of support payments of the Domestic Relations Office. Said letter again stated that the Domestic Relations Office is under the direct supervision of the courts, and requested that the Judge direct his staff and the staff of the involved office to accept the responsibility and cease advising the ssZ MINUTE BoOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. In regards to the unfair labor practice charge filed against Washington County Commissioners, Chairman read the following to- be part of official record: PENNSYLVANIA LABOR RELATIONS BOARD ) VS. ) Case No. PERA-C-5585-W WASHINGTON COUNTY COMMISSIONERS ) NOW COMES the Washington County Board of Commissioners, through their Labor Relations Consultant, John M. Felice Associates, Inc., and answers the Specification of Charges in the above captioned Complaint as follows: It is denied that the Washington County Board of Commissioners have refused to sign the collective bargaining agreement governing those employees encompassed in bargaining units captioned PERA-R-3607-W and PERA-R-3608-W. On the contrary, it is averred that, based upon recent appellate court decisions as well as cases currently pending before the Pennsylvania Labor Relations Board, the Board of Comm- issioners have serious doubt as to whether or not they alone have the sole authority to negotiate with the Union governing said employees and the sole authority to execute any collective bargaining agreement reached with said Union until such time as the threshold question of proper authority is resolved. Remarks: Chairman again stated that the State provides for 90% of the cost, Washington County 8%, and Greene County 2%. Chairman questioned why Washington County was singled out to be charged with unfair labor practices. Bicentennial Commission: Chairman stated that, as documented in Minute Nd. 138, dated October 17, 1974, a meeting was held at the time and place indicated. Chairman stated that he would like following made a matter of record. The Bicentennial of the United States is fast approaching. It is time to make plans both on the local and County basis. This is what we propose to do and to encourage and help our people become involved in this celebration. On July 12, 1968, Governor Shaffer signed into law S. B. #1523 which is now on e statute as Act 161, creating the Bicentennial Commission of Pennsylvania. This law sets out our responsibility in organizing and stimulating local Bicentennial activities and lines the criteria for sanctioning local Bicentennial projects. Lieutenant Governor, Ernest P. Kline, the Commission Chairman, announced doption of the guidelines which should encourage every County and community in the State o begin its Bicentennial planning so that we can have a well -coordinated statewide icentennial program that will offer some form of celebration to every citizen. The nnsylvania Commission will coordinate their efforts on a national scale with the Axneric evolution Bicentennial Administration (ARBA), Washington, D.C. Mr. George H. At the request of Mr. Ebner, the Washington County Commissioners on September 16, 1971-,- Minute No. 183, unanimously adopted the necessary resolution appointing Mrs. Charlotte K. Lane, the Executive Director of the Washington -Greene County Tourist Pro- motion Agency, as the liaison agent for Washington County to be responsible for Bicen- tennial planning within the County for the national celebration in 1976. On June 29, 1972, at the regular meeting of the Board of County Commissioners, the Board adopted the necessary resolution creating the Washington County Bicentennial Commission. It was the consensus of opinion of those assembled that the Chairman of the Board of County Commissioners should appoint on a pro-tem basis a Chairman, Vice -Chairman, Secretary, and Treasurer. It was the understanding of those assembled that it will be the responsibility of the Chairman pro-tem to organize this Bicentennial Commission. It is recommended that it is intended of this meeting that a society for the promotion of the Bicentennial in Washington County now be formed. Such a resolution is only a declaration of intention; its adoption does not bring the organization into being, which is accomplished by by-laws and signing of the membership roll by those who initially join the society. Solicitor Bigi then stated that he has received a letter from the Trinity School )istrict requesting that they be notified of any litigation in respect to tax appeals so that hey may participate in the proceeds. Solicitor Bigi then pointed out that in the past, the >arties involved have been notified of any major tax appeal case. He also stated that in 973, in regards to the Washington Mall Case, the Trinity School Board said that they did lot wish to participate in the hearing; they had confidence in the County to achieve the best lossible results. And the fault that they are finding with the Commissioners, want to know why they were not notified so that they could join us, but the fact remains that they did, not want to join with us and they did not go to court with us because it wouU cost them additional money for the attorney's fee. They did not have to join with us. Mr. Paluso stated that he thought it should be made clear that in any large tax dispute or appeal, the people concerned will automatically be notified of the time, place of hearing, and when it goes to court. Then it is up to them to protect their interests. Mr. Jones stated that he remembers sending out letters asking them to join with us, but no one replied. Chairman then instructed Solicitor Bigi to acknowledge receipt of the letter.
