Washington, Pa., December 5, 1974
The Board of County Commissioners met in regular session with the following mem-
bers being present: Commissioners Jones and Flynn. Absent being: Commissioner Paluso.
Also present being: Chief Clerk and County Administrator Whalen; Administrative Assistant
Fetcko; Solicitor Bigi; Assistant Solicitor Gilmore; Land Acquisition Agent Clay Graham;
Mr. Robert Umstead and Mr. Kyle Riggs of the Washington County Redevelopment Authority;
Mrs. Helen Miller of The League of Women Voters; Bob Robertson of The Observer -Reporter;
Dave Baker of The Daily Notes; and Earl Bugaile of WKEG Radio.
Meeting called to order by Chairman and roll call taken:
Mr. Jones - Present; Mr. Paluso - Absent; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions or omissions to Minute #143,
each member having received a copy.

Special Order of Business: Mr. Robert Umstead of the Washington County Redevelopment Auth,
R.E: Urban County Entitlement under the Federal Community
Development Act of 1974
Chairman stated that the records of previous meetings show that the Board has receivE
communications from the Department of Housing and Urban Development and that they set forth
certain guidelines that Washington County must follow to qualify under the federal Community
Development Act of 1974; also attached were specific dates that Washington County must submit
the necessary information to HUD of Washington County's intent. The records will indicate that
on November 22, 1974, a HUD official notified Washington County that they qualify as an urban
county with several provisos that have to be followed. Chairman stated that he understood that
Washington County will be entitled to approximately $700, 000 in fiscal year 1975, but the big
hurdle now is that Washington County must send a letter of intent and the necessary resolution
to HUD by December 9, 1974. Chairman stated that as a result, Mr. Umstead is here to make
a presentation to the Board so that they go on record officially; and in the event that any unfore-
seen bottleneck should happen that Washington County wouldn't qualify, the records will show
that they did make the attempt. Chairman further stated that over a period of three- (3) years,
at least $4 million could be available to Washington County; therefore, Washington County is
going to make an effort to qualify.

Mr. Umstead then stated that Washington County, having an excess of 200, 000 in popq-
lation, can qualify assuming that certain legal qualifications specified in the letter from the
Department of HUD are met. One of those provisions would obtain about $691, 000 in the first
year; and over a period of three years could obtain an entitlement of approximately $4. 1 milli
for housing and community development activities. Mr. Umstead stated that the first step is
for Washington County to submit their intentions to qualify as an urban county and for the Co
Solicitor to submit an opinion and certification that the County has the power to undertake hou
and community development activities. Mr. Umstead then read the resolution of Washington
County's intentions to qualify as an urban county and stated that with the resolution and certific
tion of the Solicitor, the Redevelopment Authority feels that Washington County can qualify
legally as an urban county.
Mr. Umstead informed the Board that the Redevelopment Authority has prepared a
letter of transmittal for the December 9, 1974, deadline. They have also prepared a letter and
composed a resolution to be adopted by the various municipalities in the County stating that th
will cooperate with Washington County to obtain its $4. 1 million entitlement. Mr. Umstead
stated that it is essential that all communities cooperate in this effort so that Washington Co
does not lose its $4. 1 million entitlement.
Chief Clerk then read the letter of intent to be sent to the Department of HUD's Area
Director and Assistant Secretary for Community Planning and Management.
Moved by Mr. Jones, seconded by Mr. Flynn, authorizing the Chairman of the
Washington County Commissioners to direct a letter of intent to the prescribed authorities as
per above.

Chairman then stated that the next step is to notify the 66 subdivisions of this County
of Washington County's intent because a second deadline of January 17, 1975, is imposed upon
those who do file a County notice of intent to qualify. Mr. Umstead then read the letter which
will be sent out to all the subdivisions as prepared by the Redevelopment Authority. Mr. Um -
stead also stated that the communities may have a tendency to wait until the last minute so he
requested that the date of January 17, 1975, be emphasized. Mr. Umstead further stated that
the communities that are already receiving hold harmless funds based on their prior participa-
tion will not jeopardize the funds that they are now receiving as hold harmless communities.

(Monongahela Fire Company)
Mr. Umstead then presented to the Board a Resolution approving the Proposal for Re-
development of Disposition Parcel No. 1 in the Monongahela Business District Urban Renewal
Project, Penna R.-355 by the Monongahela Fire Company and the form of the Redevelopment
Contract with said Developer. Mr. Umstead read said Resolution and went on to describe the
facility stating that the estimated cost of construction is approximately $340, 000. He also
stated that the groundbreaking is anticipated later this month with completion expected by mid-
summer of 1975.
Moved by Mr. Jones, seconded by Mr. Flynn, that the Board adopt the necessary
resolution as per above upon the recommendation of Solicitor Bigi.

Reports - Mr. Jones - RE: Storm Emergency
Mr. Jones reported that on December 2, 1974, a state of emergency was issued by
Lieutenant Ernest P. Kline because of the recent snowstorm. Mr. Jones stated that the Civil
Defense Office has been answering calls, have acquired generators for extreme emergencies,
helped people with their water supply and the only thing that they couldn't do was put up the
power lines for the West Penn Power Company.
(Controller Mascara entered the meeting. )
Mr. Jones stated that Dr. Gerstell, Head of the Civil Defense Office in Harrisburg,
called him and asked what he could do to help and also stated that he had just met with Lt. Gov.
Kline; and he asked for Mr. Jones' thoughts on what was the holdup in getting the power back or
Mr. Jones stated that he was not going to defend or harass anyone - that he was only going to
tell the facts. Mr. Jones stated that there were not any communications from West Penn as
far as the complaints were concerned. Mr. Jones felt it was asinine that if West Penn didn' t
have the manpower that they didn't go out of the area to acquire additional help. He advised
that the areas most affected by the storm were Washington, Fayette, and Westmoreland Counti(
Mr. Jones stated that the Civil Defense Office telephone number was broadcast on the radio so
that people could call if they needed help. He also stated that they put up shelters, and the Red
Cross provided food and blankets, etc. He further stated that the Civil Defense Office was pin-
pointing the trouble spots for West Penn with the help of the ham radio operators. Mr. Jones
stated that West Penn's problem is that they dan't schedule their personnel properly. He state(

Mr. Jones further stated that West Penn has been very derelict in their duties and

Chairman stated that Messrs. Jones and Charles Bohner of the Civil Defense Office

Regarding the abandonment of Hawkins Bridge, Solicitor Bigi stated that the Petition
r Abandonment is now in the Court and will be signed on Monday by Judge DiSalle.
Concerning the Somerset Township Bridge, Solicitor Bigi stated that it has been
uthorized by the Court. He has sent a copy of the Court Order to the Supervisors of Somerset
wnship and also a copy to PennDOT.
Concerning the Catsburg Project, Mr. Flynn stated that he personally talked with
. Tempest and told him that the Commissioners would like to have this contract executed.
. Tempest stated that the deed will be executed by Friday, December 6, 1974.
Solicitor Gilmore stated that no correspondence has been received from Smith Town-
p regarding the demolition, but he stated that he would write a follow-up letter.
Chief Clerk then reported that some time ago, Mrs. Julia Lobozzo met with the Boar
outlined her program that she felt she had established; and since then, Mr. Whalen has entered
o a considerable amount of correspondence with various state agencies in order to try to deter
ne just where Mrs. Lobozzo stood as far as any grant programs were concerned for her benefi .
Whalen then read part of a letter from the Department of Labor & Industry, Bureau of Voca-
nal Rehabilitation which stated that they were only vaguely aware of Mrs. Lobozzo and any
,olvement she may have in a Handicapped Opportunity Workshop in Washington County. Over
past years, the Office has had some correspondence with her; but most of it has been totally
coherent regarding what she intends to do or what she is doing for the mentally and physically
Lndicapped. Said letter said that Mrs. Lobozzo has apparently told the Commissioners that
ey have assisted her in an advisory manner which is not true. Said letter also explained in
tail what is necessary to establish such a program, and Chief Clerk recommended that the

Chief Clerk then informed the Board of correspondence dated November 18, 1974,
from the Office of the Governor concerning the Governor's Justice Commission which requeste
that the County Commissioners suggest names for appointments to the Regional Planning Counc
of the Governor's Justice Commission and asked that one elected official and one non -elected
citizen representative of a civic or professional group in the County be named. Chief Clerk
stated that the deadline for submission of names was December 5, 1974. Chairman stated that
he was going to get in touch with Mayor Stewart and ask him if he would permit Mr. Flynn to
recommend his name to the Regional Planning Council.
(Discussion was held.)
Chief Clerk read the first of two telegrams from Congressman Morgan which stated
that the Farmers Home Administration has approved m$82, 000 Rural Development Act Loan to
the Monongahela Fire Company, Inc. , to complete its community firehall.
Chief Clerk read a second telegram from Congressman Morgan which stated that the
Boroughs of Speers and East Washington have qualified for enrollment in the Department of
HUD's National Flood Insurance Program.
Chief Clerk informed the Board of an inquiry from the Bucks County Planning Commi*-
sion relative to Background Information for Noise Control Ordinance. Chief Clerk suggested
that this letter be referred to Mr. Sember of the Washington County Planning Commission for
reply.
Chief Clerk informed the Board of notification dated November 26, 1974, from
Michael George, Director of Parks and Recreation, which stated that the Outdoor Recreation
Acquisition Contract has been extended one year from December 31, 1974 to December 31, 197
Chief Clerk stated that Washington County will be 'eligible under this extension for funds under
the Bureau of Outdoor Recreation Program.
Chief Clerk then informed the Board of an emergency problem at the Men's Home
which .required that one fire plug be raised because it was too close to the ground. Chief Clerk
stated that the estimated ;cost of this project is $653. 00 and recommended that the Board app
the project to be done immediately.

raised immediately at an estimated cost of $653. 00 as per above.

Chief Clerk read communication dated November 26, 1974, from the Western Pennsyl-
vania Firemen's Training Institute, California, Pa., asking the Commissioners for an appro-
priation of $1, 000 for the school which will be held August 18 through August 22, 1975. Chair-
man stated for the record that he and Commissioner Jones met with representatives of the
Washington County Volunteer Firemen's Association at a yearly meeting prior to the adoption
of the County's budget. At the meeting, the Washington County Volunteer Firemen's Associa-
tion presented a proposal for the following fiscal year and stated that the amount of money a
priated last year was approximately $9, 000. The same amount was appropriated this year.
Chairman then gave a breakdown of how the money was used.
(Discussion was held. )
Chairman stated that Mr. Crouse had contacted Fayette, Greene, Westmoreland and Allegheny
Counties to see how much money they appropriated. Chairman stated that Fayette County had
appropriated $1, 000 and the others nothing. Chairman recommended that the Board accept the
recommendations of the local people and notify the Western Pennsylvania Firemen's Training
Institute that the County will give them $200-$250 or whatever is available.
(Further discussion was held. )

made by the Washington County Volunteer Firemen's Association as per above.

Chief Clerk then informed the Board of correspondence dated November 27, 1974,
from Penn's Southwest Association which enclosed a resolution that was recently passed by the
State House of R-epresentatives in which they went on record recommending to the United Mine
Workers that their new headquarters be established somewhere in southwestern Pennsylvania.
Also attached with the letter was a copy of a letter from United Mine Workers President A
Miller directed to Congressman Morgan thanking the Pennsylvania Congressional Delegation fo
the invitation to locate the UMW's headquarters in Pennsylvania. Mr. Miller assured Congres4-
man Morgan that they will continue to consider Pennsylvania for the new headquarters of the
UMW.
Chief Clerk stated for the record that the Board has received the Certificates of Occu-
pancy from the Department of Labor & Industry for the new facility comfort stations and shelte4s
which have been erected at Mingo Creek Park.
Chairman stated that these certificates will be posted at the Park.
Chief Clerk informed the Board of a request from the Registration/Election Office
for a leave of absence of 30 days from Linda Magera due to illness.

Chief Clerk then read a memorandum to all department heads and elected
officals reminding them that the deadline for submission of bills for payment are as follows:

Chief Clerk then read a memorandum dated December 2, 1974, from
William P. Sember, Executive Director of the Washington County Planning Commission,
regarding the Six Year Highway Program. Said letter stated that the six -year regional progra
of $360, 211, 000 that was adopted and approved must now be cut to $267, 353, 000. Accordingly,
Washington County's six -year program of $48, 000, 000 must be reduced to $33, 700, 000 which
is based on PennDot's fair share allocation. Also enclosed with the memorandum was a list
of projects which fall within the fiscally restrained allocations, which was prepared by
Mr. Sember. Mr. Sember stated that the revised program should be submitted on December
1975 for final vote on December 9, 1974.
Remarks:
Chief Clerk noted that the B02 and the B20 MonValley Expressways are first on the list of
priorities.

list of priorities submitted by Mr. Sember as per above.

Chief Clerk then read a memorandum dated November 25/, 1974 from the
Allegheny County's Special Labor Counsel, Henry Ewalt. Said memorandum enclosed a copy
of a memo regarding the Fair Labor Standards Act.
Chief Clerk informed the Board of correspondence from the Pennsylvania
State Association of County Commissioners in which the Pennsylvania Department of
Community Affairs and the Pennsylvania State Association of County Commissioners announce
their joint sponsorship of a state/county funded County Management Program. This demon-
stration project will place 15 qualified individuals in Pennsylvania counties for I! years.
Enclosed with the letter was a pre -application form for those counties interested in the
program.
Remarks:
Chairman suggested that this be tabled to be taken under advisement.

Chief Clerk stated that the operating budget for the County was posted as advertised on
cember 3, 1974. Chief Clerk also stated that in connection with this, certification has been
ceived from the Board for the Assessment of Appeals in which they list the original charge as
ertified by CLT in the amount of $259, 972, 840. 00.

Chief Clerk stated that to meet the current obligations under the Chartiers Flood Con -
Project, a transfer in the amount of $100, 000 is needed from the 1974 Bond Issue Account
the Capital Reserve Account. Also, to meet current obligations, $25, 000 is requested to be
ferred from the 1974 Bond Issue Account to the Commonwealth Conservation Account.

quest of the Chief Clerk.

chase and purchase price of property owned by the Greater Charleroi Industrial Develop-
ment Corporation which contains 43.742 acres adjacent to the Speers Industrial Park, for
the amount of $125-, 000. 00. Mr. Bigi -stated that this land will be included in the County
land bank program, and recommended that the petition be approved.
Moved by Mr. Jones, seconded by Mr. Flynn, that the above ' petition for court
approval for purchase and purchase price of -.property as per abovt' be executed upon the
recommendation of Solicitor Bigi.

Solicitor Bigi then presented to the Board two (2) CETA contracts with Visson
Motor, Inc., of Belle Vernon, and GG & C Bus Co., Inc., of Washington, Pa. Solicitor
Bigi stated that he has reviewed these contracts which were the same type as executed
previously, and recommended that they be executed.
Moved by Mr. Jones, seconded by Mr. Flynn, that the Board approve the CETA
contracts with Visson Motors, Inc., and GG & C Bus Co., Inc., as per above recom-
mendation of Solicitor Bigi.

Remarks:
Chief Clerk stated that these contracts were for on the job training under the Manpower
Program.

Solicitor Bigi then presented to the Board several agreements to be signed by
Board of County Commissioners concerning Volunteers In Probation. Solicitor Bigi stated
he has prepared these contracts and they have been signed by the various parties
involved. Solicitor Bigi stated that all that was needed now was the signatures of the
Commissioners, and recommended that these contracts be executed.
Moved by Mr. Jones, seconded by Mr. Flynn, that the contracts with the Board
of County Commissioners and Volunteers In Probation be approved as per above recom-
mendation of Solicitor Bigi.

Motion carried unanimously.
Mr. Jones then made reference to a letter he had written, dated December 6, 197#1
in regard to the Ferry Commission. Mr. Jones stated that the is trying to get a meeting
set up with the Fayette County Commissioners and the Ferry Commission. Mr. Jones
stated that Mr. Fetcko has set up a tentative date for the meeting on December 16 or 17.
Chairman then stated that as advertised in the media for the invitation to bid
on the Extended Care Facility, the article included the fact that a pre -bid conference woul
be held on December 4, 1974, at 2:00 p.m., and stated for the record that we did comply
with the advertisement obligations and met with the people involved.
Chairman also stated for the record that we do have a full text of the proclama-
tion issued by the Acting Governor, Lt. Governor Kline, proclaiming a state of extreme
emergency in the counties, which gives the counties extraordinary powers when it comes
