PALUSO, COMMISSIONERS Minute No. 146 Office of the County Commissioners Washington, Pa., December 19, 1974 The Board of County Commissioners met in regular session with the following mem- bers being present: Commissioners Jones, Paluso and Flynn. Also present being: Chief Cler and County Administrator Whalen; Administrative Assistants Crouse and Fetcko; Controller Mascara; Deputy Controller Daniels; Jay Walker of South Strabane No. 1 Fire Department; Paul Brookman of the Washington Volunteer Fire Department; Robert Giacometti of the South Strabane No. 2 Volunteer Fire Department; Michael Altieri of the Chartiers Volunteer Fire De partment; Joseph Scarci and George Galbraith of the Canonsburg Volunteer Fire Department; Mrs. Helen Miller of The League of Women Voters; Bob Robertson of The Observer -Reporter; Charles Wilson, photographer from The Observer -Reporter; Lindy Stalder of The Daily Notes; and Earl Bugaile of WKEG Radio. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions or omissions to Minute No. 145, each member having received a copy. as read. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 145 be approved, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Special Order of 'husiness: Presentation of Certificates to Fire Departments Chairman introduced those firemen present at the meeting and stated that in view of the fact that these gentlemen and their fire companies and all the other firemen provide a valu- able service to the County of Washington, the Board is very appreciative of their efforts and therefore have prepared certificates of appreciation. (Mr. Crouse then presented the certifi- cates and pictures were taken by photographers of the Daily Notes and Observer -Reporter. ) (Treasurer Morgan entered the meeting. ) Reports: Mr. Jones - RE: Ferry Commission Chairman noted that as Mr. Jones reported at the last meeting, arrangements were made with the Fayette County Commissioners, Washington County Commissioners and the Ferx Commission to have a meeting on Tuesday, December 17, 1974, to discuss the status of the Commission. Chairman then stated that Mr. Jones was -the only one present representing Washington County and requested that Mr. Jones give his report on the meeting. (Bracken Burns entered the meeting. ) MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Mr. Jones stated that the purpose of the meeting was to decide whether or not we would be legally allowed by law to exist as a ferry commission - whether we can expend monies legally for a commission as such. Mr. Jones stated that Solicitor Bigi and Mr. Cohen, representing Fayette County, were also present and are going to explore the matter of whether or not we can legally expend monies on the ferry commission as such. He said that Mr. Bigi will report further on this since it is a legal matter and that this was held in abeyance until a decision fror Mr. Bigi and Mr. Cohen is reported. Mr. Jones then stated that the next matter which was brought up at the meeting was a few appointments to be made to the Ferry Commission because two members' terms have ex- pired, and one member has resigned. Mr. Jones stated that he told them that the appointments will be fulfilled by the same people. Chairman then read the following for the record from Ordinance No. 73-1 which the County of Washington signed and enacted on April 12, 1973: SECTION 2. The commission shall consist of seven (7) members, and each county shall appoint three (3) members initially for one (1), two (2), and three (3) year terms respectively. There- after, all terms shall be for three (3) years. The seventh member of the commission shall initially be appointed by the Washington County Board of Commissioners for a one (1) year term; and the Fayette County Board of Commissioners shall appoint the seventh member for the next one year term. Thereafter, the Washington and Fayette County Boards of Commissioners shall alternate the appointment of the seventh member, in each case for a one (1) year term. SECTION 3. The following persons are hereby appointed as Washington County's commission members: a. Russell Stein, 201 Skyline Drive, California, Pa., for an initial term of three (3) years. b. Robert L. Simpson, 1000 Furlong Avenue, Roscoe, Pa. , for an initial term of two (2) years. c. John S. Werlwas, Stroal Acres, Roscoe, Pa., for an initial term of one (1) year. d. A. Dewey Pellegrine of Fredericktown, Pa., for an initial term of one (1) year. Chairman then stated that Mr. Stein's 3-year term will expire in 1976; Mr. Simpson's 2-year term will expire in 1975; Mr. Werlwas' one-year term expired as of April 1974 as did Mr. Pellegrine Is term. Chairman advised that each member of the Board of Commissioners has a right to make an appointment to the Commission. Mr. Flynn then recommended that Mr. A. Dewey Pellegrine of Fredericktown, Pa., be appointed for a three-year term, effective as of April 1974. Mr. Jones recommended that Mr. John S. Werlwas of Stroal Acres, Roscoe, Pa., be appointed for a three-year term. Mr. Paluso recommended that Mr. Keith Haney of P. O. B x 132 Charleroi, Pa -be appointed for a three-year term. Moved by Mr. Jones, seconded by Mr. Paluso, appointing the above recommended persons to the Ferry Commission. MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Mr. Jones then stated that Mr. Simpson made a report to the Ferry Commission in P P Y ;hat he has been dealing with people in the Fredericktown area on the buying of the property to the ferry in operation. Mr. Jones stated that the first point brought up was if it was legal to pend money and put it into the Ferry Commission. Mr. Jones stated that if we cannot purchase is ferry legally, through the Ferry Commission, that it will be put into the contract with the eople of Fredericktown. Mr. Jones stated that he instructed Mr. Simpson to hold this in eyance. Mr. Jones also stated that he has worked with Bill Sember of the Planning Commis - ion and that he presented to the Fayette County Commissioners an application for a grant for t ederal and state government for each county. (Mr. Jones presented the application to Fred bder, Chairman of the Fayette County Commissioners.) Mr. Jones noted that the Fayette ounty Commissioners are going to pass it at their meeting. He further stated that he thinks ch county is going to submit an application for approximately $75, 000. Chairman then read the following memorandum dated December 16, 1974, directed o Mr. Flynn from William P. Sember: SUBJECT: Restoration of Ferry Service - Monongahela River Enclosed you will find the documentation necessary to submit a joint grant application on behalf of Washington and Fayette Counties to the Bureau of Mass Transit Systems, Pennsylvania Department of Trans- portation, in the amount of $75, 000. 00 for the beginning of restoration of ferry service across the Monongahela River. As the application indicates, the approximate capital cost of imple- menting ferry service at the three locations, Fredericktown-East Fredericktown, Newell -Coal Center and Allenport-Fayette City is approximately $300, 000. 00. Total annual operating deficits, once the complete system is in operation, is expected to be around $58, 000. 00. Hopefully two-thirds (2/3) of this cost deficit will be subsidized by the Commonwealth. Under normal procedures the grant application would be for 50% of the total capital cost ($150, 000. 00); however, the $75, 000. 00 was appropriated by the State Legislature in the 1969-1971 Commonwealth Capital Budget years and should be available in a relatively short time. An application in the amount of $150, 000. 00 would have to be placed on another State Capital Budget and over a years time could easily be lost. To compensate for this situation, the application to PennDOT states that the restoration of ferry service will be implemented in stages with the understanding that Fayette and Washington Counties will submit either a new or amended application for additional funds. You are also aware, I'm certain, that State legislation (HB 2557) is now pending which would allow liquid fuels rebates to be utilized for the construction, operation and maintenance of ferry boat operations. This bill, if passed, will of course benefit both Counties in carrying out this project. If you need additional information, I will be happy to comply with your requests. PALUSO, COMMISSIONERS Chairman then stated that Mr. Jones submitted to Fayette County a duplicate copy of the grant application for the amount of $75, 000. Chairman stated that Fayette County has told Mr. Jones that they intend to take action on this at their meeting, and we have indicated that we would take action at our regular meeting today. Chairman stated that what this does, in effect, is authorize the Chairman of the Board to sign this supporting application and adopt the necessary following resolution: RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A STATE GRANT AS AUTHORIZED BY THE URBAN MASS TRANSPORATION ASSISTANCE LAW At a meeting of Washington County Board of Commissioners held on 19th day of Dcember 1974, the following resolution as duly adopted: "RESOLVED, that the Chairman, Board of Washington County Commissioners, is hereby authorized and directed to execute and file with the Department of Transportation of the Commonwealth of Pennsylvania, on behalf of this body, an application, on MT-223-A, Application For An Urban Mass Transporation A ssi.stance Grant, requesting State assistance in the amount of $75, 000. 00, for the purpose set forth in the said application. " I hereby certify that the foregoing is a true and correct copy of the resolution adopted at the meeting held on the day and year above indicated. Is / F. D. Old Business: Chief Clerk then read a letter he directed to Mrs. Julia Lobozzo, dated December 17, 1974, regarding her endeavors with respect to handicapped persons. Enclosed with the letter was a letter from the Commonwealth of Pennsylvania, Department of Labor & Industry, Bureau of Vocational Rehabilitation which fully outlined the County's position and programs in this field. Chief Clerk then stated that the Board went on record previously endorsing the ,I position of County Coroner Farrell Jackson with respect to his report on the Western State School and Hospital. As a result of this action by the Board, Chairman Flynn went on record with Governor Shapp fully endorsing the position of Coroner Jackson. Chief Clerk then informed the Board of a letter from the U. S. Secretary of Transportation addressed to Mr. Flynn regarding their national carpooling campaign. The campaign was designed to encourage individuals, communities and private employers to initiate or substantially expand carpool programs at the local and regional level. Chief Clerk then informed the Board of a report from the U. S. Department of Agriculture, Agricultural Stabilization and Conservation Service. This report is a result of the December 1st snow storm and is necessary for application for any assistance. Chief Clerk stated the estimated cost damage listed is Poultry - 1200 known lost, at an estirrrated cost of $10, 000. Chief Clerk stated that Mr. Jones had additonal information in regard to this report. Mr. Jones stated that they- called him from the Department of Agriculture and asked him to make a preliminary survey of the estimated damages as far as the farmers were concerned. Mr. Jones then read a letter dated December 17, 1974 directed to Mr. Bohner of the Civil Defense office, from the Cooperative Extension Service, which listed the loss that could be determined. Mr. Jones stated that he requested this survey during the crisis that we had. Mr. Jones then stated that he had just talked to Mrs. Draper from the Civil Defense MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS office and she is sending the estimates in along with a cover letter to the Department of Agriculture. Mr. Jones stated that he has requested a team from the Department of Agriculture be sent in to determine an estimate of damages. Mr. Jones also stated that because of lack of generators, pumps, etc. , he talked with Congressman Morgan about the limited funds. Mr. Jones stated that Mr. Morgan assured him that these generators and pump will be available. Chief Clerk then read the following copy of a letter dated December 11, 1974, from William Sember directed to Dr. Larsen, Chairman of the PennDot Transporation Advisory Committee: Dear Dr. Larsen: It is my understanding that testimony was presented at your committee meeting on December 5, 1974 by certain individuals, requesting that highway allocation funds be distributed to regional planning agencies, where they exist, instead of individual county allocations. If this assumption is correct, I believe it to be very poor protocol to have your committee make any recommendation concerning how highway allocation funds would be distributed bef ore you learn the opinions of the affected counties. Quite frankly, I can see little support for distributing highway funds at a regional level in this area, from the individual counties that comprise the Southwestern Pennsylvania Regional Planning Commission. The Program Management Committee to SPRPC, which is comprised of the Planning Directors of the six (6) counties, has shown its ability during the previous year to work in relative harmony in formulating a Transportation Plan for this region. There has been a great deal of cooperation between the counties using the present system, and I would anticipate utter chaos if a lump sum was ear- marked for the region instead of individual county allocation. I do not believe a regional allocation would add any more flexibility to highway planning and programming than now exists. On the contrary, I can envision six (6) individual units of government vying for a lump sum of construction dollars. The current system of county allocations provides a good basis and framework on which to cooperate -at the regional level; not only in highways, but in other areas as well. If I am correct in the assumption that your committee is considering any recommendation of this type, I would strongly urge you to recommend that the highway allocations to individual counties remain unchanged. At the very least, I would recommend that you obtain the comments of all counties that are located in, and are a part of, regional planning agencies. I would appreciate your distributing copies of this correspondence to other members of -your committee. Your cooperation is appreciated. / s / William P. Sember, Executive Director Mr. Jones then gave a list of the priorities for the federal highway budget. Chairman recommended that the Board go on record supporting Mr. Sember's position and instructed the Chief Clerk to notify Mr. Sember that the Board substantiates his position and are certainly in accord. Chief Clerk informed the Board of a letter from the News Election Service in New York, which included a check for the amount of $237. 50 payable to the Washington County Home for Aged Women, for election reports. Chief Clerk stated that it was agreed that this money will be put into the patients welfare account at the Women's Home. MINUTE BOOK 635 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Chief Clerk then read a letter dated December 12, 1974, from Mayor Wilson of the City of Monongahela regarding Washington County Community Development Funding. Said letter enclosed an executed copy of Resolution 19 of 1974, which was unanimously passed at their regular meeting on December 11, 1974. Letter also stated that the City is pleased with the Washington County Commissioners's distribution formula on population, assuring the City of Monongahela of additional Community Development Funds of $140, 454. 00 over the next three (3) years. Chief Clerk then read a letter from the Washington County Volunteers In Probation, Inc. , which stated that they are pleased that the Commissioners responded positively to their 1974 budget request. Chief Clerk then read a letter dated December 16, 1974, addressed to Area School District, Chief Assessor Richard Mr. Flynn from the Trinity commending Gubanish. Said letter stated that property which should have been on the books years ago has now been entered on the tax books and the appropriate taxes have been levied. The letter also stated that this amounts to nearly one million dollars in assessed value in the Trinity Area School District alone. Chairman suggested that a copy of this letter be sent to Mr. Gubanish. Chief Clerk then read a letter dated December 13, 1974, from the Monessen Public Library requesting a $1, 000 allocation to their library. Chairman stated that he had consulted Mr. Crouse regarding this library, which is classified under the State Library Code as a regional library. Moved by Mr. Paluso, seconded by Mr. Flynn, that the above request for $1, 000 be approved for the Monessen Public Library. Remarks: Mr. Jones stated that he objected last year because it is classified as a regional library and not a county library, and is objecting this year for the same reason. Chief Clerk informed the Board of an application for Highway Safety Project Grant Funds for the purchase of Emergency Medical Service technician training equipment. This is the first in Pennsylvania and is for the purchase of the essential •equipment and training supplies to be used by the Emergency Medical Technicians in their training course The total amount of the grant is $9, 690.75, of which the federal contribution is $6, 684. 00 and the County's matching contribution is $2, 906.00. Chief Clerk then read a memorandum dated December 16, 1974, from William P. Sember addressed to Mr. Jones concerning the Rodent Control Program. Said letter state that Washington County's application for a rodent control grant from the Pennsylvania Department of Environmental Resources, Bureau of Community Environmental Control, has been denied because of lack of funds for new programs. The letter also stated that if certain municipalities are in dire need of some rat control measure, the State may be able to furnish bait for some sort,, of temporary program. Miss Passarella's resignation is effective November 22, 1974, and she stated that con- cerning any audit, it was her understanding that the account has been audited as of the of the resignation of George Kubocvik, which was September 27, 1974. Chairman stated that on October 21, 1974, the following letter was presented to the County Controller which is to be made part of the record: "Please be advised that as of September 27, 1974, the date of the resignation of George Kubocvik, I have not been and will not in the future be responsible for the bookkeeping in the Adult Probation Office in the Domestic Relations Office." Chairman then informed the Board of the resignation of Mrs. Margaret awhinney of the Domestic Relations Office effective December 27, 1974, in which she stated that she cannot continue to work in the Domestic Relations Office because of the unsatisfactory working conditions and the low salary. Chairman then referred to the S. E. I. U. Contract and requested that this matter be held in abeyance. Chairman stated that this matter may be brought up at the Salary Board meeting.
