PALUSO, COMMISSIONERS 1 Minute No. 12 Office of the County Commissioners Washington, Pa., March 16, 1972 The Board of County Commissioners met in regular session with the following members being present: Commissioners. Jones, Paluso, and Flynn. Also present being: Chief Clerk Murphy; County Solicitor Capano; Assistant County Solicitor Hormell; Administrative Assistant Whalen; Reporter Robertson of The Observer -Reporter; Reporter Roule of the Monongahela Publishing Company; Reporter Liesch of The Brownsville Telegraph; and Public .Informa.tion Officer Huber. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 11, each Commissioner having received a copy. Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 11 be approved, as read. Roll call vote taken: Mr, Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Reports - None Old Business - Mr. Flynn (Gilly Trial - Jury Foreman Report) Mr. Flynn: I want the records to show that Monday morning of this week, Mr. Ted Breuer, a gentleman who served as the foreman of the jury of this last murder trial, came into my office and told me that he was not there speaking as an individual; but that he was the as the former foreman of the jury. He was also there at the instructions of a representative of Judge Sweet's office; and that it was recommended that he come before the Chairman of the Board of Commissioners and relate the complaints filed with him about the poor service and quality of food rendered while they sequestered at the George Washington Hotel. After lis- tening to the gentleman, I let it be known that I appreciated his coming before the Commiss- ioners and letting this be known to us. However, I would like the gentleman to know that wheni the time comes for the Judicial branch of government to sequester any jury, they do not con- sult this Board of Commissioners to make arrangements for room and lodging. It would see to me that if we are to enter into the picture now after the jury has been discharged, and be asked to be responsible for, this type of, service and quality of food, then certainly we should b� consulted prior to sequestion. I would like for the records to show that in the future if they want the Commissioners to be held responsible for any failings insofar as the jurors who are MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. Then if we make the arrangements we will accept the responsibilities. Mr. Flynn read a, prepared statement in regards to a news conference called by Minority Commissioner Paluso following the Regular Board Meeting of the Washington County Commissioners on March 9, 1972. (Copy of said statement may be found on page 2-A) Remarks: Mr. Paluso: What is that supposed to mean? Are you insinuating that those were not my remarks ? Mr. Flynn: I'm not insinuating anything. I'm just telling what my thinking is. Mr. Paluso: Then I take exception to your remarks. I don't think they are called for at all. If we are going to take politics out of this Board, then let's everyone appoint one person to it so that politics are removed from this Board rather than you or someone else appointing everyone. That interjects politics into the Tax Appeal Board in my opinion. Mr. Flynn: Not necessarily. 2A In re: News Conference called by Minority Commissioner Paluso following the Regular Board Meeting of the Washington County Commissioners on March 9, 1972. As a result of your Conference, an article was published in the news media wherein you as a Minority Commissioner was quoted a,s saying that the Majority Commission- ers were afraid to go downstairs and face the public - that is why we appointed an Assessment Appeal Board, As Chairman of this Board of Commissioners, I want the record to show that it is my humble opinion you as a member of this august body have far exceeded the rights and authority that was vested in you upon taking your oath of office. We are supposed to be honorable men and as such it is expected that we show respect for one another and conduct and express ourselves in a manner that is befitting the position and the people we represent. The Chairman recongnizes your right to dissent, to express your opinion, and to file minority reports; however, you have no right to make irresponsible statements assassinating the character of your colleagues for the sake of cheap publicity. The Board of Assessment Appeals was created prior to my arrival on the scene and the intent and reas for this creation was to separate and prevent political influence being a contributing factor in the Property Assessment and Appeal Program. During my tenure in office and to the best of my knowledge this policy has been adhered to and will continue to be. PALUSO, COMMISSIONERS In conclusion, I would suggest that prior to your next News Conference that you take time to censor the material authored by your'khost writers" or perhaps better still - why not try to be original. MICHAEL R. FLYNN Mr, Whalen informed the Board and those present that Washington County is to appear before the Industrial Board in Harrisburg on Wednesday, March 22, 1972, to commit the County as to their present as well as future intentions as well as future intentions as far as the operation and maintenance of the new extended care facilities are concerned. (Mr, Jack Merdian - WJPA - entered the meeting). Mr. Flynn and Mr. Jones discussed the above matter and stated that they also discussed this subject with Congressman Morgan. Mr, Flynn stated that a. meeting was held on Wed- nesday, March 15, 1972, at 9:00 a.m. at the Washington Hospital with Mr. Robert Cook, President of the Hospital, Eugene L. Strosser, Executive Vice -President of the Hospital, Keery McAmbley, and John W. Clem, who is the Assistant Director of the Western Pennsylv ania Comprehensive Health and Planning Agency, Inc. They discussed the possible purchase of Canonsburg General Hospital, South Hills Convalescent Home, Charleroi-Monessen Hos- pital, or the Monongahela Memorial Hospital. Casey, Office of the Auditor General, which advised that a representative of the said Department will appear in the Commissioners Office on March 15, 1972, to audit the Liquid Fuels Tax Fund Account. Mr. Murphy: I want you to know that they met their deadline. They were here yesterday anc are presently auditing our books. Chief Clerk read correspondence under date of March 9, 1972, from the Governor's Justice Commission which was a reply to a letter of March 3, 1972, requesting preincurred costs on Subgrant Application SW-109-71A which will be an application for con- tinuation of the Washington County Jail, Subgrant SW-041-70A. Chief Clerk read correspondence under date of March 10, 1972, from the City of Monongahela, Pennsylvania, which a,tta,ched .a copy of their Ordinance No. 5 of 1972 which was passed by unanimous vote of Council, at the regular meeting held on Wednesday, March 8, 1972. (Copy of said Ordinance can be found on page 5-A) Chief Clerk read correspondence under date of March 13, 1972, from A. Dewey Pelligrine, which thanked the Commissioners for their efforts resulting in his appointment to the Washington -Fayette County. Ferry Commission. 5-A RESOLUTION 5 of 1972 MAGISTRATES SITTING IN THE WASHINGTON COURT HOUSE FOR CERTAIN FELONIES WHEREAS, the Council of the City of Monongahela, Washington County, Pennsylvania sat in regular session on Wednesday, March 8th, 1972 and, WHEREAS, said Council discussed, with deep concern the procedure for Magistrates holding sessions in the Washington County Court House to hear certain felonies. NOW THEREFORE BE IT RESOLVED, that the City Clerk of the City of Monongahela notify the Washington County Courts, that the Council for said City express their concern over the procedure providing for Magistrates sitting in Washington for certain Felonies. It is Council's feelings that the procedure is costly for the Municipality, will not provide better service, defeats the purpose of having local Magistrates, defeats the purpose of the Constitution providing for Local Magistrates and jeopardizes the efficiency of the Police Department while Police are in Washington testifying before a, Magistrate, BE IT FURTHER RESOLVED, that copies of this Resolution be sent to the Washington County District Attorney, Washington County Commissioners, President of the Washington County Association of Magistrates and Clyde G. Mr. Whalen - Donora Redevelopment Project Mr. Whalen stated that in connection with the Donora Redevelopment Proj a report has been received that due to problems involved in the relocation in that project that the project has been increased, by $147, 000. 00, making the value of the total project $2, 103, 000. 00 (Conference) Moved by Mr. Jones, seconded by Mr. Flynn, approving Mr. Whalen and Mr. Jones to attend the 1972 Spring Legislative Conference presented by the Health Care Facilities Association of Pennsylvania to be held on March 20 and 21, 1972, at the Sheraton Harrisburg Inn, Harrisburg, Pennsylvania. Administrative Assistant Whalen read correspondence under date of March 10, 1972, from Alfred Lamo stating that he is submitting his resignation as a membe: of the Citizens Participation Sub -Committee of the Washington County Planning Commission. Mr. Lamo recommended the appointment of Mr. Robert Abba,dini, R.D. !, Box 22, Fredericktown, to replace him and requested the Board's consideration of same. Moved by Mr. Jones, seconded by Mr. Paluso, approving the appointment of Mr. Robert Abbadini of Fredericktown to replace Mr. Alfred Lamo of Clarksville as a member of the Citizens Participation Sub -Committee of the Washington County Planning Commission. New Business: Mr. Flynn Mr. Flynn: Right at the present time there is being formed what is known as the South- western Pennsylvania Resource Conservation and Development District. It is necessary that we go on record authorizing Washington County to participate in this District and to appoint one member of this Board to represent us. In Washington County representing the Soil Conser- vation District is Mr. Lee Adamson. Moved by Mr. Jones, seconded by Mr. Flynn, authorizing Washington County to participate in the Southwestern Pennsylvania Resource Conservation and Development District. Motion carried unanimously. , Solicitor: (Nottingham Township) Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Solicitor for the Department of Parks and Recreation to draft the necessary contract in order to modify the former Agreement between the County of Washington and the Township of Nottingham whereby the Commissioners would continue as of April of this year to pay the $1, 100.00 as in the exist- ing Agreement; however, beginning as of October of this year, the Commissioners would appro priate to them the sum of $2, 500. 00; and beginning next year (1973), for a three-year period, the Commissioners would grant them a sum of $5, 000. 00, payable in two installments of $2, 500.00 each. PALUSO, COMMISSIONERS Solicitor Capano read correspondence under date of February 29, 1972, from the Citizens Water Company of Washington, Pennsylvania, which enclosed, in triplicate, the Final Memorandum which was to be executed in connection with the Special Extension Deposit Agree ment dated September 11, 1969, between said Company and the County of Washington covering the installation of a water line to serve the Juvenile Home. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Chairman of the -Board to execute said Agreement as per above. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso •- Yes; Mr. Flynn - Yes. Solicitor Capano read correspondence under date of March 13, 1972, from West Penn Power Company in regards to an electric service agreement to provide reduced capacity at the Court House. Correspondence stated that information that said company has from the County's consultants indicates that the present 240-volt, three-phase service is not to be re- moved. Correspondence therefore enclosed an amended agreement dated February 10, 1972, to include the 240-volt, three-phase service. Moved by Mr. Paluso, seconded by Mr. Jones, that said Agreement as per above be executed by the Chairman of the Board, pending after the approval by the consultant that this transformer does provide the correct amount of power per plan changes in electrical system in the Court House, Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. During the course of Mr. Beckstrand's presentation, the entire Board and those present went to view the Automatic Voting Machine Demonstration Model which was located in the hallway of the Main Floor of the Courthouse. Mr. Beckstrand demonstrated the machine in operation. Following the viewing of the Automatic Voting Machine in operb-tion, the Board and those present returned to the Commissioners' Conference Room in order that Messrs. Beck - strand and Wolfe may answer any questions that the Board or any individual may have. In conclusion, each of the Board members made the following remarks: Mr. Paluso: I would like to thank you gentlemen for coming down here. I have had a little correspondence and spoke with you at the Convention. I, for one, am totally in favor of the quickest, fastest means of installing these machines or some machines. I am in favor of get= ting them installed everywhere. This is a subject that is close to my heart, as everyone knowE I think we made a great deal of progress just having that machine seen sitting in the CourthousE The next progress that I would like to see is having the machines sitting in all of the precincts. Mr. Jones: I have talked to you gentlemen, also. I, too, want to see the voting machines come in eventually but as Mr. Flynn pointed out, we have some money problems here - we are having problems with the everyday capital budget. We are going to have to sit down and be realistic about this thing. I would like to thank you for coming here today. There will be no liability and the claim would be dismisse and at the s ame time the County will make a little profit. It is a guaranteed profit because wh the thing is bid, and I have prepared the advertising in such a way, that will permit the highest amount of money to come to the County with at least some money at a guaranteed profit. But I need authorization and direction in the form of a motion from the Board directing me to sign on behalf of the Commissioners the motion for the dismissal with prejudice in Federal Court and authorization to advertise said boat for public sale. They agreed with our position as outlined in our formal statement that we had prepared the Industrial Board - that it was very factual and sound and that, we could not commit our- selves to the point beyond our financial capacity - with that they were in full agreement. Follow these conferences we went into the hearing with the Industrial Board.. We. were well satisfies the reception we received from the Board. We went on record with them with a formal statement of our position which I read into their record of proceedings. It is a brief statement I will read into the record here today, (Copy of said Statement may be found on Pages 8-a and 8-b). Following that statement Mr. Bontempo presented to them a list of certain and -construction changes to the interior of the physical plants to partially conform to the curr egulations. The Industrial Board will advise us in writing relative to their acceptance of our oposal. These would be interim matters to be accomplished as soon as possible at an esti- ated cost of $125, 000. 00. This would permit continued operations until a final determination can be made in some 3-4months. Following that, Mr. Jones and I went to Washington, D. C. and met with Congressman Morgan in his Office and we went over these same problems with him pointing out to him that it was impossible for the County to bear such a .project alone. He promised us that he will pursue our problem from all levels in the federal structure and in the matter of 4-6 weeks, he hopes to have some favorable facts for us. Mr. Jones: And I asked them, also, at the hearing as a matter of.record would they please within their minutes spell out what they would expect us and they are going to send us by regis- ed mail copies of what they require. Peechatka, Director - Department of Environmental Resources, State Soil and Water Conserva tion Commission, which stated that said letter is to help clarify recent developments in feder and state legislation that may affect all local sponsors of small watershed projects under the Watershed Protection and Flood Prevention Act of 1954 (P. L. 566). Correspondence stated that Washington County, as a local sponsor, should be alerted to these recent developments regarding landowners or tenants that have to be displaced because of the installation of dams, dikes, floodways, and other works of improvement. Correspondence stated, in conclusion, that the State Soil and Water Conservation Commission staff is currently evaluating said new legislation and developing guidelines that will enable all local sponsors to carry out their responsibilitie's under both federal and state laws. Wright, Speers Borough Secretary, which enclosed a copy of a letter received from the Department of Transportation concerning the abandonment of LR 62141. Correspondence stated that according to enclosed letter the bridge which spans Maple Creek at Station 219+91 reverts to the County and maintenance becomes the obligation of Washington County. Corres- pondence stated that with regard to the above and at the request of Speers Borough officials, Ms. Wright is writing to advise that Speers Borough is of the opinion the bridge is unsafe and will not withstand the heavy vehicular traffic using the bridge. Correspondence further stated that since said bridge reverts to the County, the Borough officials feel the Commissioners should be notified and the matter brought to the Commissioners attention for investigation. Mr. Murphy: I forwarded a copy of the above letter to Mr. Tenaglia, Bridge Engineer. Mr. Tenaglia and Commissioner Jones have talked this over and I believe that they have followed o through on this matter, Mr. Jones: When I was in Harrisburg, Mr. Tenaglia happened to be there also. I had a copy of the information with me. This bridge came into being when they put this shortcut up to the expressway up through Twilight Hollow. The only use they have of it now is that some of the feed trucks going out there have been turning around. This is not our Bridge. This bridge belongs to the State. Mr. Tenaglia was going to talk to Secretary Kassab on Tuesday with the information compiled that this bridge belongs to the State. Mr. Anthony said he has been in constant contact with his counterpart, the head of the Plan- ning Commission from Fayette County, Mr. Beck, since the Commissioners assigned to his and Mr. Beck's agency the task of getting action on this project. Mr. Anthony and Mr. Beck and their staffs have been gathering and correlating their data to lay the groundwork necessary to inform the Commission of the extent of their task and to giti the Commission the basis data it needs, in an orderly fashion, to intelligently attack this problem. The latest time Mr. Beck and Mr. Anthony were in consultation was today, March 22, 1972. Mr. Anthony and Mr. Beck and their staffs contemplate another meeting on March 27 to try to finalize a work outline for the. Commission. It is then contemplated that the work outline and data will be submitted to the Commission on April 3, 1972 at a meeting to be held at Hugo's Restaurant on Rt. 40 at 12 noon and is being arranged by Washington County Chief Clerk and Fayette County Chief Clerk who are contacting the members of the Commission from both Counties for this purpose. The Commission will be given the results of the basic studies and work outline and the organ- ization and procedure the Commission will adopt and follow will then be implemented in such a way as to expedite and speed up their work; and to provide the Commission with the exper- tise of the Planning Agencies and their facilities to intelligently, thoroughly, and quickly accomplish the purpose for which they were created. PALUSO, COMMISSIONERS Pages 8-=A and 8-B The Board of County Commissioners of Washington County fully recognize their duty and obligation with respect to the care of the ill and aged including the operation and maintenance of satisfactory facilities for this purpose. This Board is fully cognizant of the fact that the structures in use at this time do not fully comply with revised Chapter 34. The only reasonable and feasible solution would be the construction of a new facility. Since February 23, 1972, we have been seriously working on projections, investigating means and methods of payment and financing. At this date, from the information at hand, it would appear that this County would have to go it alone in bearing the entire cost of a new facility at somewhere near five million dollars. This County does not have the financial ability to amortize, on its own, the cost of a five million dollar new facility. At the conclusion of this hearing, Commissioner Jones and I are going to Washington, D. C. to meet with our Congressional contacts to fully explore any and all possibilities of securing federal assistances. We are likewise exploring all avenues of financing and or grants from our State government, including pending House Bills #1268 & #1269 which relate to P I D A & I D A Funds for construction of health facilites. We firmly believe it will be a matter of three or four months before we can be in a position to determine a solid financial approach to a possible construction of a new facility. We are extremely open-minded as to any and all possibilities, hazardous and otherwise, as far as our present structures are concerned. We believe that if your Board can work with us under reasonable and factual requirements at this time that we can eventually work out the entire problem to a fully mutual satisfaction. In attendance at the Meeting were the six members of the Commission; John Anthony, Pat,Huber of the Washington County Plan- ning Commission, William Porter, Solicitor; Dan Zeigler of the Fayette County Planning Com- mission and a member of his Staff. The Meeting was devoted mainly to outlining the duties of the Commission and setting procedurE for conducting the business of the Commission. It was decided to elect Co-chairmen to serve as officers; one from each County. Mr. Whalen stated that Mr. John Anthony, Executive Director of the Washington County Planning Commission, as per his correspondence under date of April 7, 1972, directed to Mr. Whalen, purposely avoided payment of said invoices until Greene Engineering Company presented evidence that work was progressing satisfactorily Mr. Anthony stated in his correspondence that the Planning Commission recently reviewed the data collected thus far and feels that the Solid Waste Management Systems Plan is progressing as scheduled and therefore recommends that said Invoices be honored as soon as possible. Evans Kephart, Court Administrator of Pennsylvania, regarding apportionment of the $8, 000, 000.-00 appropriated by Act 27-A (1971) among the Counties. Correspondence enclosed copies of the Rules issued by the Court Administrator of Pennsylvania, governing the alloc to the Counties of the sum of $8, 000, 000, 00 appropriated under Act 27-A. Correspondence stated that the purpose of said appropriation is to reimburse the counties for costs incurred by them in the past in the administration and operation of all courts established pursuant to Articl( V, Section 1 of the Pennsylvania Constitution, and relieve county taxpayers to this extent. Corres- pondence stated in conclusion that the amount of the requisition from this Office to the State Treasurer for Washington County is estimated at $99, 129.00., Mr. Anthony left the meeting. Mr. Whalen: This involves the office expenditures exclusive of capital expenditues for a s of offices. These offices are: Register of Wills, Sheriff, Prothonotary, Clerk of Courts, Domestic Relations, Courts, Magistrates, Constables, Adult Probation and Juvenile Probation] Offices. This is based on the 1970 expenditues and the County's costs were $823, 086. 84 and this $99, 129. 00 represents approximately 12% of that expense. Mr. Paluso: Mr. Whalen, I noticed an article in the Washington Observer -Reporter that Greene County had worked out the additional reimbursement they are going to get from this judicial branch also from the Child Welfare in changing the percentage of the Child Welfare care to 60% now versus the previous 34%. Plus, they worked out how much their reimburse- ment would be from the State to help maintain our prisoners in the State Prisons system prorated for this year. They had it worked out for this year and next year. I would like to see those figures for Washington County if you can work this out.
