Office of the County Commissioners
Washington, Pa., March 16, 1972
The Board of County Commissioners met in regular session with the
following members being present: Commissioners. Jones, Paluso, and Flynn. Also present
being: Chief Clerk Murphy; County Solicitor Capano; Assistant County Solicitor Hormell;
Administrative Assistant Whalen; Reporter Robertson of The Observer -Reporter; Reporter
Roule of the Monongahela Publishing Company; Reporter Liesch of The Brownsville Telegraph;
and Public .Informa.tion Officer Huber.
Meeting called to order by Chairman and roll call taken:
Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Present.
Chairman asked if there were any corrections, additions, or omissions to
Minute No. 11, each Commissioner having received a copy.
Moved by Mr. Jones, seconded by Mr. Paluso, that Minute No. 11 be
approved, as read.

Old Business - Mr. Flynn (Gilly Trial - Jury Foreman Report)
Mr. Flynn: I want the records to show that Monday morning of this week, Mr. Ted
Breuer, a gentleman who served as the foreman of the jury of this last murder trial, came
into my office and told me that he was not there speaking as an individual; but that he was the
as the former foreman of the jury. He was also there at the instructions of a representative
of Judge Sweet's office; and that it was recommended that he come before the Chairman of the
Board of Commissioners and relate the complaints filed with him about the poor service and
quality of food rendered while they sequestered at the George Washington Hotel. After lis-
tening to the gentleman, I let it be known that I appreciated his coming before the Commiss-
ioners and letting this be known to us. However, I would like the gentleman to know that wheni
the time comes for the Judicial branch of government to sequester any jury, they do not con-
sult this Board of Commissioners to make arrangements for room and lodging. It would see
to me that if we are to enter into the picture now after the jury has been discharged, and be
asked to be responsible for, this type of, service and quality of food, then certainly we should b�
consulted prior to sequestion. I would like for the records to show that in the future if they
want the Commissioners to be held responsible for any failings insofar as the jurors who are

sequestered being treated, then I suggest that they get in touch with the Board
of Commissioners prior to designating any specific hotel. Then if we make the arrangements
we will accept the responsibilities.
Mr. Flynn read a, prepared statement in regards to a news conference called
by Minority Commissioner Paluso following the Regular Board Meeting of the Washington
County Commissioners on March 9, 1972. (Copy of said statement may be found on page 2-A)
Remarks:
Mr. Paluso: What is that supposed to mean? Are you insinuating that those were not my
remarks ?
Mr. Flynn: I'm not insinuating anything. I'm just telling what my thinking is.
Mr. Paluso: Then I take exception to your remarks. I don't think they are called for at
all. If we are going to take politics out of this Board, then let's everyone appoint one person
to it so that politics are removed from this Board rather than you or someone else appointing
everyone. That interjects politics into the Tax Appeal Board in my opinion.
Mr. Flynn: Not necessarily.

In re: News Conference called by Minority Commissioner Paluso following
the Regular Board Meeting of the Washington County Commissioners
on March 9, 1972.
As a result of your Conference, an article was published in the news media
wherein you as a Minority Commissioner was quoted a,s saying that the Majority Commission-
ers were afraid to go downstairs and face the public - that is why we appointed an Assessment
Appeal Board,
As Chairman of this Board of Commissioners, I want the record to show
that it is my humble opinion you as a member of this august body have far exceeded the rights
and authority that was vested in you upon taking your oath of office.
We are supposed to be honorable men and as such it is expected that we show
respect for one another and conduct and express ourselves in a manner that is befitting the
position and the people we represent.
The Chairman recongnizes your right to dissent, to express your opinion,
and to file minority reports; however, you have no right to make irresponsible statements
assassinating the character of your colleagues for the sake of cheap publicity. The Board of
Assessment Appeals was created prior to my arrival on the scene and the intent and reas
for this creation was to separate and prevent political influence being a contributing factor
in the Property Assessment and Appeal Program. During my tenure in office and to the best
of my knowledge this policy has been adhered to and will continue to be.

In conclusion, I would suggest that prior to your next News Conference that you
take time to censor the material authored by your'khost writers" or perhaps better still -
why not try to be original.
MICHAEL R. FLYNN
Mr, Whalen informed the Board and those present that Washington County is to
appear before the Industrial Board in Harrisburg on Wednesday, March 22, 1972, to commit
the County as to their present as well as future intentions as well as future intentions as far
as the operation and maintenance of the new extended care facilities are concerned.
(Mr, Jack Merdian - WJPA - entered the meeting).
Mr. Flynn and Mr. Jones discussed the above matter and stated that they also discussed
this subject with Congressman Morgan. Mr, Flynn stated that a. meeting was held on Wed-
nesday, March 15, 1972, at 9:00 a.m. at the Washington Hospital with Mr. Robert Cook,
President of the Hospital, Eugene L. Strosser, Executive Vice -President of the Hospital,
Keery McAmbley, and John W. Clem, who is the Assistant Director of the Western Pennsylv
ania Comprehensive Health and Planning Agency, Inc. They discussed the possible purchase
of Canonsburg General Hospital, South Hills Convalescent Home, Charleroi-Monessen Hos-
pital, or the Monongahela Memorial Hospital.

Fireman's Association and the County Commissioners to purchase, on a matching funds
basis, several replacement radio base stations, and coming from the Office of Civil Defense

Fuels Tax Fund Account.
Mr. Murphy: I want you to know that they met their deadline. They were here yesterday anc
are presently auditing our books.
Chief Clerk read correspondence under date of March 9, 1972, from the
Governor's Justice Commission which was a reply to a letter of March 3, 1972, requesting
preincurred costs on Subgrant Application SW-109-71A which will be an application for con-
tinuation of the Washington County Jail, Subgrant SW-041-70A. Correspondence stated that

which was passed by unanimous vote of Council, at the regular meeting held on Wednesday,

Chief Clerk read correspondence under date of March 13, 1972, from A.
Dewey Pelligrine, which thanked the Commissioners for their efforts resulting in his
appointment to the Washington -Fayette County. Ferry Commission.

RESOLUTION 5 of 1972
MAGISTRATES SITTING IN THE WASHINGTON
COURT HOUSE FOR CERTAIN FELONIES
WHEREAS, the Council of the City of Monongahela, Washington County,
Pennsylvania sat in regular session on Wednesday, March 8th, 1972 and,
WHEREAS, said Council discussed, with deep concern the procedure for
Magistrates holding sessions in the Washington County Court House to hear certain felonies.
NOW THEREFORE BE IT RESOLVED, that the City Clerk of the City of
Monongahela notify the Washington County Courts, that the Council for said City express
their concern over the procedure providing for Magistrates sitting in Washington for certain
Felonies. It is Council's feelings that the procedure is costly for the Municipality, will not
provide better service, defeats the purpose of having local Magistrates, defeats the purpose
of the Constitution providing for Local Magistrates and jeopardizes the efficiency of the
Police Department while Police are in Washington testifying before a, Magistrate,
BE IT FURTHER RESOLVED, that copies of this Resolution be sent to the
Washington County District Attorney, Washington County Commissioners, President of the
Washington County Association of Magistrates and Clyde G. Tamest, Magistrate for District
2.

Administrative, Assistant Whalen read correspondence under date of March
13, 1972, from the Washington County Planning Commission, which stated that the Commiss
ion has formed a Citizens Participation Committee to provide citizen input in the County
Planning process. Correspondence stated that eight of the members of this committee are
low-income people, some receiving public assistance; therefore, the Planning Commission
would like to arrange for these people to be reimbursed for `their travel expenses which wou

Mr. Whalen stated that in connection with the Donora Redevelopment Proj

the project has been increased, by $147, 000. 00, making the value of the total project

Mr. Lamo recommended the appointment of Mr. Robert Abba,dini, R.D. !, Box 22,
Fredericktown, to replace him and requested the Board's consideration of same.

of Mr. Robert Abbadini of Fredericktown to replace Mr. Alfred Lamo of Clarksville as a

Mr. Flynn: Right at the present time there is being formed what is known as the South-
western Pennsylvania Resource Conservation and Development District. This District is

comprised of Allegheny, Fayette, Greene, Westmoreland, and Washington counties; and

the purpose of this District is to establish a formal organization to secure federal monies to
try to combat and develop some of the problems that we have in common. It is necessary that
we go on record authorizing Washington County to participate in this District and to appoint
one member of this Board to represent us. In Washington County representing the Soil Conser-
vation District is Mr. Lee Adamson.
Moved by Mr. Jones, seconded by Mr. Flynn, authorizing Washington County to
participate in the Southwestern Pennsylvania Resource Conservation and Development District.

Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Solicitor for the
Department of Parks and Recreation to draft the necessary contract in order to modify the
former Agreement between the County of Washington and the Township of Nottingham whereby
the Commissioners would continue as of April of this year to pay the $1, 100.00 as in the exist-
ing Agreement; however, beginning as of October of this year, the Commissioners would appro
priate to them the sum of $2, 500. 00; and beginning next year (1973), for a three-year period,
the Commissioners would grant them a sum of $5, 000. 00, payable in two installments of
$2, 500.00 each.

Solicitor Capano read correspondence under date of February 29, 1972, from the
Citizens Water Company of Washington, Pennsylvania, which enclosed, in triplicate, the Final
Memorandum which was to be executed in connection with the Special Extension Deposit Agree
ment dated September 11, 1969, between said Company and the County of Washington covering
the installation of a water line to serve the Juvenile Home.
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Chairman of the
-Board to execute said Agreement as per above.

Solicitor Capano read correspondence under date of March 13, 1972, from West
Penn Power Company in regards to an electric service agreement to provide reduced capacity
at the Court House. Correspondence stated that information that said company has from the
County's consultants indicates that the present 240-volt, three-phase service is not to be re-
moved. Correspondence therefore enclosed an amended agreement dated February 10, 1972,
to include the 240-volt, three-phase service.
Moved by Mr. Paluso, seconded by Mr. Jones, that said Agreement as per above
be executed by the Chairman of the Board, pending after the approval by the consultant that
this transformer does provide the correct amount of power per plan changes in electrical
system in the Court House,

by Messrs. Onopiuk and Judy whereby the Commissioners endorse and urge approval of the
application for planning assistance and works of improvement for a watershed protection and
flood prevention project on the Kings Creek Watershed under the provisions of Public Law 566
be adopted by the Washington County Commissioners; Said motion based upon the recommenda-

sioners approve and adopt two (2) Resolutions in conjunction with the Monongahela Business
District Urban Renewal Area.

of County Commissioners of the County of Washington approving the Urban Renewal Plan and
the feasibility of relocation for the Monongahela Business District Urban Renewal Area,
Project No. PA. R-355 be approved and adopted by the Washington County Commissioners.

(c) Mr, Charles E. Beckstrand, as per the County Commissioners request as per
Minute No. #11 dated March 9, 1972, made his presentation to the Board on the Automatic
Voting Machine. Mr. Beckstrand explained the history of his company as per the automatic
voting machine and also explained the durability of said machine.
During the course of Mr. Beckstrand's presentation, the entire Board and those
present went to view the Automatic Voting Machine Demonstration Model which was located
in the hallway of the Main Floor of the Courthouse. Mr. Beckstrand demonstrated the machine
in operation.
Following the viewing of the Automatic Voting Machine in operb-tion, the Board and
those present returned to the Commissioners' Conference Room in order that Messrs. Beck -
strand and Wolfe may answer any questions that the Board or any individual may have.
In conclusion, each of the Board members made the following remarks:
Mr. Paluso: I would like to thank you gentlemen for coming down here. I have had a little
correspondence and spoke with you at the Convention. I, for one, am totally in favor of the
quickest, fastest means of installing these machines or some machines. I am in favor of get=
ting them installed everywhere. This is a subject that is close to my heart, as everyone knowE
I think we made a great deal of progress just having that machine seen sitting in the CourthousE
The next progress that I would like to see is having the machines sitting in all of the precincts.
Mr. Jones: I have talked to you gentlemen, also. I, too, want to see the voting machines
come in eventually but as Mr. Flynn pointed out, we have some money problems here - we are
having problems with the everyday capital budget. We are going to have to sit down and be
realistic about this thing. I would like to thank you for coming here today.
Mr. Flynn: There is no question that this is going to come about but it is just a matter of time
I, too, thank you gentlemen. We will be in touch with you in the near future and will pursue
this further.
Mr. Beckstrand: I appreciate you gentlemen giving us the time in making this presentation
here today. With your permission, I would be more than pleased to do a complete survey for
you and present it to you at a future meeting in more detail of comparative cost of paper vs.
machine, etc., for your particular County.

dispose of said vessel - to get rid of it and the liability that was attached to it. The problem
came up on how we could do that to make the best figure and at the same time avoid litigation.
Presently there is $28, 000. 00 in claims against said boat which the County has been contesting
I am pleased to advise that we have worked out a motion to be presented to the Federal Court
which will provide that we will advertise this boat for public sale and dispose of this law suit
and the County will come out clear. There will be no liability and the claim would be dismisse
and at the s ame time the County will make a little profit. It is a guaranteed profit because wh
the thing is bid, and I have prepared the advertising in such a way, that will permit the highest
amount of money to come to the County with at least some money at a guaranteed profit. But
I need authorization and direction in the form of a motion from the Board directing me to sign
on behalf of the Commissioners the motion for the dismissal with prejudice in Federal Court
and authorization to advertise said boat for public sale.

appointments and counseled with several of the Commonwealth's officials relative to our'posi-

. They agreed with our position as outlined in our formal statement that we had prepared
the Industrial Board - that it was very factual and sound and that, we could not commit our-
selves to the point beyond our financial capacity - with that they were in full agreement. Follow
these conferences we went into the hearing with the Industrial Board.. We. were well satisfies
the reception we received from the Board. We went on record with them with a formal
statement of our position which I read into their record of proceedings. It is a brief statement
I will read into the record here today, (Copy of said Statement may be found on Pages 8-a
and 8-b). Following that statement Mr. Bontempo presented to them a list of certain
and -construction changes to the interior of the physical plants to partially conform to the curr
egulations. The Industrial Board will advise us in writing relative to their acceptance of our
oposal. These would be interim matters to be accomplished as soon as possible at an esti-
ated cost of $125, 000. 00. This would permit continued operations until a final determination
can be made in some 3-4months. Following that, Mr. Jones and I went to Washington, D. C.
and met with Congressman Morgan in his Office and we went over these same problems with
him pointing out to him that it was impossible for the County to bear such a .project alone. He
promised us that he will pursue our problem from all levels in the federal structure and in the
matter of 4-6 weeks, he hopes to have some favorable facts for us.
Mr. Jones: And I asked them, also, at the hearing as a matter of.record would they please
within their minutes spell out what they would expect us and they are going to send us by regis-
ed mail copies of what they require.

Remarks:
Mr, Paluso: Don't you think that pending the bought time that -we should sort of suspend these
activities such as engineering and feasibility things at the Woren's and Men's. Homes until we
find out what course of action we are going to take. Then when we do find out where we are
going, we will resume or discontinue this work. I think everything except routine maintenance

Mr. Flynn: This work here is work that has already been done because we changed these boiler

Society will entertain the Washington County History and Landmarks Foundation on April 9,

said date entered into each of the Commissioners appointment books.
Chief Clerk read a memorandum under date of March 8, 1972, from Mrs. Carolyn
Stevens, Secretary - County Engineers Office, directed to Chief Clerk Murphy, which stated
that county aid applications have been mailed to or have been picked up for all of the municipa-
lities and all have been notified of the cut-off date which is June 1, 1972,
Chief Clerk read correspondence under date of March 13, 1972, from Walter N.
Peechatka, Director - Department of Environmental Resources, State Soil and Water Conserva
tion Commission, which stated that said letter is to help clarify recent developments in feder
and state legislation that may affect all local sponsors of small watershed projects under the
Watershed Protection and Flood Prevention Act of 1954 (P. L. 566). Correspondence stated
that Washington County, as a local sponsor, should be alerted to these recent developments
regarding landowners or tenants that have to be displaced because of the installation of dams,
dikes, floodways, and other works of improvement. Correspondence listed said developments.
Correspondence stated, in conclusion, that the State Soil and Water Conservation Commission
staff is currently evaluating said new legislation and developing guidelines that will enable all
local sponsors to carry out their responsibilitie's under both federal and state laws. Corres-
pondence stated that when the preparations have been completed, it will be necessary to meet
with all sponsors affected to aid in the understanding and transmitting of advisory assistance
to persons eligible for relocation payments and that the County Commissionersi will be further
contacted when such a meeting is desirable.

Chief Clerk read correspondence under date of March 15, 1972, from Ms. Esthf
L. Wright, Speers Borough Secretary, which enclosed a copy of a letter received from the
Department of Transportation concerning the abandonment of LR 62141. Correspondence
stated that according to enclosed letter the bridge which spans Maple Creek at Station 219+91
reverts to the County and maintenance becomes the obligation of Washington County. Corres-
pondence stated that with regard to the above and at the request of Speers Borough officials,
Ms. Wright is writing to advise that Speers Borough is of the opinion the bridge is unsafe and
will not withstand the heavy vehicular traffic using the bridge. Correspondence further stated
that since said bridge reverts to the County, the Borough officials feel the Commissioners
should be notified and the matter brought to the Commissioners attention for investigation.
Mr. Murphy: I forwarded a copy of the above letter to Mr. Tenaglia, Bridge Engineer. Mr.
Tenaglia and Commissioner Jones have talked this over and I believe that they have followed

through on this matter,
Mr. Jones: When I was in Harrisburg, Mr. Tenaglia happened to be there also. I had a copy
of the information with me. This bridge came into being when they put this shortcut up to the
expressway up through Twilight Hollow. The only use they have of it now is that some of the
feed trucks going out there have been turning around. This is not our Bridge. This bridge
belongs to the State. Mr. Tenaglia was going to talk to Secretary Kassab on Tuesday with the
information compiled that this bridge belongs to the State.
Chief Clerk read correspondence under date of March 14, 1972, from Gweneth
Zarfoss, Secretary - Council for Human Services (Governor's Office), which stated that Gov-
ernor Shapp is concerned about the Pennsylvanias whose individual and family needs are
press-
ing but still unfulfilled. Correspondence stated that American Indians, of which statistics
indicate there are over 5, 000 in Pennsylvania, pose a difficult problem because Government
records do not list them as a separate group. Correspondence, in conclusion, requested the
submitting of any Indian Organization in Washington County or the names and addresses of any
person or persons to whom the Council for Human Services may write for further information
about these Pennsylvania citizens.
Mr. Flynn: I would suggest that the Chief Clerk acknowledge said letter and reply that this
Board of Commissioners has no knowledge of such an Organization.
Chief Clerk read correspondence under date of March 15, 1972, from George
H. Stewart, Mayor of the City of Washington, which enclosed a copy of the 1971 Financial
Statement of the Washington City Bus Lines, Incorporated. Correspondence noted the amount
of subsidy being requested from the City for the continuation of this public service is in the

is rendered not only to the City of Washington but to other surrounding communities in the
County, it is requested that the subsidy needed to continue this service be shared by the City
and County on a fifty-fifty basis.
Mr. Jones: I do not think the County subsidizes any means of transportation right now and I
think that if we open the doors concerning this - then we will have all the other bus companies
and even the ferry service coming to us and then we will have to open the door right open.
Mr. Flynn: We have no provisions in our County Budget to subsidize these programs. I
would so notify the Mayor that before we get involved in subsidizing, there is going to be a
tremendous overall study made by our Planners in conjunction with The Southwestern Pennsyl-
vania Regional Planning Commission.
Chief Clerk read correspondence under date df March 21, 1972, from J. Wesley
Miller, Building Superintendent - Washington Trust Buildings, Inc., which again offered for
immediate occupancy available space for the Law Library. Correspondence enclosed a typical
floor plan which marked the proposed area in red. Correspondence requested that the
sinners give said proposal serious consideration.
Mr. Murphy: We are awaiting at the present time for the Bar Association to have a meeting
with Mr. Capano, Mr. Hormell, Mr. Anthony Bevec and myself as to what their decision is
going to be across the street whenever Judge Fergus takes action for hi-s client in Court.
Mr. Flynn: May I suggest that the Chief Clerk acknowledge the preceding letter that the Com-
missioners are in the process of negotiation with another property owner and if in the event
that nothing materializes, the Commissioners will consider Mr. Miller's offer.
Chief Clerk read a copy of a letter under date of March 21, 1972, from Mrs. Ernest
C. Phillips, President - Mon Valley G. A. S. P. , directed to Lieutenant Governor Kline which
enclosed 110 more signatures opposing ERG's proposed strip mine adjacent to Mingo Creek
Park in Washington County. Correspondence also stated that a copy of the signatures have
also been sent to Dr. Maurice Goddard, Secretary of the Department of Environmental Re-
sources. A footnote at the bottom of said letter directed to Mr. Michael Flynn stated that
G. A. S. P. wanted the Commissioners to be aware of their concern in said matter.

Mr. John Anthony of the Planning Commission reported to me today on the work being done
to expedite and help the Ferry Commission to accomplish the purpose we have assigned to it.
Mr. Anthony said he has been in constant contact with his counterpart, the head of the Plan-
ning Commission from Fayette County, Mr. Beck, since the Commissioners assigned to his
and Mr. Beck's agency the task of getting action on this project.
Mr. Anthony and Mr. Beck and their staffs have been gathering and correlating their data to
lay the groundwork necessary to inform the Commission of the extent of their task and to giti
the Commission the basis data it needs, in an orderly fashion, to intelligently attack this
problem.
The latest time Mr. Beck and Mr. Anthony were in consultation was today, March 22, 1972.
Mr. Anthony and Mr. Beck and their staffs contemplate another meeting on March 27 to try
to finalize a work outline for the. Commission. It is then contemplated that the work outline
and data will be submitted to the Commission on April 3, 1972 at a meeting to be held at
Hugo's Restaurant on Rt. 40 at 12 noon and is being arranged by Washington County Chief
Clerk and Fayette County Chief Clerk who are contacting the members of the Commission
from both Counties for this purpose.
The Commission will be given the results of the basic studies and work outline and the organ-
ization and procedure the Commission will adopt and follow will then be implemented in such
a way as to expedite and speed up their work; and to provide the Commission with the exper-
tise of the Planning Agencies and their facilities to intelligently, thoroughly, and quickly
accomplish the purpose for which they were created.

The Board of County Commissioners of Washington County fully recognize their duty and
obligation with respect to the care of the ill and aged including the operation and maintenance
of satisfactory facilities for this purpose.
This Board is fully cognizant of the fact that the structures in use at this time do not fully
comply with revised Chapter 34.
The only reasonable and feasible solution would be the construction of a new facility.
Since February 23, 1972, we have been seriously working on projections, investigating means
and methods of payment and financing. At this date, from the information at hand, it would
appear that this County would have to go it alone in bearing the entire cost of a new facility
at somewhere near five million dollars.
This County does not have the financial ability to amortize, on its own, the cost of a five
million dollar new facility.
At the conclusion of this hearing, Commissioner Jones and I are going to Washington, D. C.
to meet with our Congressional contacts to fully explore any and all possibilities of securing
federal assistances.
We are likewise exploring all avenues of financing and or grants from our State government,
including pending House Bills #1268 & #1269 which relate to P I D A & I D A Funds for
construction of health facilites.
We firmly believe it will be a matter of three or four months before we can be in a position
to determine a solid financial approach to a possible construction of a new facility.
We are extremely open-minded as to any and all possibilities, hazardous and otherwise, as
far as our present structures are concerned. We believe that if your Board can work with us
under reasonable and factual requirements at this time that we can eventually work out the
entire problem to a fully mutual satisfaction.

Mr. Muscaro reported to the Board that he received official certification of candi-
es from Harrisburg on Tuesday and that he is rather concerned about the military ballots to
e soldiers. At the present time the Election Bureau has received 198 requests for military
allots and 171 civilian and as time goes along the requests will increase. Mr. Muscaro stated
at on April 21 he has to put the absentee ballots into the ballot box after 5:00 p.m. and he feel
at a few soldiers are going to be late getting their ballots back here. Mr. Muscaro presented
a sample ballot to the Commissioners to show the size of the ballot and how it is to be set up
his year as required by authorities in Harrisburg. A brief discussion followed.

Mr. Whalen reported that he and Mr. Jones appeared before the Labor & Industry
on Tuesday, March 21, 1972 concerning the County's extended care facilities and pre-
sented a list of corrections that the county proposes to make. Mr. Whalen stated that he and
Mr. Jones requested that the Industrial Board advise us in whiting,, of their decision and read
correspondence from the Board under date of March 23, 1972 addressed to Mr. Thomas R.

Baker and Associates - Subject: West Penn Power Service Agreement - Courthouse Electric
Service. Correspondence stated that said company has reviewed.the new Electric Service
Agreement that West Penn Power Company sent for approval. Said agreement calls for Rate
Schedule No. 30, which is the same schedule under which the County is now being billed. Cor-
respondence stated that this is a favorable rate and recommended that the Commissioners sign
the agreement so as not to delay the new project.

G. Baker and Associates directed to Chapman Plumbing and Heating, Inc. - RE: Heating Re-

Chief Clerk read correspondence under date of March 27, 1972, from James A.
McHale, Department of Agriculture, which stated that the Pennsylvania Department of Agri-
culture has taken the initiative in making their activities and services more responsive to the
needs and desires of all Pennsylvanians. Correspondence further stated that the formation
of Rural Development Councils and Consumer Councils is the first step toward establishing
better communications and providing valuable information to the citizens of the C
Correspondence informed the Commissioners that a meeting will be held at 8:00 p.m. on
April 18, 1972, at the Pittsburgh -East Holiday Inn in order to present to the people ways in
which they -can work together for a common cause.

ment of Justice directed to John P. Liekar, Esq. - Public Defender of Washington County -
RE: Extension of Subgrant SW-A-048-70. Correspondence stated that the extension has been
granted, but only until June 30, 1972. Correspondence stated that the -Department is only able
to extend the project this length of time because 1970 Federal funds will lapse as of that date,
June 30, 1972. Correspondence further stated that any funds that are not expended as of that
date will revert back to the Governor's Justice Commission to lapse back to the LEAA.

I think it would be in order for the Commissioners to direct the sale of this boat to the party
who is claiming the lien provided that the whole case is dropped, the amount claimed is
satisfied, and the County receive $2, 000.00 over and above that claim.

FERRY COMMISSION MEETING
April 3, 1972
HUGO' S RESTAURANT
The Washington -Fayette County Joint Ferry Commission held its first meeting on Monday,
April 3, 1972, at Hugo's Restaurant, Centerville Borough. In attendance at the Meeting were
the six members of the Commission; John Anthony, Pat,Huber of the Washington County Plan-
ning Commission, William Porter, Solicitor; Dan Zeigler of the Fayette County Planning Com-
mission and a member of his Staff.
The Meeting was devoted mainly to outlining the duties of the Commission and setting procedurE
for conducting the business of the Commission. It was decided to elect Co-chairmen to serve
as officers; one from each County. Mr. Harshman and Dr. Garafolo were elected Co-chairmen
Mr. Harshman suggested that arrangements be made for secretarial help to keep proper recorc
of meetings. It was also decided that the respective Planning Commissions be responsible for
preparing meeting Agenda's on a rotating basis. The Commission was then presented with the
Feasibility Studies prepared by Captain Jack Ross for their review and are being supplied with
data collected by the Washington County Planning Commission to be presented at the next meeth
The next meeting of the Commission will be held on April 25, 1972, in the Board Room at the
Brownsville General Hospital, at 7:00 P. M.
Old Business: County Hospital Plans for Renovation
Mr. Whalen: We are at the point now where it is necessary to proceed with the actual plans to
be prepared and submitted to the Department of Labor and Industry and to the Pennsylvania
Department of Health. Due to the background involved here it would be may recommendation
at this time to the Board that you authorize the firm of Carl G. Baker and Associates to pro-
ceed on this particular project.
Moved by Mr. Jones, seconded by Mr. Paluso, that the firm of Carl G. Baker and
Associates be authorized to draft the necessary plans to be submitted to the Department of
Labor and Industry and to the Pennsylvania Department of Health for approval onPhase I of the
County Hospital Plans for Renovation.

Correspondence - Mr. Murphy
Chief Clerk read a telegram under date of April 6, 1972, from Congressman
Thomas E. Morgan which announced the approval of two loans by the Small Business Adminis-
tration to Washington Industrial Development Corporation in Washington, Pennsylvania. Tele-
gram stated that this Development Corporation will assist Superior Concrete Products Com
Canonsburg, Pennsylvania. Telegram further stated that this is a concrete block m
business and two loans are involved - first in the amount of $86, 250. 00 from SBA - Additional
assistance obtained from WIDC, Pennsylvania IDA, and a local bank and said loan is to purch
land and construct a building. The second loan is in the amount of $257, 040. 00 from SBA with
additional assistance from W. D. C. and a local bank and said loan is to purchase machinery
and equipment. Telegram stated in conclusion, that this is a new business and 45 jobs will be
created.

Chief Clerk read correspondence under date of April 10, 1972, from Mrs. Char-
lotte K. Lane, Executive Director of The Washington -Greene County Tourist Promotion
which suggested those listed programs as summer projects should said Agency be fortunate
enough to have summer help. Correspondence listed: (a) that Albert Miller has expressed a
need of two girls to work on the Miss Meadowcroft Project; (2) locations of old cemeteries in
this area; and (3) dirt roads which have not been surveyed as to historic sites. Correspondei
stated that it is hoped that said projects meet with the Commissioners' approval.
Mr. Flynn: Last year through the Regional Office of the Overall Economic Development Pro-
gram - they made monies available so that we could have these people. I would suggest that
you contact Mrs. Lane and advise her that we do not have any knowledge ourselves if we are
going to have these people.

saddle, Business Manager - Peters Township School District, which commended the Board for
the Assessment of Appeals for the conduct of the hearings which were held on March 16, 1972,
in which twenty (30) appeals were made by Peters Township residents and the Board upheld the
assessment made by the Field Assessor in eighteen (18) cases.
Chief Clerk read correspondence under date of April 15, 1972, from Milton J.
app - Governor of Pennsylvania, which proclaimed April 15, 1972, at LOCAL GOVERNMENT

Central Avenue on Sunday, April 23, 1972, beginning at 3:00 pm.
Chief Clerk read correspondence under date of April 10, 1972, from Reed B. Day
Law Offices of Peacock, Keller, Yohe & Day, which stated that The Central Washington County
United Fund has some unused space currently available in its building on Cherry Avenue, and
further stated that said United Fund is aware that the Commissioners periodically have space
problems and in the event that the Commissioners are needing additional space, the United Fun

Chief Clerk read correspondence under date of April 8, 1972, from Harry M.
Harvey, which stated that Mr. Harvey was wondering if the County had completed the survey
on the property lines next to the entrance to the Fairgrounds. Correspondence stated that Mr.
Harvey expects to be hearing from the Commission soon regarding contract renewal. Corres-
nce stated that for the record, Mr. Harvey owes the County some money and expects to
the amount due through the end of the present lease. Correspondence stated that Mr.

Clarksville, Pennsylvania (Greene County) has been completed at a total cost of $3, 694.92.
Correspondence stated that the amount has been split between the Jefferson Township Board of
Supervisors (Greene County) and the County of Washington, in the amount of $1, 847. 46 each
and that said bill was mailed to the said Supervisors on Tuesday, April 11, 1972.
Chief Clerk informed the Board of twenty five (25) letters which were received fr
all of the members of the 6th Grade Class of the Prosperity Elementary School which expresse
appreciation to the Commissioners for making a field trip possible for said Class at Mingo
Creek County Park.
Mr. Flynn: I would suggest that the Chief Clerk acknowledge receipt of said letters to the
teacher of these students of the Sixth Grade Class and express the Commissioners' apprecia-
tion of each student's comments.
Administrative Assistant Whalen presented three (3) invoices in the amount of
$3, 000.00 each as submitted by Green Engineering Company as per the County's Contractual
Agreement dated November 24, 1971, in connection with the preparation of a County Compre-
hensive Solid Waste Management Plan. Mr. Whalen stated that Mr. John Anthony, Executive
Director of the Washington County Planning Commission, as per his correspondence under
date of April 7, 1972, directed to Mr. Whalen, purposely avoided payment of said invoices
until Greene Engineering Company presented evidence that work was progressing satisfactorily
Mr. Anthony stated in his correspondence that the Planning Commission recently reviewed the
data collected thus far and feels that the Solid Waste Management Systems Plan is progressing
as scheduled and therefore recommends that said Invoices be honored as soon as possible.
Moved by Mr. Jones, seconded by Mr. Paluso, that Invoices #7484, 7513 & 7537
in the amount of $3, 000. 00 each - total $9, 000. 00 - as submitted by Greene Engineering Com-
pany, for engineering services rendered for the preparation of a Comprehensive Solid Waste
Management Plan for Washington County, be approved by the Washington County Commissioner
Said three (3) Invoices are submitted for the months of January, February, and March, 1972.
Said action based upon the recommendation of the Washington County Planning Commission.

Administrative Assistant Whalen informed all those present that the Washington
County Planning Commission has now moved and that an Open House is planned for the display-
ing of the new office space at the County Home. Mr. Whalen stated that the date for the Open
House will be set as soon as the.Planning Commission is completely settled and it is requested
that the County Commissioners be the Planning Commission's honored guests for said Open
House. Mr. Whalen stated that said Open I -louse will be preferably in the latter part of May
and that the Commissioners will be so notified of said date in the near future.
Administrative Assistant Whalen stated that the Chief Clerk has arranged for Mr.
Anthony to meet here on Tuesday, April 18, 1972, at 10:00 a, m. with the County
to brief the Board on the progress of the County Wide Sewage Facilities Plan and the Compre-
hensive Solid Waste Management Plan for Washington _County at this particular time.
Administrative Assistant Whalen read correspondence under date of March 27, 1971
from A. Evans Kephart, Court Administrator of Pennsylvania, regarding apportionment of the
$8, 000, 000.-00 appropriated by Act 27-A (1971) among the Counties. Correspondence enclosed
copies of the Rules issued by the Court Administrator of Pennsylvania, governing the alloc
to the Counties of the sum of $8, 000, 000, 00 appropriated under Act 27-A. Correspondence
stated that the purpose of said appropriation is to reimburse the counties for costs incurred by
them in the past in the administration and operation of all courts established pursuant to Articl(
V, Section 1 of the Pennsylvania Constitution, and relieve county taxpayers to this extent. Cor
respondence stated that it is not for the purpose of establishing new court projects. Corres-
pondence stated in conclusion that the amount of the requisition from this Office to the State
Treasurer for Washington County is estimated at $99, 129.00.,
Mr. Anthony left the meeting.
Mr. Whalen: This involves the office expenditures exclusive of capital expenditues for a s
of offices. These offices are: Register of Wills, Sheriff, Prothonotary, Clerk of Courts,
Domestic Relations, Courts, Magistrates, Constables, Adult Probation and Juvenile Probation]
Offices. This is based on the 1970 expenditues and the County's costs were $823, 086. 84 and
this $99, 129. 00 represents approximately 12% of that expense.
Mr. Paluso: Mr. Whalen, I noticed an article in the Washington Observer -Reporter that
Greene County had worked out the additional reimbursement they are going to get from this
judicial branch also from the Child Welfare in changing the percentage of the Child Welfare
care to 60% now versus the previous 34%. Plus, they worked out how much their reimburse-
ment would be from the State to help maintain our prisoners in the State Prisons system
prorated for this year. They had it worked out for this year and next year. I would like to
see those figures for Washington County if you can work this out. I think we need this informa-
tion for Tuesday.

County Solicitor Capano presented an Agreement between The Nottingham Township
Supervisors and the County of Washington for the consideration and approval of the Board.
Said Agreement is in reference to Mingo Creek Park Road Maintenance. Solicitor Capano
stated that said Agreement is based on the Agreement which was entered into by the same two
(2) parties on August 3, 1970, except for certain provisions under which were read by Solicitor
Capano.
Moved by Mr. Jones, seconded by Mr. Paluso, that the Agreement between The
Nottingham Township Supervisors and the County of Washington be approved and entered into
by the Washington County Commissioners with the new provisions as read by County Solicitor
Capano; and that the Chairman of the Board, Michael R. Flynn, be authorized to execute said
Agreement on behalf of the County. Said action based upon the recommendation of the County
Solicitor.

Tenaglia, Bridge Engineer, received a communication regarding the Smith Township

apano stated that it was learned that this is a privately -owned bridge and not a County bridge;
efore the County cannot take any action on this matter.
County Solicitor Capano informed the Board that a communication was received
