PALUSO, COMMISSIONERS E 1 �l Minute No. 17 Office of the County Commissioners Washington, Pa., April 20, 1972 The Board of County Commissioners met in regular session with the following members being present: Commissioner Jones, Paluso, and Flynn. Also present being: Chie Clerk Murphy; Administrative Assistant Whalen; County Solicitor Capano; Assistant County Solicitor Hormell; Mr. John D. Anthony - Director of the Washington County Planning Commi s- ion; Mr. Clay Graham - Land Acquisition Agent for the County; Reporter Budinger of the Observer -Reporter; Reporter Roule of the Monongahela Publishing Company; Reporter Liesch of the Brownsville Telegraph; and Public Information Officer Huber. Meeting called to order by Chairman and roll call taken: Mr. Jones - Present; Mr, Paluso - Present; Mr. Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 16, each member having received a copy. Moved by Mr. Paluso, seconded by Mr. Jones, that Minute No. 16 be approved, as read. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Report: Mr. John Anthony - Re: Sewerage Facilities Plan Mr. Anthony reported on the Sewerage Facilities Plan, the result of a four year study by the Planning Commission which will benefit approximately 35 municipalities in the County. Mr, Anthony stated that in drawing up this plan the Commission is trying to accomplish the following: (1) To protect the streams in the County from various types of pollution; (2) Prevent and alleviate public health problems; (3) Develop a sewerage system that could be provided at the lowest cost regardless of municipal boundaries; (4) Utilize and expand existing sewerage systems where possible; (5) Coordinate the development of water lines and water systems; (6) Promote good land use practice by encouraging new develop- ments in areas which are closest to existing sewerage systems; (7) To foster cooperation between local municipalities in the development of systems; and (8) To coordinate the plans of the municipalities with those of all other responsible bodies. Mr. Anthony briefly reviewe each part of the plan and stated that although the Planning Commission feels that this is the best possible plan at this time, they recognize that there are problems that will occur in the future which they cannot anticipate and that the plans are subject to change. In conclusion Mr. Anthony requested that the Commissioners adopt the Sewerage Facilities Plan. A brief as -No BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. Mr. Flynn: The Chairman recommends in view of the fact that the results of the study of the Sewerage Facilities Plan under the requirements of the Sewerage Facilities Act that the Planning Commission recommend to this Board of Commissioners unanimously that we adopt this plan as presented, I would recommend we concur in their thinking and I would further suggest that in view of the fact that we have made provisions in our budget for a feasibility study, that we suggest to the Planning Commission that at some future date that they recomm- end to this Board of Commissioners a firm who they think would meet the necessary require- ments to make this study. I think the Planning Commission would be in a better position to recommend an engineering firm. Moved by Mr. Paluso, seconded by Mr. Flynn that the Board of Commiss ioners accept the Sewerage Facilities Plan as presented by the Planning Commission after their four year study, and also that they make recommendations to the Board as soon as possible of the next logical step which is a feasibility study of a, creation of a, county -wide authority. Old Business: Approval of Loan Mr, Flynn stated that some time ago Mr. Capano was authorized to obtain official certification from the Department of Community Affairs in reference to the borrowing of $1, 700, 000. 00 under the Municipal Borrowing Act for the Capital Improvements Program for the County. Official certification was received, Mr. Capano informed the Board, under date of April 3, 1972, and the Commissioners were advised to proceed with the borrowing. Mr. Flynn also stated that Mr. Whalen and Mr. Capano were authorized to contact the var banks and request them to submit quotes on their interest rates for a loan in said amount. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the borrowing of $1, 700, 000.00 for the Capital Improvement Program for Washington County for 1972. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Capano stated that the lowest quote received was from Pittsburgh National Bank in the amount of 2, 60% and recommended that the Board accept this quote. Moved by Mr. Jones, seconded by Mr. Paluso, that the Resolution in connection with the borrowing of $1, 700, 000. 00 for the Capital Improvement Program for County as°prepared by Solicitor. Motion carried unanimously. Correspondence: Mr. Murphy Bills: Chief Clerk informed the Board of the receipt of the following checks: 1. Ck. #65-0951049 in the amount of $1, 520. 86 for final payment of 1971 Grant for Community Organizer - Services for Aging 2, Ck. #85 received from Jefferson Township in the amount of $1, 847. 46 for 50% of the costs for the Clarksville Foot Bridge Moved by Mr. Jones, seconded by Mr. Paluso, approving the payment of the following bills: 1. Gene P. Amanati - $100.00 for Conference and Court Testimony Re: Tax Assessment (Approved by G.H. Fetherlin, Chief Assessor) 2. Donald E. Chief Clerk presented correspondence under date of April 13, 1972 from Robert P. De Lotto, Chairman, Southwestern Pennsylvania Regional Planning Commission requesting that the County remit to the Commission as early as feasible the sum of $12, 807. which includes the January payment of $8, 538. 50 requested in the Commission's letter of December 9, 1971, and the sum of $4, 269. 20 which covers the County's second payment to- ward its share of the Commission's estimated expenses during the current year. Moved by Mr. Jones, seconded by Mr. Paluso approving the budget request of the Southwestern Pennsylvania Regional Planning Commission in the amount of $12, 807. 70. Chief Clerk presented correspondence under date of April 18, 1972, from Mr. Wm. R. B. Froehlich, Executive Director of the Southwestern Pennsylvania Regional Planning Commission directed to Mr, James H. Mifflin, District Engineer, Pennsylvania Department of Transportation, District 12-0 concerning three (3) highway projects sub- mittedto the Commission by District 12-0. These are L. R. No. 108, Section DO1, L. R. 62018, Section 01S, and L.R. 242, Section 01S, located in North Strabane Twp, and Canonsburg Borough, directly outside the Canonsburg Borough Limits in a north-easterly direction; Washington County--Deemston Borough ,one mile south of the intersection of L.R. 62176; and Washington County --Middletown Borough, from T.R. 388 to L.R. 62022 of West Middletown Borough. Mr, Froehlich recommended that Penn Dot proceed with the development of these projects so as to make needed improvements to the highway network in Washington County. Chief Clerk read correspondence under date of April 12, 1972, from Michael George, Director, Department of Parks & Recreation stating that he has received several requests from farmers in the vicinity of Cross Creek County Park interested in leasitig county land for hay removal and planting. Mr. George stated that he has prepared a plan for the subject land which is based on the needs and capabilities of the interested farmers and feels that it would be beneficial to the County to lease the land in order to control the growth of vegetation. If approved, Mr. George stated that necessary lease agreements should be prepared for each farmer and presented a list of 5 requirements which must be included in the leases. Mr. Capano stated that the leasing of this land ha,s been done before and recommended that the same procedure be followed as has been in the past. Moved by Mr. Jones, seconded by Mr. Paluso, approving the leasing of count land in the vicinity of Cross Creek County Park to the interest farmers mentioned for the purpose of hay removal and planting in accordance with the provisions set forth in their lease. Chief Clerk read correspondence under date of April 17, 1972, from Miss Louise Abel, Executive Director, Child Welfare Services concerning the placement of two MINUTE BOOK 149 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR , EDWARD M. PALUSO. COMMISSIONERS children in a, foster home in Chambersburg, Pa. The arrangements for this placement were made with Tressler Social Services, York County, Pennsylvania, to place the children on April 17, 1972. Miss Abel stated that foster care payments will be paid to Tressler until another adoptive home is found as this will only be a temporary arrangement. Moved by Mr. Paluso, seconded by Mr. Jones, approving this placement and the foster care payments to be paid to Tressler Social. Services, 150 S. Duke Street, York County, Pennsylvania. Roll call vote taken: Mr. Jones - Yes; Mr.. Paluso - Yes; Mr. Flynn. - Yes. Motion carried unanimously. Messrs. Anthony and Graham left the meeting. Chief Clerk read ,correspondence under date of April 17, 1972, from the Claysville Sixth Grade, McGuffey School District thanking the Commissioners and everyone who made it possible for their class to have such a fascinating and informative trip to Mingo Creek County Park. Chief Clerk read correspondence under date of April 17, 1972, from John H. Showalter, Administrator, Washington County Home for Aged Women addressed to Mr. Whalen advising him that he has received word from Harrisburg stating that the nursing care rate for the two homes will be $400. 00 per month. Mr. Flynn stated that the Commissioners have to establish this figure in order that we get rightfully reimbursed from the state. Moved by Mr. Paluso, seconded by Mr. Jones, approving the nursing care rate of $400. 00 for the Washington County Home for Aged Women and Washington County Home and Hospital for Men. Mr. Whalen: Mr. Whalen reported that on Wednesday, April 19,--he talked with the Architect, Carl G. Baker & Associates, and they are underway on Phase I of the County Home renova- tions Mrla Whalen reported that the Environmental Resources Board notified Floyd Laubham of the Planning Commission that the Bologna Coal Company is going to have a hearing before the Board presumably regarding a renewal of their permit for strip ruining in the Cross Creek County Park area. PALUSO, COMMISSIONERS hearing and present to the Board their objections to the re -issuance of'their permit. Mr. Whalen stated that he discussed the matter over with the Chairman of the Planning Commiss ion, Mr, John Merdian, and was advised by him that it would be the recommendation of the Planning Commission that the Commissioners did voice their objections in this particular matter. Mr. Whalen further ,stated that up to this time no date for the hearing has been received but it will be in Harrisburg, The Board was in agreement that a representative would be present at the hearing to show the position of the County in this matter. Mr, Capano - Investment of Money Moved by Mr. Paluso, seconded by Mr,. Jones, authorizing Administrative Assistant Whalen, in conjunction with the Board of County Commissioners, to invest the amount of $1, 700, 000. 00 in the Pittsburgh National Bank as subscribed by law. Motion made upon the recommendation of County Solicitor Capano. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Murphy re-entered the meeting. Mr. Hormell: Mr. Hormell presented to the Board an Opinion handed down in an Assessment Appeal case involving the Ch-arleroi Federal Savings & Loan Association. Mr. Hormell called the Commissioners' attention to the fact that they are under a, court order to take another look at their assessment system due to the fact that the percentage of their assessment doesn't reach 30% in most cases. This is,the first case to come up of this type although more cases are anticipated. At the present time the Assessment Board is engaged in a massive project to try to correct this situation. Mr. Hormell further stated that as a result of this Assessment Appeal, the Court has sustained a 300% increase in the assessment of land values. The Board for Assessment Appeals recommends a 600% increas�, and Mr. Hormell and Mr. Capano feel that the opinions of the Assessment Board and the Chief Assessor should be given serious consideration by the Board as to whether or not - the Commissioners want to appeal this further. Mr. Hormell therefore requested that the Board meet in an executive session to determine as to whether they would like to appeal this case and to go over the amounts involved in the case. It was agreed upon by the Board that the above matter would be held in abeyance. Mr. Hormell presented to the Board two suits in connection with the Charlero Federal Savings & Loan Association assessment appeal whereby Ben Richman is suing the County of Washington, South Strabane Township and the Trinity School District and Ben Richman and several others are suing the County for interest in assessment appeals which MINUTE BOOK 151 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. As a result of those appeals, the court had ordered reductions and they had been paid their principal refund but want interest on their money. Mr. Hormell stated that this is not an open and shut case and requested that the Board direct the legal department to contest this action, file a defense to it, and take it to court to let them decide what the county's obligations are as far as paying the interest. Mr. Flynn: The Chair recommends we authorize our legal staff to proceed with the necess legal procedure. A discussion was then held by the Board and in answer to a question raised by Commissioner Paluso of what is involved in this matter, Mr. Hormell stated that in one complaint the pro- perty is known as the Washington Mall Shopping Center; and in the other, the property is known as the Washington Manor. Mr. Hormell further stated that money wise, the amount could not be determined since they are asking for interest upon interest. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing County Solicitor Capano and Assistant County Solicitor Hormell to take the necessary legal action in the ab mentioned cases. Ter Parade Chairman, which stated.that the Canonsburg Fourth of July Committee and the Canonsburg Jaycees would like to invite the Commissioners to participate in this year's F of July Parade, which is being held on Tuesday, July 4, 1972, at 10:00 a, m. Mr. Flynn: I suggest that we acknowledge this letter and accept this invitation. Unless some- thing unforseen should happen, we will be there. Chief Clerk read correspondence under date of April 20, 1972, from Carl G. Baker and Associates, RE: Washington County Courthouse,Air Conditioning. Correspondence was in reply to our request for clarification of said company's decision to have the two (2) air conditioning units and systems now installed in the Commissioners' office areas remain. PALUSO, COMMISSIONERS r� 1 J during the early spring and late fall seasons when cooling would be desired in these offices, yet it would not be desirable to operate the large cooling system and air condition a major portion of the Courthouse. Correspondence further stated that other reasoing for this decision was based also on the fact that, in the event of a failure of the main systems, there would al- ways be cooling available for the Commissioners' offices. Based upon the two (2) foregoing decisions, it was felt that some contract costs could be saved by eliminating the work required to remove this air conditioning equipment. Chief Clerk read correspondence under date of April 21, 1972, from Penn Plastic Company, Inc., which requested a meeting to discuss right of way for a waterline with rights for County to tap off the line. The location is the adjacent property north of the airport. Mr. Flynn: I suggest that we acknowledge receipt of this letter and make arrangements for a meeting and include Mr. Yuhas in this meeting. Mr. Anthony asked if it could be possible for the Planning Commission to also be involved in this meeting. Chairman gave his approval. (Floyd Laubham entered the meeting). Chief Clerk read correspondence under date of April 18, 1972, from the Sixth Grade of West Alexander School which thanked the Commissioners for the field trip to Mingo Creek Park that was made possible to them, Chief Clerk informed the Board of several letters received regarding environmen- tal control and pollution. Chief Clerk read a Press Release regarding legislation approved by the House of Representatives Committee on Ways and Means which would provide Pennsylvania and its com- munities with $300. 9 million this year. Copy of said Press Release can be found on page 6-A. Chief Clerk read a News Release under date of April 26, 1972, stating that Charles O. Bohner, Executive Director, Washington County Civil Defense, announces that an Auxiliary Police Class will be held at the old Washington City Police Station, West Cherry & Brownson Avenue, Washington, starting Thursday night, May 4th. The class is a 20-hour course and will run from 7:00 p, m, to 10:00 p. m, , May 4, 8, 11, 15, 18, 22, and 25th, Correspondence stated that the instructor for the course will be Mr. Jerome N. McCavitt, a former Sergeant with the State Police and a former County Detective. Also assisting with the course will be Chief of Police William Flood, Canonsburg Police Department. The course is open to males, 21 years of age or over, and never having been convicted of a criminal offense. PALUSO, COMMISSIONERS Chief Clerk read correspondence under date of April 21, 1972, from Keery McAm- bley, Director, Washington County Industrial Development Agency, which attached an Agree- ment for a gas line right-of-way over County property for execution. Correspondence stated that the gas line, to be installed by the Columbia Gas Company, will serve a new industry which is locating on a site across Chartiers Creek opposite a portion of the "Brad Williams" property which was purchased by the County. Correspondence stated that the new industry, Superior Concrete Products Company, is owned by McAnallen Brothers Construction Com- pany and will produce concrete block products. Moved by Mr. Paluso, seconded by Mr. Jones, that the County of Washington grant the right-of-way and that all three members of the Board approve and execute said Agreem as per above; said motion based on the recommendation of the County Solicitor. Mr. Whalen Mr. Whalen read an Order regarding the matter of Bologna Mining Company which stated that the County Commissioners of Washington County be notified of the application of the Bologna Mining Company for a mine drainage permit no. 2668BSM4 and that the Commis- sioners of Washington County shall be given the opportunity to request an appeal and to be heard on the aforesaid application. Said Order further stated that the Commissioners shall file anotice of appeal to the issuance of the aforementioned permit in the form attached on or before May 5, 1972, and shall also have an opportunity to take and file exceptions to the pro- posed adjudication of the Honorable Jack C. Sheffler. Moved by Mr. Jones, seconded by Mr. Paluso, that the Commissioners of Washing- ton County file a notice of appeal to the issuance of the aforementioned permit with the En- vironmental Hearing Board. New Business: Mr. Paluso: On Election night, the last ballot box came in at approximately 10:00 a.m. The same old story every Election! And to make it bad we had a close race that might have de- pended - in fact, did depend on this particular ballot box arriving. We still don't know the results. These people really did work hard and fast, but there is no way on earth that we can continue this system. This is the twentieth century, and we have to get updated and we have to get some voting machines. I made a few checks to see what the differences were. At 9:45 I called the radio station and asked them if they had the complete results from Westmore- land County, and they had them. They had broadcasted them at, I think, 9:30, and we hadn't even got started. If we are going to continue this system, we can't afford to pay these people below federal standards for one thing. I think we have to get moving on the voting,machines for another thing. I have to commend the people down there working, but there is no way we cancontinue this system. Mr. Flynn; Your point is very well taken, Mr. Paluso: I might add my comment, "Here we go again. " I would also like to request an executive meeting prior to the Salary Board meeting, with your permission Mr. Chairman, to discuss another matter that I think should be discussed. Morgan announced today that legislation approved last week by the House of Representatives Committee on Ways and Means would provide Pennsylvania and its communities with $300. 9 million this year. According to provisions of the State and Local Government Fiscal Assistance Act of 1972, Pennsylvania's state government will receive $98. 4 million, while $202. 5 million will go directly to local government units within Pennsylvania. The Act was approved April 17 by the House Committee on Ways and Means. It is expected that the entire House will vote on the bill in early May. The committee's version of the bill authorizes a five-year program which appro- priates a total of $5. 3 billion to state and local governments during its first full year. During the first year, the committee's proposal allocates $1. 8 billion to state governments on the basis of tax effort, A total of $3. 5 billion is distributed to local government units according to need as determined by population, urbanized population and relative per capita income. The Act provides virtually every city, county, village, town and township in the country with fiscal assistance. The proposed legislation places no restrictions on state government spend ing, but requires that local units channel funds into law enforcement, transportation and environmental protection programs.
