Mr. Flynn: Lease Agreements with Fair Board and Harry Harvey Mr. Flynn stated that two (2) lease agreements with the Fair Board and Harry Harvey now in effect expire on June 1, 1972. These leases are for the operation of the Fairgrounds and the Arden racetrack. Mr. Flynn recommended that the Commissioners go on record authorizing the Board to meet with the interested parties involved to negotiate and execute these leases. Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the Board of County Commissioners to meet with the interested persons involved to negotiate and execute the said leases for the operation of the Washington County Fairgrounds and the Arden ra,ce- track. Motion carried unanimously. Chief Clerk read correspondence under date of April 27, 1972, from Mr. Donald A. L azarchik, Director, Bureau of Land Protection and Reclamation notifying the Commissioners of the Department of Environmental Resources' action in reference to ERG's application to surface mine bituminous coal in Mingo Creek Park, Said letter enclosed notifi- cation directed to ERG from Mr, Walter N. Heine, Associate Deputy, Secretary for Mines and Land Protection denying their application. Chief Clerk read correspondence under date of April 27, 1972, from Robert P. Casey, Auditor General enclosing a copy of the audit report of the Liquid Fuels Tax Fund administered by the Commissioners for the period January 1, 1971 to December 31, 1971. A duplicate copy of said audit report will be released to the appropriate news media in the near future. Chief Clerk read correspondence under date of April 25, 1972, from Miss Louise Abel, Executive Director, Child Welfare Services in reference to a meeting which was,I held on March 2, 1972, with the nine directors of the surrounding counties and Mrs. Ruth Richardson, Director of Three Rivers Youth (TRY). Miss Abel stated that the reason for the meeting was to determine if any of the other counties could utilize the services that TRY pro- vides which is group homes for young adolescents who for some reason cannot remain in their own homes. Miss Abel further stated that this service works the same way as the present set -up for Day Care with the County providing 25% and the Federal Government providing 75%. Miss Abel requested the Commissioners feelings about this possibility and their willing ness to participate in the program. Mr. Flynn suggested that Miss Abel come to the next regular board meeting and present this to the Commissioners in more detail. - Chief Clerk read correspondence under date of April 28, 1972, from Miss Louise Abel advising the Commissioners of,the placement of a 4 year old boy they are making this coming week in McKean County. Miss Abel stated that since Kenny is only 4 years old, she feels that it would be in the best interest of the family and the child if her office would take Kenny to his new home. Miss Abel requested the amount of $69.00 for the plane fair since this would be the most economical and the fastest way possible. 162 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Moved by Mr. Jones, seconded by Mr. Paluso approving payment in the amount of $69. 00 to Miss Louise Abel for plane fair in connection with the above mentioned placement. Chief Clerk read correspondence under date of April 28, 1972, from Gandolf T. Interval requesting the use of the baseball field located at Arden for use as a practice field and authority to set up a working schedule to assure everyone who has permis�- ion to play on the field an equal opportunity. Mr. Flynn: I would suggest gentlemen, that we have the gentleman come in and sit down anc talk with out legal department and then take it from there if there is no objections. I don't think it would be wise to take action right now. Let the gentleman come in and talk with Mr. Capano and Mr. Hormell. Chief Clerk read correspondence under dateof April 25, 1972, from Ellen Ruffalo, The Children's School of Washington inviting the Commissioners to visit the school during their open house being held the first week of May. Chief Clerk read correspondence under date of April 25, 1972, from Mr. Norman Monack requesting permission to attend the Commissioners' regular board meeting on June 8, 1972 for the purpose of showing the Board his designs for a f lag for Washington County. Mr. Monack stated that if the Board accepts the design, it could possibly be used in the approaching Bicentennial Celebration. Mr. Flynn: I would like to suggest that the gentleman be invited to come into our meeting aE he requested on June 8 to make his presentation. I think the public should be aware of this because there is going to be different organizations, patriotic organizations, historical organizations who may want to comment and then I would suggest that after he does make his presentation that we have our legal department here look into the possibility. Chief Clerk read correspondence under date of May 4, 1972, from Mrs. Shirley Pierchalski, Secretary, North Strabane Township Board of Supervisors informing the Commissioners that North Strabane Township received a first place award in the State Association of Township Supervisors "Report to the People" contest this year. Correspond- ence stated that this is the second time the Board of Supervisors has received an award for their brochure to their citizens and enclosed copies of the brochure and a newspaper clippin€ of the article that appeared in the Daily Notes on April 28, 1972. Mr. Whalen: Mingo Creek Park �1 11 Mr. Whalen stated that in connection with the development program at the park under the Commonwealth Conservation Account, some time ago plans were submitted MINUTE BOOK 1.63, BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS E 1 the Board for their approval; however; these particular plans contained quite a few discrepan- cies and in the meantime the plans have now been re -submitted to the Department of Communi Affairs in Harrisburg. Mr. Whalen further stated that the plans will not be submitted to the Commissioners for their approval until such time as the Department of Community Affairs has finalized its approval on them. This should be within the next ten days or two 'weeks. Mr. Whalen presented to the Commissioners a bill under date of February 18, 1972 in the amount of $422, 00 from William N. Anderson. Said bill is for bore hole testings which the Commissioners authorized as part of the opposition to the E.R.G. strip mine permit application adjacent to Mingo Creek County Park. Mr, Whalen recommended tha the bill be approved for payment. Moved by Mr. Jones, seconded by Mr. Paluso, approving the payment of the foregoing bill in the amount of $422, 00 to William N. Anderson in connection with the str mine permit application by E. R. G. , Inc. Roll call vote taken: Mr. Jones- Yes; Mr. Pa.luso - Yes; Mr. Flynn - Yes. Motion carried unanimously. New Business: Mr. Whalen Elevator Replacement Mr. Whalen: The replacing of the Courthouse Elevator is a part of the Capital Budget for 1972 at an estimated cost of $50, 000. 00. I would recommend that the Board authorize Carl G. Baker and Associates, Architects and Engineers to proceed with the plans and specifica,- tions so that this can be properly advertised. Moved by Mr. Jones, seconded by Mr. Paluso authorizing Carl G. Baker and Associates, Architects and Engineers to proceed with plans and specifications in connec- tion with the replacement of the Courthouse Elevator. Budget Item: Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Mr. Whalen gave a background report on the Fiscal, accounting and responsibi lity in regards to the County Budget. Said report stated the main function of the County Budge and reviewed the voting procedure in various salary matters.' (copy of said report, memoranium under date of April 3, 1972 directed to Controller Elish, and letter under date of April 3, 1972 directed to Treasurer Morgan may be found on pages 7a through 7e). 1 a MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Re: Fiscal accounting and responsibility County Budgets are prepared by the Fiscal officers of the County, desig- nation of Fiscal officers is limited to the Board of County Commissioners, three in number. (16 P. S. 501, Aug. 9, P. L. 323 and 16 P. S. 1701, 1955, Aug. 9, P. L. 323, ) The 1972 Washington County Budget was prepared by and adopted by the duly designated Fiscal officers of the County on December 30, 1971, , On January 3, 1972 the present Fiscal officers were sworn in and immedia tely assumed the Fiscal responsibility for the County. On January 13, 1972, at the regular meeting per Minute #3, Chairman Flyr informed the Board that the 1972 Budget must be submitted to the Pennsylvania Department of Community Affairs at this time, however he stated that should a majority of the Board wis to review and or revise the Budget that such was their peroga,tive. No action was proposed or taken in this regard and therefore the 1972 County Budget became the responsibility of the present Board of County Commissioners as the Fiscal, officers for the County. One of the main functions of the County Budget is to control expenditures during the particular fiscal period and the expenses for such period cannot be in excess of the amount appropriated by the County Commissioners; otherwise the Commissioners are liable to surcharge (9. P. L.E, 401; Comm vs. Rankin, 1945, 158 Pa. Super. 12) The question arises here in connection with the powers of the County Salary Board, The County Salary Board is composed of the three County Commissioners and the County Controller, except that when salary matters involving another elected official are considered, the elected official becomes a part of the Salary Board for matters con- cerning his own particular office. Therefore in salary matters involving the various Commissioner offices and the County Controller's office, there are four (4) members of this Salary Board; when another elected official is involved, the Salary Board is composed of five (5) members. In the first instance the Board is composed of three (3) fiscal officers and one (1) non -fiscal officer. In the second instance the Salary Board composition is three (3) fiscal officers and two (2) non -fiscal officers. This points up a serious fiscal problem. With a. four (4) member Salary Board a majority of fiscal officers, two (2) in number cannot be outvoted by one (1) fiscal officer and one (1) non -fiscal officer. However in the case of the five (5) member board a majority of fiscal officers, two (2) in number can be out -voted by one (1) fiscal officer and two (2) non -fiscal officers. Therefore action by a Salary Board composed of five (5) members with one (1) fiscal officer and two (2) non -fiscal officers voting affirmatively and two (2) fiscal officers voting negative for an expenditure of funds not included in a particular budget, would by statute, place the three (3) fiscal officers in a precarious position as being subject to sur- charge. (9 P. L. E., 401; Comm, of Pa, vs. Rankin, 1945, 158 Pa, Super. 12) The fiscal officers of this County are now in this position as a result of Salary Board action taken on March 30, 1972 in connection with the County Treasurer's office Excerpts of these Salary Board minutes are attached. In this case, Mr. Paluso, a fiscal officer, joined with non -fiscal officers Controller Elish and Treasurer Morgan to approve salary increases not appropriated in the Treasurer's Budget over the objections of fiscal officers Flynn and Jones, who represent a majority as far as fiscal officers are concerned. In a comparison of powers it is not at all reasonable to assume that an action by a Salary Board would supersede, in power, an action in Mandamus. Fiscal officers where there is no money in the Treasury applicable to a particular purpose, will not be com- pelled by Mandamus to draw thereon. (9 P. L.E. 403) It is also to be noted at this time that both Mr. Morgan and Controller Elish were giv en due notice of this budget matter on April 3, 1972 - copies attached. It is recommended'that the fiscal officers direct the Treasurer forewith that he, the Treasurer, take immediate steps to being his salary expenditures in Budget Account 107-1-3 into full compliance with the total budgeted amount of $53, 594. 00 for the entire year of 1972. 1 MINUTE BOOK 165 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Whalen, Administrative Assistant TO: Peter Elish - County Controller April 3, 1972 SUBJECT: Treasurer's Office Budget - 1972 I am attaching a, copy of a letter to Mr. Morgan relative to the above - captioned matter. Considering your position and obligations as County Controller, I cannot understand your self justification in voting to expend funds which are not a part of a particular budget, FDW/cc Attachment /s/ F.D. Whalen April 3, 1972 ' Mr. Malcolm L. Morgan - County Treasurer Washington County Courthouse Washington, Pennsylvania 15301 In re: 1972 Budget - Treasurer's Office Dear Mr. Morgan: Under date of November 24, 1971, you met with the Board of County Commissioners and was involved in a detailed review of your proposed operating budget for 1972. At that time salary schedules for all employees were reviewed in detail and it was mutually agreed by all present that all employees would receive one increment of salar, adjustment effective December 27, 1971, which would cover the entire year of 1972. Also, one employee was to be eliminated from your regular employee schedule. These adjustments were reflected into your budget Account #107-1-3 in adjusted amount of $53, 594.00. The 1972 Budget was subsequently adopted on December 30, 1971, and you were furnished a copy of the adopted budget for your office. We must assume that you had no objections since we have no record of any objections recorded. The increases for Mrs. Oberst and Mrs. Solomon which were passed by the Salary Board on March 30, 1972, retroactive to January 24, 1972, will total $1152.00 for the balance of 1972, the employee being carried in excess of the budget will amount to $3913, 00. This will make a, total of $5, 065, 00 in excess of your budget for this account and this fact is a part of the Salary Board record for March 30, 1972. In accordance With my memorandum dated March 2, 1972, your budget was adjusted to a total of $93, 701. 00 due to postage on the 1972 Tax Notices being charged direct to the County postage account #114 -D-Z in the amount of $6800.00 Kindly advise your recommendations for budgetary transfers within your Treasurer's Office Budget and account for the overage of $5065.00 in Sub -Account #107-1-3. PALUSO, COMMISSIONERS Mr. Flynn- At the conclusion of the Salary Board Meeting that was mentioned in this brief presented by Mr. Whalen, I directed the gentleman to do some research and look into the matter here insofar as the responsibilities of the various offices. As a member of the pre- vious Board of Commissioners, knowing what took place insofar as the hearings were con- cerned with the various offices & knowing what the budget contained insofar as appropriations and maintenance of the various offices the question in my mind is -- how can you spend money when you don't have it? In view of the fact that we are the ones responsible; now its a matter of, record and its a matter of knowledge with the gentleman in question, the office in question rather, the Treasurer's Office that at the hearing one employee was deleted entirely from the budget and so it reflects in the final adoption of the budget yet we turn around and grant in- creases to people on the payroll and we still retain the one member on the payroll and the question I would like to have resolved is how do we intend to pay these people? Because it is quite evident that in looking at the budget that there is no money in there. Now the question again that I want resolved is -- Who is responsible here? If we are to be the fiscal officers and the responsible people in this county, the responsible officers, then certainly we must have something to say insofar as the expenditure of money is concerned.. Or that brings up another point -- What happens Mr. office holder when you run out of money? What do you do, shut down the operation of your office? There is only one way you turn to and thats the County Commissioners. And what if there is no money available to make the supplemental appropria- tion, what do you do? Now this is not being picky here, this is a very serious matter and its time its been resolved. Just where do we stand? Now certainly I am going, to be responsible as a majority member and you gentlemen as members of this board, you Mr. Jones as a ma- jority member and Mr. Paluso as the minority member and certainly we must have something to say insofar as expenditures. And thats all I ask you gentlemen. All we can say in the final analysis, I am directing Mr. Whalen to follow through on this and ask the Treasurer to tell us what he intends to do and how he intends to do it. Thats all we're asking. Mr. Jones: How close money -wise is he to it? Mr. Whalen: Well, the ,increases that were granted plus the extra person on the payroll ex- ceeds $5, 000. 00. Mr. Whalen then read correspondence under date of April 3, 1972, directe to Mr. Morgan with a copy of said correspondence being sent to Controller Elish. Mr. Flynn: To bring ;you back to the point again, we the Fiscal Officers and its our responsi- bility, if some people think it isn't necessary, I think it is and so therefore I am suggesting, or I am directing you sir to follow through with this and just ask Mr. Morgan to comply with the budget. I don't think there will be any objections to that. Mr. Paluso: Since this wasn't covered in the agenda meeting, there was nothing brought up n u F about this at all, I assume this was done after the agenda meeting so I would like to read that over myself and reserve any comments I might have until I have had the same opportunity to MINUTE BOOK 167 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Said leases are for tracts of land owned by the County to be leased to interested farmers in the area for hay removal and planting. Each farmer is required to put up a cash forfeiture for operations and is allowed to use the land only during the farming season. Said motion based on the recommendation of Solicitor Capano. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Solicitor Capano presented to the Board an Agreement for purchase of service from e Pauline Auberle Foundation in reference to James Harvey Brown who was placed in the the Court. Said agreement stated the services rendered by the home and under what condi- tions they accept the child. The County is obligated to pay the bill which is in the amount of $16. 00 per day until further order of the Court with the parents of the child to reimburse the County in the amount of $100. 00 per month for the maintenance of the child. Moved by Mr. Jones, seconded by Mr. Paluso that the County enter into the above agreement with the Pauline Auberle Foundation and that the Chairman of the Board be author- ed to acute said agreement. Mr. Hormell: Mr. Hormell informed the Board that Preliminary Objections have been filed in the case where Mr. Richman and Mr. Cohen want interest on their money. It refers to our Association's attemtp to find 50, 00 retarded children in the state who have never been received or admitted to school programs in the state. So that is why I came here this morning - to seek your support if possible and make 1 [J 11 you aware that this is what we are going to be doing. This basically is what I have to say. I can give you a little background on this. A Court Order signed in Harrisburg by a three - panel member of judges guaranteed the right to education for all retarded children between the ages of 6 and 21. This was signed in October of 1971; and the Court Order stipulated that these children be found and by September 1, 1972, school districts can be ready to receive them and have programs for them. There hasn't been a lot done to find these children, and we are trying to do our best to find them throughout the state. It is a state-wide effort, and I felt it was necessary for you to know what we are intending in Washington County. Pat Huber entered the meeting. Mr. Tony Franconari left the meeting. Mr. Bard Jud - Kings Creek Watershed Agreements Mr. Judy: You will recall sometime ago the Commissioners passed a resolution supporting the Kings Creek Watershed. This is an application for planning. This will go through all the spon- sors and then will be sent to the State Soil and Water Conservation Commission. Then it will go to Secretary Butts for his approval. After his approval, the Soil Conservation Service will prppare a flood control plan. This calls for two (2) structures - one in Pennsylvania and one in West Virginia. This does not bind you; this is just your approval for an application for plan- ning assistance. Mr. Hormell entered the meeting. Motion carried unanimously. Miss Louise Abel - TRY Program Miss Abel: I am here just to ask if you would be at all interested. I sent a letter up on April 25 just to give you a little of background about this. TRY is Three Rivers Yough. They have set up three homes in Pittsburgh for adolescents that can not remain in their own homes. The Region has found out that they could purchase group homes for the County. The Region and TRY would like to know if the County would be at all receptive to the possibility of a "group home" in Washington County; or it was suggested that two counties could go together and that would, of course, be Washington and Greene. The community would have to be receptive to this as these homes would be in the community. The second thing you would have to know is the zoning. The idea is that you either rent a home or purchase a home right in the community, and this home would be used for teenagers. There could be no more than eight. Example, land now being stripped - Dry Tavern to Jefferson. 2 - Transportation of coal in 20 TON trucks on narrow 20 ft. wide township and secondary State roads (rt. 88) causing mud - slate - dust continually on the above roads which many residents travel each day to and from work. Many school buses use these roads during the school term. The run off of mud and slate will drain into TEN MILE CREEK causing pollution �of the fishing areas. 3 - The dumping of coal will ruin the Millsboro water front for swimming area for the resi- dents and the coal dust on the river will cause additional pollution in the drinking water drawn from the river for Fredericktown a mile north. 4 - Residents of Millsboro and the boats (60) will be subject the coal dust continually and the homes will not be able to open their windows in the summer season, children with an allergy will suffer from the dust. The E. Bethlehem Township Commissioners must rea- lize that this dumping of coal will be within 40 to 80 ft. of residential property. The Boat :docks of Engle's Holiday Harbor will be within 400 ft. of this proposed operation and peopl( do live on their boats during the 6 months of boating season. 5 - Proposal of dams on top of hill at the Sandy Plains area above the town of Clarksville to hold strip drainage acid will cause a dangerous hazard above the residents of the city. A break in a dam will cause loss of life and property. Overflow of these dams will drain into TEN MILE Creek and will kill the stocked fish and pollute the drinking water. (Example - Southern West Virginia disaster, over 80 loss of life. ) 6 - We ask the ENVIRONMENTAL RESOURCES to inspect these areas and act favorable towar the citizens that will suffer from this project. We have pollution in our water and air now why add to it in this area. 7 - Please SIGN THIS PETITION TO SIGNIFY THAT YOU ARE NOT IN FAVOR OF THIS COAL STRIPING AND DUST AND DIRT IN THE E. PALUSO, COMMISSIONERS Mr. Jones - Report on mine subsidence in New Eagle Mr. Jones reported to the Board on a mine subsidence which occurred in the B of New Eagle on May 7,- 1972. Four (4) homes were involved in the subsidence which resulted in extensive damage to the homes such as cracked foundations, porches and steps being pulled away, and broken gas and water lines. Also, approximately 300 feet of borough road was damaged by the subsidence. Mr. Jones stated that along with making an inspection of the area himself, he contacted ._iMr. DeMedio who is the representative in that area and also directed a letter to the Director of the State Bureau of Mines requesting help. Mr. Jones further stated that the Borough Officials in New Eagle are ready to prepare the necessary resolution when the state does come in to correc the problem. Solicitor: Mr. Capano (Tax Refund) Solicitor Capano presented a Tax Refund to the Board for their consideration and approval in the event that the refund is in order after further perusal. Moved by Mr. Jones, seconded by Mr. Paluso, that the Tax Assessment Office be authorized to prepare the following tax refund due to either duplication or overpayment of real Iestate tax in the event that the refund is in order after further perusal by Solicitor Capano. 1. RE: Markle, Edward C. & Mary North Strabane Township Refund is being requested in re the above -captioned taxpayer for over -payment of 1972 county tax. Tax on Lot 3 was paid on February 4, 1972, and payment was duplicated on February 22, 1972. Attached find Xerox copy showing both payments. Kindly forward refund check in the amount of $6. 16 to EDWARD C. & MARY MARKLE, Box 168C, R. D. 2, Canonsburg, Pa. 15317. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Engle, _promising to pay to the order of Washington County, the sum of $2, 000. 00 on the 90th day after the execution of said Promissory Note or within ten (10) days after the closing of any sale of the Steamboat Clairton.
