The Board of County Commissioners met in regular session with the following
members being present: Commissioners Paluso and Flynn. Absent being: Commissioner
Jones, who was in Harrisburg on business. Also present being: Administrative Assistant
Whalen; County Solicitor Capano; Assistant County Solicitor HorrAbll; John Anthony - Executive
Director - Washington County Planning Commission; Clay Graham - Washington County Plan-
ning Commission; Mike George - Director - Department of Parks and Recreation; Reporter
Robertson of The Observer -Reporter; Reporter Roule of The Monongahela Publishing Company;
and Reporter Liesch of The Brownsville Telegraph.
Meeting called to order by Chairman and roll call taken:

Chairman asked if there were any corrections, additions, or omissions to Minute
No. 21, each Commissioner having received a copy.

Reports: John Anthony - Strip Proposal - East Bethlehem Township
Mr. John Anthony from the Washington County Planning Commission gave a report
on the Strip Proposal - East Bethlehem Township. Copy of said report may be found on page
1-A. (A discussion was held on this subject).
Correspondence: Mr. Whalen acting in place of Chief Clerk Murphy
Administrative Assistant Whalen informed the Board of a Court Order received
from the Honorable Judges Alexander R. Curran and Thomas D. Gladden - IN RE: Opening
Ballot Box in the Fifth Precinct of the Township of Canton, Washington County, Pennsylvania.
Said Court Order stated as follows:
" AND NOW, this 22nd day of May, 1972, it appearing that a Petition to open the
ballot box to recount the votes for office of Democratic Committeewoman in and for the 5th
Precinct of Canton Township, Washington County, Pennsylvania, was presented to the Court
and that by order of this Court dated May 5, 1972, Eugene J. Julian, Theresa Gergitch and
Joan Douglas were appointed and designated to open said ballot box and to count the entire vote;
and it further appearing that said petition and order were duly and timely filed in the Office of
the Prothonotary on May 5, 1972; and it further appearing that through clerical inadvertence
the Office of the Prothonotary did not notify either the Recount Board, the Director of Election:
or either of the candidates of the filing of the petition and order; and it further appearing that
the County Return Board has certified the results of said election but that no election certificat
has as yet issued for said office, it is hereby ordered that the Recount Board heretofore appoir
to wit, Eugene J. Julian, Theresa Gergitch, and Joan Douglas, proceed forthwith to count the

entire vote cast in the Democratic Primary Election for the office of Democratic Committee-
woman in the 5th Precinct of Canton Township, after due and proper notice to all interested
parties according to law.
Mr. Flynn: What was the end result? Did they open the ballot box?
Mr, Capano: It was supposed to be done today or yesterday. (More discussion followed on this
matter). Mr. Flynn suggested that the records show that the Washington County Election Board
which is the Commissioners, is not responsible here. They had certified it.
Administrative Assistant Whalen informed the Board of the receipt of the following
checks:
(1) Pittsburgh Regional Planning Association - Ck. #25922 - in the amount of
$2, 541.00 for SPRPC's first payment to Washington County for work undertaken
in the Cooperative Planning Process by County Planning Staff.
(2) Treasurer of the United States - Ck. #82-962-143 - in the amount of $1, 120.00
for account of Sophie Krivonick (Women's Home).
Mr. Whalen read a telegram from Congressman Thomas E. Morgan which announced
the approval of a grant in the amount of $60, 000 to California State College, California, Pa.,
for a headstart training and technical assistance program.
(Budget Items)
Mr. Whalen read correspondence from the Washington -Greene Community Action
Corporation which requested payment of the first and second quarter of this year in the amount
of $10, 000. 00 ($5, 000.00 per quarter) of the 1972 Washington County allocation to said Cor-
poration.
Mr. Whalen read correspondence under date of May 22, 1972, from Engineered
Communications, Inc., ,which attached a copy of the RCA order pertaining to radio equipment
ordered to the Midway Volunteer Fire Department. This is in agreement with arangements
made between the Washington County Firemen's Association and the County Commissioners to
purchase, on a matching funds basis, several replacement radio base stations. Correspondence
stated that as per the agreement, the previously mentioned fire department will, after installa-
tion of equipment, submit to our office a check for 50% of the total cost and made out to RCA.
Mr. Whalen read a copy of a letter from Carl G. Baker and Associates directed to
Chapman Plumbing and Heating, Inc. - Subject: Washington County Courthouse Complex.
Correspondence had enclosed shop drawings for the following: Ceiling Fans, Power Roof ven-
tilators & Curbs, and Generator flue curbs. Correspondence listed the following remarks:
"It is understood that the approval of the enclosed drawings does not relieve the Contractor of
the responsibility for any errors which may exist. All changes should be carefully backchecked
and any discrepancies between the corrected shop drawings and the Contract Drawings should
be brought to the attention of this office. Correspondence further stated that checking is only
for conformance with the design concept of the project and compliances with the information

given in the Contract Documents. Contractor is responsible for dimensions to be confirmed
and correlated to the job site; for information that pertains solely to the fabrication processes
or to techniques of construction; and for the coordination of the work of all trades_ (Approval
does not constitute final acceptance and all equipment or apparatus must perform in accor
with Contract Documents. )"
Mr. Whalen read correspondence under date of May 12, 1972, from the
of Environmental Resources which stated that on April 20, 1972, the Environmental Quality
Board adopted amendments to the Rules and Regulations and Standards pursuant to Administra-
tion of the Pennsylvania Sewage Facilities Act, the Act of January 24, 1966, P. L. 1535. Cor-
respondence said that the amended regulations incorporate a number of changes and new ideas
that will have a considerable effect in our municipality. Of special note is Section 71. 71 which
states that: "Limitations shall be placed on the issuance of permits for individual sewage sy-
stems and community sewerage systems in new sections of existing subdivisions and in new
subdivisions where the municipality does not have or fails to revise its official plan. " Further-
more, Section 71. 18 states that: "Where a municipality fails to comply with the implementa-
tion schedule for a public sewerage system proposed in its official plan or revision, the Depart.
ment may suspend the municipality's, county or joint county health department's authority to
issue permits for individual sewage systems or community sewerage systems in that section
of the municipality designated in the implementation schedule. " Correspondence attached a
summary fact sheet emphasizing the major changes in the amended regulations.
Mr. Whalen informed the Board of a note of thanks that Commissioner Jones re-
ceived in regards to his quick action on the New Eagle mine subsidence.
Mr. Whalen: Mingo Creek Park Development
Mr. Whalen: On Wednesday afternoon, Mr. Paluso and I met with Mr. George and two mem-
bers of the consultants of this particular job, and we reviewed the nine (9) items that are invol-
ved in the development project. They are as follows:
1. Site Development
2. Well Drilling
3. Comfort Stables & Picnic Shelters
4. Carnegie Gas Company
5. West Penn Power
6. Bell Telephone
7. Picnic Tables
8. Trash Receptacles
9. Electrical Construction
All of the plans have been approved with the Department of Community Affairs, and they are
now ready to be approved by the Board of County Commissioners so that the proper advertise-
ment can be prepared. Of course, there is nothing binding on the County Commissioners until
such time that the bids have been received. The only other item was one question on Item #9 -
Electrical Construction. The Department of Community Affairs still had a question about an

entrance to all our existing buildings out there. That is being cleared up at the present time.
It is necessary that the cover sheets be signed by the Board so that the consultants can be auth-
orized to prepare the necessary advertising materials.
Mr., Paluso: There are three points that the. Department had raised. They were very minor
things, but they still have to be in writing. One had to do with:the locks on the bathrooms, the
other was the curb on the bridge, and the other was the entrances from where the wires come
out of the ground to hook up to the buildings and pavilions. We told them that we wanted it in
writing and prior to it being advertised for bids.
Moved by Mr. Paluso, seconded by Mr. Flynn, that pending written receipt of the
three (3) corrections necessary to make everything comply that the Board of County Commis-
sioners authorize to prepare advertising for these various contracts for Mingo Park develop-
ment.

National Airport Study
Mr. Whalen: This involves any and all future items for development that are in connection
with our County Airport. As far as Pennsylvania is concerned, it s going to be done by Penn -
DOT inasmuch as they are the number one transportation group in the Commonwealth. This
matter is an airport study labeled "Year 1995 Statewide Airport System Plan. " Mr. Anthony
and I have discussed this in great detail. This will come before the SPRPC at their next
meeting on June 5th, and it is apparent that the designation .of PennDOT for Pennsylvania is
going to be a reality and that future grants are going to be dependent upon this particular study.
Mr. Anthony and I have discussed this, and it is our joint recommendation that the Board of
County Commissioners endorse the PennDOT work program so that Mr.. Jones will be in a
position to handle this at the next SPRPC meeting as far as the County is concerned. (More
discussion was held on this matter. )
Mr. Flynn: May I suggest that we hold this in abeyance until our next meeting which will be
June 1st.
New Business - Holiday
Chairman informed the Board and all those present that the Courthouse will be
closed from 4:30 p.m. Friday, May26, 1972, until 9:00 a.m. on Tuesday, May 30, 1972, in
observance of Memorial Day.

Solicitor Capano presented to the Board for.their consideration a resolution auth-
orizing acquisition by the County of an easement for flood control purposes (Harmon Creek
Project) over lands of Mabel .Alberta Reid in Hanover Township.
Moved by Mr. Paluso, seconded by Mr. Flynn, adopting the resolution for the
Mabel Alberta Reid acquisition and also the resolution for the James R. Garrett deceased
(Garrett heirs) acquisition upon receipt of the papers.

Solicitor Capano informed the Board of correspondence received from Penn Cent
Company - RE: Pa. C. 18900 - Borough of West Brownsville v. Penn Central Transportation
Company, _Department of Highways of the Commonwealth of Pennsylvania and County of Wash-
ington. Correspondence enclosed copies of a petition of Penn Central Transportation Company
to extend the time within which to complete the work required by the order entered in the above
proceeding.
Mr. Hormell
Mr. Hormell: The first item I have refers back to the ERG and GYSEGEM business in Mingo
and Cross Creek Parks, This deals. with the Cross Creek aspect of that matter. The result
from that hearing was sent to these people, and we're going to develop it. The permit was
turned down on the ground that whenever any use of a mineral resource is proposed that may
adversely affect the public enjoyment of a natural, scenic, and historic values of the govern-
ment is within the Commonwealth's authority to conserve and maintain those public natural

They also said that they were turning it down because the proposed operation would create a
and of fire and explosion because it was very near some high pressure gas lines. That was

e reason they gave for turning it down. Now they have appealed. And so it will be likely that
will be following it through this first step, and the appeal goes to the Department of Environ-
al Resources, and Gysegem Enterprises is appealing that. The likelihood is that it will
up in the Appellant Court. We will take the steps necessary.
The next item is indirectly related with the Cross Creek Park matter, and that
was turned down. One of the people who was contemplating operating in that area had
ased a tract of land which the purchase price was well known, and your Assessment Board
d an assessment upon the basis of 30% which they considered to be the value. Now this
r is stating that he bought the property contemplating the use of it for strip mining and
since he can no longer use it for strip mining, the value is improper and should be corres-
dingly reduced. This is an example of a collateral result of this sort of thing. This one will
coming up, and we will oppose.it on the same grounds that we opposed the others.
The third item is the matter of the case of the interest on interest. It has been
scheduled for Argument Court beginning on July 3,

REPORT
ON
STRIP PROPOSAL - EAST BETHLEHEM TOWNSHIP
May 23, 1972
the request of the County Commissioners, the Staff of the Washington County Planning Com-
ssion investigated a proposal of the B. L. F. Corporation to strip coal from the Waynesburg
in an area in East Bethlehem Township. The proposed location of the strip is the site
as the Hupp Farm. The caol mined will be transported by truck to barges on the Monon-
la at the Morton Sand & Gravel Site located in Millsboro. B. L. F. Corporation has been
anted a mine drainage Permit (No. 3272BSM5). The Water and Stripping Permits are
the time of this report, review by the Fish Commission and Department of Environmental
sources was not complete. Since the Staff investigation of this project was begun, the East
ethlehem Township Board of Commissioners has withdrawn its routine objections, thus

the project. If the operator complies with the Pennsylvania Clean Stream Law and the Surface
Mining Laws of the Commonwealth, it appears that there is no real basis for objection unless
there is a danger to the health and safety of the public involved. The main problem evident is
the fact that there could be damage to the roads in the area. L. R. 62147 (Black Dog Hollow
Road) and T. R. 88, The Township of East Bethlehem has no zoning ordinance in effect. The
proposal by the operator indicates that anydrainage from this operation will be into Black Dog
Hollow Run and would be discharged into Ten Mile Creek downstream from Ten Mile Creek
County Park, and would pose no danger to the Park Facility. For these reasons the Staff
feels that no substantial objectiord-,an be raised.

Commissioner Jones reported to the Board on his trip to Washington, D. C. on
31, 1972, to visit "Transpo 1972" in reference to mass transportation. Commissioner
ones stated at the conclusion of his.Report that he believed the County Commissioners should
xpend their time and effort in order that the County Airport may be enlarged.

Chairman stated that three meetings were held in the Commissioners' Conference
Room in conjunction with the renewal of the existing Leases as follows:
(a) Meeting with Harry Harvey held on May 17, 1972, at 2:30 p.m.
in reference to his lease arrangements with the three County
Commissioners in attendance.
(b) Meeting with representatives of the Washington County Agricultural Fair
Board held on May 19, 1972, at 11:00 a.m. with the Majority Commissioners
in attendance. Representatives present being: Harry Hank, William Hutchison,
Dorsey Woodruff, Lee Robinson, J. R. Somerville, and Martin Hallam.
(c) Joint meeting with representatives of the Washington County Agricultural
Fair Board and Arden Downs, Inc, held on May 31, 1972, at 8:00 p.m.
with Chairman Flynn in attendance. Those in attendance being: Harry Hank,
William Hutchison, Martin Hallam, Clyde Robison, Dorsey Woodruff, John
Marchezak, Lee Robinson, J. R. Somerville, Mr. and Mrs. Harry Harvey,
and Carl Halstead. Meeting for the purpose of finalizing the execution of the
lease agreements.
Chairman stated that as a result of the above said meetings, he would like to
recommend that the Board enter into a Lease Agreement with Arden Downs, Inc., for a
period of four years effective June 1, 1972, and terminating on May 31, 1976.
Moved by Mr. Jones, seconded by Mr. Flynn, that the Board of County Commis-
sioners enter into a renewed Lease Agreement with Arden Downs, Inc., for a four-year
period effective June 1, 1972, and terminating on May 31, 1976. Said Lease Agreement
based on the same terms and conditions as found in prior existing lease.
Remarks:
Mr. Paluso: I would like a chance to read the Lease.

Motion carried.
Chairman recommended that the Board enter into a Lease Agreement with the
Washington County Agricultural Fair Board for a period of four years plus effective June 1,
1972, and terminating October 31, 1976. Chairman stated that the Fair Board requested that
said Lease be extended to October 31, 1976, due to the Board's preparation for the forth-
coming County Fair which is held in August.
Moved by Mr. Jones, seconded by Mr. Flynn, that the Board of County Commis-
sioners enter into a renewed Lease Agreement with the Washington County Agricultural Fair
Board for a period of four years plus effective June 1, 1972, and termination to be October 31,
1976. Said Lease Agreement based on same terms and conditions as found in prior existing
lease. Said action subject to the Washington County Agricultural Fair Board's ratification at
their next regular board meeting to be held in June, 1972.
Remarks:
Mr. Flynn: I do not want the news media to get the impression - that Mr. Paluso, on the

Mr. Paluso: There is no objection except I just haven't read the Lease.
Mr, Flynn: But I would like to point out though'that this is through no fault of ours. You had
the opportunity, sir, to read the Lease and also to attend meetings. I do not want the news
media to get the impression that we are negotiating these Leases without this entire Board
having the opportunity to first peruse them.

Mr. Capano: Under the law the Commissioners are responsible for the burial of indigents who
have no relatives. Coroner Jackson investigated as to whether there were any persons known
who could be held responsible or any insurance and he informed me there wasn't - so we are
responsible under the law anyway,

Chief Clerk read correspondence under date of May 22, 1972, from Francis Pagac,
Secretary - Borough of Centreville, in reference to re -apportionment of the Ward System in
Centreville Borough. Correspondence stated that Mr. Pagac was instructed by Council to
contact the County Board of Elections to inquire what is being done regarding the Resolution
passed by Council at their regular meeting held in January, 1972, and which was submitted
to the County Board of Elections requesting that said Board study, analyze, and re -district
the Ward System in Centreville Borough.
Chief Clerk then read an excerpt from Minute No. #5 dated January 27, 1972, in
which the said Resolution was read by Assistant County Solicitor Hormell and a motion was
adopted whereby the County Commissioners complied with Centreville Borough's request to
analyze the Ward System in said Borough and to re -district same as per said Resolution and
also to authorize the County Solicitor to prepare the necessary legal papers.
Mr. Murphy: Upon receipt of this letter, I requested that Mr. Muscaro compile figures on
Centreville Borough and report to the Board today on these figures.
Mr. Joseph Muscaro, Director of the Election/Registration Office presented his
Report to the Board on the total registration and total voted in Centreville Borough beginning
with the May 20, 1969, election. Copy of said Report may be found on Page 7-A.
Mr. Capano: I have been in discussion with Mr. Muscaro. I have not had a chance to discuss
this matter with Mr. Hormell. I would recommend that this matter be deferred until a later
date.
Mr. Flynn: May I suggest that the Chief Clerk acknowledge receipt of said letter and forward
the Borough a copy of Mr. Muscaro's Report and also advise them that at this time the Board
cannot take positive action until we take a further look and see because we have been discussing
voting machines and this would mean re -districting in the precincts.

Mr. Muscaro brought to the Board's attention that in the last election, when North
Strabane-4 came in later, the Judge of Election was very upset about the size of said precinct
and requested that said precinct be divided. or - as a result, none of the people were going to
work in the next election on the Board. Mr. Muscaro requested that the Board take official
action in order that North Strabane-4 be divided.

material that should be presented at said workshops, a greater period of time is needed for
organization and preparation. Correspondence stated in conclusion that the Commission has
therefore decided to post pone these workshops until the early fall so that the best and most
complete program can be made available to the citizens of the Commonwealth,

Mr. Whalen - (a) County Nursing Home Contracts
Mr. Whalen: In connection with the letter we received on May 24, 1972, from Glenn Johnson,
Director of Bureau Medical Assistance - Department of Public Welfare, they have requested
that we execute revised contracts with them for our two nursing homes and these revisions
are in accordance with the new regulations which are under Federal Register Volume No.
#34 - No. #120 under date of June 24. They are actually updating their agreements to
with the regulations as they are being changed. Mr. Capano and I have reviewed the contractE
they have submitted and I think Mr. Capano is in a position to recommend that said Agree-
ments be approved by the Board and executed by the Chairman of the Board.

of Commissioners authorize the execution of the Contract Agreements between the Office of
Medical Programs of the Department of Public Welfare and the Washington County Home for

Mr. Whalen: The Department of Public Welfare has also requested that we consider revising
the Transfer Agreement that we have with the Washington Hospital. Said agreement is one
which we have to transfer patients who are beyond our control either for temporary assistanc(
or for maybe placement in another facility. We have given the Administrator of the Washing-
ton Hospital a copy of the suggested Transfer Agreement and he has indicated that he sees no
reason why they wouldn't approve it - so this is being taken care of at the present time.

Mr. Whalen: The next item is one that we have been involved in somewhat over the past year
and it is rather a controversial matter. It involves what is known as The Utilization and

Review -Plan. We have some correspondence here - in fact, possibly from about a year. The
real question here is' whether or not said Plan is really `factual when it relates solely to the
type of patient that we have in our nursing homes. Said plan is basically a plan`to determine
when rehabilitizat'ion of a patient is complete to a point where they can be 'discharged and re-
turned to their homes or, whatnot. And, of course, I think you are fully aware of the fact that
we do not have this type of patient in our homes. Primarily the biggest problem is that if we
did got them up to a discharge point and told them that they could go home -about 95% of our
people down there have no place to go. 'However, it would appear that we are going to have to
comply with said Plan and the Hospital Association has set up a conference in Pittsburgh wh
is`to be held on June'8, 1972, and We have made reservations for Mr. Petrosky and Mr. Croude
to attend this conference and hopefully, once they get through this conference and get back with
the consensus of opinion at this conference - we will be in a position to finalize the committee
for Utilization and Review. I have discus-sed'this at length with out physician at the Men's
Home', Dr. `Large, and he feels that as I outlined before, it, is sort of difficult to try to classify
our type of patients the way that they outlined. But I presume that if we are to continue to be
involved in the MAA program and the Medicade and Medicare that this is.another one of those
things that we are going to have to comply with. Possibly, by June 15's regular° beard, meetin€
that we will be in a position to come up with definite recommendations as far as utilization is
concerned, Due to the deadline which they gave us on submitting these things by May 31, 1972,
we went on record with Director Johnson on May 30, 1972, and we explained to him that these
two Agreements have to he approved by the Board of Commissioners and that today was the
meeting date and that we anticipated approval and would forward gigned'copies of the new
Agreement by the end of the week. We also explained our position on the Transfer Agreement
withWashington Hospital and also outlined what we are dding about the Utilization and Review
Plan. So hopefully, we are on solid grounds with the Director. `

with and would like to review said contract with the entire Board and Mr. Ted Schraeder,
Building Manager of Global Development, Inc., after the regular board meeting today.
County Solicitor Capano presented to the Board a Memorandum of Agreement
in reference to the employees of the Washington County Commissioners - Washington County
Jail before the Pennsylvania Labor Relations Board. Mr. Capano stated that on July 6,
1972 at 2:30 p. m. to 3:30 p, m. is the date assigned for the election by the Jail Guards (15).
Mr. Capano stated that said election is to take place in the old premises of the Washington
County's Sheriff's Office and that notices of said election will be posted.
County Solicitor Capano informed the Board that in reference to correspondenc
under date of May 23, 1972, from Mr. William C. Porter directed to Mr. Clay Graham in
reference to the Lerby and Ciaffoni properties - C-4-1, Cross Creek Park - that said
matter is being deferred at the present time for further discussion by all concerned.

the Commissioners five (5) color sketches for a proposed flag for Washington County. Mr.
Monack explained each design to the Commissioners and the significance of the design. After
a brief discussion by the Board, Mr. Flynn stated that the necessary steps to appoint a com-
mission to study the flag designs would be taken after the Legal Department has determined
whether it is permissable for the County to adopt one,

stated that this is regarding the Counselor at the County Jail.
Chief Clerk read a copy of a letter under date of May 31, 1972, from Michael
George directed to M. Clark Harris, Sanitarian, Department of Environmental Resources,
regarding the sewage pumped from the three existing comfort stations in Mingo Creek Park.
Mr. George stated that these comfort stations were pumped -once since they were put to use
in 1970 by the Hapchuk Sanitary Service; and the sewage was spread on a remote, undeveloped

area of the park. Mr. George further stated that up until this time he has been under the im-
pression that the sewage was removed from the park by Hapchuk Sanitary Service and disposed
of according to the requirements of the Department of Environmental Resources; and since
this was not the case, it is assured that all future disposals will meet the required approval
of the Department.
Chief Clerk read correspondence under date of March 24, 1972, from Anthony
Bevec, Building Superintendent, informing the Commissioners of leaks and falling plaster (as
a result of heavy rain) from the roofs at the Men's Home, Women's Home, Courthouse, and
Jail. Mr. Bevec stated that this involves quite an expense in repairing these roofs and recom-
mended that the Commissioners have an engineer make a survey of the Jail roof being that
this is a high spot above the stair wells which makes it very dangerous.
Mr. Whalen reported further on the roof situation stating that it would cost appro-
ximately $2, 500. 00 for the jail; $2, 000. 00 for the Courthouse; and $12, 000.00 for the Women's
Home. Only absolutely necessary repairs will be made on the Men's Home until such time
that the other improvements necessary down there are made, Mr. Whalen suggested to the

Chief Clerk read correspondence under date of May 30, 1972, from Robert D.
Vance, Finance Committee of the Washington County Historical Society thanking the Commis-
sioners for their assistance given to the Society for the maintenance and operation of the
LeMoyne House.
Chief Clerk presented to the Board a request for additional Liquid Fuel money in
the amount of $18, 000, 00 from the Borough of Charleroi. The money is to go towards the up-
dating of signal lights and the total cost of the project is $35, 052. 60 with the State contributing
$9, 000. 00 towards the project. Mr. Flynn stated that to his knowledge, the County has never
participated in monies as far as lighting systems are concerned. Mr. Paluso reported further
on the subject by saying that the new Westinghouse Facility which is the largest in the world
along with the other companies surrounding it have caused heavy traffic due to the fact that
the rail system has doubled in price so therefore all the companies are using trucks. Mr.
Paluso further stated that the state suggested this project and that the Borough request partial
payment from the County.
It was then decided by the Board that the matter would be tabled until it could be looked into
further.
Chief Clerk read correspondence under date of May 23, 1972, from Elaine Palus
Chairwoman, thanking the Commissioners for the grant of $1, 000.00 authorized to the Char-
leroi Library. Said letter stated that they would appreciate any help or information that the
Commissioners can give to their group. Chief Clerk read correspondence under date of
May 23, 1972, from Congressman Thomas E. Morgan in regards to the desire of the Charleroi
Library Committee to purchase the Post Office Building for a new library. Correspondence
stated that there is a certain procedure which must be followed in this matter which is a deter-
mination by the General Services Administration after the old post office is declared surplus

May 31, 1972, from Norman H. Berky, -Director, Eastern Division, General -Services Admini-
stration, enclosing a copy of a recent letter from their regional office in Washington D. C.
directed to Mrs. Elaine Paluso concerning the old Post Office building.
Chief Clerk read correspondence under date of June 5th, 1972, from Hallie Jones
concerning various covered bridges in the County. Ms. Jones stated that she was delighted to
see the repair work being done on some of the bridges in the County such as the Trostletown
Covered Bridge, the Ebenezer Church Bridge, and the Wright Bridge and thanked the Commis-
sioners. Mrs. Jones also attached a post card done of the Wright Bridge located in Somerset
Township.
Mr. Whalen:
Mr, Whalen: In connection with the proposed eight -county radio network, the Crime Justice
Commission is working out at the present time, our County has been criticized at times at
some of the meetings that we are holding up the eight -county budget. I want to report that that
is not true. We are currently engaged in making a study and survey to determine what the
county's position will be -in the future from a financial standpoint as well as the end result that
would be gained from this system and we have our Civil Defense Director, Mr. Bohner, and
Mr. Ron Godava from Engineered Communications working on this project for us and they
expect to have a report for us by early next week. This morning the Governor's Justice Com-
mission called me and they said that this is a matter of immediate importance and I informed
them that we were not going to be in a position to discuss the matter until we had a report back
from our two consultants. So he didn't press the matter any further, he said that was fine and
we could call him when we were ready to talk to them.
Mr. Whalen informed the Board that the Washington County Planning Commission
has scheduled their annual Planning Conference for Thursday, September 21, 1972. The theme
for said Conference for 1972 is "Transportation. " The Honorable Jacob G. Kassab will be the
principal speaker.
Mr. Whalen presented correspondence under date of June 1, 1972, from John D.
Anthony requesting that the Board of County Commissioners vote affirmatively to have Penn -
DOT prepare a State-wide Airport Systems Plan for the Year 1995,

order and the information was used at the hearings.

(Revenue Sharing)
Mr. Whalen reported on the status of both Federal and State Revenue Sharing.
House Bill HR14370 was discussed by telephone with representative Thomas Morgan. The
fate of this bill is definitely undecided at this time and is still in serious trouble. Represen-
tative Maham of Texas is opposed and he is the Committee Chairman. Mr. Morgan believes
that if the House Bill is called by Representative Maham that House Speaker Albert will over-
rule him. This will permit the bill to proceed through channels. Mr. Morgan is sending us
the current "fact sheets" to bring us up to date on the matter. The Washington County share
under HR14370 is $1, 008, 550.00. We have requested Congressman Morgan to do everything
possible to have welfare as related to our County Nursing Homes determined as a high priority
and he assures us that he will do everything possible in this regard.
State Revenue Sharing is related to County reimbursement for Court and Court
related offices and is under Act 27-A. This year the County was reimbursed nearly
$100, 000. 00 out of a 10 million dollar appropriation. In the current state budget the governor
is requesting that Act 27-A be funded in the amount of $52, 000, 000. 00. Using the same basic
figures under this funding the County's reimbursement would be between $400, 000.00 and
$500, 000. 00. We have requested in writing that out state senator and legislators support the
requested funding of Act 27 -A.
New Business: Mr. Flynn,
Chairman made note that the Courthouse will be closed on Wednesday, June 14,
1972, in observance of Flag Day. Due to the fact that there was a question by the Courts con-
cerning the closing of the Courthouse on this day, Chairman Flynn read the following House
Bill No. 78 which is now Act No. 90:
House Bill No. 78, which amended the County Code to authorize the Commissi
in third through eighth class counties to determine when the Courthouse and all county offices
located elsewhere shall be open, provided that the Voter's Registration Office shall be open

Solicitor Capano presented to the Board the Viewer's Report in regard to the
condemnation of land in North Strabane Township, which is the property of Richard Construc-
tion Company, Inc., Mr. Capano, reported that Richard Construction was awarded the amount
of $950. 00 for damages. This is in regards to the Chartiers Creek Flood Control.
Mr. Hormell:
Mr. Hormell: I have one item to report. We are scheduled for a hearing on the Bologna
Mining matter on June 12 in the State Office Building in Pittsburgh. That comes by virtue of
an grder from the Environmental Hearing Board which was dated on.June 5. I received in the
mail this morning a Motion for Continuance from the Attorneys for the Bologna Mining Compa
which was dated June 6. One of the reasons for asking for a continuance is that they take the
position that Washington County has no right to be heard in the case. I would therefore- assume
that before the hearing takes, place, these motions will have to be .disposed of and I don't know
what the result is going to be. We will still go ahead with the session that we have planned
for 2:00 this afternoon to go over this matter with all our technical people including the use
of some of that information that you just paid for from those engineers. We are going to make
inquiries today to see whether they are going to continue it again, I would rather suspect they
might. But they are reaising a new issue here and the new issue is that Washington County
doesn't have a right to be heard at these hearings and that's a new twist and we'll probably
have to go to court an that one.

Mr. John McCarty. of Hickory, Pa., told the Commissioners that they should not
rely on help from state or federal government if they are ever definitely obligated to build a
new county home. . He suggested a fund-raising drive in which subscriptions from the public -
at -large would be solicited. Mr. McCarty stated that he would start the drive with his own
check in the amount of $100. 00. Mr. Flynn commended Mr. McCarty and called his proposal
a "noble idea" but stated that there is a question as to whether a County can solicit or have
fund raising drives. Mr. Flynn said that a County can receive grants and gifts though, but
there might be legal blocks to a program such as this.

Foster Family Group was held on March 26, 1972, with 17 foster families being in attendance.
Correspondence stated that the focus of the meeting was upon the Region V study of Foster Ho e
payments. This discussion led to an open communication about general problems, concerns,
and even complaints existing between the agency and the foster homes. Correspondence
stated that the general consensus by those in attendance had led to the plan to schedule another
Foster Family Group meeting on Tuesday, June 27, 1972, from 7:00 to 9:00 p.m. at the Com-

2. Donora has a population of 8, 825 and has a public library. The other com-

3. Under the State Library System, Ringgold School District is served by two
istrict center libraries. Citizens who live in Monongahela, New Eagle, Donora, and Carroll

4. Citizens living in Finleyville, Union Township, and Nottingham Township are
erviced by the Washington District Center and must pay a $10.00 fee to register. There are
,312 citizens living in these three areas who must depend on Byers Library for free library
ervice as no other free service is available to them.
5. According to the State Library Code, in order to provideminimum service,

Bid for Replacement of the Courthouse Windows
Mr. Whalen: Last Thursday afternoon bids were opened for the replacement of the Courthouse
windows; and the apparent low bidder is Window Products Company of Pittsburgh, Pennsylvani
Their total bid was $91, 937 on the Number 1 Base Bid. Their Number 2 Base Bid was $96, 437
That, of course, is a little difference in the quality of the window. I talked with the engineers
this morning on this, and they have had a conference with Windows Products Company. They
are perfectly satisfied that they are responsible and that they will fulfill the contract. One of
the requirements in the bidding prior to the County contracting was that the successful bidder
would have to make a pilot installation of the window that is going to be used. The bidder in-
dicated that it is going to take him three to four weeks to get this window in. So the contracts
won't be signed until after the window is installed and is satisfactory to the Board. That is the
current status on the window contract so it will be after the pilot window is installed that the
contract will actually be executed to the successful bidder.
Mr. Whalen also reported that in reference to the Governor's Justice Commission
on the County radio system that the Bohner-Godava report should be received late that after-
noon.
Solicitor:
Solicitor Capano reported to the Board that he received correspondence from the
Global Development, Inc., which enclosed two fully executed copies of the lease with Global
Development.
Assistant County Solicitor Hormell stated that a hearing was held in Pittsburgh on
Monday, June 12, 1972, in reference to the strip mining permit applied for by the Bologna
Mining Company of Burgettstown. Commissioners Jones and Flynn were in attendance. That
Matter is now in the state of "legal limbo" until the necessary papers are prepared.
In reference to the Steamboat Clairton, it was reported that a promissory note has
been received and sent over to the Controller's Office.

Hinchey, International Organizer, Service Employees Internation Union, advising the Commis-
sioners that they have filed a demand petition with the Pennsylvania Labor Relations Board for
both the court related and non -court employees of Washington County.
Chief Clerk read further correspondence under date of June 16, 1972, from Gerald
W. Hinchey requesting the use of one of the courtrooms or other available facility to meet
with the county employees to discuss Act 195, Public Employee Law and to organize the em-
ployees, if they so desire, under the flag of Service Employees International Union, AFL-CIO.
Mr. Hinchey stated that it has come to his attention that one of the other unions, AFSCME, has
been using the county premises for meetings and actually used county premises within the last
two weeks to hold a meeting, and therefore is requesting that his union be permitted to also
use the county premises.
Chairman Flynn stated that the only meetings held with the AFSCME were contract negotiations
and that no public meetings for organization purposes were ever held. Mr. Flynn suggested
that Mr. Hinchey be notified to this effect.
Chief Clerk read correspondence under date of June 16, 1972, from Clyde S. Robi-
son, President, Washington County Fair Board, making reference to a joint meeting which was
held on May 31, 1972, with Mr. Flynn, the Arden Downs Corpo. , and the Fair Board

will contribute the sum of $1, 000. 00 to the Music Performance Transcription Fund (M. P. T. F.
and the American Federation of Musicians (A. F. of M.) Local 592 will provide 20 concerts at
Mingo Creek Park and Ten Mile Creek Park. The concerts will begin on July 4, 1972, and
will conclude on September 4, 1972. Said agreement is to be executed by the Board of Com-
missioners.
Moved by Mr. Jones, seconded by Mr. Paluso, approving the above Agreement
between the County of Washington and the American Federation of Musicians, Local 592 of
Charleroi for concerts to be provided by the American Federation of Musicians at Mingo Cr
County Park and Cross Creek County Park beginning July 4, 1972, until September 4, 1972,

Mr. Flynn - Union Contract
Mr. Flynn read correspondence under date of June 20, 1972, from Gerald W. Hin-
chey, International Organizer, Service Employees International Union, stating that he has be
informed that the Commissioners presented the bridge , employees' Union a new proposal as
of June 19, 1972. Mr. Hinchey stated that the S. E. I. U. wishes to be placed on record at this
time that they do not disagree with the County in giving the Bridge Dept, a needed increase in
benefit but they would like to point out that they consider it most definitely an unfair labor prac
tice if the increase were to go into the year 1973-1974. Correspondence suggested that the
Commissioners give the Bridge Department an interim wage raise or change in benefits sub-
ject to the results of the election being conducted by the Pa. Labor Board in the near future.
Mr. Flynn read further correspondence under date of June 19, 1972, from Earl
Light, Secretary, Labor Relations Board directed to Commissioner Flynn and Harry O'Brien,
President, AFSCME informing them that they are a party to Case No. R-2194-W which was
filed with the Pa. Labor Relations Board on June 13, 1972, Petition and will be processed in
due course. Correspondence further stated that they will be advised by the Board with appro-
priate notice, order, or certification.
Mr. Flynn made reference to the recent meeting held with the Bridge Employees and the con-
tract that was drawn up and a brief discussion was held by the Board.
Moved by Mr. Jones, seconded by Mr. Paluso, that the meeting adjourn.
