Washington, Pa., July 20, 1972
The Board of County Commissioners met in regular session with the
following members being present: Commissioners Jones, Paluso, and Flynn. Also present
being: Admipistrative Assistant Whalen; County Solicitor Capano; Assistant County Solicitor
Hormell; Michael George, Executive Director, Washington County Department of Parks &
Recreation; Reporter Robertson of the Observer -Reporter; and Reporter Route of the
Monongahela Publishing Company.

Old Business: Mr. Capano - Awarding of Mingo Park Development Bids
Mr. Capano stated that the following bids have met all the required speci-
fications as confirmed by Mr. Walter M. Gladkowski of Griswold, Winters & Swain and also
have been cleared through the Department of Labor and Industry.
Moved by Mr. Jones, seconded by Mr. Paluso, that the following six (6)
contracts be awarded as indicated below:
1. The contract for Site Development (Contract No. 1) awarded to Domenic
Parente Contractors, 6118 St. Marie Street, Pittsburgh, Pa. 15206, for the amount as set
forth in their bid - $294, 576. 00; this being the lowest responsible bid received and in
accordance with the specifications;
2, The Contract for Well Drilling (Contract No. 2) awarded to FRANK
IREY, JR. , INC., R. D. #2, Park Avenue Extension, Monongahela, Pa. 15063, for the amour-t
set forth in their bid - $14, 650. 00; this being the lowest and only responsible bid received
and in accordance with the specifications;
3. The Contract for Comfort Facilities (Contract No. 3) awarded to FRANK:
IREY, JR. , INC., R. D. #2, Park Avenue Extension, Monongahela, Pa. 15063, for the
amount as set forth in their bid - $193, 430. 00; this being the lowest responsible bid received
and in accordance with the specifications;

set forth in their bid - $6, 362. 00; this being the lowest responsible bid received and in
accordance with the specifications; Said motion based on the recommendation of County
Solicitor Capano.

(Contract No. 4) Contract Amount - $33, 000. 00
2, CARNEGIE GAS COMPANY - Bury .of Telemetering Cable
(Contract No. 5) Contract Amount - $14, 200. 00

(Contract No. 6) Contract Amount - $5, 000. 00

Department of Parks & Recreation be awarded to PASCOE EQUIPMENT COMPANY, West
Chestnut Street, Washington, Pa., 15301 for the amount set forth in their bid - $3800. 00;
this being the lowest responsible bid received and in accordance with the specifications, Said

Correspondence - Mr. Whalen
Mr. Whalen read correspondence under date of July 7, 1972, from John
E. Costello, Solicitor, Washington County Industrial Development Authority and Robert C.
Arthurs, Chairman, which enclosed a resume of the activities of the Industrial Development
Authority up to the present. Said letter stated that the projects will be reviewed with the
Commissioners some time in the near future.
Mr. Jones: I think these boys are doing a good job. A good example is that park in
Donora. They have been moving around quite a bit down there, both Redevelopment and
the Industrial Development Authority. I think they are doing a good job, plus they have
created many jobs for the people in Washington County.
Mr. Whalen presented a petition to the Board requesting that Mary
Dellarso of 231 Barr Street, Canonsburg, be appointed to fill the unexpired term of Mary
McCormick as Assessor for the taxing district of the 3rd Ward, 2nd Precinct in Canonsburg.
Moved by Mr. Jones, seconded by Mr. Paluso approving the appointment
of Mary Dellarso as Assessor for the 3rd Ward, 2nd Precinct in the Borough of Canonsburg,
to fill the unexpired term of Mary McCormick, who is deceased.

Mr. Whalen read correspondence under date of July 17, 1972, from
William H Wilcox, Secretary, Department of Community Affairs enclosing a copy of Act 4
which was passed by the General Assembly and signed by the Governor this year and may be
helpful in preventing future flood problems. Said Act authorizes all County Boards of
Commissioners to use the power of eminent domain for all the acquisition of property for
flood control and prevention purposes.
Mr. Whalen read correspondence under date of July 11, 1972, from
Senator Richard S. Schweiker, stating that since Washington County has been designated as

a Disaster area, the county is eligible for federal aid, Mr. Schweiker suggested that the

Commissioners contact the OEP (Office of Emergency Preparedness) in their area for
information on the proper procedures to be followed in making application for assistance.
Mr. Flynn: In reference to that particular communication, as we know Mr. Paluso
was in Washington, D.C. last Friday at a meeting called by the President or the Vice -
President of the United States and according to what I determined through the news media,
there is a possibility that several billions of dollars will be made available for these
flood disaster areas. Mr. Paluso had indicated yesterday that he would like to make a
report on this,
Mr. Paluso: The Vice -President chaired the meeting and they have made some changeF
in the original information that was promugated and one of the most important is that the
original loan for individual home owners from the Small Business Administration was you
repay the first $500. 00 and then you were granted $2500 forgivnes.s. The new bill that the
President has submitted, it should be passed tomorrow according to the news media, states
that you will be given forgivness for the first $5, 000.00 of the loan and no longer is the
$500. 00, the first $500. 00 payment required. In other words, if you would borrow
$6, 000. 00, the first $5, 000. 00 would be forgiven and you would only pay $1, 000. 00. The
first payment is not due until five (5) months after, receipt or in any other circumstances,
seasonal employment or something of that, sort, it can be extended further than that before
the first payment is due. Now the new bill also has a, provision where 1% interest rate on
or over $5, 000. 00 which is quite a bit of difference and quit e a savings to anyone who needs
one of these loans. Now these loans, and there has been a lot of bum dope put out about
how you apply, loans for an individual home owner -he goes directly to Small Business
Administration office in Pittsburgh and fills out the application and it will be processed in
a, week. Now if he goes through this other red tape and there has been a lot of confusion on
how to do this, this is what is holding up a lot of this money. I think the news media can
help these people if they would tell them to go directly to SBA. They have people there to
assist .them in filling out this application, and to take an estimate, contractors estimate of
the damage incurred so they will know how much of a, loan they will need. That is probably
the most important single change in all the dope we have been hearing.
After Mr. Paluso's report, further discussion .was held by the Board.
Mr, Jack France entered the meeting.
Mr,, Whalen read correspondence under date of July 14,- 1972, from
Commissioner Donald B. Hoffman of Lehigh County in regard to the destroying of old
county records. Mr. Hoffman :stated that the County Records Committee which was
established several years ago by legislative action was designed to study all of the records
of all offices of the county with the idea in mind of deciding which should be retained, which
could be retained but copies made and kept in come other depositbries and what records

might well be disposed of. Mr. Hoffman stated that he is a member of this committee re-
presenting the County Commissioners Association and they are now in the process of be-
ginning the review of material in the Office of the County Treasurer, Controller, and
Commissioners. Mr. Hoffman requested that the Commissioners submit their ideas and
recommendations on this matter so that the Committee may handle this work in the most
efficient and productive manner possible.
Mr. Capano stated that he would check with Mr. Mouyard on this matter being that he was
placed in charge of this matter for Washington County a few years back.
Mr. Whalen read correspondence under date of July 15, 1972, from Mrs.
Thomas P. Sloan thanking the Commissioners for her re -appointment to the Tourist Pro-
motion Agency and stating how much she has enjoyed being involved with the Agency.
Mr. Whalen read correspondence under date of July 11, 1972, from
Bernhard Schaffler, Clerk of Court, United States District Court in reference to Washington_
County's Voter Registration Lists. Correspondence stated that the U.S. District Court
takes names of prospective jurors from the Voter's Registration Lists for the 1972 general
election and since Washington County's list of registrants is incomplete due to the new ruling
passed by the State Attorney General, letter requested that the Court be advised of how the
Commissioners intend to supplement the list. Correspondence also requested that the
Commissioners advise the Court of the anticipated delivery date of the completed list.
Mr. Capano stated that he has taken this matter up with Mr. Muscaro and the list will be
completed and sent sometime after October 10.
Mr. Flynn: There is ligislation pending now in Harrisburg which will correct this -
we will comply.
Mr. Jack France, Solicitor for Carroll Township reported that Carroll
Township intends to protest the granting of a Mine Waste Disposal Application to The
Consolidation Coal Company by the Solid Waste Disposal Bureau in Harrisburg. The notice
of the application wasp published in the July 15 issue of the Pennsylvania Bulletin. Mr.
France stated .that any party may file protest to this application within 15 days of July 15.
Mr. France further stated the Township's need for assistance and requested financial and
moral support fram the Commissioners.
Mr. Flynn requested that Mr. France submit his request to the Board in writing so.that
the Legal Department may have a chance to peruse it. Mr. Flynn. further stated that he
didn't know if it would be practical or feasible for the Commissioners to do this but that a
formal request in writing should be submitted to the Board.
Mr, Whalen read a memorandum under date of July 14, 1972, from K.E.
Frederick, Mid Monongahela Valley Council of Governments, informing the Board that
a special Council of Governments meeting will be held on July 24, 1972 at 7:30 p, m. After

the meeting a Department of Community Affairs representative will speak on outdoor re-
creation grant programs. ,
Mr. Jones stated that he will be unable to attend the meeting and. Parks & Recreation
Director George will attend in his place.
Mr. Whalen read correspondence under date of July 14, 1972, from Mrs. Reed
B. Day, President, League of Women Voters of Peters Township thanking the Commissioners
for the time given her and Mrs. Gross to complete the questions for the Metropolitan Project,
Survey for the League of Women Voters of the U.S. Correspondence further confirmed Mrs.
Reed's conversation with Commissioner Flynn concerning the home rule optional form of
government ballot question for the ballot this November. Mrs. Day stated that this can be
accomplished by an ordinance action by the County Commissioners.
Mr, Whalen read correspondence under date of July 11, 1972 from the
Department of Transportation stating that as a result of the widespread flood damage caused
by Hurricane Agnes on June 22, 1972, Governor Shapp proclaimed a State of Extreme
Emergency. This proclamation provides that any municipality of the Commonwealth which
suffered serious flood and storm damage may employ temporary workers, rent equipment
or enter -into any such contracts or agreements as may be required to meet local problems.
Correspondence further stated that Penn -DOT will allow municipalities to use their Liquid
Fuels Tax Allocation for the purpose of reconstructing roads and bridges without the prior
Penn -DOT Municipal Services approval normally required. However, the District Super-
visor of Municipal Services serving the particular area must be notified as soon as possible
in order that the proper State Liquid Fuels Tax Applications can be subsequently approved
and a number assigned to control the Liquid Fuels Fund Expenditures at the end of.the
calendar year.
Commissioner, Paluso then read the procedure to be followed to secure loans for damages
which resulted from the flood.
Messrs. Hormell and France left the meeting.
Mr, Whalen: Harmon Creek Flood Control Project
Mr; Whalen reported that an inspection of this project was made with the Irvin
T. Miller Company and recommendations were submitted,by said Company for maintenance
to be done. The Soil and Water Conservation Office is also going to be contacted in connec-
tion with a slide which occurred on one of the dams.
City of Washington Flood Control Project,
Mr. Whalen stated that Mayor Stewart took this matter up with the Corps of
Engineers and the city will have to be the prime mover on,this project. The matter was
also taken up with Mr. Bourke of the Redevelopment Authority.

West Bethlehem Township Flood Control
Mr. Whalen stated that the County has considered this project, however,
nothing has moved on it. Mr. Whalen stated that he talked with Chairman Barshek of the
Township Supervisors in detail and they are sending copies of everything in their file on
the project.

Chartiers Creek Flood Control
Mr. Whalen, stated that he and Mr. Flynn discussed easements and right -
of -ways with John Yuhas. Mr. Yuhas. felt that the work was proceeding satisfactorily and
there should be no trouble in securing the easements and right -of-ways.
County Homes:
Mr. Whalen stated that after reviewing the Utility Review Program with
the County's medical staff, it �is their definite opinion that a separate set of guidelines should
be adopted. Mr. Whalen further stated that he wrote to Mr. Budd of the Pennsylvania State
Association of County Commissioners outlining these problems and Mr. Budd` replied back
stating that this matter was to be placed on the agenda of the July 27th meeting of the
Welfare Committee.
Mr. Whalen: I have set up a meeting for a week from tomorrow at which time Mr,,
Bontempo and Mr. Haberdank will be here with sketches and plans for the first phase of
remodeling the homes and material on the courthouse elevator.
Mr. Whalen also reported that the Window Industry was plagued with a
strike but the men should be here very soon to install the sample window.
Mr. Whalen informed the Board that Sheriff Debreczeni and Mr. Michael
Hanna, Solicitor for the Sheriff's Office will be attending the Annual Convention for the
Sheriffs Association of Pennsylvania from July 26 to July 30, 1972 at King of Prussia, Pa.
Mr. Whalen read correspondence under date of July 18, 1972, from Miss
Marcia Janosko, Caseworker, Child Welfare Services in reference to Wendy Gallo who is
presently residing in a feaster home and suffering from severe dental problems. Wendy is
to be treated at Children's Hospital with the estimated cost of the surgery being $435.00 to
$450. 00. Miss Janosko stated that the ,Child Welfare Services does not have sufficient funds
in their own budget to cover the`cost of this surgery and requested that the Commissioners
make available to them sufficient funds to cover the cost of the hospital stay.
Mr. Capano stated that after discussing the matter with Miss Janosko, he finds that there
is no other source of money available.
Moved by Mr. Jones, seconded by Mr. Paluso that the hospital bill to
cover dental surgery for Wendy Gallo in the approximate amount of $435. 00 to $450. 00 be

Mr. Flynn: Contract with John M. Felice Associates
Mr, Flynn presented to the Board a contract with John M. Felice Associates
Labor Relations Consultants for a one-year period and a nominal retainer in the amount of
$950. 00 plus $45. 00 per hour for negotiations and mileage. Said contract is for personnel -
labor relations consulting services and will remove the Commissioners from any direct
involvement in labor discussions.
Moved by Mr. Jones, seconded by Mr. Paluso approving the above contract
with John M. Felice Associates for personnel -labor relations consulting services for a
nominal retainer in the amount of $950. 00 plus $45. 00 per hour for negotiations and mileage.
