responsible for impelmenting the revenue sharing legislation now under active consideration
by the Congress. Under said legislation, most State and local governments are entitled to
receive funds directly from -the Federal Government without application. Mr. Shultz stated
that since this is a new program they may not have adequate titles and addresses for all
recipients and enclosed a card to be filled, out and returned no later than September 22, 1972,
Mr, Whalen made note that the card was mailed on September 13, 1972,
County Homes
Mr, Whalen: I talked with our architect yesterday, he has been in contact with the Depart-
ment of Labor and Industry in Harrisburg concerning our preliminary plans for correcting
the deficiencies at the homes. The gentleman from Labor and Industry has indicated to our
architect that at this particular time, they do not look favorably upon our using anything
except the first floor of those two buildings down there even after all the corrections have
been made. Our engineering firm is firmly convinced that the Department of Labor and
Industry is 100% wrong in this matter, that the construction is within the proper limits of
the life safety code of 1967 under which we are operating, and they have a conference in at
Labor and Industry on Monday morning at 10:00 with this gentleman and Mr. Habedank, our
architect, is going to be there and he called me yesterday and asked if I can attend with him
and I am scheduled in Harrisburg on Sunday afternoon anyway, so I told him that I would
definitely meet with him at Labor and Industry Monday morning. (a brief discussion was
then held)

Reports: Mr. Keery McAmbley - Italian Maid Bakery, Inc.
Mr. Keery McAmbley reported that the Commissioners received a request from
the Italian Maid Bakery, Inc., that the County finance an addition to the Bakery's building and
machinery and also to get a hold of their attorney. Mr. McAmbley stated that the attorney was
hard to get a hold of so he called the president of the company, Mr. Anthony Sabatasso.
Mr. Sabatasso explained that they were considering putting an addition on their building and
new machinery in their bakery at West Brownsville. Mr. McAmbley informed him that in 1969,
the County set up the Washington County Industrial Development Authority, and that this Author-
ity was fully equipped to finance such a project. Mr. McAmbley also told him that a project
such as this could be financed by a combination of Authority and PIDA financing, The Mon
Valley Industrial Development Corporation or the Charleroi Industrial Development Corporation
would be more than pleased to process their application to PIDA, and that we would be pleased
to take on with him after he got his building costs together and his machinery costs. Mr. McArz-
bley also explained to him that there would be no need of his company moving to Allegheny
County to secure State Financing since Washington County can and will give the same benefits
and service that any county in the State can give.
Mr. Jones: Bologna and Gvsegem Mine Strip Report
Mr, Jones: On Tuesday, Mr. Hormell and I were in Harrisburg. These were Pre -Hearings
on these cases. It boiled down to this on the Bologna case. The attorneys don't know whether
they are going to let us intervene or not. They said that since we got in late on the things in
1972 that they didn't think we were allowed to do this. So Mr. Hormell took the position that if
we aren't allowed to intervene in behalf of the people, they're violating our constitutional rights.
This was only a Pre -Hearing so a decision was not made, but they're going to notify us.

Mr. Jones: If you remember going back to the first part of the year when we had the first
hearing in the George Washington Hotel, we asked them to let us speak; and we presented
lenghty information. But they would not let us question the witnesses that they had at that first
hearing. Now, they said that they would. They are going to set another hearing so that we can

cross-examine the witnesses and bring out the facts that we have. We asked for it to be in
Washington County; but if not, in this part of the State. It will probably be in October or the
first part of November.
Old Business: Mr. Whalen
Mr. Whalen: Last week we reviewed the proposed contract with Hall & McChesney, Inc., for
updating the records system in the Recorder of Deeds Office. The real principle involved here
is to make space available. The present record system is now up to the last available book
space. This program has been about two and a half years in the making. Unfortunately, due
to some deaths in the County officials, this thing has been delayed several times. It is the sy-
stem that has been recommended. Mrs. Woodward is satisfied with it; the Bar Association has
reviewed it, and are satisfied with it. It is a continuing process that will finally wind up in
January of 1975. The total amount of this contract is $149, 935. The 1972 cost will be $12, 500,
It is a part of our capital budget for this year, and it is also a planned part of our continuing
capital budget. Following the review of this with Solicitor Capano, it is our recommendation
that the contract be executed.
Mr. Flynn: How do they suggest we pay this?
Mr. Whalen: The first installment will be this year, and then the County will pay nine (9)
quarterly installments of $12, 500 each, commencing October 1, 1972. The final payment is
$37, 435.
Mr. Paluso: Do you think it would make sense to hold that until we are working on our budget?
I think that would be the time to make a decision rather than commit ourselves now and then
have to work around it in case something should happen. It's only a month away. I think it
makes more sense to work it right in the budget.
(More discussion was held on this subject. )
Mr. Flynn: Personally, I don't think it would be wise. By the end of this year, the costs
could increase.

tract with Hall & McChesney, Inc., for updating the records system in the Recorder of Deeds
Office.

Chief Clerk read correspondence under date of September 11, 1972, from the
Washington County Firemen's Association, Inc., which stated that the Firemen's Association
Fire School at Arden Downs will be held on Saturday and.Sunday, September 23 and 24; and that
Fire Prevention Week is the week of October 8th through 14th. Letter requested $1, 000 for the
fire school appropriated by the Commissioners in their 1972 budget and also $300 appropriated
for their Fire Prevention Essay Contest, making a total appropriation of $1, 300.
Moved by Mr. Jones, seconded by Mr. Paluso, that the total sum of $1, 300 be
approved for payment to the Washington County Firemen's Association, Inc., as appropriated
by the Commissioners in their 1972 budget.

Chief Clerk read correspondence under date of September 19, 1972, from the
Washington County Firemen's Association, Inc., extending an invitation to the Board of Com-
missioners to the opening of the first Fire School to be held at Arden Downs county fair ground:,
Washington, Pennsylvania, on Saturday, September 23, 1972, at 8:00 a.m. (Mr. Jones was
designated by the Board to be the Commissioner present at this event. )
Chief Clerk read correspondence under date of September 15, 1972, from the
Washington -Greene County Tourist Promotion Agency requesting their fourther quarter alloca-
tion for the year 1972 in the amount of $4, 125. 00.
Chief Clerk informed the Board of correspondence received from Engineered Com-
munications, Inc., advising that the new radio base station equipment, purchased on the
matching fund arrangement between the Washington County Firemen's Association and the
County Commissioners, has been installed at the Midway Volunteer Fire Department and is
now in service. Letter stated that the attached check for the amount of $554.00 is their share
of the total costs and that this check and one from the County for the remaining 50% should be
submitted to RCA for complete payment of equipment.
Chief Clerk read correspondence under date of September 15, 1972, from Elliott
Bianchi, President, Monessen Public Library. Mr. Bianchi inquired whether the Board of
Commissioners is thinking of an allocation to the Monessen Public Library for the current

year. Letter then stated that records for non-resident borrowers are not maintained on a town
to town basis; but the librarian estimates conservatively that between 65 and 75 per cent of the
non-resident borrowers reside in Washington County. Mr. Bianchi then stated that it is hoped
that the Board can see its way clear to repeat the $1, 000 allocation as was made last year.
(Discussion was held on the above subject and appropriating money to the various regional
libraries. Chairman instructed Solicitor Capano to check into the statutory requirements
insofar as libraries are concerned. )
Moved by Mr. Paluso, seconded by Mr. Flynn, approving the appropriation of
$1, 000 to the Monessen Public Library.

Chief Clerk read a copy of correspondence under date of September 15, 1972, from
Michael Baker, Jr., Inc., directed to the Commonwealth of Pennsylvania, Department of
Labor and Industry - Subject: New Jefferson Avenue Bridge, Canonsburg Borough, Washington
County. Correspondence requested that Michael Baker, Jr., Inc., be furnished with the Pre-
vailing Minimum Wage for the above project.
Chief Clerk read copy of correspondence under date of September 12, 1972, from
Donald R. Dunwoody, Regional Parks and Recreation Advisor, directed to Mr. Michael George„
Director, Department of Parks and Recreation - RE: Mingo Creek County Park - Phase II,
500M Project #3-4-62-00-2. 1. Correspondence stated that the Department of Community
Affairs has received the Part III documentation for Contracts No. 1, 2, 3, 7, 8, and 9. How-
ever, said Department has not received the Part III information for Contracts No. 4, 5, and 6,
which involve work to be performed by the Carnegie Natural Gas Company, West Penn Power,
and the Bell Telephone Company. Letter then advised that the Department of Community Affairs
cannot prepare a Grant Contract and authorize an advance payment for this entire project until
the Part III documentation, executed contracts, and related information are received for con-
tracts No. 4, 5, and 6.
Mr. Murphy: At the present time, the Carnegie Natural Gas Company's contract has been sent
This morning we executed the West Penn Power Company's contract, and it is in the hands of
Mr. Michael George to be sent. The Bell Telephone Company has written their letter which
has been accepted by the Board,
Mr. Capano: Mr. Murphy, I think we should get on these people's backs to make sure we get
our copy of the executed contracts back.
Chief Clerk read correspondence under date of August 17, 1972, from Eugene Ten-
aglia, Bridge Engineer, which stated that on August 16, 1972, in the Borough of Elco,

Mr. Tenaglia met with Mr. George P. Haley, Mayor of Elco, Mr. Dan Cox, Jr., and Mr. Alvin
Gainer concerning a low water bridge on Woods Run. Mr. Tenaglia stated that he thinks this
job can be done with the Washington County Bridge Department at a very low cost. Mr. Tenaglia
also recommended that it be done in November or December, when the water is low or frozen
due to the fact that they have to drill into solid rock to make footers. The approximate cost of
said job will be in the amount of $2, 700.
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing Mr. Eugene Tenaglia,
Bridge Engineer, to proceed with the work concerning a low water bridge on Woods Run as per
above.

Chief Clerk read correspondence under date of September 13, 1972, from A. M.
Lombardi, Jr., Co -Chairman, Washington County Task Force on Aging, directed to Mr. Richar 1
Lee Johnson, Vice -President, Health Services, A. T. Kearney and Company, Inc, Letter
stated that the Commissioners of Washington County, finding themselves in a predicament
common to mostly all their counterports - that is, health and related care for the aged, have
created a Task Force to study this problem. Letter then stated that said problem is one which
has a diverse background and a variety of alternatives suggested for solution. Hence, the Task
Force is now at the point where they feel a Consultant is needed to help resolve this county -wide
problem. In conclusion, letter stated that said Task Force would be interested in said company'
background in working with counties to help resolve similar problems.
Chief Clerk read correspondence under date of September 14, 1972, from David J.
Kolesky, Executive Director, Pennsylvania Economy League, Inc. Correspondence stated that
in -reply to the Commissioners' request that the Washington County Branch of the Pennsylvania
Economy League, Inc., undertake a study to determine the extent of assessment inequities in
the Bethlehem -Center School District, said League regrets to inform the Board that they cannot
honor said request for the following reason: The Pennsylvania Economy League, Inc., even
through it is a governmental research organization, does not engage in municipal appraisal pro-
jects; and, therefore, does not have staff knowledgable in the field of property appraisal. Letter
then submitted comments and observations.
Chief Clerk read correspondence under date of September 13, 1972, from O. Bard
Judy, District Conservationist, Soil Conservation Service. Mr. Judy stated that he has been in
contact with the Carroll Township Supervisors and the Carroll Township Planning Commission ir.
regard to the mine refuse area of the U. S. Steel. Mr. Judy then advised the Board that the S0i13
Inventory and Evaluation Report for Area Resource Planning willbe prepared for the Supervisors
and the Planning Commission by September 15.

Chief Clerk read correspondence under date of September 15, 1972, from Janet
Abernathy, Secretary, Addictive Diseases Council. Correspondence stated that the Greene
County Commissioners suggested the names of three Greene County residents who are particu-
larly interested in alcoholism to be added to the membership of the Washington -Greene County
Advisory Council for Addictive Diseases. Letter then stated that at its last meeting, the Addic-
tive Diseases Council expressed its willingness to add these three men to the 13 Washington
County residents appointed to form the Council last December. Letter also stated that Dr. Lauda
suggested that perhaps the Washington County Commissioners would be good enough to send out
a letter to each of these men formally notifying them of their appointments to membership to the
Council. They include: Dr. Gordon Jones, Kenneth Willison, and Rev. Robert E. Borland.
Deputy County Controller Criquellion entered the meeting.
Chief Clerk read correspondence under date of September 11, 1972, from Walter N.
Peechatka, Executive Secretary, Department of Environmental Resources, State Soil and Water
Conservation Service. Letter stated that on January 1, 1973, the four-year term of one farmer
member will expire as director of Washington _County's soil and water conservation district and
also the term of the county commissioner member. Attached to said letter was a list of new
nominating organizations approved by the State Soil and Water Conservation Commission during
the last year. A second list contains those nominating organizations which should be deleted
from the approved list.
Chief Clerk read correspondence under date of September 11, 1972, from David E.
Smith, Planner, Southwest Region, Governor's Justice Commission. Enclosed were copies of
the letter from Jack France, Chairman of the Criminal Law Committee, Washington County Bar
Association, and a letter from said Commission's Office to the Harrisburg Office, requesting
that said Commission undertake a study of the court system in Washington County. Letter states.
that it is said Commission's intent to utilize previous studies as a basis for studying the Wash-
ington County System. This approach, combined with technical assistance from the Law Enforce -
m.ent Assistance Administration, should provide a solid foundation from which to analyze the
system from initial arrest through to jury verdict. Letter then stated that said study has been
discussed with members of the District Attorney's Office, the Court, and the Bar Association,
all of which are in agreement tha t they study should be conducted. Letter requested that the
County Commissioners give their approval of this study with the understanding that it will be of
zo cost .whatsoever to the County.

Commission to undertake a study of the court system in Washington County as per above with

Administrative Assistant Whalen reported that there has been considerable confusion
in some press releases related to MH/MR. � Under date of September 14 a letter came out on
possible loss of Funds Available to Pa, for SRS Title I and Title IV -A Contracts and the MH/MR
"Drawdown" of these funds. In this particular letter they warned that there will probably be no
money available for the new programs under MH/MR. On Sepft*rhber 18, another letter was
received; the subject was the September 14th letter.

Mr. Whalen then read correspondence from the Department of Public Welfare under
date of September .18, 1972 - SUBJECT: Letter of September 14, 1972. Letter stated that the
Conference Committee has resolved the House and Senate versions of the Revenue Sharing bill.
The new committee bill will not sharply decrease the funds available to Pennsylvania for social
services. Therefore, the Department of Public Welfare will not be canceling their purchase
of service contracts. However, this experience clearly pinpoints the general feeling of key
members of the United States Senate regarding rapidly rising social service costs. There is
still a possibility that additional restrictions will be added to this source of funding. Letter
also stated that paralleling the Federal activity, the State is attempting to improve its system
of assuming that said Department are,purchasing needed services for eligible clients at a
reasonable cost.
Liquid Fuels Account Encumbrances:
Mr. Whalen: The next item I have concerns,the review of our existing, funds within the Liquid
Fuels Account on which we have encumbered. We are reviewing all the encumbrances that
have been inactive for the past six to twelve months or older. The largest one is in the Boroug z
of Donora in which they have an encumbrance of $50, 000 for the Thompson Avenue Bridge. I
have written them on two occasions and finally got a reply dated -September 15, 1972.
Mr. Whalen then read -correspondence from Thomas E. Petrus, Borough Secretary,
Borough of Donora, which stated that in reference to the Thompson Avenue,Bridge there has
been a lack of communication between the Borough, Engineer, and PennDOT; but that said -
Borough is still very much interested in said project. Mr. Petrus stated that within a week he
hopes to have more detailed information to submit to our office.
Window Replacement:
Mr. Whalen stated that all the contracting arrangements have been completed with
the contractor for the Window Replacement and the delivering sehedule on the windows and
the installation remains the same,
Mr. Whalen read correspondence under date of September 13, 1972, from Raymonc.
Foote, Revenue Agent, Farview State Hospital. - RE: Per Diem Rates. Letter stated that
during the month of August said office received notice from the Department of Public Welfare
that the per diem rates for all hospitals were increased effective August 1, 1972; and that they
were instructed all billings should reflect the new billings immediately. Letter also stated that
s ince all billings from s aid office are done on the last day of the month, they showed the in-
crease in the August 31st billing for the month of August. Letter further stated that neither
said Revenue Agent nor Farview State Hospital sets the per diem r-ates.- All rates are establish-
ed by the Department of Public Welfare.

Mr. Whalen read correspondence under date of September 15, 1972,- from Senator
Austin J. Murphy concerning proposed previsions to the election laws. Mr. Murphy stated
that on August 24, 1972, he voted in favor of a series of bills that would have clarified all of
the registration and voting procedures. Regrettably, this bill was defeated in the Senate but
will be brought back for an early vote in September. Mr. Murphy assured the Board, of 'his
favorable vote at that time.
Earth Slide -Contract - Washington County Airport
Mr. Whalen informed the Board that he received Frank Gavlik & Sons, Inc. Is pro-
posal on the Washington County Airport in the amount of $24, 150.

Solicitor Capano read correspondence under date of September 18, 1972, from
William C. o Porter - IN RE: Paul Ciaffoni and Emile Lerby Property,. Cross Creek Park.
Mr. Porter stated that Robert Ciaffoni, agent for Paul Ciaffoni, has advised Mr. Porter that
unless we are willing to pay the interest or detention money they have demanded, they will call
off the settlement agreement and proceed with appointment of viewers and hearing in this matter.
Mr. Capano: I discussed this matter with Mr. Porter the other day. This will probably
necessitate an additional expenditure of $1, 500 to $2, 000, Mr. Porter feels that we ought to
accept it rather than go into Court on the matter. Therefore, I recommend that you go on
record authorizing this additional expenditure.
Moved by Mr. Jones, seconded by Mr. Paluso, authorizing the additional expendi-
ture of $1, 500 to $2, 000 in the case of Paul Ciaffoni and Emile Lerby Property as per above.
