PALUSO, COMMISSIONERS Minute No. 42 Office of the County Commissioners Washington, Pa., October 26, 1972 The Board of County Commissioners met in regular session with the following mem- bers being present: Commissioners Jones and Paluso. Absent being: Commissioner Flynn. Also present being: Chief Clerk Murphy; Administrative Assistant Whalen; Assistant County Solicitor Hormell; Reporter Budinger of The Observer -Reporter; and Reporter Roule of The Monongahela Publishing Company. Meeting called to order by Acting Chairman and roll call taken: Mr. Jones - Present; Mr. Paluso - Present; Mr. Flynn - Absent. Acting Chairman asked if there were any corrections, additions, or omissions to Minute No. 41, each Commissioner having received a copy. as read. Moved by Mr. Paluso, seconded by Mr. Jones, that Minute No. 41 be approved, Roll call vote taken: Mr. Paluso - Yes; Mr. Jones - Yes. Motion carried unanimously. Reports - None Old Business - None Correspondence - Mr. Murphy Moved by Mr. Paluso, seconded by Mr. Jones, authorizing the payment of the following bills: 1. McClelland-Yuhas & Associates, Incorporated - $210 - for survey of slide area - Washington County Airport 2. William C. Porter - services rendered - Mingo Creek Park - RE: Lewis Property ($29. 50) - Nickeson Property ($29. 50) - TOTAL - $59.00 Approved by Clay Graham 3. Carl G. Baker and Associates - $982.43 - for plans for Life Safety Code for Washington County Health Facilities (Approved by F. D. Whalen) 4. Carl G. Baker and Associates - $1, 321132 - for engineering services for design of new boiler for Home for Aged Women and for renovations to Jail and Courthouse (Approved by Anthony Bevec) Roll call vote taken: Mr. Paluso - Yes; Mr. Jones - Yes. Motion carried unanimously. Chief Clerk informed the Board of the request from the Washington County Agricul- tural and Home Economics Extension Service for the remaining balance of $3, 494. 00 of their budget allotment. PALUSO, COMMISSIONERS G Chief Clerk read correspondence under date of October 19, 1972, from the Human Relations Commission which stated that said Commission is most grateful for the privilege of using one of our stately and impressive court rooms for a Public Hearing on October 13, 1972. - Chief Clerk read correspondence under date of October 17, 1972, from Norman W. Lyon, Director, Citizens Library. Letter stated that since old county records Wre being micro -- filmed, Mr. Lyon thought the Commissioners should know that there are a considerable number of volumes of old records of wills, deeds, tax receipts, treasurer's receipts, and road and building expense books in the basement of Citizens Library. Mr. Lyon stated that he did not know how they came, to be there, but he presumes that the county employees brought them there at the time the building was put in use. Mr. Paluso suggested to turn this over to the Recorder's Office and request for their recom- mendation in writing. Chief Clerk read correspondence under date of October 20, 1972, from Vincent Zic- cardi, Public Defender Project, which stated that they will be visiting the office of the Public Defender and meeting with Mr. John P. Liekar on Thursday afternoon, November 2, 1972. Letter stated that the purpose of the interview will be to learn about the efficiency, effective- ness, and needs of the Public Defender in Washington County. (Mr. Merdian entered the meeting.) Chief Clerk read correspondence under date of October 16, 1972, from West Beth- lehem Township which stated that the Supervisors of said Township wish to express their appreciation and gratitude to the Washington County Planning Commission for their cooperation and assistance pertaining to business of the Township. Letter also stated that they would appreciate it very much if the Commissioners would give the Planning Commission their per- mission to work for and with the West Bethlehem Township Supervisors to update the town of Marianna. Mr. Jones: I think we should extend as much help as we can. (More discussion was held on this matter between Commissioner Paluso and Jack Merdian. ) New Business: Mr. Jones (Appointments to Tally Board) The following were appointed to the Tally Board to work on Election night, November 2, 1972, for the counting of absentee ballots: Mrs. Willie Mae Wright, Washington, Pa, - appointed by Commissioner Flynn Mrs. Cheri Bartolozzi, Dunlevy, Pa. - appointed by Commissioner Jones Margaret Wilson, Washington, Pa. - appointed by Commissioner Paluso Mr. Bugaile of WKEG Radio and Reporter Liesch entered the meeting. 352 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. PALUSO, COMMISSIONERS Assistant County Solicitor Hormell read the following from an Opinion from the Secretary of the Commonwealth in regards to the counting of absentee ballots: "All special ballots listing only President and Vice -President candidates must be counted at the court house commencing at the closing of the polls. Ballots from voters who are qualified to vote for all state and local candidates as well as President and Vice - President, but which ballots have been received after five o'clock p.m. of the Friday before -the election, but before the closing of the polls on election day must be counted at the court house at the closing of the polls. A special election return board must be convened on election night in order to count these ballots at the Court House. Members of that special board shall be appointed in teams of three by the County Board of Elections. Each County Commissioner must appoint one member of each team, Again, I wish to caution you that those absentee ballots valid only for Presidential and Vice -Presidential elections which are counted at the Court House on election day, must be kept separate from all other ballots, even after the count has been made. " More discussion was held on this subject. (Legal Aid Society) Mr. Paluso: Yesterday I attended a three-hour meeting of the Legal Aid Society. The OEO funds part of the Legal Aid Society; we do not have the State participation. One of the new requirements is that we have to merge with Fayette County so it will be Washington -Greene -Fayette County Legal Aid Society. However, there isn't any in Fayette County at the present time. . The man from OEO says that we. have to take them in without any official action. I say that the Fayette County Commissioners have to sign an agreement of some sort or someone has to back up their participation in this. - I would like -you to do a little background on it. I want the Fayette County Bgard of Commissioners to have to enter into an agreement if and when this merger takes place. Mr. Hormell: I will take care of this. Solicitor: Mr. Hormell Assistant County Solicitor Hormell- presented two (2) Tax Refunds to the Board. for their consideration and approval. Moved by Mr. Paluso, seconded by Mr. Jones, that the Tax Assessment Office be authorized to prepare the following tax refunds due to either duplication or overpayment of real estate tax: 1. RE: Oppenheim, Jay P. Speers Borough Request for refund has been made in re the above -captioned tax account. Attached find Xerox copy showing that 1972 county tax was over -paid in the amount of $55. 58. Amount of tax due by Jay P. Oppenheim was reduced by Correction Slip Dated June 29, 1972. Kindly issue check in the amount of $55. 58 to CHARLEROI FEDERAL SAVINGS AND LOAN ASSOCIATION, First Street and McKean Avenue, Charleroi, Pa. 15022 2. RE: Krivitsky, Ronald & Shirley Ellsworth Borough Request for refund has been made in re the above -captioned taxpayer. Attachedfind Xerox copy and duplicate tax receipt showing over -payment of $7. 52. Tax Adjustment #579 reappraised property and reduced tax accordingly. Kindly forward refund check in the amount of $7. 52 to CHARLEROI FEDERAL SAVINGS AND LOAN ASSOCIATION, First Street and McKean Avenue, : Charleroi, Pa. 15022 Roll call vote taken: Mr. Paluso - Yes; Mr. Jones - Yes. Motion carried unanimously. Assistant County Solicitor Hormell reported that on September 28, 1972, the County Commissioners by Minute No. 39 approved the sale of County property to the Fife Moving and Storage Company, which was the Brad Williams property. Mr. McAmbley's office and the County Industrial Development Agency are now ready to proceed on that sale. They have sub- mitted to the Board for review all the necessary data. The amount of the sale was $9, 500. Moved by Mr. Paluso, seconded by Mr. Jones, directing the Solicitor's Office to petition the Court for approval for the sale of the above -mentioned property; said action based 354 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS on the recommendation of Assistant Solicitor Hormell. Roll call vote taken: - - Mr. Paluso - Yes; Mr. Jones - Yes. Motion carried unanimously. Mr. Hormell: -Last week we approved the agreement between the Washington County Industrial Development Agency and Crile. After that meeting, there was a change requested in the agree- ment. The original agreement provided that if the County did not complete the work on or be- fore June 1, 1974, that Crile would have the right to undertake the completion of said work. After we had the agreement signed and took it back to the other party, more discussion took place. Now they want it changed to be as follows: "after completion of the work specified in Paragraph 3 (c) and prior to issuance of Certificates of Completion by Agency to Contractor, Crile, upon written notice from Agency shall have thirty (30) days to review said work and if no written objections are made to any of the aforesaid work by Crile within said period of thirty (30) days, the Contractor may be paid and no claim shall be made thereafter by Crile against County and Agency for any work not completed. If said work is not completed on or before June 1, 1974, Crile shall have the right to institute an action for breach of contract against County and Agency for damages covering all costs and expenses which shall be required to complete said work in accordance with this Agreement. Mr. Hormell: I think this is a definite improvement on the previous provisions. I would like to have the new section inserted in the minutes and a motion made to re-ekecute the agreement containing the new clause. Moved by Mr. Paluso, seconded by Mr. Jones, authorizing the re -execution of the agreement between the Washington County Industrial Development Agency and Crile with said new clause inserted. Roll call vote takenf Mr. Paluso - Yes; Mr. Jones - Yes. Motion carried unanimously. Mr. Hormell:. Last Friday, Mr. Jones and myself attended a conference in Pittsburgh with the Southwestern Pennsylvania Regional --Planning Commission. The purpose was a committee that Mr. Jones was involved in after a meeting that had taken place on the 7th of August to discuss park development in the six -county region. They had quite a comprehensive study ready for submission to this special committee; and in turn, it will be submitted to the Regional Planning;' Commission. As you will recall, the Commissioners here were very much interested in river - front parks. At the time of this meeting last Friday, Mr. Jones wanted some immediate action taken on that. They had done some research on it and taking into consideration such things as the present availability of land, low river bank, etc., but they are well on their way to approving sites. At the motion of Mr. Jones, which was passed unanimously, the SPRPC approved this concept; and they indicated that any action taken by any of the County Commis- sioners in any of the counties involved with these three rivers would meet with their approval.
