11:30 a.m. - Opening of Bids for Flags and Markers for Veterans' Graves
The following bids were opened and read by Controller Elish:
(NOTE: Mr. Hormell first read a memorandum from Elmer Obitko, Director, Department of
Veterans' Affairs, which stated that he inadvertently opened the following envelope with the rest
of his mail. As soon as he saw the check inside, he immediately sealed it with scotch tape. He
stated that he did not see the amount of the check or any other contracts. Mr. Hormell stated
that since there was only one bid, he would not question this matter.)
(a) Furnishing and Delivering of Markers for Veterans' Graves:

Moved by Mr. Paluso, seconded by Mr. Jones, that all bids be turned over to the
Solicitor for his perusal and if they are in order that they be brought up at the next meeting to
be approved.

Chairman asked if there were any corrections, additions, or omissions to
Minute No. 55 and 56, each Commissioner having received a copy.
(Correction by Commissioner Paluso - Minute No. 55)
(1) Page 16 - Amended to Read- Moved by Mr. Jones, seconded by Mr. Paluso authorizing
another signature to be affixed to the forementioned agreement between C. Vance DeiCas trading
as McDonald Associates Engineering and the County of Washington due to questions raised
concerning proper procedure for signing official documents.
Chairman requested that the minutes show that even though he was not present at the meeting
whereby the Agreement between Mr. DeiCas and the County was approved, and did not make or
second the motion, he did sign the Agreement due to the fact that Mr. Paluso refused to sign,
making a second signature on the Agreement which was recommended by Solicitor Hormell as
per Minute No. 55, dated February 8, 1973.
Moved by Mr. Jones, seconded by Mr. Paluso that Minute No. 55, as correc-
ted be approved, and that Minute No. 56 be approved as read.

Old Business: None
Special Order of Business: Chairman stated that there would be a Special Order of Business
in order that Mr. Norman Lyon of the Citizens Library of Washington could make his presentat-
ion to the Board.
Mr. Lyon presented to the Commissioners a proposed agreement between
Washington County and Citizens Library for the purposes of (1) improving the quality of public
library services in Washington County, as empowered by The Pennsylvania Library Code
(1961, P. L. 324, as amended), (2) extending free public library services to more residents of
Washington County, and (3) providing an incentive to townships, boroughs, cities, and school
districts to increase their support of public library services. The agreement is in conjunction
with the federal government's proposed withdrawal of aid for library service in Washington
County, and will cost the County approximately $158, 157. per year. According to the plan

submitted by Mr. Lyon, Citizens Library, which is the center for the Washington District,

would be the designated agent and would receive and expend all funds to local libraries. Mr.
Lyon had previously submitted to the Board a proposal for a bookmobile service throughout
the County, but stated that the present plan would save $60, 000. 00 after the first year and
would prove to be a better arrangement for the County libraries. The funding will be primarily
supported by a 75� per capita grant for each qualifying library in the County and also approxima-
tely $91, 000. 00 to help establish three (3) new libraries to be located in unserved portions of
the County. Revenue Sharing money in relation to funding the project was also discussed.
Chairman Flynn made reference to a letter under date of February 16, 1973
from Josephine M. Stephens, M. D. stating her hope that the Commissioners will continue to
contribute to the library in Monessen since the local library in Monongahela is run for the
benefit of the school children and contains little good adult reading. Dr. Stephens further stated
that to have to pay a fee as a non-residential borrower at the library would be an addition to
the already heavy burden of the taxpayer.
Mr. Lyon made reference to various tables contained in his proposal showing
the population standing of the areas concerned, 1971 contributions to the libraries and a map
pinpointing areas served and unserved by library service. A discussion was held on Mr.
Lyon's proposal and in conclusion Mr. Flynn assured Mr. Lyon that the Commissioners are
very concerned and will have to consider the matter very seriously.

Chief Clerk informed the Board of the receipt of the following checks:
(1) Ck. #61-023403 in the amount of $116 0. 93 for Foster Care Payment for
the month of November, 1972.
(2) Ck. #32-032233 in the amount of $15, 000. 00 for first, second, third, and
fourth payments for the grant for Washington County Senior Citizens Center.
Chief Clerk read correspondence under date of February 15, 1973, from
Michael George, Director, Department of Parks and Recreation submitting for approval two
(2) Change Orders from Recreation Equipment Unlimited, Inc. in regard to the picnic tables
and benches at Mingo Creek County Park.
(1) Change Order in the amount of $427. 50 - re: adding of four (4)
bolts to each picnic table and raising the top of the table from a
10 inch to a 12 inch level above the seat (approved by Mike George)
(2) Change Order for increase in contract price from $10, 800 to
$` 11, 866. 50. Total increase in the amount of $1, 066. 50 to cover
increased labor and lumber costs.
Chief Clerk read correspondence under date of February 7, 1973, from
Recreation Equipment Unlimited, Inc. directed to Mr. Walter M. Gladkowski, Grisowld,
Winters & Swain in reference to the second change order above. Said letter stated that

due to the circumstances surrounding their contract (picnic tables for Mingo Park) they have
found that the unusual delay in the actual notification to proceed has put them in a higher wage
bracket and several price changes on Douglas Fir. As a result they have found that they need
an additional $7. 11 per table in order to have a satisfactory financial transaction.
Mr. Flynn: Well I would suggest this gentlemen, on the first one, I would recommend
that we approve that. On this second one that is part and parcel to his calculated risk when he
accepted the bid and when he was awarded the contract. I would suggest that we turn it over
to our legal department for adjudication.
Moved by Mr. Paluso, seconded by Mr. Flynn that the above Change Order in
the amount of $427. 50 in reference to the addition of four (4) bolts to each picnic table and rais-
ing the top of the table from a 10 inch level to a 12 inch level above the seat be approved for
payment.
A brief discussion was held on the picnic tables at the park.

Chief Clerk read correspondence under date of February 9, 1973 from the
U. S. Department of Housing and Urban Development directed to Michael George, Director,
Department of Parks & Recreation advising that the requisition submitted by the Parks Depart-
ment in relation to the Open Space Land Program has been approved in the amount of $15, 125. OQ
and submitted to the U. S. Treasury Department for payment. Letter further stated that the
Treasury Department will mail the check for deposit directly to the Parks and Recreation bank
account or their depositary and a deposit slip from the bank or depository should be received
immediately thereafter. Chief Clerk read further correspondence from F. D. Whalen,
Administrative Assistant directed to First National Bank and Trust Company in reference to
County Parks & Recreation Account #06-0000-9600 attaching a copy of Advice of Direct Deposit
of Grant or Loan Check in the amount of $15, 125. 00 and requesting the bank to advise the
Commissioners upon receipt of the funds.
Chief Clerk read correspondence under date of February 20, 1973, from Miss
Louise Abel, Director, Child Welfare Services, stating that the Child Abuse Committee which
was established as a result of a successful conference held on Child Abuse last April, has
established Parents Anonymous, a group with the purpose of helping to prevent the problem of
child abuse. A phone has been placed in one of the homes of the members which the Washington
County Health and Welfare Council has given money for to pay the installation and monthly
service. Because of seemingly objection by some members of the Health and Welfare Council

Abel for the Child Welfare Services to assume the monthly telephone bill in the amount of
$11. 50 each month for the remainder of 1973.

Chief Clerk read correspondence under date of February 15, 1973 from
Metro Petrosky, Jr. , Director, Adult Welfare Services, informing the Commissioners that
the volunteer services for the County Homes is opening its office as of February 20, 1973. Mr.
Petrosky invited the Commissioners to come downand present the keys to the Volunteer Services
Director, Miss Sharon Russell.
Chief Clerk read further correspondence from Metro Petrosky, Jr. under
date of February 16, 1973 enclosing a list of disadvantages of the California Senior Citizens
Center at their present location in California and the advantages that they would enjoy at the
new location, 313 Liberty Street, the former residence of the Minister of the California
Methodist Church. Also enclosed was a copy of the minutes of the meeting held by the
California Area Senior Citizens on February 6, 1973. Chief Clerk also read the following
Resolution in connection with the above.
RESOLUTION
BE IT RESOLVED, that the membership of the California Area Senior Citizer. s
Center has given its approval to the moving of its operation from 244 Second Street to 313
Liberty Avenue, California, Pa, 15419,
This ' has been accomplished, unanimously, by a vote of the membership
occurring on Tuesday, February 6, 1973.
The contemplated move of the operation will transpire upon thirty (30) days
notice to the present lessor, Mr. and Mrs. Charles Teslovich of 408 Camfield Street,
Pittsburgh, Pa. 15210.

Citizens so that lease arrangements can be entered into with the Church.

Chief Clerk read correspondence from Frank Gene Pallette submitting his re-
signation as the Judge of Elections in the 3rd Precinct of the First Ward in Canonsburg due to
health reasons.
Chief Clerk read correspondence from Mrs. Yola Pallette, submitting her re-
signation as the Minority Inspector of Elections in the 3rd Precinct of the First Ward in
Canonsburg also for health reasons.
Mr. Whalen: On November 20, 1972, Mr. Flynn and I met with Secretary Paul Smith of
Labor and Industry and the Secretary of the Industrial Board, Mr. Weaver at which time we
asked for a hearing to establish temporary and adequate safety corrections as interim measures
pending a final decision on the disposition of our County Homes. We have now been advised
that this hearing has been scheduled for Tuesday, February 27, at 11:00 a. m. in the Labor and
Industry Building in Harrisburg. This requires of course also the attendance of a Registered
Architect and Mr. Robert Graham of Carl G. Baker and Associates has made another inspec-
tion at the two homes and he is prepared to make an official report to the Labor and Industry
Board.
New Business: Mr. Jones - Mon Valley Expressway
Mr. Jones reported that the official groundbreaking ceremonies for the Mon
Valley Expressway will be held on Thursday, February 22, 1973 at 10:00 near the Hughes Ford
Garage on Route 40. A press conference will be held after the affair with a luncheon to follow
at California State College.
Mr. Jones read correspondence under date of February 20, 1973, from Charles
O. Bohner, Director, Washington County Civil Defense in reference to the weekly Monday
radio and siren tests on the Washington County Civil Defense Warning Network. Mr. Bohner
stated that due to circumstances beyond his control, effective Monday night, March 12, 1973
the 8:00 p, m. and 9:00 p. m. hours check of the Washington County Civil Defense Fire Radio
and warning will not be made. However, the weekly monday night test from the Washington
County Control, Washington Police Station will be made at the usual time at 7:00 p. m. each
Monday night.

Pennsylvania 19442 for the amount set forth in their bid, this being the lowest and only respon-
sible bid received and in accordance with specifications. Also included in this motion is that
the contract for Flags for Veterans graves be awarded to COLLEGEV ILLE FLAG & MFG.
COMPANY, 4th and Walnut Street, Collegeville, Pennsylvania 19426 for the amount set forth
in their bid, this being the lowest and only responsible bid received and in accordance with

Mr. Flynn: Now what I want to bring to the attention of you gentlemen is this: In the news
media there have been several stories referring to these Pennsylvania Labor Relations Board
Hearings whereby they go on to say that the Commissioners claim that they have the right to
hire and fire while the Pennsylvania Labor Relations Board contends that it remains a respon-
sibility of the County Salary Board. That is not the case. The Pennsylvania Labor Relations
Board has moved that the Commissioners are the employers, period. The County Controller
petitioned the Board to intervene based on the fact that they say they are part and parcel. And
also since the election here the Courts, through their Court Administrator, Mr. David Posner
have also petitioned to intervene. Now the Courts feel that they should be part and parcel to the

Salary Board and they should be part and parcel 'to contractural arrangements and agreements,
the Controller feels that they should be. So there is your clarification. The Pennsylvania
Labor Relations Board did not say, they said we are the employer, period. It is the Controller
and the Courts that have filed a Petition to Intervene. I want to clear this up because they are
saying that the Pennsylvania Labor Relations Board contends they are responsible for the
County salary. They don't take that position. They realize that we are the corporate power.
The Board of County Commissioners are the corporate powers. We are to negotiate and execute
contracts, and nobody else. However, judging from what took place in Pittsburgh yesterday,
and some of the petitions presented to the Board for consideration. One of them claimed that
the Commissioners are not the chief executives. So I raised the question if we are to concur
in thinking with the gentleman who presented the petition that the Commissioners are not the
chief executives, that he please enlighten me just who is the chief executive? Would it be the
Controller, would it be the President Judge? Would it be the County Treasurer, maybe the
Prothonotary, I don't know. But they do say that we are not the chief executives. Everybody
wants to get in on the act, everybody wants to tell you who you shall hire, everybody wants to
tell you how much you're going to pay them,all you can do Mr. Jones, as a Majority Commiss-
ioner, you and Mr. Flynn, all the responsibility is on your shoulders, is to raise the necess-
ary money.
Mr. Hormell: May I interject at this point, I think that everyone should know just where we
sit with the procedure. The matter has already been decided by the Pennsylvania Labor Re-
lations Board and as Mr. Flynn has said that Board has decided that Washington County is the
employer and then gone on to say the appropriate officers to represent Washington County are
the County Commissioners. To that order the County Controller has taken exception and the
Courts have taken exception stating that the Pennsylvania Labor Relations Board is wrong and
that they should either overrule themselves or the court should overrule them. I think that
accurately sets the stage. In the event the Labor Relations Board continues in its opinion and
affirms its opinion, then its going to be up to the Court and it will be up to Mr. Elish as to
whether or not anything further will be done. In the event that they overturn it, then I would
say it would be up to the Commissioners to determine whether anythigg further will be done.
Now what would be done further? The agreed party, whomever it might be would take the'
matter into the Commonwealth Court which has jurisdiction over any dispute coming from a
State Agency. It might be interesting at this point also to note that although the Labor Relation:,
Board did give the Court through Mr. Posner the privilege of speaking, the Pennsylvania Labor
Relations Board has not recognized our Court as being a party to theses proceedings and in fact
the Labor Unions involved presented a petition stating that the Court had no business in the

matter and they didn't even want them heard. So the Labor Relations -Board did give them

the privilege of speaking but they are reserving judgement on that too. I think that supplements
what you said Mr. Flynn. Note was made that there is another case scheduled for March 23,
1973.

Mr. Whalen read correspondence under date of February 22, 1973, from Michael R.
Flynn directed to Helene Wohlgemuth, Secretary, Department of Public Welfare, regarding the
reconstructing of the Washington -Greene. County Addictive Disease Program, Said letter advisee.
thatthe Washington -Greene County Commissioners have selected the Drug and alcohol Planning
and Implementation Council. Also submitted were the names of the appointees, their term of
office and a brief resume of their respective backgrounds. Six appointments originate from
Washington County, and the remaining five being Greene County appointments.
Mr. Flynn stated that this is a requirement of the Governor.'s Justice Commission on Drug and
Alcohol Abuse,
Mr. Whalen read correspondence under date of February 26, 1973, from James L. Knox;
Director, Washington -Greene County Addicitive Disease Program, which informed the Board
that the new Planning and Implementation Council for the Washington -Greene County Addictive
Disease Program held its first regular monthly meeting on Friday, February 23, 1973, at
7:30 p.m. in the Yorkin Building. Letter stated that an election was held, and the following
Council members were placed in the offices indicated:

Mr. Whalen read correspondence under, date of February 21, 1973, from J. Phil Doud,
Director, Bureau of County Audits, Office of the Auditor General. Letter advised the Board
that a representative of the Department of the Auditor General, Commonwealth of Pennsylvania,
will appear in our office on March 5, 1973, to audit the Liquid Fuels Tax Fund Account.
Mr. Whalen read correspondence under date of February 16, 1973, from Governor Milton
T. Shapp which stated that the Governor urges the County Commissioners to use a portion of

in their County that the Federal government is cutting. Governor Shapp stated that he has
recommended that the State pick up a portion of the Federal cutbacks in programs to aid senior
citizens and for day care programs that are now operating in most counties. Mr. Shapp then
stated that preliminary estimates indicate that the loss of Federal funds to support programs
at all levels of government in Pennsylvania will exceed $3 50 million. In conclusion, Mr. Shapp
stated that he is urging that local governments put some of their Federal revenue sharing funds
to use along with State funds to assure that vital programs continue. Because of the uncertainit,y
of the total cutbacks at this time, Governor Shapp suggested that the Board consider holding a
block of federal revenue sharing funds in reserve for now to be put to these uses when the situa-
tion becomes more clear.
Mr. Whalen read correspondence under date of February 23, 1973, from the Music
Performance Trust Funds which acknowledged the Board's contribution of $1, 000 for the Loc.

Mr. Whalen read correspondence under date of February 25, 1973, from Mrs.
Charles Martin, Jr., which brought to the Commissioners' attention Route 837 starting from
Monongahela to Elrama. Mrs. Martin stated that this road is terrible to travel on, sinking
and bumpy; and that at night it is hard to see because there are not any lights.
Mr. Flynn suggested that the letter be acknowledged and point out that it is not the County's
responsibility.
Mr. Whalen read correspondence under date of February 26, 1973, from Louise R.
Brown, Manpower Planning Director, Office of the Mayor, City of Pittsburgh. Ms. Brown
stated that it has been about a year since she first met with Mr. Flynn regarding the unemploy-
ment problems in Washington County and efforts to develop a comprehensive area -wide man-
power planning system in the Pittsburgh Standard Metropolitan Statistical Area, comprised of
the City of Pittsburgh, Allegheny, Beaver, Washington and 'Westmoreland Counties. At that
time, Mayor Flaherty had expressed a strong interest in developing a plan to better coordinate
the Area's manpower programs and to improve the delivery of manpower services to the poor
and unemployed. Correspondence stated that President Nixon announced in his Budget Message
that manpower programs would be decentralized to the local elected officials, without federal
special manpower revenue ,sharing legislation. This would mean that local elected officials
would become the "prime sponsors" for the implementation of manpower programs in their
jurisdiction. Said office is of the understanding that the Mayor and the County Commissioners
will receive manpower funds for their jurisdictions, instead of separate contracts to the variou
public and private non-profit agencies. Mrs. Brown requested to meet with a designated in-
dividual of the Board's staff to further discuss the details of this effort; and since time is of
essence, Ms. Brown hoped that March 7, 1973, would be an acceptable date for said meeting.

Mr. McAmbley and to forward a copy of said letter to him.
Mr. Whalen read correspondence under date of February 28, 1973, from Miss
Louise Abel, Public Welfare Administrator III, Child Welfare Services, which stated that the
Annual- Central Region Child Welfare League of American Conference is being held from March
28 through March 30, 1973, in Toronto, Canada. Miss Abel would like to send two workers to
this conference. The registration fee is $30. 00 per person or a total of $60, In addition, there
are meals and lodging which would approximately be $120, 00.

Mr. Whalen read correspondence under date of February 1, 1973, from Keith E.
Frederick, Executive Director, Mid -Monongahela Valley Council of Governments. Letter stated
that in past years,' the annual dues for the county was set at $7, 071. However, it is the feeling
of Mr. Massafra and other COG officials that the dues rate for Washington County was too high
and that it should be reduced in half to $3, 535, per year,

to -the Mid -Monongahela Valley Council of Governments for dues for the years 197.2 and 1-073.

Mr. Whalen: A question came up at the last meeting concerning the liability insurance coverage
for the Senior Citizens Centers of which we have at least six. To protect the County of a sound
coverage of the two that are operating, we are in the process of preparing some detailed infor-
mation concerning the coverage for these. So as soon as this is received, we can clarify that
subject.
Mr. Whalen reported on a hearing before the Industrial Board which he and Mr.
Flynn attended on Tuesday of this week. Mr. Whalen stated that, Mr. Flynn reported to the
Industrial Board that the County did not want to enter into extensive repairs with the old homes
and that it was the intent of the Board to replace the current structures with new facilities as
soon as possible, Mr. Graham, representing Carl G. Baker and Associates, presented some
corrections that they recommended be made as interim corrections and pending the final dis-
position of the home question. Mr. Whalen summarized the population of the two homes as of a
year ago - February 23. Mr. Whalen stated that pending approval by the Industrial Board of the

interim request, they asked that the Industrial Board permit the County to re -open the admissions
on that basis. In other words, we would still agree to non -ambulatory patients on the first floor;;
and ambulatory patients on the second floors. The Board advised- that their answer would be
forthcoming within a week to ten days.

:Status of Collective Bargaining Matter)
Mr. Hormell: We have received a certification from the Labor Relations Board certifying that

SEIU, AFL-CIO has been designated the exclusive representative for all professional non -court
related employees and also has been designated as the exclusive representative for all non-
professional non -court related employees. No exceptions were filed to this order. The questior
of who is the bargaining agent is still up in the air. With respect to non -court related employee.,
exceptions have been filed by the Controller. A decision has not been made on that. Until that
decision is made, there is no decision as to who is the proper party to negotiate on behalf of the
County - whether it be the Commissioners as such or whether it be the Salary Board. With rela-
tion to Court related employees, it is further complicated by the fact that in addition to excep-
tions having been taken by the Controller, exceptions have also been taken by the Court. Initiall.,r,
the Labor Relations Board ruled that the Court did not have the right to participate. A motion
was filed to dismiss the Court's petition, and now the Court has filed a motion in reply to the
motion to dismiss. So that matter is in the state of limbo.
Mr. Hormell stated that he received correspondence from C. Vance DeiCas, Pro-
fessional Engineer, McDonald Associates Engineering, advising the County Commissioners that
said company has not been paid. Letter also stated that a claim will be made for interest of the
unpaid balance due them. Mr. -Hormell stated that he prepared, as he was so instructed, a Com-
plaint in Mandamus against the Controller and that he presumed that the Sheriff had handed it to
the Controller, but he was not sure of that.
Chairman Flynn informed the Board and all those present of an interesting bulletin
prepared by the Commissioners of Election, Harrisburg, Pennsylvania, which is in reference
to the forthcoming election.
Mr. Flynn also informed the Board and all those present of the receipt of the Final
Report of the Joint Ferry Commission. Mr. Flynn stated that he will make arrangements to
meet with the Planning Commission and for a subsequent meeting with the Fayette County Com-
missioners to take final action on this matter.
Mr, Michael George, Director, Department of Parks and Recreation, presented
to the Board a check in the amount of $130, 000 which was awarded to the Washington County
Department of Parks and Recreation for use in developing new facilitie-s at Mingo Creek Park.
Moved by Mr. Jones, seconded by Mr. Paluso, that the meeting adjourn.
