Chairman asked if there were any corrections, additions, or omissions to Minute No. 67 and 68, each Commissioner having received a copy. (Messrs. Elish and Nasin entered the meeting) Old Business: Mr. Paluso Mr. Paluso read correspondence under date of May 10, 1973, from George E. Anthou, Esquire, regarding a report submitted to Mr. Jones by Solicitor Hormell in reference to various purchases of tax delinquent property by certain elected or appointed officials of Washington County. Mr. Anthou stated that his name was included as a purchaser and made note that he bought this property on behalf of a client while he was engaged in private practice and not yet having been appointed Assistant District Attorney, Mr. Anthou further stated that there was no impropriety on his part nor was said purchase violative of any law of this Common- wealth, and requested the Commissioners to make the necessary and appropriate corrections at the next board meeting so as to reflect the true nature of his involvement in the premises. (a brief discussion was held) Solicitor Hormell stated that he feels that Mr. Anthou does not have accurate information, that he stated that the purchases were valid in his opinion and that one newspaper had given a wrong impression of his statements. Solicitor Hormell also recommended that Mr. Anthou's letter be made part of the record and that a photostatic copy of the part of the report in question pertaining to Mr. Anthou be sent to him. Correspondence: Mr. Murphy Chief Clerk informed the Board of the receipt of the following checks: 1. Commonwealth of Pennsylvania - payment for foster home and institutional costs (Child Welfare) for the month of February, 1973 - $1, 290. 68. 2. Commonwealth of Pennsylvania - payment for foster home and institutional costs (Child Welfare) for the month of January, 1973 - $1, 133. 26. 3. Commonwealth of Pennsylvania - 50% reimbursement on $1, 800. 00 paid by County of Washington to John C. Piganell, Chief Juvenile Probation Officer, and one Probation Officer to attend the Annual Training Institute of The Pennsylvania Association on Probation, Parole and Correction at Titusville, Pa., on May 20-23, 1973, and that a check in the amount of $160. 00 be issued to Mr. Piganell for all expenses. Gump, Chief, and Charles Toth of the Department of Parks and Recreation to attend the Washington County Law Enforcement School for the week of June 11, 1973, with no charge to the County. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a memorandum under date of May 14, 1973, from F. D. Whalen, Administrative Assistant, stating that the Fiscal Report"to the Commonwealth of Pennsylvania with regard to the two County Home Facilities has been drastically changed by the Auditor General's Office and without full understanding of the methods and manner in which to complete this report, it is going to be an impossibility to be constructive. Mr. Whalen stated that there was a seminar on May 14, 1973, at the Sheraton -Harrisburg Inn and after discussing the matter with Mr. Jones and Mr. Flynn, and in accordance with their direction, he authorized Mr. i 600 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. Moved by Mr. Jones, seconded by Mr. Paluso, approving the action taken by Commissioners Flynn and Jones in authorizing Mr. Charles Crouse to attend the forementioned. seminar in Harrisburg. (Mr. Jack Merdian of WJPA entered the meeting) Chief Clerk read correspondence under date of April 26, 1973, from Representative John L. Brunner in referrence to several inquiries regarding the financial burden of the Yablonski trial. Mr. Brunner stated that he contacted, among other people, the Governor's Office, and enclosed a copy of a letter which he received relative to the matter. Mr. Brunner further stated that if they don't get a favorable reply in the near future, they intend to introduce special legislation. In connection with the above, Chief Clerk read correspondence under date of April 17, 1973, from Ralph D. Tive, Special Assistant for Legislation directed to Representative Brunner stating that he has been in touch with Mr. Charles McIntosh, Budget Secretary, and that as soon as they have a discussion on this matter and involve the Adjutant General, he will let Mr. Brunner know the outcome. Also in connection with the above, Chief Clerk read corres- pondence from Ralph D. Tive, Special Assistant for Legislation, directed to Representative Roger Raymond Fischer which was relatively the same as the letter directed to Mr. Brunner. Chief Clerk read a memorandum under date of May 9, 1973, from Administrative Assistant Whalen directed to Chairman Flynn concerning the failure of the hotwater heating coils at the County Jail. Memo stated that the water is presently being heated by the auxiliary coil which is not in moderately good condition and a failure of this unit could be expected at any time. Mr. Whalen stated that in accordance with Mr. Flynn's direction, he has authorized Building Superintend ent Bevec to arrange for the replacement of this unit on an emergency basis, and therefore it will be necessary that this action be confirmed at the next regular meeting of the Board of County Commissioners. Mr. Murphy stated that the hotwater heater is now in working order and took 2 days to install. Moved by Mr. Jones, seconded by Mr. Paluso, approving the installation of a, new hotwater heater at the County Jail due to an emergency situation which developed between the regular board meetings. PALUSO, COMMISSIONERS Motion carried unanimously. Chief Clerk read correspondence under date of May 2, 1973, from David W. Sweet, Field Representative, Southwest Region, Governor's Justice Commission, thanking Mr. Whalen for his assistance in planning the Criminal Justice Seminar held at Washington and Jefferson College. Mr. Sweet also commended the staff of the Commissioners' Office for their efforts in {helping to put on the program. Chief Clerk read correspondence under date of April 19, 1973, from Alfred A. Gwaley, Chairman, Washington County Fund Drive, Penn's Southwest Association, stating that a fund drive is currently being conducted in Washington County to raise funds for Penn's South- west Association. A contribution card for the Commissioners' consideration was enclosed with said correspondence, Mr. Paluso attended a luncheon in reference to the above and informed the Commissioners of the purpose behind the fund drive. Mr. Paluso also highly recommended that the Commissioners participate in this drive. Chairman stated that the matter would be tabled until the next regular board meeting and formal action would be taken at that time. Chief Clerk read correspondence under date of May 3, 1973, from Thomas E. Nbrgan in reference to the relocation of Interstate 70 in southwestern Pennsylvania. Said cor- respondence enclosed a letter from Claude S. Brinegar, Secretary of Transportation, regarding this matter. Mr. Jones stated that Penn -DOT is holding a public hearing on Thursday, May 24, 1973, at 3:00 p.m. at the Penn -DOT district office in Uniontown, Pa., at which time the Com- missioners may air their views concerning this relocation. Mr. Jones further stated that Mr. Sember has been perusing this matter and should attend this public hearing along with one of the- Board members, Moved by Mr. Jones, seconded by Mr. Paluso, that Mr. William Sember, Acting Director of the Washington County Planning Commission and the Board of County Commissioners3 be authorized to attend the abovementioned public hearing. Chief Clerk read correspondence under date of May 1, 1973, from George Yaksic, a member of the Smith Township Planning, ,Commission, commending the Commissioners for the active role they have taken in the Municipal Officials Training Classes and for the, vital contri- bution they are making to the County. Mr. Yaksic stated that the Commissioners have shown great dedication in their efforts to establish progressive programs which will give the citizens the opportunity to lead fuller and more rewarding lives. Chief Clerk read correspondence under date of April 30, 1973, from George W. ,e MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Frazier stating that on Saturday, April 21 st, he and a group of Webelos scouts from Peters Township had the pleasure of having Mrs. Martha Kulp as their nature trail guide through Mingo Creek Park. Mr. Frazier stated that Mrs. Kulp did a fine job and commended the people who make the nature trail guides possible. Chief Clerk read correspondence under date of May 8, 1973, from C. Vance DeiCas, P. E. , McDonald Associates Engineering, in reference to the Airport Slide. Said letter stated that with the coming of good weather, Frank Gavlik and Sons were authorized to start work again on the correction of the slide. They are now removing the wet material from the slide and stor- age areas. Under Gavlik's present contract,' there wasn't any barrow area designated and when the construction started in the fall of 1972, a barrow area was established on the north side of the west end of the runway. Due to excess ground water, a new barrow area south of the west end of the runway is being established and this will eliminate any damage to the area adjacent to the runway. Mr. DeiCas stated that he would like to bring to the Commissioners' attention the deterioration of the entrance roadway and roadways around the present hangers, and with liquid fuels available, recommended the County pave these areas as soon as possible. Chief Clerk read correspondence under date of May 14, 1973, from Charlotte K. Lane, Executive Director, Washington -Greene County Tourist Promotion Agency, inviting the Commissioners to the opening ceremony of the Fourth Annual Bicycle Tour. The starting point will be the parking lot at the Washington -Jefferson College at 9,00 a. m. Saturday, June 23. There will be three rides on Saturday--65, 50 and 25 miles. Four rides on Sunday--65, 50, and 25 and a 15 mile historical ride. Proclamation Moved by Mr. Jones, seconded by Mr. Paluso, proclaiming the day of May 21, 1973, as World Trade Day and call upon all citizens to cooperate in observing the day with the business community and local officials in activities to enhance the importance of world trade to our local economy and to our relations with other nations. New Business: Ten Mile Creek Park Moved by Mr. Paluso, seconded by Mr. Jones, that the 50� admission and parking fee and the 50� fee for the launching of boats in Ten Mile Park be abolished with the understand- ing that the fees may be reinstated at any time if the need arises. Motion carried unanimously. 1 MINUTE BOOK 605 BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS E 1 Chief Clerk read a telegram under date of May 15, 1973, from Congressman Thomas E. Morgan announcing the approval of a grant by the Office of Economic Opportunity in the amount of $21, 000. 00 to the Washington -Greene Community Action Corporation to begin July 1, 1973, and run for 6 months. Controller Elish presented to the Board the following issue: PASS TRIAL For the Pass case which is to begin on June 14, my solicitor Frank Roney, Charles Gillespie and I are meeting with Mr. Richard Sprague and members of his staff, the Erie Counts Controller, and Representatives of the Common Pleas Court of Erie tomorrow morning (May 18, 1973) in Erie to determine policy and procedure in handling the costs of this case. I am recommending the following: 1. That we are billed directly for all necessary expenses of this case, and that Erie County will not act as an intermediary for us, except in an extreme emergency for some vital expenditure or expenditures. 2. I, or some member of my staff, will be in Erie daily if necessary to supervise and audit each expenditure as it occurs. Mr. Elish stated that as the bills occur and are audited by him and his staff in Erie County, they will be brought to the County Commissioners for approval and payment. Mr. Elish further stated that the County will be reimbursed for all State Police expenditures. Mr. Hormell stated that it should be understood that the auditing and approving of the bills by the County Controller is still subject to the approval of the Board of County Commissioners. Nfr. Paluso recommended that in the Pass Trial, the State Police be billed directly for expenses incurred by them and not Washington County. Moved by Mr. Jones, seconded by Mr. Paluso, approving the above recommenda- tions as submitted by County Controller Elish insofar as the Pass trial, which is scheduled for June 14, 1973, is concerned. Roll call vote taken: Mr. Jones - Yes; Mr. Paluso - Yes; Mr. Flynn - Yes. Motion carried unanimously. Chief Clerk read a memorandum under date of April 6, 1973, from Robert M. Scheipe, Chief Clerk, directed to persons who requested printed matter in reference to a charge for legislative printed matter. Said memo stated that House Bill 535, presently before the House of Representatives will allow the Legislature to begin charging a fee for Histories, Bills Journals and other printed matter. This bill resulted from the increased costs incurred in printing and mailing legislative printed matter and also conferences between the Chief Clerk of the House and the Secretary of the Senate. The matter was cleared with the Governor's Office and it is anticipated that the bill will become an Act very shortly. The fee for this material will be announced as soon as formal action is taken on House Bill 535. (Messrs. Elish and Roney left the meeting) Chief Clerk read a memorandum under date of May 2, 1973, directed to Michael R. Flynn, Chairman from F. D. Whalen, Administrative Assistant, in reference to the Catsburg , 606 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR , EDWARD M. PALUSO, COMMISSIONERS Project - City of Monongahela. Said memo stated that since there had been no action taken in, said matter since October, 1972, and feeling that the Commissioners would be faced with another inquiry from the City of Monongahela, on March 13, 1973, Mr. Whalen requested that Mr. Sem- ber of the Planning Commission submit to the Commissioners an up-to-date report on any and all developments since that time. Attached to said memorandum was a copy of a report made by Mr. Floyd Laubham dated March 28, 1973, which outlines the current status of the project and the _.alternatives that could be considered. In conclusion, Mr. Whalen stated that as of April 30, 1973, he is advised by Mr. Sember that another inquiry has been received from the City of Monongahela in this regard. In connection with the above, Chief Clerk read correspondence under date of March 28, 1973, from Floyd A. Laubham, Analysis Planner, stating the particulars of the project. At the con- clusion of his correspondence, Mr. Laubham stated that for the present, the Catsburg project is in limbo and perhaps County and Monongahela City representatives should.meet to discuss joint action on the matter. A brief discussion was held. Moved by Mr. Jones, seconded, by Mr. Paluso, authorizing Mr. William Sember of the Planning Commission to arrange a meeting between the Board of County Commissioners and the City of Monongahela to discuss a plan of action in regards to the Catsburg Project. Corcoran, Deputy Executive Director, Governor's Council on Drug and Alcohol Abuse stating that after a review of the vitae of Mr. James Knox, he was found qualified for the MH/MR and Specialist position. Chief Clerk read correspondence under date of May 14, 1973, from F. D. Whalen, Administrative Assistant, in regard to the Chartiers Flood Control Project stating that on Thurs- day, May 10, 1973, he talked with Mr. Robert Zeman, Esquire, Special Legal Counsel for this project, relative to the current status of acquisitions, right-of-ways, easements, etc. An inquiry has been received from Mr. Ferguson of the Pa. Dept. of Environmental Resources concerning the status of reimburseable expenses for the period ending June 30, 1973. Mr. Zeman will review his files and will contact Mr. Ferguson with a wri.tcien up-to-date report. Mr. Whalen further stated that on Friday, May 11, 1973, he met personally with Mr. Vance DeiCas of McDonald Associates, the engineer of record on this project, to discuss the current status of his work. Up to this time, Mr. DeiCas has not received any work from the Corps of Engineers with regard to amending the specifications to narrow the channel especially at the MINUTE BOOK 607 BOARD OF COUNTY COMMISSIONERS WASH NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, FRANK JONES, JR., EDWARD M. PALUSO, COMMISSIONERS Jefferson Ave. Bridge Site; and as a result, he has not been extremely active at this particular time. Both Mr. Zeman and Mr. DeiCas have advised that until the Corps of Engineers come up with a modification at the Jefferson Avenue Site that the acquisition costs will probably be beyond the economic possibilities of the County to continue the project. Mr. DeiCas will get in touch with Mr. Whalen as soon as he has contacted Mr. Leonard Lucas to determine the position of the Corps of Engineers. Chief Clerk react correspondence under date of May 15, 1973, from Mr. John L. Merdian, Chairman, Washington County Planning Commission, stating that in a letter dated May 8, 1973, the WCPC informed Mr. Whalen and Mr. Murphy that William Paul Gilbert who had been approved by the Salary Board for employment with the Planning Commission, would not, after all, be working for the County. Mr. Gilbert was hired as a Senior planner at a salad, of $12, 000 and was to begin employment on May 14. Mr. Merdian further stated that the per- sonnel committee of the WCPC interviewed Mr. Kenneth J. Krupa as a replacement for Mr. Gilbert. Mr. Krupa has excellent qualifications for the position of Senior Planner and can begin employment on July 2, 1973, at a salary of $11, 000 with the understanding that once he completes his Masters Degree, he will be given the difference between his starting salary and the budgeted amount - $12, 000. 00 for this position.
