said Court Order is in reference to a matter which came up a month ago whereby the
President Judge has issued a ruling on the County to show cause why the expenses for
going to school for the magistrates should not be paid by the County. County Solicitor
Capano informed the Board that Judge Richard DiSalle dismissed the petition. -
County Solicitor Capano read correspondence under date of April 9, 1970,
from Mrs. Virginia Bendick, which stated that she was very disappointed to have learned
that the County had leased a Magistrate Office in Burgettstown. Mrs. Bendick stated in
her letter that she was considered an applicant as records will show and despite- promises
both written and by telephone, her space was rejected by not being given the courtesy of
andnspection. County Solicitor Capano made reference to a letter under date of April
13, 1970, directed,to Mrs. Bendick which stated the boundaries ,for Burgettstown were
directly under the control of Judge Sweet. Mr. Capano stated that when the Chief Clerk
went to examine the premises offered in Burgettstown he informed Mr. Capano that Mrs.
Bendick's premises were outside of the area defined and therefore could not, be considered
Mr. Flynn: My assumption is that Mrs. Bendickr had been misinformed. Judge Sweet
designated the area in Burgettstown. If anybody has any accusation to make, let them
come forward. The Commissioners represent ,the people of this County.
Commissioner Bevec read correspondence under date of April 13, 1970,
from Stanley A. Miller, Secretary, Department of Public Welfare, Subject: Level of
State Reimbursement for Interim Care Placements. Correspondence stated that in
recognition of increased costs of care in private licensed facilities under the interim
care program, effective May 1, 1970, the State will participate in a maximum monthly
allowance of $335. 00, or the usual monthly charge of the facility, whichever is the lesser
If a client is admitted or discharged from a facility during a given month, the charge
in which the State will participate will be at a rate of $11. 00 per day or the daily charge of
the facility, whichever is the lesser, for the number of days lin residence that month.

The Board of County Commissioners met in regular session with the
following members being present: Commissioners Revec, Mazza, and Flynn. Also
present being: Acting Chief Clerk Mildred Ivery; County Solicitor Ca.pano; Mr. John D.
Anthony - Director, Washington_ County Planning Commission; Deputy Controller Whaler
Mr. Roland Bourke - Executive Director of the Redevelopment Authority; Mr. Larry
Zimmerman - The Redevelopment Authority; Mr. George Roule representing The
Monongahela Publishing Company; Reporter Coleman of the Brownsville Telegraph;
Reporter Robertson of the Observer -Reporter;�and Public Information Officer Huber.

Chairman asked if there were any corrections, additions, or omissions
to Minute No. 114, each Commissioner having received a copy.

Special Order of Business: , _
Chairman stated that the regular order of business would be dispensed
with in order that Mr. Roland Bourke, Executive Director of The Washington County
Redevelopment Authority, could make a presentation to the Board of County Commissior
ers in relation to the progress of the Curry Field Project. Mr. Bourke also presented
slides of (1) a Mall in Maryland and (2) the existing conditions in Canonsburg.
Mr. Flynn: Thanked Mr. Bourke- for his presentation
Mr. Bourke left the meeting.
Mr. Zimmerman left the meeting.
Unfinished Business:
Report on Harrisburg meeting concerning Ferry service.
Mr. Mazza: At the meeting held last Wednesday in Harrisburg with the Department
of Community Affairs on behalf of the Board Mr. Anthony and myself attended the
meeting in conjunction with leaders from the local district in Fayette County and also a
few legislators in Fayette - Greene Counties. Also, I believe one or two Senators were
in attendance for this meeting. We traveled lightly on the cost of this service. There
are other complications that would involve the Public Utility Commission and the
Department of Highways. I'll let Mr. Anthony continue from here.
Mr. Anthony: On April 15, 1970, Commissioner Mazza and myself met with Dan Rolens,1
Deputy Director of the Department of Community Affairs, to determine if the

Commonwealth could participate in the costs (capital and operating deficit) related to
the restoration of the three ferries at (1) Allenport & Fayette City; (2) Newell & Coal
Center'; and (3) Fredericktown & East Millsboro. Four- studies had been done -'prior to
this meeting and these studie's showed that it would cost a minimum of $150, 000; 00 in
capital expenditures`to resume the needed equipment for the three ferries and that these
three ferries would run an annual operating deficit of at least $4400. 00. The State
legislation did not include ferries as a form of mass transit and until the legislation
was amended no participation would be forthcoming., Also, the passenger count was
too low to operate these ferries to be considered as elegible under that criteria:- The
Commonwealth did indicate that if either of these restrictions were renewed they would
provide a 50%n grant on capital expenditures and cover 2/3 of the operating deficit. If
and when PAT extends rapid transit lines into Washington County, the Washington
Planning Commission recommends the following action:
(1) ThAt the County Commissioners wait until the State
legislation is amended to insure that the Commonwealth
will participate in this project.
(2) Try ,to determine what other bodies could participate
financially.
(3) Follow closely the activities of Fayette County which could
look into the legal aspects of forming a joint authority.
(4) Instruct the Washington County Planning Commission to
continue to cooperate closely with Fayette County and the
local municipalities.
Acting Chief Clerk read correspondence under date of April 14, 1970,
from L. S. Cook, Manager - Allenport Plant, Wheeling - 'Pittsburgh Steel Corporation,
which stated that Wheeling - Pittsburgh Steel Corporation, Allenport Plant, support
the Washington County Commissioners and other community officials interested in the
much needed ferry service across 'the Monongahela River: Said letter further stated
that said corporation is particularly' interested in the ferry service between Allenport
and Fayette City and feel that it would be beneficial to the 'employees of the Allenport
Plant and residents of the valley.
Acting Chief Clerk read Correspondence under date of April 21, 1970,
from A. J. _DeMedio, Legislator -49th District, which stated that upon receiving a call
from Mr. Edwin Bickhart of the Department of Community Affairs advising Mr. DeMedic
of the need for certain legislation in order to facilitate the receiving of state aid for the
ferries at Fredericktown, , Coal Center, and Allenport, Mr. i DeMedio immediately
contacted Mr. Milton Wiseman of the Legislative Reference Bureau at the Capitol
and instructed him to prepare a bill amending the Mass Transportation Assistance
Authority Act of ,1967 to include ferries within its purview.

Acting Chief Clerk read correspondence under date of April 21, 1970,
from Eugene Tenagli. a, Bridge Engineer, which, stated that the Centerville Borough
Council would like to reconstruct a, borough bridge located -on Emery Hill road which
spans the Fish Pot Hollow stream. The Council, would life to make this bridge a two-
lane bridge because it carries a heavy load of traffic and all the school bus,es,., The bri
would cost approximately $21, 080,: 00
Moved by Mr. Bevec, seconded by Mr. Mazza, that the above request

County Solicitor informed the ,Board that at the last regular board meeting
(Per Minute No. 114 dated April 16, 1970) the Commissioners approved a contract with
NCR which was a Maintenance Agreement Contract. Mr. Capano stated that it has become
necessary to change the effective date. New- effective date is May 1, 1970 thru and includ-
ing May 31, 1970.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the new effective date
for the above contract, as amended, be approved by the Washington County Commissioner*.

Acting Chief Clerk informed the Board of correspondence, under date of
April 15, 1970, from Elias S. Cohen, Commissioner, Office of Family Services, ,which
enclosed a check in the amount of ,$3750. 00 as payment under the Grant -in ,Aid program,
Services for the Aging. This sum covers the Commonwealth's share for the first and
second payments of the 1970 grant for the Program Developer. Cheek to be deposited
in Account 309.

Acting Chief Clerk read correspondence under date of April 20, 1970, from
Orvillo Wold, Air Pollution Control Technician, Region V, addressed to Mr. Tony
Mastrangelo, Superintendent of Washington County Home & Hospital for Men, which stated
that the smoke plume coming from the stack of the said County Home was observed on
April 16, 1970. Said correspondence stated that smoke plume is in excess of the limits
set forth in Section 1. 3 of Air Pollution Commission Regulation -IV Said correspondence
enclosed a copy of the Ringlemann test.
Mr. Flynn: The Commissioners were notified by the two Superintendents of both County
Homes concerning -the above problem. Our understanding is that the surrounding nei
have formed together and drawn up ,a petition regarding the smoke stack. The ;Commiss
ers will have to, take some action on this problem. Mr. Mazza, Mr. Bevec, and myself
have discussed this and have come to the conclusion that we will have to engage the
services of a heating engineer to make a feasibility study and then make recommendations
to the Commissioners ,to change the present heating system.

Commissioners engage the services of a heating engineer to make a feasibility study and
to make recommendations to the Commissioners to change the present heating system at
the Washington County Home & Hospital for Men and the Washington County Home for Aged
Women, and also the Washington County Courthouse and Jail.

from Honorable Dale F. Shughart, Chairman, Juvenile Court Judges' Commission,
directed to Juvenile Court Judges, Board of County Commissioners, and Chief Juvenile
Probation Officers, stating that because. of the State's.financial problems, there will
be no state funds allocated this ,year to stage the Summer Work Experience Program.
Said correspondence stated that hopefully this program will be re-established next year.
Acting Chief Clerk read correspondence under date of April 16, 19,70,
from Gerald N. Massaro, Director - Southwest Region Pennsylvania Crime Commission
directed to Joseph Feconda, Warden at County Jail, which stated that the Pennsylvania
Crime Commission has favorably approved the request for funds in the amount of
$13, 844. 00.

Charles F. Hess, Director - Department of Agriculture - State ,Soil and Water Commisg
ion , which stated that ;the application for cost -sharing on the Wheeling Creek Watershed
under the 1970 program has been receiveddn said office. Correspondence stated that
as soon as said Department can determine the extent that said Department will be able
to cost -share on the Wheeling Creek Watershed, a visit will be arranged with the
Washington County Commissioners to discuss the terms of the agreement
Acting Chief Clerk read correspondence under date of April 15, 1970,
from Gabriel P. Betz, Professor of Geography - California State College, which
commended Mr. Floyd Laubham for his time and energy in securing participants and
in organizing the program for the Spring Geography Conference held on Saturday, April
11, 1970. Said correspondence stated that Mr. Laubham is a valuable member of the
Washington County community.
Acting Chief Clerk read correspondence under date of April 17, 1970,
from Andrew Speller, Director - Division of Fiscal Management, which stated that the
Mental Health and Mental Retardation Program's request for the period 4/l/70 to 6/30/7
has been approved for payment and forwarded to the fiscal offioA--s for further process
Said correspondence stated that the following adjustment was made on said request:
The amount of $114, 559. 00 is being approved by the Department of Public Welfare in
place of $188, 250. 00 which was requested by Washington County.

be authorized to advertise for bids for one(1) car and one Side Door Delivery Station Bus
for the Sheriff's Office and the Sealer of Weights and Measures respectively. Said bids
to be received at the Office of the County Controller;, Washington County Courthouse,
Washington, Pennsylvania, until 11:00 a. m. , • Daylight Saving Time, May 28, 1970 and
opened immediately thereafter in the office of the County Commissioners.

program of Careers in Social Work for the Child Welfare Services. Employment to be
effective Monday, June 15, 1970, for a period of ten weeks. Salary to be paid by the
Department of Public Welfare; County to pay transportation expense.

Acting Chief Clerk read correspondence under date of April 16, 1970, from
Audley Crumrine, Executive Director of Washington County Housing Authority, which
advised the Commissioners that the Housing Assistance Administration has recently
cancelled said Authority's reservation for 70 units in Monongahela due to inactivity on the
part of the local community in pursuing this project. Also, the Authority has been
notified that the Annual Contribution Contract which is held with the Housing Assistance
Administration for 132 units in the Borough of Charleroi has been terminated for the same
reason - lack of progress and inactivity on the part of the local community in furthering
redevelopment where 100 units for the elderly was to be located.

Probation Officer, which stated that statistics have been compiled so that the Commission

Acting Chief Clerk read a memorandum under date of April- 21, 1970, from
Robert M. , Johns, D. D. S.,, Acting Project Director, directed to Administrators of
Non -Profit Health Facilities - In re: _ Applications for FY-1971 Health Facility Construct
Funds (Hill -Burton), which stated -that the Pennsylvania Department -of Public Welfare
is asking that hospitals and other health facilities that -are considering application for Hill
Burton construction, funds during the fiscal year July 1970 through June 1971 file a letter of
Preliminary Notification of Interest prior to submitting a formal Letter of Intent. Said
Preliminary Notification should be sent to the Office of Medical Services and Facilities,
Harrisburg, no: later than April 30, 1970.

(Amendment to Resolution adopted January 22, 1970) be adopted and that the County
Solicitor be authorized to prepare the necessary papers to borrow from Pittsburgh
National Bank the sum of Two Hundred Fifty Thousand ($250, 000. 00) Dollars as part of
the authorized aggregate amount adopted in the Resolution of April 23, 1970, at the rate
specified:

WHEREAS, the Washington County Board of Commissioners authorized,
by Resolution duly adopted January,22, 1970, the borrowing of an aggregate amount of
One Million ($1, 000, 000. 00) Dollars in anticipation of taxes to be collected for the current
fiscal year of 1970, to conduct the regular and .current affairs of Washington and pay all
lawful expenses; and
WHEREAS, it has become necessary to borrow an additional sum of Two
Hundred Fifty Thousand ($250, 000. 00) Dollars;

in anticipation of taxes to be collected for the current fiscal year, the loan (s) to be
evidenced by the certificate (s) of indebtedness of the County,in form acceptable to the
banks, payable on or before December 31, 1970, with interest from the date (s) thereof
at a rate of 4. 064% per annum,payable at quarter -annuals, said loans and interest to be
repaid from the .first monies available;fr;om taxes in anticipation of which such temporary
loans and interest were made; - which taxes .are hereby appropriated for that purpose, and
that the Budget of the County for the current fiscal year and the taxes levied shall include
and be sufficient to repay said loan (s), and that any two (2) of the Commissioners be and
they hereby are authorized to execute and deliver in the name of the County Commissioner
and the County the certificate (s) of indebtedness which shall constitute the general
obligation (s) of the County, and that the Chief Clerk of the County Commissioners be,
and he hereby is, authorized and directed to attest such certificate (s) of indebtedness
and affix the County seal thereto, and further that the execution and delivery of a

Resolution be adopted:
RESOLUTION
WHEREAS: The Washington County Commissioners realizes the inportance of Planning
in providing guidance in economic development, and
WHEREAS: The Washington County Planning Commission and professional staff have,
for the past ten years provided the residents of Washington County with a
very valuable service in the field of planning for the future development
of Washington County, and in recognition of the dedicated group of
prominent citizens. NOW THEREFORE BE IT RESOLVED, the
Washington County Commissioners, commend the Washington County

Solicitor:
Mr. Capano: The Controller's Office called to my attention and also to the attention of
the Commissioners that they did not find on record a resolution declaring the work to
be performed at the County Jail as being in a category as an emergency. Our check of
the records confirmed the statement made by the, Controller's Office to us. However,
I feel and I am quite, certain that a statement of emergency had_been declared and a
resolution adopted even though we did not find it in the record. -It could have been that
the resolution was inadvertently omitted from the minutes. Therefore, J suggest that
the following resolution be adopted as a reaffirmation and bo nfirmation of a resolution
intended to be adopted on February 26, 1970, and that the resolution be made a part of
the minutes and record on February 26, 1970.

- RESOLUTION
WHEREAS, the Board of Commissioners have consulted with State and
Federal Prison Inspection Officials and have been informed by these State and Federal
Officials, that the present condition of the Jail makes it impossible to provide the
extraordinary security precautions needed for this type of prison population, and
WHEREAS, these State and Federal Officials have recommended certain
essential improvements be made immediately in order to provide adequate security in
and around the Jail and proceeding by the normal practice of submitting the work to
competitive bidding would result in considerable delay;
THEREFORE BE IT RESOLVED, this 26th day of February, 1970, that
an emergency exists in and around the Washington 'County Jail as per Section 1802
paragraph (b) of the County Code and that work begin immediately waiving the bidding
requirements as per the above quoted section of the County Code.

Solicitor Capano presented for the Board's approval a deed submitted by the
Tax Claim Bureau. Solicitor stated that the person to whom the deed was executed has
since died. The original deed was lost and never recorded and the purpose of this deed
being to replace and duplicate the original deed issued.
Moved by Mr. Bevec; seconded by Mr. Mazza, that the Board of County
Commissioners execute the above said deed and that the Chairman of the Board, Michael
R. Flynn, acknowledge as attorney in fact.

be submitted to the Commonwealth of Pennsylvania as an overpayment on the 1968 Small
Watershed Agreement; said overpayment applies to the Redevelopment Authority Contract
of the County of Washington.

Moved by Mr. Mazza, seconded by Mr. Bevec, that West Penn Power Com-
pany be granted permission to erect a pole in accordance with Drawing DA-63154 as
submitted by said company with the understanding that the service will be underground from
the proposed pole and all expenses for said service to be at the expense of Tri-State
Aviation, Inc.

Solicitor presented and read Court Order No. 419, March Term, 1970 A. D. ,
In re: Fred J. Broglie, J: P. Court Order, is a result of a former petition filed on April
17, 1970, to show just cause why Fred J, Broglie's name should not appear on the ballot
for Committeeman on May 19, 1970, according to the Rules Governing Standards for Condu
to Justice of the Peace. Said, Court Order fstates that the matter is -set for argument or
hearing, as the case may be, on April 28, 1970, at 3:00 p.m. in Courtroom No. 1
Solicitor presented a lease in conjunction with the District Magistrates for
the approval of the Commissioners.

Mr John D. Anthony, Director of the Washington County Planning Commiss-
ion, reported on a meeting held with the Secretary of Highways pertaining to the Mon Valley
Expressway and Oak Springs Road in which he and Mr. Mazza attended. Mr. Anthony
reported to the Board that Section 4 and 5 of the Expressway, removed from the six -year
program last year because of insufficient funds, will head the list of priorities set by the
Commission.
Commissioner Flynn stated that his own personal observation is that it is
the time of the month when "irresponsible people make irresponsible statements. "
Commissioner Flynn referred to an article which appeared in the Brownsville Telegraph
in which the Solicitor of Centerville Borough made a statement concerning the tax duplicateE
being prepared by the Data Processing Department. Commissioner Flynn made reference
to a letter sent under date of April 17, 1970, by J. V. Murphy, Chief Clerk, directed to all
borough and township secretaries, and also to a letter under date of April 22, 1970, from
Sandra Lesch, Data Processing Manager, commenting on the erroneous information which
appeared in the newspaper article.
Solicitor Capano presented to the Board a Release of All Claims submitted
by James Capra, Garage Superintendent, which requires the execution of the Chairman of
the Board. Said Release is in reference to an accident involving Norman Delso, employee
of the County, and Minnie Stiehm. Damages in the amount of $146. 00 is to be payable to
Washington County.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the Chairman of the
Board, Michael R. Flynn, be authorized to execute the Release of All Claims as submitted
by James Capra, Garage Superintendent.
