BEVEC, JOHN MAZZA, COMMISSIONERS THE FOREGOING MINUTE READ AND APPROVED: ATTEST: Minute No. 116 ACTING CHIEF CLERK 1970 Office of the County Commissioners Washington, Pa., April 30, 1970 The Board of County Commissioners met in regular session with the following members being present: Commissioners Bevec, Mazza, and Flynn. Also being present: Acting Chief Clerk Ivery; County Solicitor Capano; Deputy Controller Whalen; Mr. John D. Anthony - Director of the Washington County Planning Commission; Mr. John Mores - Analytic Planner for Washington County Planning Commission; Mr. George Roule representing Tie Monongahela Publishing Company; Reporter Coleman of the Brownsville 'Telegraph; Reporter Crouse of the Observer - Reporter; and Public Information Officer Huber. Meeting called to order by Chairman and roll call taken: Mr. Bevec - Present; Mr. Mazza - Present; Mr Flynn - Present. Chairman asked if there were any corrections, additions, or omissions to Minute No. 115, each Commissioner having received a copy. Moved by Mr. Bevec, seconded by Mr Mazza, that Minute No. 115 be approved as read. Old Business: Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Acting Chief Clerk read correspondence under date of April 22, 1970, fr Frank L. Malinzak, Chairman, Fayette County Commissioners, which stated that the Fayette County Board of Commissioners unanimously agree to take whatever steps necessary to re-establish ferry service across the Monongahela River at the earliest possible date. Said letter requested that a Fayette -Washington County Joint Authority be formed as soon as possible to become the vehicle to carry out this project --not withstanding financial participation by state and federal agencies. Mr. Flynn: The Washington County Commissioners will acknowledge receipt of said letter. What steps have you taken Mr. Anthony? MINUTE BOOK 1-29 BOARD OF COUNTY COMMISSIONERS WASHI,NGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS E E Mr. Anthony: I have not taken any steps since the last time that we discussed this matter because (1) I believe we should wait until after the legislation is changed in Harrisburg and (2) I would like to see a little more detailed pursual of exactly how much cost is involved. Acting Chief Clerk informed the Board of a check in the amount $16, 663. 92 received from the Commonwealth of Pennsylvania on April 24, 1970, for Day Care CenterE Acting Chief Clerk read correspondence under date of April 22, 1970, from Ann Abajace, Regional Director - District 17, in which the Women's Democratic Clubs of Washington County recommend an Election Board Seminar for Washington County Election Boards. Said letter stated that it was the feeling that said Seminar would be beneficial to the Election Boards, the Voters, and the Candidates. Mr. Flynn: The Washington County Commissioners will acknowledge receipt of the letter but we cannot set up a Seminar between now and May 19, 1970. We will do our best to have some type of program between now and November. Assistant, County Solicitor Porter entered the meeting. County Solicitor Capano entered the meeting. Acting Chief Clerk read correspondence under date of April 25, 1970, from) James C. Richardson, Commander Post 302 - Co -Chairman Veterans Council of Monongahela which stated that the City of Monongahela will act as host in the celebration of Veterans Day on November 11, 1970. Said correspondence requested a contribution from Washington County to aid in defraying the expenses incurred to the Veterans Council of Monongahela. Mr. Flynn: The Commissioners will acknowledge said correspondence and will comply when a statement of expenses is submitted by said Council. Acting Chief Clerk read correspondence under date of April 24, 1970, from Howard E. Goldfarb, Chairman of the Law Library Committee, which stated that the move of the Law Library has been under way for some time and that the present facilities are not really adequate, particularly for a county of this size. Said letter further stated that the Law Library Committee is hopeful that a general solution for space problems will be found in the near future. Also, letter stated that the Committee is disturbed of the fact that no industrial help has been offered to the Law Librarian for some weeks in order to place the books on the shelves. Mr. Flynn: This is not the decision of the County Commissioners. This is done under the Courts' direction. As far as help is concerned, the Law Librarian is under the jurisdiction of the Courts. 140 MINUTE BOOK BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PENNSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS Mr. Anthony: I met with Tony Bevec, Building Sia.perintendent, concerning this matter and he and I have not come to any firm conclusions. The recommendations that I made to him would be considerably more costly. We are aware that this is a bad situation. DEPARTMENT OF PARKS AND RECREATION: Moved by Mr. Bevec, seconded by Mr. Mazza, that the following final relocation payments due the following be approved for payment: 1. Ernest Ankrom ME -I,- Mingo Creek County Park in the amount of $146. 00. 2. Russell Campbell ME-8, Mingo Creek County Park in the amount of $122. 00. Acting Chief Clerk read correspondence under date of April 24, 1970, from Congressman Thomas E. Morgan, which enclosed a breakdown of Federal outlays in Washington County for Fiscal Year 1969. The County total is $93, 939. 714. 00. Acting Chief Clerk read correspondence under date of April 21, 1970, from Orville D. Wold, Air Pollution Control Technician, Region V, directed to the Washington County Jail, which stated that the Department of Health is in receipt of complaints concerning excessive smoke from the operation of coal fired boilers. Said letter stated that it is requested that a control plan be submitted to said Office by June 30, 1970. Said control plan should spell out the method of control and schedule of compliance with Regulation IV by October 1, 1970. Remarks: Acting Chief Clerk made note that a similar request has been made upon the Washington County Home & Hospital as received from the Department of Health. Moved by Mr. Bevec, seconded by Mr. Mazza, that the bill in the amount of $1, 100. 00 as submitted by Donald E. York, MAI, 51 E. Wheeling Street, Washington Pennsylvania, for Appraisal of Nemacolin Country Club ($1, 000. 00) and Pre Trial Conference and Court Testimony on Washington Mall ($100. 00) be approved for payment. Remarks: Said bill has been approved by Charles H. Bush, Chief Assessor. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Moved by Mr. Bevec, seconded by Mr. Mazza, that the bill in the amount of $5, 000. 00 (second payment due) as submitted by Gandy Interval, 495 Duncan Avenue, Washington, Pennsylvania 15301, for window screening at the Washington County Jail be approved for payment. Motion carried unanimously. Solicitor informed the Board of oQrrespondence under date of April 27, 1970, from Gaylord W. Greenlee, c/o, Greenlee, Richman, Derrico & Posa - Attorneys at Law, addressed to Mr. Capano, In re: Pioneer Trails, Inc., which stated that the letter is response to their conversation as to the interest due Pioneer Trails, Inc. , on the refund because of their successful appeal of the assessment at No. 325 May Term, 1968. Letter stated that a total of $86. 70 is due to Pioneer Trails, Inc. , for interest for the 1967 and 1968 overpayment of taxes. Mr. Capano: I have not checked into this matter. Mr. Greenlee feels that Pioneer Trails, Inc., is entitled interest for the payments which they have made pending the appeal. Solicitor presented a 3 party Agreement between Washington Industrial Development Corporation, Washington County, and Superior Valve Group. Mr. Capano: The County is interested in four of the items in the agreement concerning Washington County: (1) Sale by Washington County of 1. 3533 acres of land near the County Home for Men for $3, 000. 00 to the Washington Industrial Development Corporation; (2) Sale of 0. 7041 acres of land for the sum of $1000. 00 to the Washington Industrial Development Corporation near the County Home for Men; (3) the Superior Valve Group is reconveying to Washington County .4191 acres of land which adjoins the County Home for Men. This portion of land was conveyed in error originally to Washington Industrial Development Corporation at no expense to Washington County; (4) the County reserves the ownership and title to the barn and other out buildings located in the 1. 3533 acres which they will remove upon receiving 90 days notice from the owners of the property. I request that the Commissioners authorize the execution of the Agreement and also authorize the County Solicitor to get Court approval for the sale of the 0. 7041 acres of land. Moved by Mr. Bevec, seconded by Mr. Mazza, that the Washington Count Commissioners execute the three party Agreement between Washington Industrial Develop- ment Corporation, Washington County, and Superior Valve Group. MINUTE BOOK 13 BOARD OF COUNTY COMMISSIONERS WASHINGTON COUNTY, PEN NSYLVANIA MICHAEL R. FLYNN, JOHN P. BEVEC, JOHN MAZZA, COMMISSIONERS L 1 Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried Vaanimously. Moved by Mr. Bevec, seconded by Mr. Mazza, that the County Solicitor, A. V Capano, be authorized to, obtain Court approval for the sale of 0. 7041 acres of land for the sum of -$1000. 00 to the Washington Industrial Development Corporation. Roll call vote taken: Mr. Bevec - Yes; Mr. Mazza - Yes; Mr. Flynn - Yes. Motion carried unanimously. Assistant County Solicitor Porter left the meeting. Mr. John Mores, Analytic Planner - Washington County Planning Commission, made a presentation to the Board concerning the request received from the State Health Department in reference to approval of Solid Waste Landfill Sites in strip mine areas. The following is a list of sites under consideration: SITE NAME 1. South I ills Disposal 2. Wayne Cook Landfill 3. Burgettstown Landfill 4. Independence Township Landfill TCNITTTTO VTD Union Township Robinson Township Jefferson Township Independence Township 5. John Weld Landfill Fallowfield Township Mr. Mores stated to the Board that it is recommended that all five sites be approved on an interim basis until Washington County's Solid Waste Management Plan is completed; at which time these sites will again be reviewed, as to their adequacy according to the standards of the Plan and to the need for" :landfill sites of Washington County. Mr. Mores stated that this interim approval should be granted providing cert conditions are -met. -- Mr. Mores listed said conditions to the Board. Mr. Mores also reported on the need for landfill sites, the problems that can arise and also possible stream pollution, road system, esthetic considerations and the Protection of Washington County from outside refuse. Mr. Mores stated, in conclusion, that interim approval should be granted to the five sites until the Plan is com-plet,ed; this, is to be done after a letter is received from each owner acknowledging the conditions found in the Recommen- dations Section -of said report. Mr. Mores stated that this interim approval is suggested because of the following reasons: 1. Although there may be problems associated with these landfills, they still constitute some of the best locations for refuse disposal in the County. 2. There must be some place to dispose of refuse, and many lesser sites have been closed or in the process of being closed.
