3. The study that is required to determine the full adequacy of these
sites and, alternative sites that may be available will require a great deal of effort and
time. Therefore, interim approval is in order.
A long discussion was held by the Board members and those present
concerning whether or not interim approval should be given to the five sites at this time.
Mr. Flynn: I suggest that the Commissioners accept these recommendations as sub-
mitted by the Washington County Planning Commission and that the Washington County
Planning Commission go ahead and notify these five (5) different sites to comply with the
regulations set down.
Mr. Anthony: Mr. Chairman, could you give the Planning Commission permission to
informally discuss this matter with the five different sites concerned and we will report
back to the Commissioners as soon as possible without taking any action -today.
Moved by Mr. Bevec, seconded by Mr. Mazza that the meeting adjourn.

The Board of Commissioners met in regular session with the following
members- present: Commissioners Bevec, Mazza and Flynn. Also present being:

of the Washington County Industrial Development Agency; Mr. Jack Underwood - Assis-
tant Director of Washington County Industrial Development Agency; Mr. A. B. Kenney -
West Penn Power Company; Mr. George Roule representing Monongahela Publishing
Company; Reporter Robertson of the Observer - Reporter; and Public Information
Officer Huber.

Chairman asked if there were any corrections, additions, or omissions
to Minute No. 116, each Commissioner having received a copy.
Moved by Mr. Bevec, seconded by Mr. Mazza, that Minute No. 116 be
approved as read.

Mr. Keery McAmbley, Executive Director of the Washington Industrial
Development Agency, informed the Board that his Solicitor is in the process of drafting
a resolution in order to make application to the State for Site Development funds on a
project in which the Commissioners would provide the necessary matching funds. Mr.
McAmbley stated that said resolution would be prepared for the next regular meeting in

order that the Commissioners can take the necessary action.
Mr Anthony: I would like the Washington County Planning Commission to review this
application prior to the next meeting.

Special Order of Business:
Public Defender Liekar entered
the meeting
Chairman stated that the regular order of business will be dispensed with
in order that Judge Charles G. Sweet and Attorney Thomas J. Terputac, President
of the Washington County Bar Association, could make a presentation to the Board con-
cerning fees of appointed counsel in cases that the Public Defender does not handle.
Mr. Terputac: The Bar Association is aware of the budgetary requirements of the
Commissioners. We are also aware that the Commissioners have strained the budget
limit. The hurts are also aware of these problems and are confronted with the mass
problems of (a) increase in crime and (b) increase in costs. The Bar Association
recommends the following to the Commissioners:
(1) The Public Defender has done a good job and has a great
amount of work but the Executive Committee is of the
opinion that the payment for the attorneys representing
indigent defendants appointed by the Court should be
made through the Public Defender's Office or some other
means so that the Bar Office does not have to handle the money.
(2) The Bar Association feels that there should be some
reasonable increase in fees as follows:
$15. 00 per hour for office routine research on a case.
$20. 00 per hour for hearings and trial to a maximum
of $150. 00
Also, out-of-pocket expenses should be picked up.

Judge Sweet: This matter isn't a Salary Board situation. This matter is one in which
the Courts and Commissioners will have to reach an agreement. It would be much
simpler to have a flat scale - $50. 00 for pleaders and $125. 00 for a trial. I would be
glad to enter into an agreement on behalf of the Courts with the Commissioners at a
scale that would double what the lawyers are receiving now. - from $25. 00 to $50. 00 for
a mass hearing and raise trial from $75. 00 to $125. 00. If the Commissioners want to
enter into an agreement at a higher figure that I have mentioned, I am willing to try to
accommodate the members of the Bar. I think it would be an injustice to keep them at
the 1964 level.
Mr. Flynn: Judge Sweet and Mr. Terputac have made their presentation to the Board.
At this time the Commissioners will table this request until the next regular meeting.
I suggest that at everyone's convenience, a meeting be arranged with Judge Sweet, Mr.
Terputac, Mr. Liekar, Mr. Posa, and the Commissioners between now and next
Thursday's regular meeting. At the next meeting we will go on record adopting a policy.

Mr. Keery McAmbley, Executive Director of the Washington Industrial
Development Agency, requested that the Commissioners consider- the possibility of
in,6orporating his agency so that loans could be made through the Pennsylvania Industrial
Development Agency.
Mr. Flynn: I - suggest that Mr. McAmbley proceed on the resolution and on the other
item the Commissioners will have to give it some thought.
Mr. McAmbley left the meeting.
Mr. Underwood left the meeting.
Mr. Kenney left the meeting.
Correspondence:
Acting Chief Clerk read correspondence under date of April 21, 1970,
from R. J. Godava, Engineered Communications, which enclosed frequency coordination
forms which must be completed by all future radio licensees and submitted to a regional
coordinator who will assign a specific radio frequency to the applicant.
Mr. Bevec: This is in reference to setting up a communication system in the Sheriff's
cars and County Detective's cars under the Crime Commission program. A discussion
was held with RCA representatives and the first thing the Commissioners had to do was
to apply for the license. The approximate cost of establishing a base station as a center
of communication for this equipment is estimated at $14, 985. 00.
Acting Chief Clerk read correspondence under date of May 1, 1970, from
Stanley A. Miller, Department of Public Welfare, which stated that Washington County
can anticipate receiving $76, 879. 34 under the Payments to Counties for Child Welfare

Services Program. Said payment is for the two quarters in the period January 1, 1970
to June 30, 1970.
Moved by Mr. Mazza, seconded by Mr. Bevec, approving final settlement
payment on the following properties in the amounts as stated; check to be made payable to
Robert L. Ceisler, Esq.
I. John A. Doerfler - $6, 100. 00
2. Percy B. Williams - 9, 550.00
Remarks:
Note was made that on the Doerfler property, $11, 500, 00 was the agreed
total settlement and on the Williams property, $25, 000. 00 was the agreed total settle-
ment.

Acting Chief Clerk read correspondence under date of April 29, 1970,
from Romayne Harry, Assistant. Director for Management Services, Bureau of Housing
and Environmental Control, addressed to Mr. John D. Anthony which enclosed a copy
of the Service Purchase Contract authorizing payment for the preparation of an official
plan as provided for in the Pennsylvania Sewage, Facilities Act. Correspondence
stated that check for 25 percent of the total cost will be forthcoming within the next few
weeks. Service Purchase Contract in the amount of $5550. 50.
Acting Chief Clerk read correspondence under date of April ,28, 1970,
from Joseph Adlestein, M. D. , Deputy Secretary for Mental Health and Mental Retardat-
ion, which stated that the revised allocation for the fiscal period 1969-1970 has been
approved in the amount of $595, 000. 00.
Moved by Mr. Bevec, seconded by Mr. Mazza, authorizing the sale
of two (2) oil furnaces at the Washington County Airport to be posted for public notice
for a period of ten (10) days. ,

Mr. Capano: I would like to hold these proposals until the next regular meeting.
'Acting Chief Clerk read two (2) proposals as submitted by Gandy Interval,
495 Duncan Avenue, Washington, Pennsylvania, for (1) repair of barn roofs damaged
at Arden Downs due to windstorm - all labor and materials for five buildings - $1335. 00
and (2) repairs to tile roof and hatch that was (damaged by windstorm on the main roof
of the Washington County Jail - all labor and materials - $500. 00.
Mr. Capano: This work will be covered by the insurance company. The County is to
receive the $50. 00 deductible which will amount to $250. 00. I think it would be a good
idea if the insurance company made the check directly payable to Mr. Interval after
the work is completed.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the two estimates as
submitted by Gandy Interval be approved and that he be authorized to proceed on the
above work.

Moved by Mr. Bevec, seconded by Mr. Mazza, that Invoice No. 54270
under date of April 29, 1970, as submitted by Joseph F. Bontempo and Associates
for supervision of construction for Washington County Juvenile Detention Home, W
ton, Pennsylvania - Estimate No. 4 of Baldwin Electric Company, Inc., dated April
23, 1970, in the amount of $21. 35 be approved for payment.

Moved by Mr. Bevec, seconded by Mr. Mazza, that the request for pay-
ment under date of May 4, 1970, as submitted by Baldwin Electric Company, Inc.,
393 West Chestnut Street, Washington, Pennsylvania, for Estimate No. 1 for electrical
work at the Washington County Prison for the electrical and security systems in the
amount of $17, 550. 00 be approved for payment.
Remarks:
Said bill has been approved by Anthony Bevec, Building Superintendent.

Solicitor:
Mr. Capano: I have a resolution which was adopted on January 9, 1969, whereby the
County approved the acquisition of land for expansion purposes for [Mingo Creek County
Park, Ten Mile Creek County Park, and Cross Creek County Park. I talked this over
with Mr. Ceisler. The resolution was not broad enough in my opinion and Mr. Ceisler
has drawn up an amendment to this resolution which broadens the powers of the County.
Moved by Mr. Bevec, seconded by Mr. Mazza, that the amendment to the
Resolution adopted on January 9, 1969, be approved by the Washington County
Commissioners.

Moved by Mr. Bevec, seconded by Mr. Mazza, that the contract between
Washington County and the National Cash Register Company for an extra piece of equip-
ment for the Treasurer's Office for a period of four (4) months at the monthly rental
charge of $76. 00 be approved by the Washington County Commissiornk�rs and that the
Chairman of the Board, Michael R. Flynn, be authorized to execute said contract.

Solicitor Capano presented a hangar rental to the Board for approval.
Moved by Mr. Mazza, seconded by Mr. Bevec, that the lease between
the County of Washington and Mr. Henry Schurman, 234 Shiloh Street, Pittsburgh,
Pennsylvania 15211, for the storage of one (1) aircraft, Cherokee - 180 9299-J, in Hangar
No. A-1 for the sum of $40. 00 per month beginning May 1, 1970, and thereafter from
month to month, be approved; and that the Chairman of the Board, Michael R. Flynn, be
authorized to execute said Lease. Rental fee to the County of Washington, c/o John
Yuhas, County Surveyor, 67 West Cherry Avenue, Washington, Pennsylvania 15301.

the Chairman of the Board, Michael R. Flynn, acknowledge as attorney in fact.

was brought to Mr. Moschetta's attention that the Federal Government through the "Safe
Streets Act" has allocated funds, a portion of which is available for funding the Public

be contacted immediately in this regard.

Solicitor read correspondence under date of April 29, 1970, from A. Evans
Kephart, State Court Administrator, which stated that the forms for Criminal Complaint,
Summons and Warrant have,;been dey igned and submitted to a printer for the preparation
of camera copy and when these copies are available they will be forwarded so that
arrangements may be made to have them printed and supplied to the Justice of the Peace,
elected or appointed on or after November 4, 1969.

Solicitor read correspondence under date of May 5, 1970, from J. W. -
Reinhard, Secretary, Pennsylvania Public Utility Commission, which stated that the
PUC has set Wednesday, May 27, 1970, at 10:00 a.m. in the Veterans and Engineering
Office as the time and place for hearing on the application of the Department of Highways
of the Commonwealth of Pennsylvania for approval of (1) the construction of a crossing
where State Highway Route 1099 (Donora-Monessen Bridge), constructed as prop,,osed,

will cross above the grade of the tracks of the Pittsburgh and Lake Erie Railroad Company
on the south side of the Monongahela River, in Rostraver Township, Westmoreland
County, and (2) the construction of a crossing where the same highway, constructed as
proposed, will cross above the grade of the tracks of Penn Central Company, Washington
County, and the allocation of the costs and expenses incident thereto.
Mr. John D. Anthony, Director of the Washington County Planning

Commission, submitted to the Board a copy of the cost -sharing agreement for the Harm
Creek Watershed. Mr. Anthony stated that the Pennsylvania State Soil and Water Con-
servation Commission refund 25% of the Total cost. Mr. Anthony stated the 25%
refund due to Washington County amounts to $3275. 00.
